Mountain Valley Cabin LLC (hereafter referred to as the "Applicant') has applied to the Community Development Director of Pitkin County, Colorado ( "Director ") for Activity Envelope Review with no vesting requested, to pipe water down from a diversion point off the Joseph Mautz Ditch No. 2 that exists on Strawberry Creek. The piped water will be used for an irrigation system that is to be installed in a lower field. 2. The subject parcel is located east of Aspen along the Roaring Fork River. The property address is 44280 Hwy 82. PID#: 273729100003 (Legal Description, Attachment A) 3. The parcel is approximately 46 acres, is in the AR -10 zone district, and is conforming in size. 4. The Applicant was issued an exemption from Activity Envelope Review for phase one of the project that included the re- placement of a diversion structure off Strawberry Creek. This portion of the project qualified for an exemption pursuant to section 7- 10 -30(c) of the Code. 5. The Applicant has provided an Activity Envelope Plan that shows all aspects of development including staging, location of irrigation equipment, piping, and access to the site. The Applicant has indicated that no encroachment onto slopes > 30% will occur with this project. 6. The Director finds that the Activity Envelope has been located in conformance with Chapter 7. APPROVED by the Director, subject to the following conditions: 1. The Applicant shall adhere to all material representations made in the current or prior applications or in public meetings or hearings and shall consider those representations to be conditions of approval, unless amended by other conditions. 2. Prior to submission of the site plan application, the Applicant shall be required to submit for approval by the County Attorney and Community Development an Activity Envelope Plan in accordance with Land Use Code Section 2- 30 -20(g) and Application Manual Section 2.1.1. The above referenced approvals shall be a condition precedent to finalization and recordation. 3. The Applicant shall submit for review and approval by the Planning Engineer, an earthmoving permit. The earthmoving permit shall include a revegetation plan and construction management plan. 4. Prior to commencement of any earthmoving or other construction activity, the Applicant shall stake the comers of the activity envelope and install construction fencing around the construction site within the perimeter of the building envelope. All areas disturbed by construction shall be re- vegetated with native shrubs and grasses within one growing season of the project's completion. 6. COUNTY and APPLICANT further agree that it is impracticable for COUNTY staff to complete processing or present sufficient information to the Planning Commission and/or Board of County Commissioners to enable the Planning Commission and/or Board of County Commissioners to make legally required findings for project approval, unless current billings are paid in full prior to decision. 6. Therefore, APPLICANT agrees that in consideration of the COUNTY'S waiver of its right to collect full fees prior to a determination of application completeness, APPLICANT shall pay a base fee in the amount of $ 31 \ti 5 which is based on \o hours of staff time, and if actual time spent by staff to process the application exceeds the average number of hours by more than 20 %, then the COUNTY will bill the APPLICANT quarterly for the additional time spent. (RESOURCE) has prepared the following submittal of request for approval of Site Plan and Activity Envelope. The purpose of this request is to complete Phase 2 of the Joseph Mautz Ditch No. 2 Improvements on the Mountain Valley Cabin, LLC property located in Pitkin County, Colorado. In July of 2008, Mountain Valley Cabin, LLC received an Order from the District Court in Water Division No. 5 regarding the abandonment of their Joseph Mautz Ditch No. 2 water right. The Order stated that a portion of the subject water right would not be abandoned provided that ' Mountain Valley Cabin re- establish the original physical diversion point or file a change of water right application by December 31, 2010. In response to this Order, Mountain Valley Cabin, LLC developed a plan that (1) would re- establish the Joseph Mautz Ditch No. 2 original diversion point and (2) would improve the efficiency of the overall irrigation system. These Joseph Mautz Ditch No. 2 Improvements were divided into two Phases. Phase 1, which was approved for construction, includes the installation of a diversion structure with locking capabilities, a Parshall flume to measure diversions, and a screen and overflow structure to remove unwanted debris ' and sediment. Phase 2, includes the installation of a sprinkler irrigation system and the associated piping and appurtenances. A more detailed description of each element included in Phase 2 of the Joseph Mautz Ditch No. 2 Improvements can be found in Section D below. PROJECT AREA DESCRIPTION 4 The Mountain Valley Cabin, LLC property is located approximately 3 miles Southeast of Aspen, off of Highway 82. The property parcel is approximately 43.7 acres. The Activity Envelope for the Joseph Mautz Ditch No. 2 Improvements project is approximately 7.7 acres. This area is shown on the Site Plan attached in Figure land represents the portion of the total property that is likely to undergo