Attached is an Earthmoving Permit application for the following projects on Aspen
Mountain:
1) Dakine Bowl trail improvement,
2) Snowmaking pipe replacement on lower Deer Park trail.
Following a pre - application conference with you and Lance on April 7, 2009, you
determined this project to be consistent with the language and Land Use Approval
identified in the existing Aspen Mountain Master Plan. Lance confirmed that an
Earthmoving Permit application is the appropriate way to proceed.
Project Description
Dakine Trail Improvement
Dakine is an existing clearing immediately adjacent to skier's right of the Walsh's Trail
boundary. The proposed glading (shown on the attached site plan) intends to open 4 areas
adjacent to Walsh's that will facilitate continuous skiing and snowboarding all the way to
the existing Loushin Road /Lud's Lane.
The majority of the glading will remove primarily standing/fallen dead and diseased trees.
However, to best utilize the existing open glades, some live tree removal is proposed as
well, with some limbing of larger trees as necessary. The proposed reduction in tree
density will make the stand more resilient to the current beetle and pathogen problems that
are becoming more evident in recent years, while reducing the wildfire danger in that area.
The goal is to reduce the timber density in the identified areas by 40% to provide a quality
skiing /snowboarding experience. This timber stand is primarily populated with lodgepole
pine, spruce and fir of average -to -small caliper.
Timber and slash will be stockpiled and burned on the flat /open area below area C.
Although most of the work will be completed without heavy machinery, a timber skidder
and skid steer machine could be used to facilitate removal of the larger trees.

Access to the site will be via Lud's Lane to Loushin Road and up the relatively flat area
below areas C and E. No new roads are anticipated to complete this work. Disturbed areas
will be completely revegetated when the project is completed.
Most of this work could take place over the snow in late April and early May to minimize
ground disturbance. Once the snow melts, the project's glading efforts will be assessed and
further glading needs will be identified and analyzed.
Snowmaking Pipe Replacement
Approximately 600 feet of deteriorating snowmaking pipe will be replaced in the vicinity
of lower Deer Park Trail. This existing pipe developed a leak this year and is determined to
be corroded and in disrepair.
No snowmaking expansion is intended with this replacement.
The new air and water pipe will be installed in a 5 -foot deep and 4 -foot wide trench near
the location of the existing pipe as shown on the attached site plan. The old pipe will not be
removed.
Total additional excavation associated with pipe replacement will be approximately 400
cubic yards. All disturbed areas will be revegetated in accordance with Aspen Skiing
Company Revegetation Plan.

Revegetation
This re- vegetation plan is designed to satisfy the requirements of both the U.S. Fores
Service and Pitkin County.
Aspen Skiing Company has a long history of successful re- vegetation efforts. Knowledge
acquired over the years on site will be applied to all aspects of implementing our re-
vegetation plan.
Aspen Skiing Company recently completed an extensive Vegetation Management Plan for
all four of its ski areas. These studies were conducted by Western Bionomics, LLC. of
Steamboat Springs, Colorado under the guidance of the White River National Forest
personnel. The scope of work addresses a total Management Plan and includes both
analysis and prescription in areas of forest vegetation, non - forest vegetation, soil
management, wild life habitat and scenic values.
The vegetation management plan was coordinated with a 1993 study prepared by the
Wildlife Habitat Enhancement Council entitled "Opportunities for the Enhancement of
Wildlife Habitat and Environmental Awareness on Aspen Mountain."
Re- vegetation of the disturbed sites on Aspen Skiing Company Mountains will have four
primary goals:
1) Prevent soil loss and siltation of drainage as a result of removing forest cover,
2) Establish vegetation that is compatible with existing native vegetation in appearance,
composition, and permanence
3) Creating habitat that will support use by native wildlife
4) To provide quality skiing terrain.
These goals will be accomplished by planting native grasses or species adapted to the
area and using mulch to reduce soil loss and enhance the establishment of seeding.
In areas with steep slopes and shallow or erodable soils, mulch will be used in combination
with an erosion control mat or netting to provide further protection of soils and seedlings.
Follow -up measures, such as additional seeding and /or fertilization, will be applied as
needed.
These measures conform to the Pitkin County Landscape Guidelines, which have been
incorporated where appropriate throughout this revegetation plan.
The native seed mixes listed below have been selected to provide visual diversity,
prevention of soil erosion and ensure that a variety of feed materials are available
throughout the growing season.

