Roll Academy in the AABC. Education classes are a Special Review Use in the B-2 zone district. The Applicant contends that the introduction of the studio to the existing building will have negligible impacts. Space in an existing building is being converted to the music studio and therefore a GMQS Exemption is considered in this review. APPLICANT: The Rock N' Roll Academy/Pacific Avenue Associates, LLC REPRENSENTATIVE: Russell Cattaneo LOCATION: 408 Pacific Avenue, AABC Block 4, Lot 3-H, PID#3643-344-06-907 ZONING: B-2 BACKGROUND/EXISTING CONDITIONS: The Rock N' Roll Academy obtained a Temporary Commercial Use/Special Events Permit in August 2010 to hold Summer Rock Camp and classes at a nearby location, the Dance Progressions Studio, within the AABC. The Applicant is proposing to remodel approximately 650 square feet of space currently used as office space in the existing structure located at 408 Pacific Avenue. The remodeled space will house educational and studio space for use by the Rock N' Roll Academy. The building owned by Pacific Avenue Associates, LLC contains a mix of uses including residential space, office space. a gym and a yoga studio. REFERRAL COMMENTS: The application was referred to the AABC (John McBride); no comments were received. Over one hundred (100) adjacent property owners were notified. We received no comments. STAFF COMMENTS: Education Classes are a Special Review use in the B-2 zone district and is subject to the following Special Review Criteria: Page 1 of 6 j 0-P 9 CRITERIA FOR APPROVAL — SPECIAL REVIEW USES OR ACTIVITIES 2-30-30(b) (2) The Special Review shall consider. A. The special review use shall be consistent with the applicable County Master Plan. Response: The existing building and parcel are located in the AABC, and are within the Aspen Area Community Plan's boundaries_ The Plan calls for the AABC to remain a Mixed -Use development area, with both commercial and residential uses. The Special Review Use for Education Classes falls within the parameters of Mixed -Use, and is compatible with the Plan. B. The special review use shall not corJlict with any applicable sections of the Pitkin County Land Use Code, including the County Land Use Policies in Chapter 1. Response: The special review use does not conflict with any applicable sections of the Code. C. The proposed development must not materially endanger the public health, safety or welfare D. The proposed development must not substantially injure the value of adjoining or abutting property. Response: Staff has no information that would indicate that the development would injure the value of adjacent properties, or endanger the public health. safety or welfare. E. The special review use shall be consistent with the intent of the Zone District in which it is proposed to be located. Response: "The B-2 (Business) district is intended to provide for the establishment of commercial and low -intensity, non-polluting industrial uses which do not require or generate high customer traffic volumes and to permit customary accessory uses, including high density, long-term residential dwelling units." The proposed special review use is a commercial use of low -intensity. F. The special review use shall be compatible with the character of the immediate vicinity proposed for development and surrounding land uses, or shall enhance the mixture of complimentary uses and activities in the immediate vicinity of the parcel proposed for the development Response: The proposed special review use will be located within the existing building. and is similar to the existing commercial uses in the AARC. G. The location. size, design and operating characteristics of the proposed special review use must be in harmony with the surrounding area and minimize adverse effects, including visual impacts, impacts on pedestrian and vehicular circudation. traffic generation, parking, trash. service delivery, air/water pollution or other impacts on natural resources, noise, vibrations and odor on surrounding properties Response: The proposed Special Review use will have no visual impacts as the use will be located inside an existing building. The impacts on pedestrian and traffic circulation will be minimal due to the limited number of employees and hours of operation, which are primarily afternoons and early evenings during the school year. Summer classes would consist of two classes per day, running from 9:30 AM to 5:30PM. Parking will be mitigated by the existing parking available on the parcel and would be limited as those attending the classes would be dropped off or utilize public transportation, as they are not old enough to drive. Other impacts on trash, delivery service and the environment will be negligible. Page 2 of 6 a H. There must be adequate public facilities and services to serve the special review use. including but not limited to roads, potable water, sewer, solid waste. parks, police. fire protection, emergency medical services, hospital and medical services, drainage systems, and schools. Response: There are adequate public facilities and services to serve the Special Review use on this parcel. USE SPECIFIC STANDARDS — EDUCATIONAL CLASSES 4-30-30(B): The following standards apply to facilities that provide Educational Classes: A. This use shall be limited to a marirnum class size of twenty-five (25) persons, including instructors. at