disturbance during the construction and installation of the above mentioned improvement projects. The project site generally slopes from the west to the east and is likely to contain subsurface geology commonly found in alluvial fan deposits. The existing vegetation within the vicinity of this 3 000ni 1 '.0'RESFOURCE r site consists of native grasses, scrub oak brush, rabbit brush, pine trees, and aspen trees. Wetlands are not present on the project site or within the activity envelope. NEED FOR PROJECT As stated above, Mountain Valley Cabin, LLC was under Order by the District Court to re- establish the original diversion point of the Joseph Mautz Ditch No. 2 by December 31, 2010 or abandon the water right complete. The Joseph Mautz Ditch No. 2 water right has historically irrigated 6.3 acres of pasture grass. The Phase 1 installation of a new headgate structure and flow measuring device at the original point of diversion satisfies the District Court's Order. In conjunction with re- establishing the water right, Mountain Valley Cabin, LLC decided to improve the efficiency of the overall irrigation system by replacing the open channel earthen ditch and flood irrigation practices with an enclosed pipe and sprinkler irrigation system. This improved w irrigation system will increase the efficiency of water application and maintain the flow of ' Strawberry Creek. PROJECT DESCRIPTION RESOURCE designed both Phase 1 and Phase 2 of the project The plans for the pipeline and sprinkler system are attached in Appendix A. For Phase 2 of the Joseph Mautz Ditch No. 2 Improvements, the contractor shall maintain all applicable local, state, and federal licenses and permits that apply to this construction project. Installation of pipe: A six inch diameter main pipeline will be installed to serve water from the screen and overflow structure to the sprinkler system. The approximate length of this main pipeline is 900 feet and its location will follow along, adjacent, or near the existing Joseph Mautz Ditch No. 2 alignment. The alignment was selected to follow existing open area corridors such that trees would not be impacted or removed. A more detailed description of materials and installation specifications can be found in the construction plan drawings attached in Appendix A. The main pipeline will be installed in such a manner that minimizes disturbances. Appropriate Best Management Practices will be implemented to control soil erosion and off -site sediment transport from exaction. All disturbed areas will be revegetated with a native grass seed mix, and any tree with a breast height diameter of six inches or larger that is removed will be replaced. ' Installation of irrigation system: Trenches will be excavated for the sprinkler pipeline network based on the layout designed by Grand Junction Pipe. The recommended pipes sizes and 4 HIRES k A sprinkler heads will then be installed and the trenches backfilled. A more detailed description of the materials and installation specifications can be found in the construction plan drawings attached in Appendix A. Some pruning of existing vegetation within the irrigated field will occur. Appropriate Best Management Practices will be used to control soil erosion during excavation and the disturbed areas will be revegetated with a native grass seed mix. 0 COMPLIANCE WITH THE PITKIN COUNTY CODE SECTIONS This section will address how Phase 2 of the proposed Joseph Mautz Ditch No. 2 Improvements project complies with the Development Standards listed in Chapter 7 of Pitkin County Land Use " Code. Sec. 7- 10 -50: Activity Envelope/ Site Plan The Activity Envelope was developed in accordance with Section (a) — (g) and can be found in the attached Figure 1. The Activity Envelope represents the minimum area needed to successfully complete the proposed project — this area is not "constrained." The Site Plan associated with the Activity Envelope shows areas of clearing, grading, grubbing, and earthmoving over 50 cubic yards, as well as, slopes greater than 15 %. The items listed in Table 7 -1 of Section (h) are addressed below. Sec. 7- 20 -10: Site Preparation and Gradina This project will comply with Sections (a) -(d) (a) Grading and Fill Placement: All grading and filling associated with this project will occur only within the approved Activity Envelope. These proposed areas of grading and filling have been identified on the Site Plan. (b) Clearing, Grubbing, and Vegetation Removal: With the exception of noxious weeds, the clearing or grubbing of land and /or the removal of vegetation shall take place only within the approved Activity Envelope. Any disturbed area will be revegetated as described in more detail in Sec. 7 -20 -130. (c) Tree Removal and Mitigation: The proposed plan does not anticipate the need to remove only trees. Trees will only be removed from within the approved Activity Envelope, and Best E (� ti ^ f' 1 -,- 3 R E S R C E A Management Practices will be applied to minimize the number of trees (if any) to be removed. Each tree with a six inch or larger diameter at breast height that is removed from within the Activity Envelope, will be replaced with one or more trees that combine for a total caliper equal to or greater than the original. All revegetation efforts will comply with the Pitkin County Revegetation Guidelines. Mountain Valley Cabin, LLC will work