CY a m m s c o , Y . a 000003 1 M V MEMORANDUM TO: Cindy Houben, County Community Development Director FROM: Ezra Louthis, Planning Technician RE: Aspen Consolidated Sanitation District Negligible Growth Impact GMQS Exemption Request DATE: August 30, 2001 REQUEST: The applicant is requesting a negligible growth impacts exemption from Commercial GMQS for the expansion of their existing building to accommodate a new sewage line. APPLICANT: John Anderson, Aspen Sanitation District LOCATION: 20085 Highway 82, Aspen(on the river,below the AABC) ZONING/LOT SIZE: AFR-10/12.61 acres BACKGROUND: Growth in the Aspen area has exceeded the capabilities of the existing sewage intake lines that currently exist on site at Aspen Consolidated Sanitation. In order to accommodate a larger line, the building has to be expanded out 8 feet by 20 feet. Bud Eyler and I walked the site for 1041 concerns, and determined that the proposed expansion was exempt from 1041 hazards. REFERRAL COMMENTS: The application was referred to, but no comments were received from the County Attorney. STAFF COMMENTS: Commercial Developments with Negligible Growth Impacts: Pursuant to Section 3-150-150 of the Land Use Code, the Community Development Director may approve commercial development which is exempted from GMQS subject to compliance with the following standards. A. General:An applicant seeking the exemption shall demonstrate the development will result in a negligible: 1. Visual impact on the community from the development; 000004 Response: The proposed development is small in nature (approx. 160 square feet), and cannot be seen from any public rights of way. 2. Number of additional employees and the provision of housing for the employees which meets the approval of the Housing Designee; Response: No additional employees are being created. 3. Demand for additional parking and that said parking will be accommodated on-site or in another appropriate location; Response: No new parking spaces are needed, as no new employees are created. d. Impact on the City, County,public and private roads and trail system accessing the development; Response: There shall be no additional impact on roads or trails. 5. Need for basic governmental services such as water supply, sewage treatment, drainage control,fire and police protection and solid waste disposal; Response: The expansion will create no new burden on any governmental services and will in fact provide greater sewage treatment. 6. Visual impact on the community from the development: The will be minimal visual impact to the community due to the fact this is an addition of only 160 Sq. Ft. to the foot print. Area is already an industrial zone with existing sewer treatment plant located within. A. 2. Number of additional employees and the provision of housing for the employees which meets the approval of the Housing Designee: Since the project involves the updating of equipment and the structures housing the equipment, no new employees will be required. There are a total of ten employees at this site currently. 50% of these employees are already being housed in District owned employee housing located within the town limits. The other 50% reside down valley in privately owned homes. A. 3. Demand for additional parking and that said parking will be accommodated on-site or in another location. Adequate parking for employees on-site is currently provided. Additional parking is already available on-site should there be a necessity created. A. 4. Impact on City, County, public and private roads and trail system accessing the development There will be no impact to roads, City, County, public or private. The existing access road to the sewer plant is sufficient to provide access to the project. There are no impacts to the trail system. LJO0012 A. 5. The will be no additional impacts to these services. In fact, an improvement to the efficiency of the sewer plant will result from this project in the form of modernization, safety and capacity. Grit and screenings will, as a result of this project, be compacted, washed and dried prior to landfilling resulting in less volume being delivered to the Landfill. The resultant waste product will be less odorous and safer for our community! A. 6. Burden on the facilities of the RTA, Aspen School District, library, hospital and park system; and: There will be no additional burdens created for any of these agencies. A. 7. Adverse impact on communities air, water, land and energy resources: The are no adverse impacts on this community's environmental well being. In fact, modernization of the sewer treatment facility is absolutely necessary to the continued mission of The Aspen Consolidated Sanitation District to provide wastewater treatment for the citizens of Aspen. Community development has approved hundreds of new homes in this community without proper consideration for the need for infrastructure improvements. If the level of growth is allowed to continue, this and future expansions of the treatment facilities will be necessary to meet demand for services. It is therefore imperative that Community Development grant the District an immediate negligible growth exemption for this Headworks Improvement Project. Pitkin County Public Works Department("Applicant"),has applied to the Board of County Commissioners of Pitkin County,Colorado(`BOCC")for the following approvals: A. GMQS Exemption and Special Review for an essential government and community facility for the storage building; B. GMQS Exemption and Special Review for an affordable housing dwelling unit deed restricted to affordable housing price, income and occupancy guidelines located outside of the AH zone; C. Special Review for a single-family dwelling unit in the PUB zone district;and D. Major Amendment to a Special Review Permit. 