DOCUMENT LAYOUT THIS FILE MAY OR MAY NOT CONTAIN ALL OF THE INFORMATION LISTED BELOW IN THE FOLLOWING ORDER Summary Sheet Resolution for the BOCC and/or P &Z Ordinance for the BOCC and /or P &Z Determination for the Hearing Officer Administrative Determination Staff Memo Application Public Notice, Acceptance Letter, Referral(s) Letter Site Plan Miscellaneous Plat(s) ADMINISTRATIVE DECISION OF THE COMMUNI'T'Y DEVELOPMENT DIRECTOR OF PnKIN COUNTY, COLORADO, APPROVING A TEMPORARY COMMERCIAL USE /SPECIAL EVENT PERMIT FOR THE 2011 REDSTONE COMMUNITY ASSOCIATION'S WINTERFEST Administrative Decision No. 7 -2011 RECITALS Pursuant to Subsection 4- 30 -50(i) of the Pitkin County Land Use Code, the Community Development Director of Pitkin County, Colorado ( "Director ") may approve a Temporary Commercial Use /Special Event Permit for commercial activities or special events. 2. The Redstone Community Association (hereafter, the "Applicant ") has applied to the Director for approval of a Temporary Commercial Use /Special Event Permit to conduct the Redstone Winterfest. The event will occur on February 18, 19, and 20, 2011. Approximately 75 to 200 people are expected per day with the higher end of the approximation over the weekend. The Event will consist of a snowshoe race that will loop around the Redstone Castle, a skijoring clinic behind the Coke Ovens, and snow sculpting at the Redstone Park. 3. The Pitkin County Sheriffs Office, the Carbondale Fire Department, the Emergency Management Department, the Public Works Department have all approved this event with conditions. The Applicant has provided proof of adequate Insurance covering this event. 4. The Applicant has requested the use of Redstone and Elk Parks from the Open Space and Trails Department (OST) but has not yet obtained the required OST Permit. The Public Works Department has issued a Right of Way permit for use of the property behind the Coke Ovens. 5. The Applicant has provided consent letters from appropriate property owners for the snowshoe race to occur on those properties. 6. The Director finds that, to the extent applicable, the application complies with the standards in Subsection 4- 30 -50(i) of the Land Use Code. THE DIRECTOR HEREBY APPROVES the Temporary Commercial Use /Special Event Permit for the 2011 Redstone Winterfest subject to Applicant's compliance with each of the following conditions: All material representations made by the Applicant in the application (which shall specifically include representations made in all related supporting documents, correspondence subsequently provided by the Applicant, and representations made by phone), shall be adhered to, and considered conditions of approval, unless superseded by specific conditions in this Determination. 2. The Applicant must demonstrate possession of applicable permits at all times during the permitted activity and present such permits upon request. Page] of3 0S'- Z0i/ 3. Approval to hold this activity does not imply that extra services will be provided nor does it place any additional liabilities on Pitkin County. 4. All activities at the Redstone Castle shall be restricted to outside areas only or those covered under the Castle Special Events Permit. There shall be no use of inside facilities. 5. The Applicant has received permission from the Public Works Department to utilize the County property behind the Coke Ovens for Skijoring Clinics only during the Winterfest. No motorized vehicles with treads shall be utilized in this area. Disturbance of soils under the snowpack in this area shall be prohibited. 6. The Applicant shall obtain the necessary permits from the Open Space and Trails Department for the use of Elk and Redstone Parks prior to the event. The Applicant shall abide by all terms, conditions and stipulations as required in the permit and famish a copy of said permit to the Community Development Department prior to the event. 7. The Applicant shall be responsible for assuring that all areas in which activities takes place shall be cleaned up and restored to its prior condition within two (2) days after the end of the event. 8. No event parking shall occur on Highway 133. Parking may occur along the fenced portion of the Coke Ovens along Coal Creek Road. County Roads, including Coal Creek Rd and Redstone Boulevard shall remain passable by all Emergency vehicles and the traveling public. Applicant shall contact a towing company prior to the event and arrange for their service on an as- needed basis. Contact information for the towing company shall be provided to on -site parking attendants, the County Engineer, and the County Sheriff's Department prior to the event. No emergency accesses shall be blocked. 9. Pedestrian walkways crossing Highway 133 shall be clearly marked. If there is significant traffic during the event, the Applicant shall place traffic control operators at walkways to ensure pedestrian safety when crossing. 10. All food and beverage service shall be limited to currently existing licensed commercial food establishments. 11. Pennants, banners and posters advertising the event shall not be erected more than two weeks prior to the event and must be removed within two (2) days after the termination of the event. 12. Will there be a hazard caused by the numbers of pedestrians in the vicinity and/or the fact that folks will cross the highway for some events? Will CSP be needed and/or able for traffic /security? Will the Redstone Castle be affected in any way ?: Does the owner need to give permission? I'm assuming that Carbondale Fire has already signed off on their being used as EMS providers ... (yes?)
