RESOLUTION OF THE PITKIN COUNTY PLANNING AND ZONING COMMISSION
GRANTING SCENIC OVERLAY/RIDGELIKE REVIEW APPROVAL TO THE
TIEGE APPLICATION
Resolution No. PZ-91- 7 q
WHEREAS, Joan Tiege, hereinafter "Applicant", has applied to
the Planning and Zoning Commission of Pitkin County, Colorado,
hereinafter "Commission", for scenic overlay/ridgeline review
approval for construction of a house pursuant to Section 3-
1.13(E) of the Land Use Code; and
WHEREAS, the site is located within the mapped scenic
overlay/ridgeline area along Brush Creek Road and Highway 82; and
WHEREAS, said parcel is located on Lot 7, Block 7 in the
Brush Creek Subdivision; and
WHEREAS, the Applicant's parcel is zoned AF-1; and
WHEREAS, the Commission considered the Application at a duly
noticed public hearings at a regularly scheduled meeting on August
20, 1991; and
WHEREAS, the Commission determined that the applicant has
complied with review criteria for development within scenic overlay
and ridgeline mapping areas.
NOW, THEREFORE, BE IT RESOLVED by the Commission that it does
hereby grant scenic overlay/ridgeline review approval to the
Applicant subject to the following conditions:
1. The height of the residence shall not exceed 30 feet to the
ridge of the roof from existing grade.
2. Roof materials shall be earthtone in color and non -reflective.

3. Wood and stone materials shall be used in the facade of the
residence, as represented by the applicant.
4. Landscaping shall be placed to break up the facade which will
be seen from the Highway. Landscaping shall adhere to adopted
State Highway 82 Corridor Landscape Guidelines. Existing
shrubs on -site shall be preserved to the extent possible. A
landscape plan shall be submitted to Planning Staff for review
and approval prior to issuance of a certificate of occupancy.
5. Exterior lighting shall be designed in such a manner that
light sources shall not be seen from public rights -of -ways.
Exterior lighting shall comply with the County lighting
regulations.
6. Erosion control measures shall be used in construction of the
improvements. Revegetation of areas disturbed by construction
shall occur within one growing season of construction. Areas
disturbed by construction shall be revegetated with indigenous
plant materials and the driveway cut shall be retained with
natural materials.
7. The residence, including garage, storage and caretaker unit
(if requested) shall be limited to a size of no greater than
4,000 square feet of floor area, unless approved by the
Planning Commission.
8. All material representations made in the public hearing and
in the application shall be adhered to.

MEMORANDUM
TO: Planning and Zoning Commission

RE: Tiege Scenic Overlay/Ridgeline Review
DATE: August 20, 1991
REQUEST: Joan Tiege requests scenic overlay/ridgeline review and
approval for construction of a residence which is proposed on Lot
7, Block 7, in the Brush Creek Village Subdivision.

ZONING: AF-1
ACCESS: Juniper Hill Drive
STAFF COMMENTS:
The applicant proposes to construct a 3,000 + square foot single
family dwelling. The area proposed for development has slopes of
approximately 15% in grade. The lot is located within a mapped
scenic overlay/ridgeline area. Photographs of the proposed site
will be brought to the meeting.
Section 3-1.13(E) of Ordinance 90-07 (attached) provides review
criteria for development within the mapped scenic overlay area.
The proposal generally complies with the criteria. Specifically,
the applicant has done the following to mitigate visual impact:
1. Topography and location of the site screens it completely from
Brush Creek Road. It is visible from Highway 82 but will not
break a ridgeline.
2. Wood and stone materials are proposed for the home, as a means
of helping to blend it in to the backdrop. A metal roof is
proposed. It is recommended that it be charcoal grey in
color and non -reflective.
3. The building height will be limited to 30 feet to the pitch
of the roof from existing grade. At this height, the building
will not break a ridgeline.
The applicant has not proposed vegetative screening. It is
recommended that landscaping be placed to break up the facade which
will be seen from the highway. Landscaping should adhere to adopted

State Highway 82 Corridor Landscape Guidelines. It is recommended
that existing shrubs on -site be preserved to the extent possible.
It is further recommended that the development's exterior lighting
be designed in such a manner that light sources will not be seen
from public rights -of -ways. Exterior lighting should comply with
the County lighting regulations.
RECOMMENDATION: Planning Staff recommends approval of the request
subject to the following conditions:

AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS
OF PITRIN COUNTY, COLORADO ADOPTING AN AMENDMENT
TO SECTION 3-1.13 OF THE PITRIN COUNTY LAND USE CODE,
SCENIC FOREGROUND OVERLAY, TO INCLUDE RIDGELINE DEVELOPMENT
Ordinance No. 90-07
WHEREAS, the Board of County Commissioners (hereinafter
"Board") has reviewed various alternatives to regulate visually
obtrusive development within Pitkin County; and
WHEREAS, the Planning and Zoning Commission (hereinafter
"Commission") reviewed the proposed Code Amendment at regularly
scheduled meetings and work sessions which were open to public
comment on the following dates: September 25, 1989, November 7,
1989, December 17, 1989, January 9, 1990, March 6, 1990, April
17, 1990 and May 8, 1990 at which time evidence and testimony was
presented with respect to said regulation; and
WHEREAS, the Commission recommended approval of the proposed
code amendment on May 22, 1990 and mapping on June 19, 1990; and
WHEREAS, the Board reviewed the proposed amendment at first
reading on June 26, 1990, and second reading held as a public
hearing on August 14, 1990 and September 11, 1990, at which time
evidence and testimony was presented with respect to the proposed
amendment.
WHEREAS, 1041 Hazard Areas may be in conflict with
preservation of scenic areas, the Board acknowledges that 1041
issues may take precedence over scenic concerns and these issues
shall be reviewed on a case by case basis.

NOW, THEREFORE, BE IT RESOLVED by the Board that it does
hereby approve an amendment to the Pitkin County Land Use Code to
include ridgeline development regulations within the Scenic
Foreground Overlay regulation and to rename this Section (3-1.13)
of the Pitkin County Land Use Code "Scenic Overlay". Section
3-1.13 shall be repealed and reenacted to read as follows:
3-1.13 Scenic Overlay
(A) Intent
The intent of the Scenic Overlay is to establish a
scenic conservation area which includes those lands
which are proximate to and most visible from State
Highway 82 and Brush Creek Road with specific concerns
for the areas which constitute the visual entrance
"image" and passage through Aspen and Pitkin County.
The Scenic Overlay also identifies the need to maintain
a natural ridgeline silhouette against the sky and to
steer development away from ridgelines throughout the
County as viewed from public roadway corridors. The
scenic overlay corridor is interpreted to insure that
these developments are designed to compliment the
natural landscape and the natural features within the
public viewplane in order to obtain.an aesthetically
pleasing, rural atmosphere.
(B) Applicability of Regulations
Development on any parcel of land which falls within or
is crossed by the Scenic Overlay on the officially
adopted Pitkin County Zoning Maps shall be subject to
review to determine the conformance of the development
with the evaluation criteria identified below. The
scenic overlay maps include mapped ridgelines, scenic
foreground areas and public viewplanes.
Development shall be defined as any construction,
vegetation or grading activity which changes the basic
character or use of a parcel of land or which
significantly alters the visibility of an existing use
from a public right-of-way as identified in Section
B(1) below.

Metes and bounds parcels with designated building
envelopes approved after 7anuary 1, 1988. This includes
parcels which have received 1041 approvals and vested
rights (Reso 88-95).
Planning Director Sign -Off
(1)
The applicant shall demonstrate that development within
the mapped scenic overlay is insignificant and will not
impact the visual quality of the ridgeline or overlay
area. In this case the Planning Director may approve
development with conditions upon a finding that:
a. Development cannot be seen from the
designated corridors as defined in
Section (B)(1), or
b. In the case of additions or remodels of
existing homes, visible development is thirty
percent (30%) or less, of the existing square
footage of the structure, or
c. For areas not mapped within the Scenic Overlay but
included in Ridgeline mapping, such development
shall not break a ridgeline.
(E) Review criteria for development within the Scenic Overlay
and Ridgeline mapping shall be as follows:
(1) Whether the development has utilized existing
topography and natural vegetation, such as ridges and