with County staff on species selection and stocking density. a (d) Protection of Natural Terrain: RESOURCE has worked to develop a project that promotes Best Management Practices and seek to minimize disturbances to the natural vegetation. Revegetation — All disturbed areas will be revegetated with a native grass seed mix. The ground will be prepared for seeding by raking the surface. The seed will then be broadcast in perpendicular directions at a rate of one pound per 1,000 square feet. The surface will be raked again after seeding. Weed free mulch will then be applied at a rate of 2 tons per acre to protect the seed from wind and water erosion and conserve s moisture. Revegetation specification can be found in Sec. 7 -20 -130. Topsoil — Where possible the topsoil will be sorted and stockpiled for later use on the project. Weed Prevention — All revegetation seed will be certified weed free. No seed mix will contain any species on the Pitkin County or State of Colorado noxious weed list. More specifically, no seed mix will contain Reed Canary Grass. In addition, the mulch that is applied on top of the seed will be certified weed free. 4 Utility Installation — N/A Erosion, Sedimentation, and Stormwater Management — Erosion and sediment control Best Management Practices will be implemented to minimize the amount of soil transported to receiving waters from areas disturbed by construction activities. w Sec. 7- 20 -20: Steen and Potentially Unstable Slopes There are no unstable slopes or slopes with grades greater than 30 percent within the proposed Activity Envelope. There is one section along the main pipeline that exceeds a slope of 15 percent. This section is highlighted on the Site Plan, which is attached as Figure 1. s I ' 2 1"RESOURCE (?or! 4 0 Sec. 7- 20 -30: Wafer Course and Drainage Subsections (a) and (b) are understood. (c) Drainage: The construction activities associated with this project will not impede the flow of A any natural water course and will not alter the historic flow pattern and runoff amount. The runoff ' coefficient before construction activities begins is estimated to be around 0.40 due to the topography and undeveloped forest nature of the site. This runoff coefficient is expected to + remain 0.40 after construction and subsequent restoration. a Best Management Practices will be implemented for stormwater pollution prevention. Silt fence will be installed around the perimeter of the project and will remain until all disturbed areas are re- vegetated and stabilized. Straw bales will serve as temporary sediment barriers and will be q placed across or at the toe of slopes to intercept and detain sediment and decrease flow velocities from small drainage areas until construction is complete and disturbed areas are revegetated. If necessary, stormwater will also be diverted during construction via diversion ditches. (d) Groundwater: This project will not result in the introduction of any contaminants to groundwater or interfere with any recharge area or aquifer. Therefore, this subsection is not applicable. (e) Irrigated Area: This project includes the installation of a sprinkler irrigation system on lands historically flood irrigated by Joseph Mautz Ditch No. 2. Disturbances associated with construction activities will not adversely affect these lands and all disturbances will be revegetated at the conclusion of the project. The installation of a more efficient sprinkler system will enhance future irrigation efforts. (t) Irrigation Ditches: Mountain Valley Cabin, LLC is the solo owners of the Joseph Mautz Ditch No. 2. This project will replace the open channel earthen ditch with a pipeline that connects to a sprinkler irrigation system. Diversion through the Joseph Mautz Ditch No. 2 headgate will not occur during the construction process. (g) Sedimentation: As described above, Best Management Practices will be implemented to minimize the erosion and control sediment. 7 :::::RESOURCE 000ril5 (h) Water Quality: Included in the Best Management Practices for drainage and sedimentation control are methodologies to minimize the amount of soil transported to receiving waters from areas disturbed by construction activities. These practices seeks to minimize the effect that the project has on the water quality in the surrounding area ^ (i) Efficient Water Use: By replacing the existing open channel earthen ditch and flood irrigating ® furrows with a pipeline and sprinkler irrigation system, water is persevered through the reduction of evaporation and seepage losses. Sec. 7- 20 -40: Floodplain Hazards The protect site and proposed pipeline and sprinkler system are located outside of floodplain hazards mapped by the Federal Emergency Management Agency. The access existing trail and bridge over the Roaring Fork River that traverses across the 100 year floodplain as shown on the - attached Figure 1. There will be no impact to the 100 year floodplain. Sec. 7- 20 -50: Geologic Hazards The project site and proposed Activity Envelope are located outside of regions identified as geologic hazards on the Geologic Hazards Map maintained in the Community Development Department. Therefore, this section of the land use code does not apply. Sec. 7- 20 -60: Wildfire Hazards The terrain contained within the proposed Activity Envelope is mildly sloped from west to east, and the vegetation