RECITALS
Anthony F. Mollica ("Applicant") has applied to the Pitkin County Board of County
Commissioners ("BOCC"), to consider an extension of vested real property rights pursuant to
Section 4-140.30 of the Land Use Code. The application is technically a request to reinstate the
vested rights of the Applicant, as such rights expired on December 9, 1996.
2. The subject property is located in the Redstone area and is referred to as Tract 10 of the Crystal
River Estates, and is more specifically described as a tract of land situated in the South V2 of the
Northeast Y< of Section 29, Township 9 South, Range 88 West of the 6th PM.
3. The property received an Administrative 1041 Hazard Review approval in 1993 (previously, the
property was referred to by the name of Sewell). The vested right to the approval has expired.
4. The BOCC heard this application at its regularly scheduled meeting on January 27, 1999 at which
time evidence and testimony were presented with respect to the application.
5. The BOCC finds that the parcel is encumbered by severe wildfire hazard as determined by the
Colorado State Forest Service.
6. The BOCC finds that development of the subject property is prohibited, pursuant to Section 3-80.70
(A)(3) of the Pitkin County Land Use Code, which prohibits development in areas identified by the
Colorado State Forest Service as containing severe wildfire hazard.
NOW THEREFORE BE IT RESOLVED by the Pitkin County Board of County Commissioners
that it does hereby deny the Mollica Reinstatement of Vested Rights.