The seed bags have the appropriate information (name and address of the supplier, the seed
names, the lot number, net weight, origin, percent weed content, the guaranteed percentage
of purity and germination, and the pounds of pure live seed of each seed species) on them.
All supplied seed will be free of noxious weed seeds. A signed statement certifying that the
seed furnished is from a lot that has been tested will be made available. Seed, that has
become wet, moldy or otherwise damaged in transit or in storage will not be used.
During the process of clearing sites, both rubber -tired and tracked equipment will be used
on slopes of 30 percent or less. On steeper slopes, only tacked equipment will used.
Damaged area will be regraded to appropriate smoothness and patched with soil material,
if necessary.
Seedbed preparation will consist of leaving a rough, irregular soil surface. This will
include removing large rocks. Regardless of the mix of seed used, seed will be planted by
broadcasting or drill seeding within ten days after soil disturbing activity has ended.
Toward the end of the construction season, all areas will be evaluated and additional
revegetation measures will be implemented as needed. Planting during the early fall will
allow the seed to be fully moistened and worked into the soil by natural processes prior to
germination in the spring. For some species, overwintering also enhances germination by
weakening the seed cost.
Seeding rates will vary because of seed size, method of seeding and site requirements.
Seeding rates of 50 to 250 seeds per square foot, depending on seed size, will be used.
Available plant nutrients are a necessity for any aggressive revegetation program that
restores and maintains soil productivity resulting in healthy, vigorous vegetation.
Generally, all vegetation responds favorably to the addition of nitrogen and phosphorus
fertilizers. A mixture of 20 -20 -10 will be used as a supplement to assist revegetation.

An application rate of 50 to 250 seeds per square foot followed by a second application of
equal amount later in the growing season or the following growing season has been
demonstrated to be most effective and efficient.
Following seeding slopes with steepness less than 2:1 will be mulched with approximately
1,500 pounds per acre of straw. This straw or hay will provide the cover needed while still
allowing sunlight to penetrate the mulch, warming the soil and enhancing plant growth.
Application is done either by hand placing or mechanically blowing the mulch. The straw
will be crimped into the soil and, in areas subject to wind erosion, anchored with a
tackifier. Areas with steepness greater than 2:1 will be further stabilizer by using plastic
netting or mat.
Based on the specific mitigation and monitoring plan set forth in agreement with the USFS
Aspen District Ranger and ASC, USFS personnel will be conducting evaluations to ensure
quality resource protection. A standard of 70 percent ground cover after the second
growing season or the amount equal to the adjoining undisturbed areas, if less than 70
percent will be used to determine reapplication, modification, or fertilization. The Forest
Service will also monitor ASC's compliance with the revegetation specifications contained
1n the annual Summer Operating Plan.

