PT Ranch House LLC ( "Applicant ") has applied to the Pitkin County Board of County Commissioners ( "BOCC ") to request a 20 year extension of the vested right to construct a single family residence on the property. 2. The property is located at 1888 Castle Creek Road, and is more specifically described in Exhibit A. 3. The parcel contains 2.95 acres and is nonconforming in the AR -10 zone district. 4. The property is comprised of two merged parcels (Adelson and Molasky parcels) that previously contained two single family residences. The Hearing Officer granted approval for the redevelopment of the parcel in concert with the redevelopment of the adjacent Castle Creek Banks Partnership Lot 2 (CCBP Lot 2). Pursuant to Determination No. 13 -2008, the Hearing Officer approved a lot line adjustment; granted site plan and special review approval to utilize 3 TDRs for a single family residence on CCBP Lot 2; granted site plan and special review approval for a caretaker dwelling unit on the PT Ranch House parcel; and approved an activity envelope for a future single family residence on the PT Ranch House parcel. The BOCC heard this application at a regular meeting on November 17, 2010 at which time evidence and testimony were presented with respect to this application. The BOCC finds that the commitments made by the Applicant during the 2008 land use review to postpone the development of the residence for at least 15 years, to abandon the barn /corral /pasture envelope on CCBP Lot 2 that was located in the Castle Creek riparian area, to remove artificial turf and a golf hole located within 20' of Castle Creek on CCBP Lot 2 and restore the riparian area, and to forgo the entitlement to develop a barn containing up to 1,160 square feet on CCBP Lot 2, do not provide compelling public benefits and do not justify a 20 year extension of the vested rights for the activity envelope. Senior Planner RE: PT Ranch House LLC Extension of Vested Rights SUMMARY: Pursuant to Section 2-20-170, the Applicant is seeking a 20 year extension of the vested rights to construct a single family residence. APPLICANT: PT Ranch House LLC REPRESENTATIVE: Glenn Horn LOCATION: 1888 Castle Creek Road ZONING /LOT SIZE: The parcel contains 2.95 acres and is nonconforming in the AR -10 zone district EXISTING CONDITIONS /BACKGROUND: The PT Ranch House LLC parcel is comprised of two merged lots (Adelson and Molasky parcels) that previously contained two single family residences. The Hearing Officer granted approval for the redevelopment of the parcel in concert with the redevelopment of the adjacent Castle Creek Banks Partnership Lot 2 (CCBP Lot 2). Hearing Officer Determination No. 13-2008 approved a lot line adjustment; granted site plan and special review approval to utilize 3 TDRs for a single family residence on CCBP Lot 2; granted site plan and special review approval for a caretaker dwelling unit on the PT Ranch House parcel; and approved an activity envelope for a future single family residence on the PT Ranch House parcel. The BOCC shall consider the following criteria in reviewing a request for an extension of vested property rights: The applicant's compliance with can• conclition.s requiring performance prior to the clale of application for extension or reinsialemenl of vesteel rights. Response: The Applicant has complied with all conditions related to issuance of building permits for the new residence on CCBP Lot 2 and the caretaker dwelling unit on the PT Ranch House parcel. The two residences would replace three existing residences. The Applicant is requesting the following approvals: A) Activity Envelope and Site Plan Review for a new single family residence on the PT Barn lot and a caretaker dwelling unit on the PT Ranch House parcel. B) Activity Envelope for a future single family residence on the PT Ranch House parcel. C) Special Review and GMQS Exemption for TDR Receiver Site to utilize up to three TDRs to develop up to 13,250 square feet of floor area on the PT Barn lot. D) Special Review and GMQS Exemption for a Caretaker Dwelling Unit on the PT Ranch House parcel. E) GMQS Exemptions for replacement structures F) Minor Plat Amendment to revise the previously approved building envelope. G) Lot Line Adjustment to revise the lot line between the PT Ranch House parcel and the PT Barn lot to increase the size of the PT Barn lot by approximately 3 acres. H) PUD Variance Amendment to vary the side yard setback and to alter the grade within the 100' Castle Creek Road setback by more than 30" on the PT Barn lot. 2) The property is located 1888/1890 Castle Creek Road (metes and bounds parcel known as the Adelson and Molasky Parcels; more specifically described in Exhibit A) and 1896 Castle Creek Road (Lot 2, Castle Creek Banks Partnership Lot Split) 3) The metes and bounds parcel contains 6.5 acres and is nonconforming in size in the AR -10 zone district. Castle Creek Banks Lot 2 contains 20.3 acres and is conforming in the AR -10 zone district. 