RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY,
COLORADO, GRANTING APPROVAL TO THE ROBERT THROM DETACHED
CARETAKER DWELLING UNIT AND AMENDED
1041 HAZARD REVIEW PLAT
Resolution No. 98- 049
Robert and Phyllis Throm ( "Applicant") have applied to the Pitkin County Board of County
Commissioners ("BOCC"), for approval of a detached caretaker dwelling unit.
2. The property is located at 8998 Snowmass Creek Road and is described as a parcel of land being
situated in Section 34 and 35. Township 9 South, Range 86 West of the 6th P.M, Pitkin County,
Colorado.
The Applicant proposes to deed restrict the proposed caretaker dwelling unit pursuant to Section 3-
150.130(B), Caretaker Dwelling Units, and Section 3- 210.10, Special Review, of the Pitkin County
Land Use Code ( "Code ").
4. The building envelope for the Caretaker Dwelling Unit is exempt from full 1041 review because
no 1041 hazards exist pursuant to Section 4 -40. `C - - ; = .
The BOCC heard this application at its regularly scheduled meeting on December 2, 1998, at which
time evidence and testimony were presented with respect to the application.
6. The BOCC has determined that the detached caretaker dwelling unit meets the standards
established in Section 3- 150 -130 of the Code.
NOW, THEREFORE BE IT RESOLVED by the Pitkin County Board of County Commissioners
that it does hereby grant approval for a detached caretaker dwelling unit, subject to the following
conditions which shall run with the land and be binding on all successors in interest:
Prior to application for a building permit, the Applicant shall record a 24 x 36 inch mylar an
amended 1041 Hazard Review Site Plan which meets the approval of the Community Development
and County Attorney. The site plan shall also be submitted in a digital format for integration into
the County Geographic Information System (GIS). The face of the site plan shall include the
following additional information:
A. The site plan shall be identified as "Throm Amended 1041 Hazard Review." The site plan
shall include a building envelope for the detached caretaker dwelling unit which meets all
appropriate setbacks, along with the building envelopes approved for the main residence and
detached garage with loft identified and approved during the original 1041 Hazard review.
B. The site plan shall include a vicinity map.
C. The site plan shall include the appropriate signature blocks.

D. The site plan shall identify the 100 -year flood plain for Snowmass Creek. All structures shall
be located outside of the 100 -year flood plain.
E. The site plan shall include the following 1041 Hazard Review Warning and Disclaimer:
"The applicant acknowledges that he /she has been informed b Pitkin County of the
existence of 1011 Environmental Hazard areas that might affect the property, any
improvements and the use and occupancy thereof. "
'_. Prior to application for a building permit, a caretaker dwelling unit deed restriction shall be
accepted by and recorded with the Housing Office.
Prior to application for a building permit, the Applicant shall submit actual floor plans of the
proposed unit (calculating the net livable square footage) to the Housing Office for review.
4. Housing Office staff shall inspect the unit prior to issuance of a Certificate of Occupancy.
5. The kitchen unit shall contain at least a two -burner stove with oven, a standard sink, and no less
than a 6 cubic foot refrigerator plus freezer.
6. Should the Applicant decide to install a fireplace /woodstove, a fireplace application must be filed
with the Environmental Health Department.
7. Prior to application for a building permit, the Applicant shall obtain a septic permit from the
Environmental Health Department. All sewage disposal systems must be designed by a registered
professional engineer. Sewage disposal system shall be located within the approved building
envelope.
8. Prior to application for a building permit, the Applicant shall provide documentation of an
adequate domestic water supply on the property. Quantity and quality of said supply shall meet
the approval of the Environmental Health Department.
9. No development, including grading, entry or ranch gates, septic systems, landscaping (including
berming) and vegetation removal or disturbance shall occur outside of the designated building
envelope, except for utility and driveway extension and maintenance, and as may be necessary to
implement the wildfire mitigation measures required elsewhere in this document.
10. Landscaping and revegetation on the property shall utilize low water (xeriscaping) native plant
materials and concepts. The timing of any sprinkler systems shall be decreased for low water
plants.
11. The Applicant shall implement the following measures to mitigate impacts to wildlife:
A. Fencing should be avoided. If necessary, fencing shall comply with the amended Pitkin County
Fencing Guidelines. Fencing outside of the approved building envelope shall be prohibited.
B. Removal of native vegetation shall be prohibited outside of the approved building envelope.

