Pitkin County ( "Applicant ") has applied to the Board of County Commissioners of Pitkin County, Colorado ( "BOCC ") for a subdivision exemption to create to create two lots. A 1.996 acre lot (Lot 1) will contain the existing residential development, and will remain in private ownership. A 1.875 lot (Lot 2) will be conveyed to Pitkin County for open space and recreation; this lot will provide access to the Crystal River and will allow for a trail connection to the adjacent USFS lands. 2. The Crystal River flows through the property, with the majority of the property on the east side of the river and a smaller portion on the west side of the river. 5. The BOCC reviewed the application at a duly noticed public hearing on October 27, 2010, at which time evidence and testimony were presented with respect to this application. 6. The BOCC finds that the application is consistent with the applicable provisions of the Pitkin County Land Use Code. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Pitkin County. Colorado, that it does hereby approve the Avalanche Boat Launch Subdivision Exemption to create an open space parcel, subject to the following conditions, which shall run with the land and be binding on all successors in interest: I. This purchase would secure much needed and key public access to the Crystal River and to other federal lands that include the old Janeway townsite. It is important for public lands to be accessible to the public, subject, of course, to the limitations that are needed to protect and enhance wildlife and the other values mentioned above. The Crystal River access is important recreational access both for fishing and for popular hoating for the "Avalanche to BRB" run on the Crystal River. The property also includes a remnant of the old Crystal River Railroad grade that tied Janeway to Avalanche Creek Road. This railroad grade was once the primary transportation corridor between Carbondale and Marble and was used to haul the Tomb of the Unknown to Arlington. This grade, therefore, has significant cultural significance. Access to the old Janeway town site is presently limited to a remnant of a County wagon road that climbs over a nearby knoll near the Alabaster Mine. Janeway was the primary stage and rail stop prior to the development of Redstone. It still contains a remnant of a cabin and corrals. The proposed access is superior to the old County wagon road in that it is relatively flat and would be suitable for children and less able hikers. The USFS maintains a winter closure up Avalanche Creek and along an old wagon road into Janeway. CVEPA encourages the Pitkin County Open Space Department to manage this Janeway access consistent with those closures, and consistent with the plans of the USFS and the Colorado Division of Wildlife regarding any other use restrictions as may be desirable to protect the natural resources and the wildlife in the area. Access to the Janeway site opens the area to the opportunity for rehabilitation of the river bank and the meadow to rid it of cheat grass and prickly pear which have loitered there since Janeway was closed some 75+ years ago without full recovery. Perhaps a cooperative plan with the many groups and individuals interested in restoration, revegetation, and habitat improvement of our damaged public lands can be put into place. Perhaps we can restore the lands to decent habitat with some grant help and interest from the County, the county's numerous non -profit groups, the USFS and the DOW using some kind of IGA and volunteer work groups. It is our belief that the purchase should proceed, and that the most appropriate resource management can then be identified through a public planning process such as was done for Filoha Meadows and is underway for the Redstone Open Space lands. PROCESS: A Subdivision Exemption to create an open space parcel is a one -step process with review by the BOCC at a duly noticed public hearing. REFERRALS: The application was referred to the Crystal River Caucus, but comments were not submitted in time to include in the packet. STAFF COMMENTS: SUBDIVISION EXEMPTION FOR CREATION OF AN OPEN SPACE PARCEL Section 2-30 - 30(h) of the Land Use Code provides an exemption from subdivision for the creation of parcels for community or public facilities or open space subject to compliance with the following standards. (a) The suhdivision of land for commnrnitp and public and open space, including parcels conretemce to public entities Jor puhlic purposes, is exempt from subdivision subject to compliance with the standards in Sec. 6- 30 -120. IW-7 Response: A 1.875 lot (Lot 2) will be conveyed to Pitkin County for open space and recreation; this lot will provide access to the Crystal River and will allow for a trail connection to the adjacent USES lands. (b) An applicant will be required to prepare and record u uh the County Clerk and Recorder a subdivision exemption plat approved by the Community Development Director meeting the requirements of the Pitkin County Land Use Application Manual. Response: A proposed plat is included with the application. (c) For applications that comply udth applicable criteria, a GMQS exemption is available pursuant to Sec. 6 -30 -130. Response: The fathering parcel development right will remain with Lot 1. A growth management exemption is not necessary or required for Lot 2. RECOMMENDATION: Staff recommends that the BOCC approve the Avalanche Boat Launch Subdivision Exemption, subject to the attached Resolution. The notice read " Please return your comments to