4) The BOCC approved the Castle Creek Banks Density Reduction Lot Split in 1992, pursuant to Resolution No. 92 -400; the final plat was recorded in Plat Book 34 at Page 78. A building envelope was approved on the north side of the lot adjacent to Castle Creek Road; a pond /pasture /corral area envelope was approved in the southeast corner of the lot adjacent to Castle Creek. The lot is improved with a single family residence built above a barn and a carport (approximately 5,800 square feet as calculated by the Assessor). 5) The parcel is improved with two single family residences — one containing approximately 1,100 square feet (aka Molasky house) and one containing 8,210 square feet (aka Adelson house). Vos Caudill, Pitkin County, CO Determination No. a_ -2008 Page ? 6) The Hearing Officer heard this application at a duly noticed public hearing on October 28, 2008, at which time evidence and testimony were presented with respect to this application. 7) The }fearing Officer finds that the request complies with the applicable provisions of the Land Use Code, as follows: A) The Activity Envelopes are located on slopes of less than 30 %, and the areas of slopes in excess of 30% qualify as minor slope anomalies pursuant to Sec. 7- 20- 20(c)(3) of the Code. B) The Activity Envelopes avoid the 100 year floodplain of and are set back more than 100' from Castle Creek, with the exception of an envelope to accommodate restoration of disturbed areas and tree planting. C) The Site Plan complies with the applicable criteria in the Code. D) The proposed structures are consistent with the criteria for development within the Scenic View Protection Area. E) The use of three TDRs on the site is appropriate, given the siting of the residence to minimize visual impact as seen from Castle Creek Road and compliance with the other special review criteria. F) The minor plat amendment and lot line adjustment comply with the applicable criteria in the Code, NOW, THEREFORE, BE IT RESOLVED by the Prtkin County Community Development Hearing Officer that he does hereby approve the PT Ranch I louse LLC/PT Barn LLC Activity Envelope and Site Plan Review, Special Review and GMQS Exemption for TOR Receiver Site and Caretaker Dwelling Unit, Lot Line Adjustment, Minor Plat Amendment and PUD Variance Amendment, subject to the following conditions, which shall run with the land and be binding on all successors in interest: 1) The Applicant shall adhere to all material representations made in the current or prior applications or in public meetings or hearings and shall consider those representations to be conditions of approval, unless amended by other conditions. 2) The Applicant shall comply with all standards for development within Scenic View Protection Areas as represented in the application and approved in this Determination. The exterior of the residence shall utilize indigenous earth tone materials or colors and the roofs shall have a non - reflective color or composition. Reflective roof materials shall not be used unless the materials are treated prior to installation to eliminate reflection, with the exception of materials associated with solar or photovoltaic equipment. Driveway lighting is prohibited and all other lighting shall comply with the lighting code. 3) Prior to submission of any building permit applications for the new residence, the Applicant shall be required to submit for approval by the County Attorney and Community Development a Site Plan with an Activity Envelope in accordance with Land Use Code Section 2- 30 -20(g) and Application Manual Section 2.1.12. The above referenced approvals shall be a condition precedent to finalization and recordation of them. Concurrently, the Applicant shall submit for approval by the County Attorney and Community Development an amended plat for Lot 2. The Site Plan shall be amended as follows: A) Eliminate that the steep slopes between the upper, developed bench and the lower bench adjacent to Castle Creek from the activity envelopes. B) Amend Activity Envelope E to exclude all but those areas where planting and restoration are to occur. Determination