C. All garbage must be kept indoors or in bear-proof containers.
12. The Applicant shall comply with the following landscaping and wildfire defensible space
mitigation standards:
A. The Applicant shall establish and maintain, for a distance of 10' around all structures,
vegetation at 6" or less (i.e. mowed grass). Woody vegetation shall not be planted within this
perimeter.
B. Flammable material (i.e. firewood) shall not be prohibited.
C. For a distance of 30' around the structure, the existing mature spruce shall be thinned so that
the crowns are no closer than 10' between trees.
D. Lower limbs shall be removed to a height of 10' to eliminate ladder fuels.
13. The Applicant shall comply with the following additional wildfire mitigation standards:
A. Roof construction shall be Class A, non - combustible (no wood shake /shingles) material with
no flat roofs.
B. Roofs and gutters shall be kept clear of debris.
C. Yards shall be kept clear of all litter, slash, and flammable debris.
D. Fences shall be kept clear of brush and debris.
E. Wood fences shall not be connected to the structure.
F. The structure shall have a minimum of one 10 lb. ABC fire extinguisher.
G. All vents shall be screened with corrosive resistant wire mesh of one quarter inch maximum.
H. Utility lines shall be buried.
14. The structure shall comply with the codes and requirements of the Basalt and Rural Fire Protection
District.
15. The Applicant shall adhere to all material representations made in the application and public
meetings.

SUMMARY OF REQUEST The applicants are requesting approval of a detached caretaker dwelling
unit.
APPLICANT: Robert and Phyllis Throm
LOCATION; The property is located at 8998 Snowmass Creek Road.
ZONING/LOT SIZE: RS -30; approximately 35 acres
REFERRAL COMMENTS; Referral agency comments are incorporated throughout this memorandum,
and are attached for reference. Referrals were received from the County Attorney's Office, Environmental
Health, Zoning, Housing Authority, County Wildlife Biologist, Floodplain Administrator,
Snowmass /Capitol Creek Caucus (included with application) and the Colorado State Forest Service.
Comments were not received from the Division of Wildlife.
COUNTY ATTORNEY COMMENTS: The staff report was reviewed by the County Attorney's Office
on 11/24/98.
BACKGROUND: The property was granted approval for a 1041 Geologic and Floodplain Hazard
Review pursuant to Resolution No. 85 -81 for the construction of a single family residence and a bridge.
The principal residence and a detached garage have been constructed and the bridge has been installed.
The proposed CDU building envelope avoids all 1041 hazards.
ANALYSIS OF PROPOSAL;
CARETAKER DWELLING UNIT (CDU): The following is a review and analysis of the proposal relative
to the applicable standards of Section 3- 150.130(C) of the Land Use Code. The Board may permit a
CDU not to exceed 700 square feet, to be located within a properly approved outbuilding on any lot in
the RS -30 zone district under the following conditions and limitations:
1. The totalfloor area of the principal and caretaker unit shall not exceed the allowable FAR of the
applicable zone district.
Response: The allowable FAR for the RS -30 zone district is 15,000 square feet of residential floor area.
The applicants have indicated that the square footage of the principal residence and the proposed
caretaker dwelling unit will be in compliance with allowable FAR.