Fugitive Dust Control Plan
Summer 2009
This plan addresses dust control during and after earthmoving activities. Preventive
measures applied during construction are more economical and effective than corrective
measures.
Dust Control for Unpaved Roads on Site
Chemical Stabilizers
On unpaved roads on areas where traffic is heavy, approved chemical stabilizers, such as
magnesium chloride, will be used.
Speed Control
Speeds shall be limited to a 20 -mph maximum on mountain roads and 15 mph near
residential dwellings.
Road Surface
The surface of the existing roads is comprised of rock, a combination of compacted soils
and gravel. Maintenance of roads is accomplished with gravel, grading and application of
water /chemicals when necessary.
Other
Low permeability fences will be used in areas where wind erosion or additional dust
control or additional dust control measures are needed. Low permeability fences will be
installed near the base near the base area where to road passes by private homes.
Dust Control for Disturbed Surface Areas
Watering
Areas to be disturbed shall be watered as necessary on an ongoing basis.
Chemical stabilizers
Chemical stabilizers will not be used on graded areas where future revegetation is required.
Speed Control
Speeds shall be limited to a 20 mph maximum on mountain roads and project sites, and 15
mph near residential dwellings.
Minimizing Disturbed Areas
Areas of disturbance will be minimized. Revegetation of disturbed areas will occur as soon
as possible after disturbance occurs. Due to construction sequencing of activities, all of the
disturbed sites will not be exposed at the same time.

Furrows
Due to the nature of wind above 9,000 feet, the use of furrows has little value.
Compaction
Soils will be managed to prevent accumulations of loose dirt.
Wind Breaks
Low permeability fences will be used in areas where wind erosion or additional dust
control measures are needed.
Steep Slope Covering
The steep slopes on the project (road cuts, ski trails) will be revegetated (seeded and
mulched) within ten days of final grading. Netting will be used on sites requiring
additional measures to hold the mulch in place.
Prevention of mud and dirt tracking onto paved surfaces
Transition Zones
Gravel transition zones will be established between mountain roads and paved public
roads.
Cleanup of Paved Area
Cleanup of carry out will be accomplished by washing down the pavement as needed. The
gravel transition zones will be maintained to ensure proper performance.
Other Provisions
Helicopter Staging Area
Any helicopter staging area will be watered whenever necessary to prevent excessive dust.
Record Keeping
Trail manager will keep a logbook on all dust control measures taken during the course of
the project, and shall make this logbook available for inspection by Pitkin County
personnel as requested.

Drainage and Erosion Control Plan

Aspen Skiing Company erosion and drainage plan was designed to protect the natural
resources in the project areas.
The plan consists of, for the most part, two measures. The first is the use of silt fences and
erosion bales located at the toe of disturbed sites during the construction activities. The
second control measure is an aggressive revegetation program described in the
Revegetation Plan. Seeding and mulching will be enacted within ten days after the
completion of the soil disturbing or construction activity. The specific erosion control
measures are detailed on the revegetation and drainage plans.
Other erosion control measures will be used throughout the area as needed. One specific
measure is water bars. They will be installed at appropriate intervals along cleared ski
slopes, roads, trails and backfilled trenches to limit distance that sheet runoff can flow
unchecked. The water bars will divert runoff into the adjacent uncleared forest whenever
possible. Other appropriate, energy- dissipating structures (i.e., rock, hay bales, or slash
piles) will be installed to prevent erosion in the forested areas receiving the diverted slope
runoff.
The U.S. Forest Service will assist in the designation of additional control measures, if any
are needed. These measures may include, but are not limited to silt fencing, sediment

basins, check dams, berms, mulching, revegetation, or natural materials will be used to
decrease energy and remove silt.
Aspen Skiing Company maintains a Stormwater Discharge Permit with the Colorado
Department of Public Health and Environment and adhere strictly to the Pen
requirements.