NoJ3_ -2008 Page 3 4) Prior to submission of any building or other development permit applications for the primary residence on the PT Ranch House parcel, the Applicant shall be required to submit for approval an application for Site Plan Review, pursuant to Secs. 2 -30 -20 and 7 -10 -50 of the Code. 5) The PT Bam lot is exempt from Growth Management for up to 5,750 square feet of floor area. At building permit application for the new residence, the Applicant shall surrender three TDR Certificates and a copy of the deed(s) evidencing the Applicant's acquisition of the Certificates (if applicable), in order to develop in excess of 5,750 and up to 13,250 square feet of floor area. 6) The PT Ranch House parcel is exempt from Growth Management up to 5,750 square feet of floor area. 7) Prior to issuance of a building permit application for the new residence on the PT Barn lot and the caretaker dwelling unit on the P "I' Ranch House parcel, the Applicant shall: A) Provide proof of an adequate water supply (in terms of quantity and availability) for domestic and fire protection purposes, and for irrigation purposes, if applicable, to the Environmental Health and Natural Resources Department. B) Complete a fireplace /woodstove registration form with the Community Development Department, if necessary. C) Submit a drainage and erosion control plan for review and approval by the Planning Engineer. if site disturbance exceeds one (1) acre, the Applicant shall obtain a stormwater permit from the State of Colorado. D) Obtain a County access /driveway permit acceptable to the Aspen Fire Protection District and Planning Engineer for the extension of the driveway. Where utilities are to be extended within the driveway, utility line locations shall be showp on the drawings. E) Submit a construction management plan for review and approval by the Planning Engineer. Pay the applicable road and employee housing impact fees. F) Obtain a permit from Environmental Health and Natural Resources for the new on -site wastewater disposal system. 'fhe existing systems shall be properly abandoned. G) Submit a detailed revegetation plan for disturbed areas with appropriate seed mixes. The plan shall specify the native seed mix to be used, the rate at which it will be applied and the method of cover. H) Submit a landscaping, revegetation and tree removal/mitigation plan. Landscaping shall be substantially consistent with the landscaping shown on the site plan. Landscaping shall be completed prior to issuance of the Certificate of Occupancy for the residence. t) Submit a restoration plan for the picnic /golf hole area adjacent to the creek. The barbeque grill shall be removed and may not be replaced within the 100' setback from Castle Creek. J) Obtain a Floodplain Development Permit 8) Areas disturbed by construction shall be re- vegetated within one growing season of the project's completion. 9) The Applicant shall comply with the following standards for Development in a Wildfire Hazard Area: A) Defensible Space: The area around all buildings /structures, limited by property boundaries that may limit a property owner's ability to comply with this section, shall incorporate landscaping with wildfire defensible space considerations as follows (note: actual vegetation manipulation to Determination No. 5 -2008 Page 4 meet these conditions may not be necessary where the natural vegetation pattems have already fulfilled these conditions). I . Brush, debris and non - ornamental vegetation shall be removed within a minimum ten -foot (10') perimeter around all structures. 2. Vegetation shall be reduced to break up the vertical and horizontal continuity of the fuels at a minimum of a thirty (30) foot perimeter around a structure built on flat ground. (For greater slopes, reference the CSFS Safety Zone chart in Wildfire Guidelines For Rural Homeowners, which provides general guidelines that may be modified by a wildfire expert acceptable to the County). 3. Spacing between clumps of brush and vegetation up to the thirty (30) foot perimeter shall be a minimum of two (2) times the height of the fuel. Maximum diameter of the clumps shall be equal to the height of the fuel. All measurements shall be from the edges of the crowns of the fuel. 4. All branches from trees and brush within the thirty (30) foot perimeter shall be pruned to a height of ten (10) feet above the ground with removal of ladder fuels from around trees and brush. 