The property is a 44.09 acre lot with AR -10 zoning, with an FAR of 7500 SF. A single family 6,093 SF three bedroom residence was completed in September 2000. The owner is seeking approval for an Activity Envelope and Site Plan Review to amend an existing Accessory Building Envelope, and develop a 2552 SF barn with a 1000 SF attached CDU. The existing well permit allows for 3 single family dwellings and the septic system was permitted for 4 bedrooms. Section 2 -20 -150 (b): MINOR DEVELOPMENT TO A DEVELOPMENT PERMIT The proposed development meets the requirements of this section. 2 �36) ,�,,0<< Section 2 -30 -20 (g): ACTIVITY ENVELOPE and SITE PLAN CRITERIA FOR APPROVAL Previous approvals include a building envelope for a single family dwelling, an accessory building envelope for a barn and an additional accessory envelope for a septic field. The barn accessory envelope no longer meets current wetlands and river set backs and is to be abandoned. The septic accessory envelope is to be amended and reconfigured to meet current setback requirements and allow the activity envelope to include the barn with an attached CDU, 2 off street parking spaces, the driveway, the staging area during construction and the existing septic field as demonstrated by the application. Section 7- 10-50: SITE PLAN AND ACTIVITY ENVELOPE The applicant shall comply with the standards of this section. Section 7- 20 -10: SITE PREPERATION AND GRADING The applicant shall comply with the standards of this section. No tree shall be removed for the proposed project. Section 7- 20 -20: STEEP AND POTENTIALLY UNSTABLE SLOPES The proposed Activity Envelope is less than a 15 percent slope. One foot contours are depicted on the site plan. The toe of sloping terrain is several hundred yards to the north of this envelope. Section 7- 20 -30: WATER COURSES AND DRAINAGE No encroachment or channeling activities shall take place in the coal creek or the existing wetlands or irrigation ditches. The proposed structure will not have a basement or crawl space. Positive drainage from the structure shall be provided during final grading. Sedimentation control and re vegetation shall comply to the standards of this section. 3 Section 7- 20 -40: FLOOD PLAN HAZARDS The proposed Activity Envelope is not in the 100 year flood plan as indicated on the Improvement Survey. See Attachment 9. Section 7- 20 -50: GEOLOGIC HAZARDS The propsed Activity Envelope has no apparent geologic hazards. Soil samples will be collected and analyzed by a geotechnical engineer prior to construction. Section 7- 20 -60: WILDFIRE HAZARDS The proposed envelope is located in a Mapped Low Wildfire Hazard Area. Wildfire mitigation shall follow the guidelines required in this section. The fire station is located to the north of Redstone. Section 7- 20 -70: WILDLIFE HABITAT The District Wildlife Manager from Carbondale office made a site visit and reviewed the proposed bam/CDU location. A memo addressing his observations is included in this application. See Attachment 15. Section 7- 20 -80: RIVER and STREAM CORRIDORS and WETLANDS When the original 1041 Hazard Review received Minor Amendment Approval (Reception 41604 1) for a septic location in 1998, it was determined to be the only suitable location on lot 9, primarily for site elevation and flat topography. Wright Water Engineers were hired by the owner to revisit the site and confirm the wetland delineation in the area adjacent to the proposed activity envelope. That boundary was recorded by High Country Engineering and included on the Improvement Survey. At that time, the existing drive alignment and the high water delineation along Coal Creek were documented for the area closest to the proposed activity envelope. See Attachment 9. We are requesting a wetlands setback reduction of 50 feet for the proposed activity envelope. The building would be set back approximately 90' from the wetlands. The Wetlands Consultant's memo explains their involvement and site visit. See Attachment 14. 4 Jt ;�t1E� Section 7 -20 -100: HISTORIC PRESERVATION Included within the property lines of Lot 9 is the historic Hillside Cemetery. Expansion, disturbance or alteration of the historic site is currently prohibited. Access to the cemetery is only for those individuals or parties having legitimate cemetery business. Section 7- 20- 120(d): STANDARDS FOR SCENIC PROTECTION AREAS Existing topography and natural vegetation screen the proposed activity envelope from view of Highway 133. Section 7- 20- 120(e): RURAL CHARACTER GUIDELINES FOR BUILDING LOCATION This location of the proposed activity envelope is at the edge of the pasture, behind an existing stand of nature spruce trees and approximately 2000' from the entrance at Highway 133. See Attachments 10 and 11. Section 7 -20 -130: LANDSCAPING and VEGETATION PROTECTIONS The site is basically level and final grading will provide positive drainage from the structure. No berms will be constructed. No trees are to be removed for this project. Re- vegetation of disturbed areas shall comply to this section. Section 7 -20 -140: LIGHTING The applicant shall comply with the standards of this section. Section 7 -30: ROADS The existing gravel driveway will be used to access the proposed activity envelope. Improvements within the