Introduction and Overview
This Stormwater Discharge Management Plan has been prepared for construction
activities at 4 mountains owned operated by Aspen Skiing Company in compliance
with the requirements of the State of Colorado Stormwater Discharge Permit
application. It covers the approved construction activities expected to occur at
Aspen Skiing Company until the year 2008. This plan will be amended annually.
Aspen Skiing Company believes that the U.S. Forest Service's regulations and
guidelines supersede those of the State of Colorado on Forest Service land,
however, it is our objective to be in compliance with the Colorado Water Quality
Control Act and the Federal Water Pollution Control Act so that State staff is
informed of those activities and has a high confidence level that appropriate actions
are being taken in regard to revegetation, dust control, erosion and other storm
water issues.
The Federal land use approvals necessary for these actions to take place are
contained in various USFS Records of Decision (ROD), based on several
Environmental Impact Statements (EIS) and Environmental Assessments (EA) for
various NEPA reviews ASC's 4 mountains. The decision incorporated all the
mitigation and monitoring requirements in these documents and they will be
adhered to in regard to the construction activities covered by the ROD.
The Forest Service has committed to a high level of review by its staff to ensure that
all mitigation measures will be performed to the highest standards. An additional
Forest Service employee, cooperatively funded by USFS and Aspen Skiing
Company, will be overseeing construction activities.
In addition, the requirements from the USFS will be overseen by a full -time Aspen
Skiing Company representative, the Summer Construction and Trails Supervisor on
each mountain, whose responsibility it is to ensure that all activities are in
compliance with all measures represented within this permit application.
Construction Activities
Continuous and ongoing construction activity and main ground disturbing activities
include snowmaking pipe installation, lift installation, pond construction, critical
trail grading, facilities, trail maintenance, and trail construction.
Sequencing of Projects
Projects that involve ground disturbing activities will be sequenced in the following
manner:
1) identify project and area of ground disturbance,
2) establish project in the mountain specific Summer Construction Plan,
3) identify site specific Stormwater Management BMP's,
4) install all structural sediment controls,
5) grub and clear the site of surface vegetation, strip topsoil if available for
replacement,
6) conduct/complete grading activities,
7) install topsoil and/or conduct final surface preparation activities,
8) apply seed and fertilizer at the prescribed quantities,
9) install and crimp mulch as necessary,
10) irrrigate as necessary to achieve satisfactory growth.
Total Site Area
The Aspen Skiing Company is a permittee under a Special Use Permit by the US
Forest Service for the following acreage at each mountain. These areas are primarily
used for winter recreation, downhill skiing /snowboarding, and a variety of summer
activities.
• Snowmass Mountain — 5,400 acres
• Aspen Mountain — 1,250 acres
• Aspen Highlands — 1,560 acres
• Buttermilk Mountain — 950 acres
Area of Disturbance
The specific amount of ground disturbance will vary each construction season on
each mountain.
Soils Description
Soils descriptions are included in the Natural Resource Management Plan, specific
to each mountain, which describe and map the soil units at the specific sites and
assess the erosion potential and limitations.
Vegetation Description
Vegetation on the mountains is classified into ten different groups; alpine, mixed
conifer, lodge pole pine, aspen, natural grasslands, man -made openings, shrubs,
riparians, open water, talus /non vegetated.
Receiving Waters
The receiving waters for Snowmass Mountain are East Snowmass Creek, Snowmass
Creek, East and West Fork Brush Creek, Spring Creek, and they all flow into the
Roaring Fork River.
The receiving waters for Buttermilk Mountain is Maroon Creek which is also flows
into the Roaring River.
The Roaring Fork River is a tributary to the Colorado River.
BEST MANAGEMENT PRACTICES (BMP)
The Aspen Skiing Company Erosion Control Plan is based on the Colorado
Department of Transportation (CDOT) Stormwater Management Plan and is
designed to protect the natural resources in the project areas.