2. There shall be provided one off-street parking space for each bedroom within the principal unit
and one off - street parking space for each bedroom in the caretaker unit.
Response: The applicants have indicated that they will provide adequate parking for the CDU.
3. The applicants shall deed restrict the unit to comply with the caretaker unit deed restriction
pursuant to Section 3- 150.130(0) (3) of the Land Use Code.
Response: The applicants agree to deed restrict the CDU in accordance with County regulations.
9. The dwelling unit deed restriction may only be removed upon approval by the Board of County
Commissioners.
Response: The applicants agrees to comply.
SPECIAL REVIEW: A caretaker dwelling unit is listed as a special review use in the RS -30 zone district,
and therefore must comply with the special review standards in Section 3 -210 of the Land Use Code.
These standards require that:
1. The use is consistent with applicable master plans, County Land Use policies, the intent of the
zone district, and the character of the surrounding area
Response: The use is consistent with applicable master plans, County Land Use policies, the intent of
the zone district, and the character of the surrounding area.
2. The location, size, design and operating characteristics of the use are in harmony with the
surrounding area and minimize adverse effects.
Response: The proposed detached caretaker dwelling unit will be located at the entrance of the property
off of Snowmass Creek Road just before crossing the river to the main residence. The unit will be
located within a cleared area, encompassed by mature spruce. The structure will be semi - visible from
Snowmass Creek Road. Vince Urbina of the Colorado State Forest Service visited the site and offered a
number of mitigation measures which have been incorporated as conditions of approval. His
recommendations can be seen in more detail in Attachment F of this memorandum. The location, size,
design and operating characteristics of the unit will be in harmony with the surrounding area and will
have minimal adverse effects.
3. Adequate public facilities and services are available.
Response: There is an existing spring that services the site, however, the applicant has indicated to staff
that a new well will be drilled. Documentation shall be submitted to the Environmental Health
Department (EHD) as to the quantity and quality of water available on the site to service the CDU. The
existing septic system on the property services the primary residence. The applicants have indicated that
the CDU will have its own septic system.

OTHER: The applicants did not designate a building envelope on the site plan submitted for review for
the proposed CDU. Staff has taken the liberty of established a building envelope for the proposed CDU,
septic system and a well in accordance to recommendation made by the Environmental Health
Department and setback requirements. A copy of the staff designated building envelope can been seen in
Attachment H. Expansion of the building envelope may be required depending on soil testing.
Pursuant to Section 3- 50- 040(A), "development is prohibited within the 20' strip of land measured
horizontally from the mean identifiable high water mark" of Snowmass Creek. In addition, development
is prohibited with designated yard setbacks unless a variance approval is granted by the Board of
Adjustment, this includes a mounted septic system (30" above natural grade). The side yard setback for
this property is 50' and the front yard (access side) is 100'. The applicants have indicated that the
proposed septic system will be located to the southwest of the proposed building envelope across the
driveway, therefore the well shall be located within the northwest portion of the designated building
envelope. According to the Environmental Health Department, a septic system for a detached caretaker
unit is sized for 2- bedrooms under the current septic regulations. In accordance to septic system
regulations, the proposed well for the CDU shall be located 100' from the septic system and the septic
system shall be located 50' from any stream and 10' from the property line.
Jonathan Lowsky, County Wildlife Biologist, visited the site and made a number of recommendations
which have been included as conditions of approval. Mr. Lowsky's comments can be seen in
Attachment G.
RECOMAIENDATION: Staff recommends that the BOCC pass the following motion, "to approve the
detached caretaker dwelling unit for the Throm property, subject to the conditions in the attached
resolution."

BACKGROUND According to the Pitkin County Land Use, Section 3150.130 5, "Other Caretaker" units.

under such guidelines as may be from time to time established by said Authortty; be
rented for temps not less than six (6) months a rented. The caretaker dwelling unit
may be occupied by members of the immediate famil even though they may not
qualify as employees of the community. "Immediate Famiy shall mean a person
related by blood or marriage who is a flrat cousin (o' closer relative) and his or her
children.
M ENDATION : Staff recommends approval as long as the following conditions are met::
the kitchen contains at least a two- burner stove with oven, standard sink, and at least a 6-cubic foot
refrigerator plus freezer;
2. actual floor plans of the proposed unit (calculating the net livable square footage) be submitted to the
Housing Office prior to building permit approval; and
3. a Caretaker Dwelling Unit deed restriction be recorded before building permit approval (this
document shall be obtained through the Housing Office).