5. Tree crown separation within the thirty (30) foot perimeters shall have a minimum of ten 6. (10) feet between the edges of the crowns, except for mature stands of aspen trees 7. where ladder fuels have been removed. In areas of aspen regeneration, undersiory shrubs and down and dead materials shall be removed. 8. All branches that extend over the roof eaves shall be trimmed and all branches within fifteen (15) feet of chimneys shall be removed. 9. The density of fuels up to a one hundred( 100) foot perimeter of the structures shall be reduced where natural reduction has not already occurred. 10. All deadfall up to a one hundred (100) foot perimeter shall be removed. 11. No new conifer trees shall be planted within ten (10) feet of a residence. 12. No flammable mulches shall be placed within two (2) feet of a residence. 13. The property owner shall be responsible for the continued maintenance of the defensible space vegetation requirements. B) Roofing. Class A covering or Class A Assembly as defined by the currently adopted Building Code. No wood shakes or shingles. Roofs with less than a 3:12 pitch are not permitted unless they comply with the following: 1. All roof coverings shall be constructed of non - combustible materials and installed on a Class A roof assembly. 2. All roof coverings shall have a surface that shall facilitate the natural process of clearing roof debris. 3. Protrusions above the roofline, such as parapets, shall be prohibited. 4. Roofs shall be installed as required by the adopted Building Code and shall have a minimum pitch of 1:48. 5. All roof designs, coverings, or equivalent assemblies shall be specifically approved by the Fire Marshall prior to submittal of a building permit application. C) Water Supply for Fire Safety 1. Individual structure water supply and storage shall be accessible to fire department vehicles from the exterior of the structure through a fire department approved mechanism (such as a N Determination No. 06 -2008 Page 5 fire hydrant). The lot shall have a minimum 20,000 gallon water storage tank (or alternative approved by the Fire District). 2. to -house sprinkler systems that meet the standards of the AFPD and the adopted Building Code shall be installed in all new buildings. D) Maintenance and Miscellaneous Requirements 1 Roofs and gutters shall be kept clear of debris. 1 Roof vents shall be screened with corrosive resistant wire mesh, with mesh one -fourth ('h) inch maximum. 3. Any outbuilding shall adhere to the same wildfire requirements. 4. Yards shall be kept clear of all litter, slash and flammable debris. 5. All flammable materials shall be stored on a parallel contour a minimum of fifteen (15) feet away from any structure. 6. Weeds and grasses within the ten (10) foot perimeter shall be maintained to a height not more than six (6) inches. 7. Firewood /wood piles shall be stacked on a parallel contour a minimum of fifteen (15) feet away from the structure. 8. Swimming pools and ponds shall be accessible by the local fire district. 9. Fences shall be kept clear of brush and debris. 10. Wood fences shall not connect to other structures. I l Fuel tanks shall be installed underground with an approved container. 12. Propane tanks shall be buried, if possible, or installed according to NFPA 58 standards and on a contour away from the structure with standard defensible space vegetation mitigation around any aboveground tank. Any wood enclosure around the tank shall be constructed with materials approved for two (2) hour fire- resistive construction on the exterior side of the walls. 11 Each structure shall have a minimum of one ten (10) pound ABC fire extinguisher. 14. Addresses shall be clearly marked with two (2) inch non - combustible letters and shall be visible at the primary point of access from the public or common access road and installed on a non - combustible post. 10) The Applicant shall comply with the following conditions regarding wildlife: A) Manipulation of vegetation outside of the Activity Envelopes is prohibited. Landscaping shall be limited to the designated Activity Envelopes. B) New fences shall comply with the following: 1. Mesh or woven wire fences are prohibited. 2. Wood rail fencing shall employ three (3) rails or less, be the round or split rail type, shall not exceed fifty -four (54) inches in height above ground level, and twelve (12) inches in width (top view), and shall have at least eighteen (18) inches between the lower two (2) rails. 