MANAGEMENT
Revegetation
The following ASC Revegetation Plan is designed to satisfy the requirements of
the U.S. Forest Service and the Aspen Skiing Company. ASC has a long history
of successful revegetation efforts. The knowledge learned over the years on site
will be applied to all aspects of this project.
Revegetation of the disturbed sites will have four primary goals: (1) prevent soil
loss and siltation of drainages as a result of removing forest cover; (2) establish
vegetation that is compatible with existing native vegetation in appearance,
composition, and permanence; (3) creating habitat that will support use by native
wildlife; and (4) to provide quality skiing terrain.
These goals will be accomplished by planting native grasses or species adapted to
the area and using mulch to reduce soil loss and enhance the establishment of
seeding.
In areas with steep slopes and shallow or erodible soils, much will be used in
combination with an erosion control mat or netting to provide further protection
of soils and seedlings. Follow -up measures, such as additional seeding and/or
fertilization, will be applied as needed.
The native seed mixes listed below have been selected to provide visual diversity,
prevention of soil erosion and ensure that a variety of feed materials are available
throughout the growing season.
All supplied seed will be free of noxious weed seeds. A signed statement
certifying that the seed furnished is from a lot that has been tested will be made
available. Seed which has become wet, moldy or otherwise damaged in transit or
in storage will not be used.
During the process of clearing sites, both rubber -tired and tracked equipment will
be used on slopes of 30 percent or less. On steeper slopes, only tracked
equipment will be used. Damaged areas will be regraded to appropriate
smoothness and patched with soil material, if necessary.
Seed bed preparation will consist of leaving a rough, irregular soil surface. This
will include removing large rocks. Regardless of the mix of seed used, seed will
be planted by broadcasting or drill seeding within ten days after soil disturbing
activity has ended.
Toward the end of the construction season all areas will be evaluated and
additional revegetation measures will be implemented as needed. Planting during
early fall will allow the seed to be fully moistened and worked into the soil by
natural processes prior to germination in the spring, for some species, over
wintering enhances germination by weakening the seed coat.
Seeding rates will vary because of seed size, method of seeding and site
requirements. Seeding rates of 50 to 250 seeds per square foot, depending on seed
size, will be used on most sites.
Available plant nutrients are a necessity for any aggressive revegetation program
that restores and maintains soil productivity resulting in healthy, vigorous
vegetation. Generally, all vegetation responds favorably to the addition of
nitrogen and phosphorous fertilizers. A mixture of 20 -20 -10 or Biosol will be
used as a supplement to assist revegetation.
An application rate of 50 to 250 seeds per square foot, followed by a second
application of equal amount later in the growing season or the following growing
season has been demonstrated to be most effective and efficient.
Following seeding, slopes with a steepness less than 2:1 will be mulched with
approximately 1,500 pounds per acre of straw. This straw or hay will provide the
cover needed while still allowing sunlight to penetrate the mulch, warming the
soil and enhancing plant growth. Application is done either by hand placing or
mechanically blowing the mulch. The straw will be crimped into the soil and, in
areas subject to wind erosion, they may be anchored with a tackifier. Areas with a
steepness greater than 2:1 will be further stabilized by using plastic netting or
mat.
Based on the specific mitigation and monitoring plan set forth the USFS Aspen
District Ranger and Forest Service personnel, Aspen Skiing Company will be
conducting evaluations to ensure quality resource protection. A standard of 70
percent ground cover after the second growing season or the amount equal to the
adjoining undisturbed areas, if less than 70 percent will be used to determine
reapplication, modification, or fertilization. The Forest Service will also monitor
ASC's compliance with the revegetation specifications contained in the annual
Summer Construction Plan.
The Summer Trails Director for each mountain, will be responsible for ensuring
revegetation for this project is successful.
Reclamation
Areas that will be reclaimed are building sites, structure placements, and land forms
that will be moved, replaced, or abandoned. Reclamation will consist of minor
disturbances from grading the previously developed areas into the natural contours
and revegetating. These areas will be reclaimed as the construction schedule allows
or requires. Appropriate and revegetation will occur within ten days after
construction activities on site have been completed.
OTHER CONTROLS
Fugitive Dust Control Plan Construction Activities
This plan addresses dust control during and after earthmoving activities. Preventive
measures applied during construction are more economical and effective than
corrective measures.
DUST CONTROL FOR UNPAVED ROADS ON SITE
Chemical Stabilizers
On unpaved roads on areas where traffic is heavy, approved chemical stabilizers,
such as magnesium chloride, will be used.
Speed Control
Speeds shall be limited to a 15 -mph maximum on mountain roads and 5 mph near
residential dwellings.
Road Surface
The surface of the existing roads is comprised of rock, a combination of compacted
soil, and gravel. Maintenance of roads is accomplished with gravel, grading and
application of water /chemicals when necessary.
Other
Low permeability fences will be used in area where wind erosion or additional dust
control measures are needed. Low permeability fences will be installed near the
base area where the road passes by private homes.
DUST CONTROL FOR DISTURBED SURFACE AREAS
Watering
Areas to be disturbed shall be watered on an ongoing basis.
Chemical Stabilizers
Chemical stabilizers will not be used on graded areas where future revegetation is
required.
Speed Control
Speeds shall be limited to a 15 mph maximum on mountain roads and project sites.
Minimizing Disturbed Area
Areas of disturbance will be minimized. Revegetation of disturbed areas will occur
as soon as possible after disturbance occurs. Due to construction sequencing of
activities, all of the disturbed sites will not be exposed at the same time.
Furrows
Due to the nature of wind above 9,000 feet, the use of furrows has little value.
Compaction
Soils will be managed to prevent accumulations of loose dirt.
Wind Breaks
Low permeability fences will be used in area where wind erosion or additional dust
control measures are needed.
Steep Slope Covering
The steep slopes on the project ( road cuts, ski trails) will be revegetated (seeded
and mulched) within ten days of final grading. Netting will be used on sites
requiring additional measures to hold the mulch in place.
PREVENTION OF MUD AND DIRT CARRY OUT INTO PAVED
SURFACES
Prevention
Gravel transition zones will be established between mountain roads and paved
public roads.