envelope shall comply to this section. Two parking spaces shall be provided for the proposed CDU per the design standards specified in this section. Based on this requirement, Wright Water Engineers, Inc. (WWE) was retained by Milan and Eva Baranek to delineate wetlands and other waters of the U.S. (which include rivers and streams) in the vicinity of a building envelope located near the northwest comer of their property. METHODS On June 15, 2009, WWE completed a field visit to canvas the area for wetlands and other potential waters of the U.S. The presence of wetlands was determined based on the criteria and methods outlined in the Regional Supplement to the Corps of Engineers Wetland Delineation Manurl: Western Mountains, Valleys, and Coast Interim Regional Supplement (Supplement). This manual is one of a series of regional supplements to the U.S. Army Corps of Engineers' (Corps) Wetland Delineation Manual (Manual) (U.S. Department of the Army, 198 According to these documents, wetlands are areas with positive indicators of hydrophytic vegetation, hydric soils and wetland hydrology. Please note that WWE was asked to delineate only the western boundary of wetlandstother waters of the U.S. closest to the building envelope. RESULTS During our field visit, WWE identified and flagged the western boundary of a wetland located northeast of the building envelope. Positive indicators of wetland vegetation, soils and hydrology were observed. An Improvement Survey, prepared by High Country Engineering, Inc., revised December 16, 2009, shows the delineated western boundary of the wetland. It is WWE's understanding that the other wetland boundaries were from a previous wetland delineation completed by WWE. No other waters of the U.S. were identified in the vicinity of the building envelope within the property boundary. However, it should be noted that Coal Creek is located outside the property boundary to the southwest. Coal Creek and its vicinity were not included in W WE's scope of services. Coal Creek is located outside the property boundary to the southwest. An assessment of Coal Creek was not included in WWE's field study. With respect to setback requirements for the delineated wetland, Pitkin County, Colorado Land Use Code states the following: "a. All activity and development after the 5th of July, 2006 shall maintain a riparian area/wetland buffer of at least one hundred (100) feet, measured horizontally from the . identifiable high water line of each feature identified in subsections (a)(lxa) and (b) above. This one hundred (100) foot setback may be reduced to between one hundred (100) feet and a minimum of fifty (50) feet upon demonstration by the applicant that such reduction shall not result in water quality degradation, stream bank erosion and/or a reduction in the quality of riparian or wetland habitat pursuant to standards in Section7- 20- 80(4)." Based on the above, a 50 foot set -back from the wetland and "demonstration by the applicant... that such a reduction shall not result in water quality degradation, stream bank erosion and/or a reduction in the quality of riparian or wetland habitat" would seem to meet the above requirements. However, other Site Specific Factors (e.g., slopes, erodible soils, hazardous/toxic materials, etc.) listed in subsequent sections of the Pitkin County, Colorado Land Use Code need to be taken into consideration. An analysis of these Site Specific Factors was not included in WWE's scope of services. Additionally, although it was not included as part of WWE's study, the appropriate buffer from Coal Creek's identifiable high water mark should be taken into consideration in developing the building envelope. My apologies for not sending something earlier. As we discussed the proposed building site is within an already disturbed area thus minimizing any impacts to wildlife and the surrounding wetlands. The area is however within mapped elk severe winter range and winter concentration areas. The course scale at which these areas are mapped tends to fairly accurate, subject to on -site verification. The SWR and WC areas are more accurately described as any areas above the toe of the south facing slope. The proposed building site is located on the flat several hundred yards from the toe of the slope which will limit much use by elk during severe winters due to the depths of accumulating snow. Some use will still occur in some of the wetlands areas as elk will move down to browse on the vegetation above the snow line but will be very limited. This information was requested by you at our November 9, 1995 field meeting. to n Wetlands were identified on Lot 9, along the valley floor associated with Coal Creek. The wetland rag boundary was flagged in the field and surveyed on November 13, 1995. The current proposal n development on Lot 9 includes a primary building envelope, and accessory building envelope, and an access road. The access road to the primary building envelope will span the wetlands at the narrowest margin, as shown on Figure 2. Construction of the bridge at this location will be m completed using pads and/or matting to minimize temporary impacts to wetlands. M Therefore, there will be no impacts to wetlands or other "waters of the U.S." from the proposed development.