3. Wire fencing must be three (3) strands or less. The top wire should be a twelve - point -five (12.5) gauge twisted barbless type at a maximum height of forty-two (42) inches. The middle strands (which may be barbed) should be located a minimum twelve (12) inches apart and from the top wire preventing entanglement when mule deer jump over. The bottom strand should be sixteen (16) inches from the ground. C) Fruit bearing trees and shrubs shall be prohibited within the Activity Envelopes, D) With reasonable notice to the property owner, access shall be provided to the Colorado Division of Wildlife for trapping, tagging, studying, or otherwise managing wildlife, except in case of a wildlife emergency. 9 Determination No.13 -2008 Page 6 E) Trash/garbage shall be kept in an approved bear resistant container or enclosure, including during construction. F) Pets shall not be fed outside. Bird feeders shall be avoided from April through November. Lever style door handles shall be avoided on the exterior of the house. Composting shall be limited to yard waste. (3) Horse grains, pellets, and cookies shall be stored in bear resistant containers. H) Contractors shall be prohibited from bringing dogs on -site during construction. 1 1) No development shall occur outside of the approved activity envelopes, with the exception of vegetation removal necessary to comply with the wildfire mitigation measures described above. 12) Prior to commencement of any earthmoving or other construction activity, the Applicant shall stake the corners of the activity envelopes and install construction fencing around the construction site within the perimeter of the envelopes. The fencing shall remain in place until issuance of a Certificate of Occupancy. 13) No structural development in excess of 30" above or below natural grade shall occur within the setbacks , with the exception of driveways and associated retaining walls of up to 6' above or below natural grade and fencing. Landscaping in the form of berms shall not exceed four feet from the most restrictive grade. Any development located within setbacks mandated by County zoning regulations that does not comply with these restrictions shall require a variance from the Board of Adjustment. Approval of an activity envelope within such setbacks does not assure approval of a variance. 14) This approval acknowledges that the proposed caretaker dwelling unit will serve as the primary residence on the PT Ranch Clouse parcel until such time as a primary residence is constructed. Prior to issuance of a building permit for the primary residence, the Applicant shall obtain and the Housing Office shall record a caretaker dwelling unit deed restriction. Actual floor plans of the unit shall be submitted to the Housing Office with the deed restriction. The Housing Office may inspect the unit with 48- hours' notice to the owner. 15) The caretaker dwelling unit on the PT Ranch House parcel shall be limited to not more than 1,000 net livable square feet. The kitchen shall contain a minimum of a two burner stove with at least a 5 cubic foot oven that can bake and broil, sink of at least 14 "W X 16 "D X 5.25'H, and at least a 5.3 cubic foot refrigerator and 0.73 cubic foot freezer. A minimum of two off - street parking spaces shall be provided for the unit. The caretaker dwelling unit must have separately accessible utilities. This does not preclude shared utilities. The building shall be limited to 20' in height, as calculated by the Land Use Code, 16) All retaining walls in excess of 4' shall be engineered. 17) No calculations for height, bulk, setback, size, floor area, or any other building and zoning requirements have been conducted. These requirements will be considered at the time of building permit. The applicant is presently developing a single family dwelling unit on CCBP Lot 2 and a detached CDU on the adjoining PT Ranch House LLC lot. The two parcels are being developed as a unified development, however the lots are subdivided and may be sold separately. This letter describes the existing conditions on the property when the applicant obtained land use approvals in the fall of 2008. Thousands of bicycle riders and visitors to the Castle Creek Valley destined for recreational activities pass by the two lots every year. Prior to 2008, the lots were improved with three single family dwelling units. Approximately 700 lineal feet of the land located adjacent to Castle Creek Road had been heavily graded and denuded of most vegetation by prior owners. The applicant obtained approval to improve the site by restoring the original grading and planting hundreds of aspen and blue spruce trees. Most of the aspen and blue spruce trees on the property had been removed for fire