one time. In the RS-20 and RS-30 zone districts this use shall be limited to one (1) class per day. Response: The Applicant has committed to limiting class sizes in the current 650 square foot space to six (6) students and one (1) instructor per class, with a total of no more than three (3) consecutive classes per day. The Applicant shall be required to obtain new Special Use Approval should the current approved thresholds or other material changes in operations take place (i.e. the number of students or floor area required for studio space increase). The proposed use is not located in the RS-20 or RS-30 zone districts. SPECIAL REVIEW USE 2-40-20(C) Review Standards and Limitations of Uses by Special Review: A. Special Review Use Limitations under the Pitkin County Land Use Code pursuant to Sec. 2- ,10-20(c) include 1. Commencement of Operation: Approved special uses shall begin within three (3) years following the date of approval of the development permit, unless a longer period is specified, or the approval shall become null and void. 2. Special Review Use: The decision making body may approve a special review use subject to a limited time period during which a use may operate. 3. Submission of Annual Report and Review of Annual Reports: The decision making body may require any person operating pursuant to a special review use to submit a statement to the Community Development Director attesting to the continued conformance of the use to the conditions of the approval. If after reviewing the statement, inspecting the site and considering any other relevant materials, the Community Development Director determines that the use is in conformance with the provisions of the Special Review Use approval. the use may continue pursuant to the provisions of approval If the Community Development Director determines that the use is not in conformance with the provisions of the Special Review Use approval, the Community Development Director may recommend to the original review authority that it consider the withdrawal of such approval. Failure of any person operating a we under a Special Review Use approval to submit such a statement within the period specified above shall be considered a violation of the provisions of the special review approval and may be sufficient cause for withdrawal of the approval. Page3of6 3 4. Approval Withdrawal Procedure: The decision -making body shall consider and act on approval withdrawal after a public hearing. Notice of the public hearing shall be mailed to the applicant and published in a newspaper of general circulation in the County not later than thirty (30) days prior to the hearing. The notice shall state the time. location and subject matter of the hearing. 5. Approval Expiration: Any Special Review Use shall expire after any continuous twelve (12) month period of non-use. Any unfulfilled obligations of the approval shall continue to be binding after expiration of the approval. Response: The Applicants shall abide by all Limitations of the Land Use Code. Additionally, Staff supports the granting of the Special Review Use for a term of five (5) years, with the following conditions: a. That any changes in thresholds, including, but not limited to the number of students, instructors or floor area be reviewed prior to change b. That the Special Use be subject to review by the BOCC on an annual basis, if the Community Development Department is made aware of any negative impacts (i.e. noise). If an annual review is held the BOCC may revoke or modify the approval. GMOS EXEMPTION FOR COMMERCIAL DEVELOPMENTS WITH NEGLIGIBLE GROWTH IMPACTS (SECTION 6-30-150): A GMQS Exemption is provided for commercial development with insubstantial growth impacts. For a development to qualify for this exemption, the applicant shall demonstrate that: A. The development contains no more than one thousand (1000) square feet of new commercial floor area. Response: The proposal is for 650 square feet of existing commercial office space to be converted for the Special Use. B. The development will generate an insubstantial number of additional employees. For purposes of this section. insubstantial shall mean that the development will generate no more than three (3) additional employees. Response: The proposed use will generate only a single employee. the instructor. The space is currently used as office space, which according to the calculations from Table 8-3, generates 2.93 employees. This is net change of-1.92 employees. 650 square feet = 222 [the square footage for 1 employee] = 2.93 employees. C. The development will generate an insubstantial demand for additional parking and the parking that is needed will be accommodated on -site or in another appropriate location. For purposes of this section. Substantial shall mean that the development will generate the demand for no more than five (5) additional parking spaces. Response: The Applicant has stated that there will be adequate parking and access for the Special Review Use. According to Table 7-3, the minimum required off-street parking spaces required for the Non -Residential Use is one (1) parking space per four hundred (400) square feet of non-residential floor area or 1.625 parking spaces for the 650 square feet required for the Special Review Use. The development will generate an insubstantial demand for basic governmental facilities such as water