COLORADO GRANTING A SPECIAL REVIEW PERMIT, 1041 HAZARD REVIEW, AND
MAJOR PLAT AMENDMENT FOR THE AIR TOUCH CELLULAR COMMUNICATIONS
TRANSMISSION FACILITY

RECITALS
I. Air Touch Cellular has applied to the County for a Special Review Permit, 1041 Hazard Review,
and Major Plat Amendment to construct a facility on Judith Royer's property located at 1581 Lower River
Road, Lot 14 Aspen River Valley Ranch that includes the following elements:
• Two antennae poles approximately 20 ft. in height with 8 ft. "whip antennae" on top.
• One 13ft. by 15ft. equipment storage shed.
• Access to the equipment shed.
2. Judith Royer's property contains 17.85 acres and is a conforming parcel in the AFR-10 zone
district.
3. The Planning and Zoning Commission considered this application at a public meeting on
December 22, 1998 and tied a vote two to two on whether to recommend denial of the application to the
Board of County Commissioners.
4. The Applicant has, since the December meeting with the Planning and Zoning Commission,
provided additional geologic information and has included an antennae pole for the Sheriff's office.
NOW, THEREFORE, BE IT RESOLVED by the Board that it hereby grants approval for the
Air Touch Cellular Special Review Permit, 1041 Hazard Review, and Major Plat Amendment subject to
the conditions listed below which shall run with the land and be binding on all successors in interest:
1. The Applicant shall adhere to all material representations made during the application process.
2. Within 30 days of each anniversary of the granting of this Special Review Permit, the owner of the
transmitting facilities at that time shall submit a statement to the Planning Director attesting to the
continued conformance of the use to the conditions of this permit.
3. If the use does not begin with one year of the granting of this permit, the permit shall expire.
4. If the use is discontinued for any 12 consecutive months, this permit shall expire.
5. To avoid interference with mule deer wintertime habitat construction shall occur only between April
15th and October 15th.

6. All vegetation disturbed during construction shall be revegetated with the same species within the
first growing season after construction. Prior to the issuance of a building permit, the applicant shall
submit to the Community Development Director a re -vegetation and native vegetation screening plan
outlining the strategy to maintain and/or screen the building, towers, and road. The owners of the
facilities shall submit a re -vegetation and screening report with their annual compliance statements.
7. Prior to the issuance of building permits, the Applicant shall submit to Community Development a
drainage and erosion control plan for the access to the equipment shed.
8. There shall be no development outside of the building envelope.
9. The equipment shed shall have no doors, grills, or other unshielded openings on the North, East, and
West sides of the building.
10, The building construction shall include a berm approved by the County Engineer designed to divert
potential debris flows.
11. The Applicant shall submit documentation attesting to the fact that Royer agrees to the revised
application with the additional pole and increased building size prior to the issuance of building
permits.