wood in the first half of the 20 century by Aspen residents. The trees were easily accessible from Castle Creek Road and at approximately the same elevation as the Road. Since the site is close to town it was easy to access the trees for firewood. A single family dwelling unit containing 13,250 square feet of floor area is being developed on CCBP Lot 2, and a detached Caretaker Dwelling Unit (CDU) is being developed on the PT Ranch House lot. The single family dwelling unit and the CDU are sited as far away as possible from Castle Creek Road. The applicant has voluntarily committed to postpone development of a second free market house containing no more than 4,300 square feet of floor area for 15 years (house will be located on the PT Ranch House lot) The proposed plan will substantially improve the appearance of the land as viewed from Castle Creek Road. PRE DEVELOPMENT CONDITIONS This section of the application describes existing conditions of CCBP Lot 2 and the PT Ranch House LLC lot prior to 2008. The entire Castle Creek Valley floor including the subject parcel are zoned AR -10 (Agricultural Residential 10 Acres). A single family residence and accessory agricultural buildings are permitted uses in the zone district. A single family dwelling unit may be developed on a lot which contains less than 10 acres of land. Castle Creek Banks Partnership Lot 2 Castle Creek Banks Partnership Lot 2 contains approximately 20.3 acres and was improved with a single family dwelling unit located on the second floor of a barn and a carport. Figure 2 is an Improvement Survey Plat of the Lot. According to the Pitkin County Assessor's records, the Lot 2 000002 was improved with approximately 5,800 square feet of floor area Castle Creek Road bisects the west side of the Lot. The majority of the land in Lot 2 is located on the Creek bottom contiguous with Castle Creek which flows through the Lot from south to north. Virtually all of the Creek bottom land is inaccessible and undevelopable. Approximately one acre +/- of land is located at approximately the same elevation as Castle Creek Road and was developed with the barn, dwelling unit, carport, parking area and horse paddocks. A small area located immediately adjacent to the Creek has been improved with a three par golf hole. The golf hole green is comprised of artificial turf located within 20 feet of the Creek. Figure 3, Castle Creek Banks Partnership Lot 2 and PT Ranch House Lot Existing Conditions depicts the improved portion of the CCBP Lot and the entire PT Ranch House property in 2008. Figure 3 shows all of the previously described improvements, Castle Creek Road, Castle Creek, driveways and the hillside which divides the upper parcel from the land adjacent to the Creek. Figure 4, Castle Creek Banks Partnership Lot 2 and PT Ranch House Lot Site Disturbances Composite, shows that the majority of the landscape in the vicinity of the barn and house had been disturbed. Most of the natural vegetation had been removed to create areas for horses and the golf hole. The 2008 landscape of the site was inconsistent with the natural landscape in the Castle Creek Valley and unattractive as viewed from Castle Creek Road and from Castle Creek. The bam/dwelling unit was comprised of 5,800 square feet of floor area and was located only 60 feet from Castle Creek Road within the 100 foot Road setback. There is only one house in the entire Valley located closer to the Road than the bar/dwelling unit. The PT Ranch House LLC lot contains approximately 6.5 acres and is improved with two free market single family dwelling units (see Figure 3). According to the Pitkin County Assessor's records, one single family dwelling unit containing approximately 1,100 +/- is located on the north side of the property (aka Molasky house) and a second single family dwelling unit containing approximately 8,210 +/- square feet of floor area is located on the south side of the lot (aka Adelson house). Figure 5 is an Improvement Survey Plat of the Lot. Figure 3, Castle Creek Banks Partnership Lot 2 and PT Ranch House Lot: Existing Conditions depicts the improved portion of the CCBP Lot and the entire PT Ranch House property. Figure 3 shows a driveway located on the far north end of the property which provides shared access to the PT Ranch House, Kaplan, Goldsmith and Rafelson parcels. The Figure also shows a driveway that links the PT Ranch House parcel to CCBP Lot 2 and another driveway which leads to the golf hole. Figure 4, Castle Creek Banks Partnership Lot 2 and PT Ranch House Lot Site Disturbances Composite, shows that the majority of the landscape on the lot has been disturbed. There are three driveway cuts on the east side of the property which provide access to the land along the Creek. The site had been heavily graded and most of the natural vegetation had been removed to create areas for horses and driveways. Like CCBP Lot 2, the existing site landscape was inconsistent with the natural landscape in the Castle Creek Valley and unattractive as viewed from Castle Creek Road and from Castle Creek. 