OFFICIAL TO ENACT A TEMPORARY EXTENSION ON THE EXPIRATION OF
BUILDING PERMITS

RECITALS
1. Pitkin County Community Development Staff has initiated an amendment to the Pitkin
County Code, Sections R105.3.2 and R105.5 of the Pitkin County Code, Title 11.04.040
in an effort to address unusual construction and development difficulties encountered by
owners and builders over the past 18 months due to economic hardships.
2. The Pitkin County Code states that building permits are deemed to have expired if they
have not been issued within 12 months of filing, and/or if work on the permit is not
commenced within 12 months of its issuance, and/ or if the work authorized by the permit
is suspended or abandoned for a period of 180 days after the work is commenced.
3. Numerous permits have currently expired or will soon expire as a result of these Code
mandated time limitations.
4. The BOCC has found that the current depressed economic situation has created an undue
hardship for many owners and builders and that some temporary relief from Code
mandated expiration limits is justified and appropriate.
5. The BOCC introduced, read, and adopted the proposed amendments on July 14, 2010,
and held a confirmatory public hearing on July 28, 2010. Evidence and testimony were
presented with respect to this amendment.
6. The BOCC finds that this temporary extension on the expiration of building permits is
consistent with Pitkin County's goals and policies regarding land use and development in
the County.
NOW, THEREFORE, BE IT ORDAINED by the Pitkin County Board of County
Commissioners that it hereby directs the Chief Building Official to grant a one -time temporary
extension until August 31, 2011, for all building permits which have expired in 2010 or which
will expire in 2010; allowing this additional time for permittees to meet the terms of Section
R105.3.2 and/or Section R105.5 of the Pitkin County Code.