me by Friday, October 19, 2010" so I was reading it as this coming Friday since the date /day don't match However, by chance if you can still include what I presented to the BOCC on the 13th I would appreciate it In addition I would like to receive a copy of all other public input, particularly if one was included from CVEPA and that was referenced by commissioner Newman referenced at the BOCC meeting. So that you are aware the letter of support is a misrepresentation. Apparently Mrs Farris drafted the letter herself and did not represent the CVEPA board or membership In addition she plagiarized the Agenda Summery that was prepared by Dale Will for the BOCC There is also a conflict of interest issue since both Dale Will and John Armstrong sit on the CVEPA board. I ask that if this letter has been submitted to Community Development that it be rejected based on its questionable representations. I also requested that the BOCC do the same at the 10/13 meeting but they gave no response. One other note about the notice of the First Mortgage Company LLC Subdivision Exemption to Create Open Space Parcel. While there are many other issues other than what I am submitting, I've tried limiting my response to address the Agenda Item Summery only. Popular boating access: There is no documentation of any "popular" boating access. The statement implies that the area was used consistently by boaters of all types. In fact there is no record of any sort that can document the type of "popular" use or frequency that the Director of Open Space references. Also the time that the Crystal can be navigated by the general public is short and would only be a month or two from after runoff to low flow: last week in June through July. Even the more experienced kayakers have not been documented in any meaningful numbers to use the four miles as stated during runoff. Safety: In this instance the safety of children is not at issue and is no reason to create additional access. There is already access to the area on public land that could easily be improved if safety were a true concern. If this were a valid reason then many of the trails in Pitkin County should be closed to individuals under a certain age for the same safety concerns until the county could assess the many dangers. By creating access closer to the river and highway, an augment can be made that the county would be putting "children" at greater risk from those additional hazards. In addition the term "suitable" does not define exactly what the risks are, does not specify what age group of children are being put at risk or even how the hazards would be alleviated by creating additional access. Would the county close the existing access to Janeway if the supposedly safer access were to be created? In addition where is the documentation of any injuries on other county trails that can be applied and that are relevant for the cost of this additional access? 0 Preservation: The reason of preservation is a disputable one. No private individual could ever develop or subdivide the property without county exemptions and that would never happen in the absence of any TDR's. Contrary to preserving it, recreational development will have the opposite effect by creating more parking along both sides the highway, more use impacts, inevitable disputes with the property owner(s), dogs, trash, sanitation, fires, introduction of evasive species and wildlife habitat degradation. Leaving it to one private property owner guarantees preservation of the property especially when one considers the strict county land use codes that we are all familiar with. Preservation is not applicable with only two acres, unless you are considering within city limits. If the county was serious about preserving this property then it should purchase the entire lot and pass a resolution that sterilizes any development instead of subsidizing or bailing out a private individual with Open Space tax funds. Key access: This purchase will not result in preserving any "key access ". Even the Director of Open Space has stated that people have been accessing the area for many years so where is the need for additional access? True that the current access is not "convenient" but that could be easily alleviated and save taxpayers hundreds of thousands. This proposal is all about recreational development and completely disregards the Crystal Caucus Master Plan, Wildlife Task Force Study and the concerns of many who live in and outside of the Crystal Valley. The Director of Open Space stated one of his objectives is to create another recreational "Moab" in the Crystal Valley without any regard to its fragile and unique environment. There are many visitors and residence alike that appreciate and respect the untarnished environment of the Crystal Valley and who are alarmed by the unnecessary destruction for the sake of recreation. Commissioner Richards stated in her "priorities going forward" that working to protect wildlife, the natural environment, land use codes and rural character were among her short term goals. Considering that and points presented, Open Space funds should not be used for environmental degradation, needless recreation or to subsidize a private property owner $300.000.00 for a boat ramp and to duplicate access to public lands at the taxpayers expense. The reasons for this proposal are part of a strategic plan for extreme recreational development in the Crystal Valley, one that manipulates public input, ignores it or tries to marginalize any opposition regardless of the reasons.