hills to screen buildings to the maximum extent
possible.
(2) Whether the development has been designed to complement
the natural topography of the land, including, whenever
possible and appropriate, the utilization of innovative
architectural techniques such as earth sheltered design
natural materials and coloring, non-reflectability and
clustering of structures on the least visible portions
of the site.
(3) Whether the development's height and bulk has been
designed to avoid, to the maximum extent possible, the
visibility of buildings from the highway and public
viewplanes.
The proposed structure shall be placed so it does not
break a ridgeline, unless there are no alternate
building sites on the lot.
Whether the proposed development has avoided the
location of uses on the highest ground or most visible
portion of the site as viewed from State Highway 82 and
public right-of-ways, identified in Section (B)(1).
(6) Whether the development has been located outside of the
designated Scenic Overlay, or on a suitable site at the
greatest distance possible from State Highway 82 and
identified ridgelines.
(7) Whether the development has been, landscaped in
accordance with the adopted State Highway 82 Corridor
landscape guidelines and has preserved natural
vegetation, to the maximum extent possible, including
the avoidance of development within irrigated meadows.
Existing vegetation shall be maintained to the maximum
extent possible, while using existing vegetation to
screen development. A landscaping plan shall be
submitted by the Applicant and approved by the Planning
and Zoning Commission.
(8) Whether the development's exterior lighting has been
designed in such a manner that light sources, such as
facade and landscape lighting, will not be seen from
public right-of-ways as identified in Section (B)(1).
In addition, an application shall be consistent with
the lighting regulations identified in the Pitkin
County Land Use Code.
(9) Landforms and earth moving shall generally not be
acceptable as the sole measure of compliance with these

regulations. However, they may be utilized in
conjunction with other site techniques designed into
the development plan. These methods may be acceptable
when utilized as one of several methods to complement
and enhance development, rather than as the single
device for screening development from view from the
State Highway 82 Corridor and as mapped.
(10) Whether the development has been designed so as to
avoid, to the maximum extent possible, any Scenic
Viewplane identified on the adopted State Highway 82
Corridor Master Plan and Down Valley Comprehensive
Plan.
(11) In the case where 1041 Hazard Areas may be in conflict
with preservation of scenic areas, the Board
acknowledges that 1041 issues take precedence over
scenic concerns. These issues shall be reviewed on a
case by case basis.
The Planning and Zoning Commission shall review the
development for its conformance with the above criteria, and
shall finally approve (including such revisions or
conditions as may be appropriate) or deny the proposal at a
Public Hearing as noticed pursuant to Section 6-3.4(d).
(G) Appeal Procedures
(1) Any person adversely affected or aggrieved by a
decision of the Planning Director may appeal to the
Planning and Zoning Commission. The applicant may
present his or her application, evidence and testimony
to the Planning and Zoning Commission at a scheduled
public hearing noticed according to the standards of
Section 6-3.4(d). The Planning Commission shall make a
determination at such hearing as to whether or not to
uphold, modify or reverse the decision made by the
Planning Director.
(2) Any person adversely affected or aggrieved by a
decision of the Planning Commission may appeal to the
Board of County Commissioners. The applicant may
present his or her application, evidence and testimony
to the BOCC at a scheduled public hearing noticed
according to the standards of Section 6-3.4(d). The

decision made by the Planning Commission. The decision
of the Board shall be the final action of the County.

(H) Review of Regulation Effectiveness
(1) Prior to the one (1) year anniversary of the adoption
of this regulation, the Planning and Zoning Commission
and BOCC shall review the effectiveness of this
regulation.

Planning Commission agenda. This review is required to be a public
hearing notice of which must be published in The Aspen Times 30
days prior to the hearing. We have published the hearing for the
August 20th P&Z meeting. I have enclosed a copy of the notice for
your info. We are also required to send a copy of the notice to
each of the adjacent property owners within 15 days of the hearing.
Will you be able to give me a list of the adjacent owners with
their mailing addresses? I will need this by August 2nd. You are
required to put a sign on your property within 15 days of the
hearing. I have enclosed an information sheet explaining the
public hearing notice requirements, but if you have any questions

The Planning Commission meets at 9:00 am in the Commissioners's
Meeting Room in the County Courthouse, 506 East Main Street.