The Aspen / Pitkin Environmental Health Department has reviewed the details of the Throm
application under the authority of the Pitkin County Land Use Code and has the following
comments.
ADEQUATE PROVISIONS FOR WATER NEEDS: Sections 2 -17 and 3 -1104:
"It is the policy of the County to insure the availability of a water supply of adequate quality, quantity, pressure and dependability for fire
protection and support of a proposed land use prior to approval of the use. The County shall require land uses to hook up to existing public
systems if service is available."
An existing spring serves this site. The intended water source for the caretaker unit is unknown.
Disregard the following comments if the caretaker unit utilizes the existing private spring.
This Department needs adequate information on the quantity and the quality of water available.
To do this, the owners will need tests of on -site wells or springs done by a water engineer or well
driller. The applicant must ensure that the water quality is acceptable by having it tested by a lab
such as the Snowmass Water and Sanitation District or Aspen Consolidated Sanitation District.
Other lots in this area have had water of acceptable quality and quantity. Before this department
can issue a septic permit, the owners must drill the well to ensure that the well will meet the
required setback distance from the septic system. Before drilling the well, the applicant should
be sure that it will be possible to fit the septic system far enough away from the well. Pitkin
County Land Use Code requires that the well site be within the building envelope. The possibility
exists that the well may not fit within the building envelope.
We recommend low water landscaping (xeriscaping), with the timing of any sprinkler systems
decreased for low water plants. Contact the Colorado State University Cooperative Extension
office or Denver Water Board for more information on xeriscaping.

SEWAGE TREATMENT AND COLLECTION: Sections 2 -18 and 3- 1105: "It is the policy i,t the County to
ensure that adequate sewage treatment facilities are available to serve existing and new developments. Public and private sewage disposal systems
and connections to such systems shall comply with the sewage disposal guidelines of Pitkm County's Individual Sewage Disposal System
Regulation."
Currently, an individual septic system serves the main house. The proposed caretaker unit will
need a septic system. All such systems installed within Pitkin County require septic permits
issued by the Environmental Health Department, and must comply with the County's septic
regulations. Owners should realize that the engineer must perform the soils tests between April 15
and Nov. 15 of each year. The County cannot issue building and septic permits without these soils
tests. To receive a septic permit, the applicant will need to submit a septic permit application
through a Registered Professional Engineer who will design the system. The packet must include
several items, including percolation test results and profile hole information. It must also include a
site plan with pertinent physical features. A floor plan for the caretaker unit and a copy of the
County's land use approval are needed as well. Once we receive the completed application, this
Department will analyze and review the proposed septic design.
The applicant should know that it may take from 2 -6 weeks to obtain a well permit (required
before septic system design). It may take some time to have soils tests performed and additional
time to have the system designed. The department can evaluate the site and soils tests only
between April 15 and Nov. 15. The owner should carefully evaluate this schedule to make sure
all steps have been taken to make the permitting process as fast as possible.
Applicants should also be aware that many building envelopes are too small to allow any but
the smallest house and still have the septic system meet required setbacks from wells. It may be
difficult to locate the sewage disposal within the building envelope.
Here is one example of the required distances between wells or streams and septic systems. (The
greater the sewage flow, the greater the distance must be between the septic system and the well
or stream. Sewage flows are a function of the size of the house and the number of rooms that these
or future owners may use as bedrooms as their family size and situation changes. A septic system
for a detached caretaker unit is sized for 2- bedrooms under the current septic regulations.)
Applicants should carefully evaluate this information so they can ensure the caretaker unit they
want to build can meet these setbacks.
A 1- bedroom detached caretaker unit, smaller than 2,000 sq. ft. must have its well 100' and any
stream 50' from the septic system.
The type of soil will determine how large the septic system must be. The owners will need to
obtain site specific soil data.
The leach field should be in an area of no traffic, the owner should plant the field area with dry
land grass, and residents should not water the leachfield area. It is desirable to locate the system
below the house so that the system can operate by gravity. The applicant should refer to the Pitkin
County Sewage Regulations for detailed information, or call our office to discuss this site.
Ditches on the site may pose a hazard. Water drainage from the ditch could impair the
functioning of the septic system by overloading and saturating the soils. This would severely
impair the soil's ability to absorb and filter water of the septic system. Percolation test holes
should be below the ditch in the area of the proposed leach field. If water from the ditch collects in
these holes, the design will have to keep water from the ditch away from the leach field. These
measures include but culverting the ditch or creating diversion swales to move the water away
from the septic system. The system must be at least fifty feet away from the ditch.
The Pitkin County Land Use Code prohibits soil absorption systems in areas where the ground
slope is in excess of thirty percent (30 %).
A condition of approval for this application is the receipt and approval of the septic
permit before issuance of a building permit.
WATER QUALITY IMPACTS: Sections 2 -14 and 3 -705 and 3 -710:
"It is the policy of the County to preserve and protect its present water resources. To this end it is the policy of the County that no land use be
initiated which would adversely affect the quantity, quality, or accessibility of the County's water resources; or which would occur at the expense
of established water - dependent agricultural activities; or which would result in increased salmization of water resources, loss of minimum stream
flows, further destruction of wildlife habitat, or major expenditures to reacquire or redistribute major water resources It is also the policy of the
County to maintain a natural vegetative buffer along its surface waters such that the surface and groundwaters of the area are not encroached upon
by land uses or other human activities which could cause deterioration of water quality or impair the natural treatment processes provided by
meadows and wetlands."
The Environmental Health Department will be addressing water quality impacts on down stream
water quality. This application should not impact down stream water quality if the setbacks
between the septic system and physical features comply with the Pitkin County Sewage
Regulations.
The Environmental Health Department's mission is to preserve and protect the quality of Pitkin
County's water resources. Since a large percentage of the population is dependent upon water
from wells, elimination of groundwater pollution, and protection of aquifers and their drainage
areas are of utmost importance. Roofs and asphalt areas can be nonpoint sources of water
discharge that can contaminate water supplies. This Department recommends that nonpoint
sources of discharge be retained on the property of origin. To accomplish this, the owner can use
landscaping, drainage patterns, detention ponds, and /or dry wells for water runoff from
buildings.