consists of discontinuous pockets of native grasses, scrub oak brush, sage brush, rabbit brush, pine trees, and aspen trees. The majority of construction activity will be the installation of the sprinkler irrigation system, which is on relatively flat grassland. This site would therefore be considered a low hazard Regardless, the Contractor shall maintain continuous emergency vehicle access, on and around ^ the site. Vehicles will enter the property from Highway 82, cross an existing bridge along the Roaring Fork River, and then continue along a foot path to the irrigated field. r F? °E °RESOURCE onon1 G o ,. Sec. 7- 20 -70: Wildlife Habitat Areas r The project site and proposed Activity Envelope are located outside of areas designated as ■ wildlife habitats by the Colorado Division of Wildlife The proposed Activity Envelope was delineated with the five "General Principals listed in Sec. 7 -20 -70 (b) in mind. Furthermore, the disturbances from construction activities associated with this project will be only temporary The natural native landscape will be restored to pre- construction conditions. 4 Sec. 7- 20 -80: River and Stream Corridors and Wetlands Strawberry Creek, a perennial stream, has been identified on the proposed site plan. There are no intermittent streams or isolated natural wetland within or surrounding the proposed project site and Activity Envelope. Phase 1 of the Joseph Mautz Improvements project involved the construction of a headgate diversion on Strawberry Creek. This application for approval of an Activity Envelope and Site Plan, however, is for Phase 2 of the project, which includes construction activities within an existing irrigation ditch system that is not tributary to Strawberry Creek. Therefore, this project is exempt from minimum setback requirements Construction activities will occur only within the approved Activity Envelope and Best Management Practices a will be used to control drainage and erosion. Sec. 7- 20 -90: Irrigated Land for Food or Crop Production A majority of the project site and proposed Activity Envelope are located on an irrigated field. No lands that have historically been irrigated will be eliminated by construction activities associated with this project. In fact, the installation of a sprinkler irrigation system should improve the production of grass on the field. J Sec. 7 -20 -100: Historic Preservation The land within the proposed Activity Envelope does not meet the historic preservation standards, and therefore, this section of the land use code does not apply. M Sec. 7 -20 -110: Archeological Resources A The project site and proposed Activity Envelope are located outside of the Country's adopted list of Archaeological Resource Areas. Therefore, this section of the land use code does not apply. 41 9RESOURCE s r r Sec. 7 -20 -120: Scenic View Protection The proposed project will have little to no impact on the existing scenery. The view of the property will remind the same, and therefore, this section of the land use code does not apply. ' Sec. 7 -20 -130: Landscaping and Vegetation Protection (a) Purpose: The construction activities associated with this project are temporary and disturbances to the existing vegetation will only occur within the approved Activity Envelope and will be restored to a natural state at the projects conclusion. Best Management Practices will be implemented to minimize such disturbances and revegetation will comply with Pitkin County guidelines. The rural character of the County will not be impacted by this project. (b) General Provisions: This project complies with items 1, 2, and 8 of the General Provisions. The removal of natural vegetation will only occur where necessary and will be revegetated at the conclusion of the project. Trees will be maintained to the maximum extent possible and will be replaced based on County guidelines. Item 7 will be addressed with County staff, if financial assurances are required, and items 3 -6 are not applicable to this project. (c) Required Landscaping in Rural Areas: This project will comply with items 1 and 2 for rural landscaping. Native species indigenous to this project will be used for revegetation and will be planted in grouping natural to the surrounding environment. (d) Required Landscaping in Urban Areas: This project is set in a rural area; and therefore, this subsection is not applicable 4 Sec. 7-20-140: Lighting This project does not include the installation of any form of lighting; and therefore, this subsection is not applicable. 4 Sec. 7-20-150: Solar Access This project is not a subdivision and does not include the installation of any buildings. You have represented that the diversion structure can be constructed for less than $20,000. However, the rest of the improvements such as the sprinkler system and pipes will exceed $20,000. Pursuant to Section 7- 10 -30(c) of the 2006 Land Use Code you may consider the replacement of the diversion structure exempt from formal planning review and the project may proceed directly to earthmoving permit review. Other improvements such as the sprinkler system and piping will not qualify for an exemption from the Code. Attached is pre - application conference summary sheet that outlines the submittal requirements for the rest of your project. Please present this email with your earthmoving permit submittal packet.
