NOW, THEREFORE, BE IT RESOLV, by the Board that it .does grant 1041 Special Review approval for the Throm 1041 Special Review with respect to geologic faults and fJnodplain hazards subject to the following conditions: 1. The applicant shall mitigate any water quality problems associated with the construction of the bridge as outlined by the Environmental Health Department memo dated 5/15/85. 2. The access road to the site shall be developed in accordance with the suggestion made by Nick Lampiris in his letter dated 3/18/85 (on file with the Aspen / Pitkin Planning Office) and the attached map. 3. The dwelling shall be located within the envelope as indicated on the plat submitted with the application. 4. Prior to the issuance of a building permit, a site specific soils study shall be done by a professional engineer to insure proper foundation design. 5. Prior to issuance of a building permit, the applicant shall obtain a well permit (for the spring) from the Division of Water Resources. 6. APPLICANT: Bob Throm LOCATION: Sections 34 and 35, Township 9 South, Range 86 West; located approximately 10 miles south of the Snowmass Conoco Station on Snowmass Creek Road (County Road 11). SITE DATA: The site is 35 acres in size and is a pre- existing metes and bounds lot. WATER: Proposed use of a spring. SEWER: Proposed individual sewage disposal system. ACCESS: Off of County Road #11 (Snowmass Creek Road) and over a proposed bridge. EXISTING ZONING: RS -30 PUD ADJACENT ZONING: RS -30 PUD I. DESCRIPTION OF THE PROPOSAL: The applicant proposes to build a single - family residence. The site is designated on the CSU Hazard Maps as being within the 100 year floodplain and having potential geologic fault concerns. A. History: This proposal was reviewed by the Planning Commis- sion on May 21, 1985, and was approved with conditions. The BOCC must take the final action on the request since it involves a floodplain concern [Section 6 -6.1 (b)]. B. Site Description: The site is currently vacant and consists of varying terrain. The parcel has steep slopes along its north side adjacent to the County Road. It becomes less steep going south along the County Road and opens up into flat lands along Snowmass Creek. The steepness of the slopes increase as you cross the creek and head east. C. Project Description: The applicant proposes to develop the parcel with one single - family homesite and to construct a bridge over the 100 year floodplain as a portion of the access to the site. Nick Lampiris, a consulting geologist studied the site and submitted a letter dated March 15, 1985. The letter indicates that from the standpoint of geology, the site is excellent for development of a single - family dwelling. The faults identified in the area have been inactive for thousands of years. He recommends that there be at least a 20 foot setback from the steep slopes and that a site specific soils study be done to insure proper foundation design. He also suggests that the proposed access road could be better aligned to the north of the ridge to prevent the need for a cut and fill situation. The Planning Commission recommended at their meeting on May 21st, that the applicant supply information to show confor- mance with the floodplain regulation. Pat Dobie was hired by the applicant to do a backwater analysis of the proposed 000005 bridge siting. His study off -site impacts caused by bridge structure. II. MAJOR ISSUES AND CONCERNS A. He notes that the water quality will be impacted during bridge construction and that measures should be taken to mitigate this problem. 4. County Engineering Department - Tom Newland of the County Engineering Department reviewed the report done by Pat Dobie and found it to be adequate regarding floodplain issues. B. Staff Comments: 1. The Planning Commission has made a determination regarding the 1041 geologic faults concerns. However, Section 6- 6.1(b) of the Code indicates that final decisions regarding floodplian issues must be approved by the BOCC. 2. The siting of the proposed dwelling is clearly outside of any 1041 fault or floodplain hazard area. 3. The suggestion by Nick Lampiris to relocate the access road around the north side of the ridge, as shown on the plat, should be adhered to. 4. The site is located in a rural area with several large homes in the immediate vicinity. The proposed 2800 s.f. home is appropriate for the area. The proposed building site is well shielded from the County Road by large evergreen trees. It is to be located approxi- mately 1200 feet off the County Road. 5. Overhead power lines are currently located on the parcel. The floodplain maps indicate a power line extension lies within approximately 200 feet of the proposed dwelling. RECOMMENDATION: On May 21st, the Planning Commission recommended approval of the 1041 special review with regards to the fault hazard concerns and placement of the proposed dwelling with the following conditions: 1. The applicant shall supply adequate information indicating conformance with the floodplain regulations, Section 5 -402.2 of the Land Use Code. Final approval for the homesite shall be contingent on the finding by the BOCC that the applicant can meet the floodplain requirements and can mitigate water 2 quality problems associated with construction of the bridge as outlined in the memo from the Environmental Health Department dated 5/15/85. 