supply, sewage treatment, drainage control, fire and police protection, and roads, will place an insubstantial burden on the conununity is bus system. schools, library, hospital. and parkitrail system. For purpose of this section, insubstantial shall mean that the development will not generate the need for any new capital improvements (other than minor improvements needed to directly serve the development, such as a water service line or a driveway), and will not generate the need for arty new staffing by governmental personnel. Any minor improvements that are determined necessary to serve the development shall be provided by the applicant. Response: The development will not generate a greater demand for basic governmental facilities such as roads, water, fire, police or trail system or create additional impact. E. The development will cause an insubstantial adverse impact on the community's air, water and other natural resources and will cause negligible adverse impacts on surrounding properties. Any such adverse impacts that are caused by the development shall be mitigated by the applicant. Response: The proposed expansion will not create additional impacts. COMMERCIAL DEVELOPMENT — CHANGE IN USE 6-30-160: A GMQS exemption is provided for change in use of an existing structure from the residential, commercial or tourist accommodation use categories to another such category. While the conversion of an office space into a retail business is not considered a change of use for growth management purposes, it is considered a change of use for other purposes (such as special review) in the Land Use Code. To qualify for this exemption, the applicant shall comply with the following requirements: A. The applicant shall demonstrate that the structure in which the change in use is proposed was legally created by producing a valid copy of the building permit for the structure. Response: A Certificate of Occupancy was issued for the building in 1982 (Attachment 2). B. The applicant shall agree to mitigate any employees that are generated by the proposed change in use, as specified in Section 8-30. Response: The Applicant agrees to mitigate any employees that are generated by the proposed change in use, as specified in Section 8-30. While the proposal will not change from one use category to another (both are commercial), the Applicant is proposing to convert the space to a less intensive commercial category than General - Office, as described pursuant to Section 8-30 and Table 8-3 and is thereby exempt from the Employee Housing Impact Fee. C. The applicant shall accommodate the additional parking needed on -site or in another appropriate location the additional parking needed to serve by the proposed change in use. Response: The applicant has agreed to comply with the parking standards and requirements pursuant to Section 7-30-20 and Table 7-3 of the Land Use Code. Page 5 of 6 V D. The applicant shall agree to provide any improvements to water supply, sewage treatment, drainage control. fire and police protection. roads, transit, trails, schools, library. hospital, and parks that are necessitated by the proposed change in use. Responses The proposed use will create no additional impacts to the site. E. The development will cause an insubstantial adverse impact on the community's air, water. and other natural resources and will cause negligible adverse visual impacts on surrounding properties. Anv such adverse impacts that are caused by the development shall be mitigated by the applicant. Response: The community's air, water and other natural resources will not be impacted. The proposed use will have negligible visual impacts on the community due to its location inside an existing building. RECOMMENDATION: Staff recommends that the BOCC adopt a motion approving the Pacific Avenue Associates, LLC Special Review use request to allow The Rock N' Roll Academy to provide Educational Classes located at 408 Pacific Avenue in the AABC, subject to the conditions in the attached Resolution. Pacific Avenue Associates, LLC and The Rock N' Roll Academy ("Applicants") have applied to the Board of County Commissioners of Pitkin County, Colorado ("BOCC") to renovate office space to Educational Classes within the B-2 district of the Aspen Airport Business Center. Pursuant to Sections 4-30-30(B) and 2-30-30(Hx2) Education Classes may be allowed in the B-2 Zone District by Special Review. Section 6-30-150 of the Land Use Code provides a GMQS Exemption for Commercial Development with Insubstantial Growth Impacts. 2. The parcel is in the B-2 zone district. Said parcel is located at 408 Pacific Avenue and is more specifically described as Block 4, Lot 3-H. AABC. 3. The BOCC heard this application at a duly noticed public hearing on November 3, 2010, at which time evidence and testimony were presented with respect to the application. 4. The BOCC fords that the Special Review Use and GMQS Exemption for Commercial Development with Insubstantial Growth Impacts to allow for Educational Classes are generally consistent with the applicable provisions of the Pitkin County Land Use Code. NOW, THEREFORE, BE IT RESOLVED by the BOCC that it does hereby grant Special Review for Educational Classes and GMQS Exemption for Commercial Development with Insubstantial Growth Impacts approval for the Pacific Avenue Associates, LLC / Rock N' Roll Academy to hold Educational Classes for a five year period. subject to the following conditions, which shall run with the land and be binding on all successors in interest: 1. The Applicants shall adhere to all conditions and material representations made in the current application and shall consider those representations to be conditions of approval, unless amended by other conditions or as amended herein. 