Dear Catherine,
As discussed via email, here is an amendment to the Attached recently approved
f--arthmov ing Permit for projects on Aspen Mountain.
Project Description
Dakine Trail Improvement
Dakine is an existing clearing immediately adjacent to skier's right of the Walsh's Trail
boundary. The proposed glading (shown on the attached site plan) intends to open 4 areas
adjacent to Walsh's that will facilitate continuous skiing and snowboarding all the way to
the existing Loushin Road /Lud's Lane.
The majority of the glading will remove primarily standing /fallen dead and diseased trees.
'-fowever, to best utilize the existing open glades, some live tree removal is proposed as
∎c ell, with some limbing of larger trees as necessary. The proposed reduction in tree
density will make the stand more resilient to the current beetle and pathogen problems that
, becomina more evident in recent years, while reducing the wildfire danger in that area.
!The goal is to reduce the timber density in the identified areas by 40% to provide a quality
skiing / snowboarding experience. This timber stand is primarily populated with lodgepole
pine, spruce and fir of average -to -small caliper.
Timber and slash wilt he stockpiled and burned on the flat /open area below area C.
Althougli most of the work will be completed without heavy machinery, a timber skidder
and skid steer machine could be used to facilitate removal of the larger trees.
Access to the site will be via Lud's Lane to Loushin Road and up the relatively flat area
below areas C and E. No new roads are anticipated to complete this work. Disturbed areas
will be completely revegetated when the project is completed.

ground disturbance. Once the snow melts, the project's glading efforts will be assessed and
further glading needs will be identified and analyzed.
liAmendment
The portion of this project that was originally scheduled to take place over -snow will no
longer take place. Instead, the entire scope of the project will take place conventionally
over dry ground as described above
However, the over -snow dead tree removal will take place instead in the area between
North American and Midnight trails as identified in the submitted USFS 2009 Summer
Construction and the 3 -Year Aspen Mountain Construction Management Plan. This tree
removal was originally scheduled to occur later this year, but will take place now to
reduce ground disturbance in this area. The timber debris will he moved to appropriate
burn sites and burned when conditions warrant. Attached is a site plan of this project area.