This project should not contribute significantly to degradation of air quality in Pitkin County since
it consists of only a single family home (with caretaker unit).
FIREPLACE
The less densely populated parts of the county like this site may have two devices per building.
The owners can install no more than one wood burning fireplace and a second device that can be
either a gas log fireplace or a certified woodstove. In addition, the owner can install unlimited
numbers of decorative gas appliances. Occupants may not burn coal in any device. The owners
cannot install fireplaces or woodstoves in barns or agricultural buildings.
A condition of approval for this application is the receipt and approval of the
fireplace /woodstove permit by the Environmental Health Department. This is a condition
of building permit issuance.

I visited the site with Bob Throm on September 15` Access to the site is from
the Snowmass Creek Road. There are no problems with the access to the
caretaker site. The aspect of the building envelope is south and it is nearly level.
The vegetation is primarily blue spruce, grass with some scattered willow and
alder. I would rate the wildfire hazard as medium. I visited with Bob at length
about establishing defensible space and orienting the structure on the site.
I only have two recommendations for this site.
1) For a distance of 10 feet around all structures establish and maintain
vegetation at 6 inches or less (e.g., mowed grass). Woody vegetation should
not be planted within this perimeter. In addition, flammable material (i.e.,
firewood) should not be stored here.
2) For a distance of 30 feet around the house thin existing mature spruce so the
crowns are no closer than ten feet between trees. Remove the lower limbs to
a height of 10 feet to eliminate ladder fuels.

previously disturbed area and is not significantly extending the influence of development. My
recommendations are as follows:
1. Fencing should be avoided. If necessary, fencing must follow the new Pitkin County Fencing
Guidelines and must be prohibited outside the building envelope.
2. Removal of native vegetation must be prohibited outside the building envelope.
3. Due to the large amount of black bear activity known to occur in the area, all garbage must be kept
indoors or in bear -proof containers approved by the Pitkin County Wildlife Biologist or personnel of
The Colorado Division of Wildlife.

This letter is part of my request to construct a detached caretaker dwelling unit at 8998 Snowmass
Creek Road. We desire to seek approval to construct a caretaker unit outbuilding located in the R -30
Zone District.
The unit will have approximately 20' x 32' plus 4' x 12' vestibule (688 square feet) interior space
and shall provide two off - street parking spaces. The total square footage of the principal residence
(four bedrooms) and the caretaker dwelling unit (one bedroom) shall not exceed 6000 square feet,