000003 Bicycle riding on Castle Creek Road is a major recreational activity. Similarly, driving Castle Creek to view the scenery and access Ashcroft Ski Touring, the Pine Creek Cookhouse, Taylor Pass, Pearl Pass and wilderness trail heads is a popular visitor and local activity. The subject site was an eyesore which detracted from the appeal of the Castle Creek Valley. The applicant is proposing to restore the native landscape and significantly improve the appearance of the property for all people that travel on Castle Creek Road. BACKGROUND This section of the land use application summarizes past Pitkin County land use reviews and approvals for each of the subject parcels. Castle Creek Banks Partnership Lot 2 On October 27, 1992, the Board of County Commissioners granted a Fifty Per Cent Density Reduction Lot Split/PUD approval to CCBP pursuant to Resolution 92 -400. Figure 6 depicts the Castle Creek Bank Partnership PUD Subdivision Final Plat. The Plat shows the two lots and approved building envelopes. Lot 2 was approved for a building envelope on the north side of the lot adjacent to Castle Creek Road and a Pond/ Pasture /Corral Area Envelope located in the southeast comer of the Lot adjacent to Castle Creek within the riparian area. The northerly building envelope has been developed. The Pond/Pasture /Corral Area Envelope remains undeveloped. PT Ranch House Lot As previously noted, the PT Ranch House lot is improved with two single family dwelling units on merged lots. The smaller house, known as the Molasky house, was built in 1955. The larger Adelson house was built in 1976 and expanded in 1995. When the applicant acquired the Adelson and Molasky parcels in 2006, it was determined that the parcels were deemed to be merged. PROEJCT DESCRIPTION This section of the land use application describes the proposed redevelopment plan for CCBP Lot 2 and the PT Ranch House lot. The short term plan was to adjust the lot line between the two parcels to increase the size of the CCBP Lot 2 as depicted by Figure 7. Approximately three acres of land was shifted from the PT Ranch House lot to the CCBP Lot 2. 0 000004 Figure 8, the Castle Creek Banks Partnership Lot 2 and PT Ranch House Lot Site Plan shows the new single family dwelling unit which is being built on the Lot. The new house is located as far as possible from Castle Creek Road. This location was selected to minimize the visual impacts of the house as viewed from the Road and to maximize the privacy of the house for the occupants. The house will contain up 13,250 square feet of floor area and will be a one story house as viewed from Castle Creek Road. There will be a full basement which daylights to the east. The one story design minimizes the visual impact of the house from the Road and neighboring properties. A small, one story detached Caretaker Dwelling Unit (CDU) and an Activity Envelope to encompass a future free market single family dwelling unit is proposed the PT Ranch House parcel. The CDU is under construction, however the applicant has agreed not develop the free - market single family dwelling unit for at least 15 years from the approval date of the land use application in 2008 and seeks vested property rights for 20 years from the same date. The CDU will function as a free market dwelling unit until the free market single family dwelling unit is constructed. Both parcels will be graded and landscaped as depicted on the Grading and Planting Plans (see Figure 9 and 10. The Planting Plan will restore the native landscaping of the site which existed prior to the extensive tree removal and grading which occurred on the property. The applicant's goal is for the site to emulate the typical landscape of the Castle Creek Valley which is dominated by Aspen trees, isolated conifers and dense underbrush comprised of native grasses, wild flowers and shrubs. Figures 12 -15 compare and contrast the appearance of the site in 2008 with the way the site will appear upon completion of development. The Figures show there will be a significant