2. The spring should be properly developed and tested for bacteriol- ogical and chemical quality, however, this should be possible. There are no water rights presented in the application indicating that the spring can be used for a domestic supply or that a well can be drilled. On -site wastewater disposal should be accomplished by a conventional septic system. Soils in the general area are suitable and there are no obvious pollution problems created by installing a septic tank - absorption field. The water quality of Snowmass Creek will be impacted during bridge construction. This construction activity is covered by a nationwide permit and a separate permit (404 from the U.S. Army Corps of Engineers) required. This department would recommend that the following. construction practices be implemented to minimize sediment loading into the stream. Soil disturbance on the banks should only occur during low flow periods in the fall. All construction should be hydrologically isolated from earth disturbance in the bridge area until soil stabilization by any of the recormended procedures such as coffer dams, culverts and other flog diversion structures. The building site appears to be well outside the floodplain, however, insufficient detail is presented on bridge location and design to assess its physical and structural relati- onship to the floodplain hazard. I would recommend that a detai 1 ed bridge design be submitted for review by the bui 1 di ng department prior to final approval. I also concur with Nick Lampiris' recommendation that the road be relocated to the north to avoid a cut and fill. Finally, I would request that a fisher- man's access easement for Snowmass Creek be required of the applicants. Hyman Ave. Aspen, CO. 81611 Dear Mr. Throm: 1 have completed my geologic investigation of the proposed building site near the south central portion of your property along Snowmass Creek, I have also reviewed the 1972 geological reconnaissance of the area by Chen and Associates, Inc. The property lies almost entirely east of the Snowmass Creel:. Road well up the Snowmass Creel: valley, Pitl:in County, Colorado. More specifically, it lies in Sections 34 and 35, T 9 S, R 86 W, 6th P.M. within the Highland Peal:: 7 1/2 minute quadrangle. The topography of the site, although it was viewed with considerable snow cover, consists of an open meadow merging with a linear ridge trending roughly north and south along the east side of the physiographic floodplain of Snowmass Creek. There is a steep hillside approximately 200 feet east of the building site and a gentle Swale leading to the Snowmass Creel valley appro;:imately 150 feet northeast of the building site. There is a steep bank with approximately twenty feet of relief leadino down to the floodplain about twenty feet west of the site. The surficlal geology of the site consists of lateral moraine deposits which form the ridge that the proposed home will rest on. These glacial deposits consist of unsorted silts, sands, cobbles and boulders in an unconsolidated state. The bedrocl formations are not visible near this site but are probably sandstones, s.11tstones and shales of the Jurassic or Cretaceous formations of the area. These generally dip about 45 degrees to the northeast. There is a geologic fault mapped by Bryant (1972) which trends along the valley floor in this area. From the standpoint of geology, this is an excellent site for development of a single family dwelling. The aforementioned fault gives no indication of having moved for thousands of years, and therefore, is considered to be inactive and not a 000022 Throm Building Site March 18, 1985 Page Two threat to development. There are no other potentials for geologic hazard associated with the site as described in the field. The setback:: from the steep bank was indicated to be (and should be) at least twenty feet. Natural drainaqe will not approach the building site and is minor east of the site in the vicinity of the Swale. Obviously the site is well above the 100 year floodplain of Snowmass Creek. The steep hillside over 200 feet to the east cannot negatively impact this site. Despite the excellent suitability of this site, a soils engineering study should be performed at the site specific level to insure proper foundation design. It is my understandinq that water for domestic use will be available through the development of a spring on the property. If a well is decided upon, sufficient quantities of potable water should be available within 75 feet of the surface. Waste disposal in the permeable soils of the site should be achievable through the use of a standard septic system with accompanying leach field, but the F'itk:in county Sanitation Engineer should be consulted for his specific recommendations. Access to the site is not yet in, but can be engineered with a bridge over Snowmass Creek:: and standard techniques for road buildinq across wetland areas. The road as shown on the accompanying map could perhaps be better aligned by swinging north around the glacial ridge and up the Swale as shown, thereby eliminating a cut and fill situation. July 1, 1985 Aspen, CO 81611 RE: Snowmass Creek Backwater Analysis Mr. Robert Throm 521 East Hyman Dear Mr. Throm: "No development... or alteration of any portion of the floodplain shall be permitted which in time of flooding would... impare the flow or storage capacity of a floodplain so as to cause foreseeable damage to others either within or outside of the floodplain boundaries." The intent of this regulation is to insure that any proposed structure built within a floodplain be designed and constructed to prevent damage or impact to adjacent properties. The following is an analysis of the probable impacts on the stream hydraulics and floodplain area around your proposed bridge across Snowmass Creek. This report was prepared to satisfy the requirements of Section 5 -402 of the Pitkin County Land Use Code. Within that regulation, sub - paragraph (a)(5) is the critical area of concern relative to this project: With respect to the proposal at hand, the impacts associated with the construction of a bridge are (1) alteration of the stream hydraulics and (2) increase in stream turbidity. Any alteration of a floodplain changes the stream flow characteristics to varying degrees. Therefore, to minimize the damage to adjacent properties, this bridge was designed to allow the passage of a 100 year f lood event without