2. The property is adjacent to RFTA Bus Bam off of State Highway 82 and is addressed as 76 Service Center Road. The property is more specifically described in Exhibit A. 3. The Planning and Zoning Commission("Commission")at a regularly scheduled meeting on September 19,2000,reviewed the application,and a recommendation of approval was forwarded to the BOCC. 4. The BOCC heard this application at a duly noticed public hearingon September 27,2000, at which time evidence and testimony were presented with respect to this application. 5. The BOCC finds that the Applicant's proposal complies with applicable section of the Pitkin County Land Use Code,provided that conditions of this document areadhered to. NOW THEREFORE BE IT RESOLVED by the Pitkin County Board of County Commissioners that it does hereby grant approval to the Pitkin County Public Works Major Amendment to a Special Review, Special Review,and GMQS Exemption, subject to the following conditions,which shall run with the land and be binding on all successors in interest: p1. Prior to the submittal of any building permit applications, the Applicant shall record a Subdivision Exemption Plat pursuant to section 3190-050 of the Code to delineate the two separate parcels as approved pursuant to BOCC Resolution No. 82-116. This plat shall also include all structures,including the storage unit and the cabin,on the subject parcel. The Applicant shall submit a Drainage and Erosion Control Plan to the County Engineer for review and approval,prior to the submittal for any building permits. 4. Lighting shall comply with the Pitkin County lighting standards at the time of installation. 5. All development must comply with the provisions of the Pitkin County's Noxious Weed Management Plan. 6. Pursuant to Ordinance No. 022-2000,the Applicant is subject to the Fair Share Requirements and shall pay a road impact fee as calculated at the time of builling permit issuance. 7. All areas disturbed by construction shall be revegetated with native shrubs and grasses to limit water consumption and additional runoff within one growing season of the project's completion. 8. Prior to the issuance of any building permits,documentation shall be submitted to the Environmental Health Department that the Aspen Consolidated Sanitation District(ACSD)can service the property. The Applicant shall comply with ACSD rules, regulations, and specifications. r- 9. Prior to the submittal for any building permits, the Applicant shall pursue a Water Service 1—� Agreement(WSA)with the City of Aspen Water Department. Documentation shall be provided to the Environmental Health Department that the property will be serviced by the City Water Department via the WSA. A comprehensive plan shall be submitted to the City of Aspen Water Department that delineates the size and location of water utilities currently on the subject parcels and utilities required to service the proposed structures. 10. The Applicant shall comply with the following standards for the employee dwelling unit: p A. Prior to the submittal of a building permit, floor plans of the employee unit shall be provided to the Housing Office. (� B. The deed restriction of the unit,Category 2, shall be filed prior to the issuance of a building permit application. C. Prior to Certificate of Occupancy,the Housing Office shall conduct a site visit. D. The unit shall be upgraded in accordance with the following criteria: 1) The interior walls of all units must be freshly painted. 2) The interior appliances must be purchased within the last five years and be in good and working conditions. 3) Carpet must be less then five years old and be in good condition and repair, or be replaced. 4) The exterior walls shall be&eshly painted within one year of dedication. 5) A general level of upgrade to yards and landscaping shall be provided. 6) Windows, heating, plumbing,electrical systems, fixtures and equipment shall be in good and working order. 7) The roof must have a remaining useful life of at least ten(10)years. 8) The unit shall meet the Uniform Building Code minimum standards, any applicable housing code, or in the absence of an adequate code,the housing code acceptable to the Housing Authority. 9) The Unit shall be appro -d by the Housing Authority and verified by a qualified Building Inspector accepted and approved by the Housing Authority.