improvement in the site appearance upon implementation of the site plan. Additionally, the Planting Plan proposes the restoration and enhancement of isolated riparian and wetlands vegetation which has been degraded by prior property owners. The golf hole and artificial turf adjacent to the Creek will be removed and replaced with native vegetation. REQUEST FOR LONG TERM VESTED PROPERTY RIGHTS This section of the land use application demonstrates compliance with the Land Use Code standards for long term vested property rights (Section 2 -20 -170 (c)) 000005 Vested Property Rights Term of Vested Property Rights Section 2 -20 -170 (c) (a) Term of Vested Property Right (1) THREE YEAR TERM If an applicant has requested and obtained a vested property right under C.R.S. 24 -68 -101 et. seq., that vested right shall expire three (3) years from the date of approval, unless extended pursuant to subsection (d) below. (2) DEVELOPMENT AGREEMENTS A vested right, as defined in C.R.S. 24.68 -101 et. seq., may be vested for a period longer than three (3) years through the use of a development agreement. A development agreement is an agreement between the County and the property owner providing that vested rights will be granted for a longer term in return for additional certainty or benefits granted by the property owner to the County regarding a specific final development of the property. For example, vested right for periods longer than the statutory three (3) year period may be considered if (a) the applicant makes commitments that the property will protect significantly more open space, or will provide significantly more affordable housing, than would otherwise be required by this Land Use Code, or (b) the proposed development will be completed in phases, and the County and applicant wish to agree on the timing of those phases and related infrastructure requirements. Development agreements shall not be used simply to extend the three (3) year vesting period when significant additional contributions of open space or affordable housing (beyond the requirement of this Land Use Code) are not made, and a phased development is not Involved, or simply to provide additional flexibility in the timing of development. The applicant would like to enter in a Development Agreement with Pitkin County. The applicant commits to preserve more open space by removing the Pond, Pasture and Corral Area Activity Envelope which is located on the south end of the lot. This Activity Envelope is located adjacent to Castle Creek and is proximate to sensitive wetlands areas. The CCBP Lot is entitled to develop a 1,160 square foot barn. The applicant commits not to develop the barn. Each of the two lots owned by the applicant qualifies for a free - market single family dwelling unit. The applicant commits not to develop the second single family dwelling unit on the PT Ranch House Lot for a minimum of 15 years from the date of the land use approval. This agreement is intended to provide for phasing of the development in order to postpone construction impacts on neighbors and the public. The residents of the Castle Creek Valley have been impacted by development in the site vicinity. In the future, they will be impacted by the redevelopment of the Music School Campus and the expansion of the Aspen Valley Hospital. The applicants phasing commitment complies with the Code requirement that there be phasing in order to obtain long -term vested property rights. 0 [11111. The applicant requests approval of a vested property rights term for 20 years from October 28, 2008 approval date. SUMMARY This letter has described pre - development conditions on CCBP Lot 2 and the PT Ranch House lot. The site had been heavily graded by prior owners and most of the trees on the site were removed by Aspen residents for firewood. The applicant is redeveloping the property. The plan calls for development of a free market house, detached CDU restorative grading and the planting of hundreds of trees consistent with the predominant landscaping in the Castle Creek Valley. The applicant commits to: • Abandon a barn/corral/pasture envelope located in the Castle Creek riparian area on CCBP Lot 2; • Forgo the entitlement to develop a barn containing up to 1,160 square feet of floor area on CCBP Lot 2; • Remove artificial turf and a golf hole located within 20 feet of Castle Creek and restore the riparian area; • Postpone the development of a free market single family house on the PT Ranch House LLC property for at least 15 years from the 2008 land use approval date.