creating a backwater condition which extended onto upstream properties. In our analysis (copy attached) we found that the proposed structure with a span of 64 feet and an elevation of 4 feet above the streambed will successfully pass 1040 cubic feet of floodwater per second (Q -100). In order to allow for debris flow and the other uncertainties associated with a flood of this enormous magnitude, we allowed an additional foot of freeboard which justifies the design shown on the attached plans. This rise will be dissipated over a reach of 124 feet extending upstream from the bridge. Since the bridge will be located 140 feet below the upper property line, no offsite impacts will be generated by this structure. During the construction period, the generation of turbidity results to a certain extent from machinery operating within the water course and for the most part from dewatering of the abutment cavity. Every reasonable attempt will be made to keep these and other activities from causing stream degradation. At a minimum, the following practices should be adhered to during the bridge construction: 1. Only rubber tired equipment will be allowed within the stream channel when excavating or backfilling the abutments. 2. An alternate route will be found for concrete trucks, cranes and the like, and no stream ford wil 1 be constructed. 3. Should the foundation excavation be dewatered, pumps will discharge onto adjacent fields at a sufficient distance to allow for percolation and sedimentation of fine particles. 4. No excess concrete or concrete - coated equipment will be wasted or cleaned on -site. Assuming that the construction recommendations pointed out in this analysis are followed, the construction of your bridge will have no significant adverse impacts on either your property or adjacent properties. Nationwide permits are designed to allow the work to occur with little delay or paperwork. They are issued to satisfy the requirements of both Section 10 of the River and Harbor Act of 1899 and Section 404 of the Clean Water Act, unless otherwise stated. No permit application is required for an activity covered by a nationwide permit. The Corps of Engineers has issued a nationwide general permit for minor road crossing fills including all attendant features both temporary and permanent tnat are part of a single and complete project for crossing of a non -tidal waterbody, provided that the crossing is culverted, bridged or otherwise designed to prevent the restriction of and to withstand expected high flows and provided further that discharges into any wetlands adjacent to the waterbody do not extend beyond 100 feet on either side of the ordinary high water mark of that waterbody. A "minor road crossing fill" is defined as a crossing that involves the discharge of less than 200 cubic yards of fill material below the plane of ordinary high water. The following special conditions must be followed in order for this nationwide permit to be valid: 1. That any discharge of dredged or fill material will not occur in the proximity of a public water supply intake; 2. That any discharge of dredged or fill material will not occur in areas of concentrated shellfish production unless the discharge is directly related to a shellfish harvesting authorized by Paragraph (a)(4) of this section. 3. That the activity will not jeopardize a threatened or endangered species as identified under the Endangered Species Act, or destroy or adversely modify the critical habitat of such species. In the case of Federal agencies, it is the agency's responsibility to review its activities to determine if the action "may affect" any listed species or critical habitat. If so, the Federal Agency must consult with the Fish and Wildlife Service and /or National Marine Fisheries Service; 4. That the activity will not significantly disrupt the movement of those species of aquatic life indigenous to the waterbody (unless the primary purpose of the fill is to impound water); j. That any discharge of dredged or fill material will consist of suitable material free from toxic pollutants in toxic amounts; 6. That any structure or fill authorized will be properly maintained; 7. That the activity will not occur in a component of the National Wild and Scenic River System; and 8. That the activity will not cause an unacceptable interference with navigation. In addition to the conditions specified above, the following management practices should be followed, to the maximum extent practicable, in the discnarge of dredged or fill material under nationwide permits in order minimize the adverse affects of these discharges on the aquatic environment. Failure to comply with these practices may be cause for the district engineer to recommend that the division engineer take discretionary authority to regulate the activity on an individual basis: 1. Discharges of dredged or fill material into waters of the United States shall be avoided or minimized through the use of other practical alternatives. 2. Discharges in spawning areas during spawning seasons snall be avoided. 3. Discharges shall not restrict or impede the movement of aquatic species indigenous to the waters or the passage of normal or expected high flows or cause the relocation of the water (unless the primary purpose of the fill is to impound waters). 4. If the discharge in wetlands creates an impoundment of water, adverse impacts on the aquatic system caused by the accelerated passage of water and /or the restriction of its flow, shall be minimized. S. Discharge in wetlands areas shall be avoided. b. Heavy equipment working in wetlands shall be placed on mats. 7. Discharges into breeding areas for migratory waterfowl shall be avoided. 8. All temporary fills shall be removed in their entirety. If the above conditions cannot be met, the work will have to be authorized by an individual or general permit issued by the district engineer.
