REQUEST: Pursuant to Section 3-8.11(d) of the Code, Spencer
Pearson is requesting approval of a special use permit which will
allow the applicant to occupy an existing 400 square foot single
family residence during the construction of a new 4,000 square foot
residence which will be attached to the existing home.

STAFF COMMENTS:
Section 3-8. 11(d) of the Code stipulates the following:
The Board of County Commissioners may, upon receipt of
an application therefor, permit the issuance of a
building permit for a single family residence which is
intended to replace an existing single family residence
on the same parcel of land, notwithstanding the occupancy
of the existing single family residence during the
pendence of construction of the replacement residence,
provided the applicant executes an appropriate guarantee
in a form acceptable to the Board which will insure the
cessation of the use of the existing residence as a
single family dwelling upon the issuance of a certificate
of occupancy for the replacement residence.
Pursuant to a July 2, 1991 policy decision by the Board, the
Planning Director may grant a temporary use permit upon a finding
that the applicant has complied with the following measures:
1. The applicant shall pay an administration fee of $152 . 00 to
the Aspen/Pitkin Planning Office.
2 . Prior to issuance of a building permit, the applicant shall
draft an agreement with the County stipulating that, within
thirty days of issuance of any Certificate of Occupancy
(permanent or temporary) for the new residence, the existing

residence on site shall be demolished or removed from the
property or converted to an accessory structure.
3 . The applicant shall post financial security in a form
acceptable to the County Attorney to guarantee the removal or
conversion of the structure. The amount of financial security
required shall be based on an estimate for demolition costs
prepared by a bona fide demolition contractor. Said estimate
shall be reviewed and approved by the Chief Building Official.
The financial security shall be required prior to the issuance
of a building permit.
The applicant has drafted an agreement with the County (see
attachment 1) stipulating that, within 30 days of issuance of a
certificate of occupancy for the new residence, the kitchen in the
existing residence will be removed. The existing structure, which
is to be attached to the new residence, will be converted to a
combined study and private art/photography studio. The applicant
agrees to post financial security in the form of a performance
bond, a letter of credit, money order or cash to cover the cost of
the removal of the kitchen in the existing residence. The estimate
for cost for disconnection and removal of the kitchen has been
prepared by a bona fide contractor. Said estimate has been
reviewed and approved by the County Building Inspector. Financial
security will be required prior to issuance of a building permit.
RECOMMENDATION: Staff recommends approval of the temporary use
permit, subject to the following conditions:
1) Prior to issuance of a building permit, the applicant shall
post financial security in the form of a performance bond, a
letter of credit, money order or cash to cover the cost of
removal of the kitchen in the existing residence.
2) The County Attorney shall approve the form of financial
security prior to issuance of a building permit.
3) Within 30 days of issuance of a certificate of occupancy for
the new residence, the kitchen in the existing residence shall
be removed.

Dear Sirs:
My wife and I live in a 400 square foot house with a 60 square foot
kitchen and dining nook. We are ready to build a 4000 square foot
house that attaches to the existing house. We plan to put in the
foundation this autumn and begin construction next spring. Rather
than renting a home during the year we are under construction, we
would like to continue residing in the present structure.
We plan on abandoning the present kitchen in favor of the kitchen in
the expanded residence. The existing structure will be converted to
a combined study and art/photography studio.
I have an estimate (enclosed) from a contractor to remove the
kitchen for $100. I will remove this kitchen within 30 days of
issuance of the occupancy permit for the new residence. I will pay
the administration fee of $152 and post $100 cash as security to
guarantee the conversion of the structure.
I appreciate the county's effort to streamline this process consistent
with a Joanna Schaffner memo dated July 2, 1991 entitled "Agenda
Item Summary". Good work.