2. All previous conditions of approval on the property shall remain in effect unless modified by the terms of this approval. 3. No calculations for height, bulk, setback, size, floor area, or any other building and zoning requirements have been conducted. These requirements will be considered at the time of building permit review. Structures represented in the application might not be permitted under building and zoning regulations. 4. The Applicants shall be allowed to occupy a total of 650 square feet of office space in the existing building at 408 Pacific Avenue in the AABC. During the school year, the Applicants shall be allowed to hold no more than three (3) consecutive classes, comprised of one instructor and no more than six (6) students per class, Monday through Friday from 4PM to 8PM. The schedule for the calendar year shall be approximately the same as the Aspen Public Schools calendar year. Summer camp during June, July and August shall be limited to no more than two classes per day, Monday through Friday, between the hours of 9AM-6PM. 5. The Applicants shall be required to obtain new Special Review Use Approval should the current approved thresholds or any other material changes in the operation take place during the five (5) year time period of this approval. 6. In the event the Community Development Department is made aware of any negative impacts generated by the Special Use, the Applicant and Special Use shall be subject to annual review by the BOCC. If there is an annual review, the BOCC may modify or revoke the permit. 7. All signage associated with the facility, shall meet the requirements in Section 7-60-50 of the Land Use Code. 8. All equipment associated with the facility must comply with the noise ordinance specifications as described in the Pitkin County Code, § 6.36.030. 9. The Applicants shall carry and provide proof of adequate Liability Insurance, as required by the County for all times of operations. The Applicants must notify the Community Development Director of any change of status to policy during the active season. 10. The Special Review Use approval shall expire alter any continuous twelve (12) month period of non-use. 11. Prior to the issuance of any building permits, the Applicant shall: a. Pay the applicable road impact fees. b. Submit a construction management plan for review and approval by the Planning Engineer showing the locations of staging, material storage and employee and construction traffic parking. c. Submit a parking plan for the development showing where parking will take place. 12. The Special Use approval shall expire after five (5) years, on November 3, 2015. If the Applicants wish to pursue an application for continued operation of the Education Classes beyond the length of this approval, a new application for Special Review and GMQS Exemption for Commercial Development with Negligible Growth Impacts shall be filed with Pitkin County Community Development no later than August 3, 2015. The premises is approximately 650 square feet (unit 206) in the building owned by Pacific Avenue Associates, LLC at 408 Pacific Avenue in the Aspen Airport Business Center. Parking and access is provided on both the front (single story) and back (two story) of the building. The current access and parking will be adequate for the proposed change in use. Currently this building is mixed use. There are two residential units in the building, office usage (Rassmussen Construction), a Yoga Studio (King Yoga), and a gym (Unique Physique). The Rock and Roll Academy provides group music instruction for students ages 8 —18. The Rock and Roll Academy would conduct Summer Rock Camp during the months of June, July, and August. Summer Rock Camp would consist of two classes, one morning and one afternoon class. These classes would last from roughly 9:30 AM to 5:30 PM. During the spring and fall school semesters the Rock and Roll Academy would conduct after school classes. These would be 1 Y: hour classes with the first class beginning at 4:00 PM. There would be no more than 3 consecutive classes each day. Both Summer Rock Camp classes and after school classes will consist of no more than 6 students and 1 coach each. The Rock and Roll Academy would like to begin Summer Rock Camp during August 2010 and move forward with fall after school classes and so forth from then. Under ideal circumstances we would like to see The Rock and Roll Academy expand and be able to serve three classes at once. The total students attending these three classes would be no more than 18 at one time with 3 coaches. At that point The Rock and Roll Academy would occupy roughly 1800 square feet of space. Under Section 6-30-150 of the Pitkin County Land Use Code this change of use would be exempt from GMQS criteria. With regard to part (a) of this Section there will be no new floor area added. Regarding part (b): this use will generate one new employee (this employee will actually move from a current job in Pitkin County).
