This application was submitted July 5, 2006. My recollection is that I requested additional
information to demonstrate that the proposed residence would not break a ridgeline as seen from
Brush Creek Road. No additional information was submitted. Given the length of time that this
application has been incomplete, we consider it to be withdrawn. When the owner is prepared to
proceed with redevelopment, Site Plan Review pursuant to the current Code will be required.

Lusk 1041 Hazard Review and Scenic Overlay Review

Project Overview
The subject property is located at 44 Medicine Bow Road in the Brush Creek
Village Subdivision (Please refer to Exhibit A- Vicinity Map).
The parcel contains 2 acres and is presently developed with a 2,400 square -foot
residence, associated accessory outbuildings and uses, a driveway, and parking
areas.
Stuart Lusk, hereinafter "the Applicant", is requesting Pitkin County approval of
1041 Hazard Review and Scenic Overlay Review. The Applicant wishes to
obtain approvals that would allow the construction of a new 5,750 square -foot
residence and associated accessory uses and/or structures.
Land Use Reviews
Section 3 -80 -040: Scenic Oveday
The proposed residential development will be visible from limited sections of the
Highway 82 corridor.
Review Criteria for development within the Scenic Overlay mapping, as follows:
Whether the proposed development has utilized existing topography and
natural vegetation, such as ridges and hills to screen buildings to the
maximum extent possible.
Applicant's Response: Existing vegetation, which mainly includes mature
junipers and native shrubs, will be preserved to the maximum extent possible.
The proposed building site is located against a steep hillside in the background,
therefore lessening the apparent mass of the buildings. Ridges and hills have
been utilized to the maximum extent possible in the placement of the primary
building envelope.
2. Whether the proposed development has been designed to complement
the natural topography of the land, including, whenever possible and
appropriate, the utilization of innovative architectural techniques such as
earth sheltered design, natural materials and coloring, non- refelectability
and clustering of structures on the least visible portions of the site.
Applicant's Response: The primary building envelope has been located in an
area that is partially screened by the natural topography of the site. The exterior

finish of the structures will be comprised of natural materials and coloring, and a
non - reflective roof will be utilized. Please refer to the color- rendered elevation
drawing attached as Exhibit C.
3. Whether the proposed developments height and bulk have been
designed to avoid, to the maximum extent possible, the visibility of
buildings from the highway and public viewplanes.
Applicant's Response: The proposed residence will comply with Pitkin
County height regulations. The bulk of the residences will be minimized by virtue
of their design into the hillside, existing topography and vegetation.
4. The proposed structure shall be placed so it does not break a ridgeline,
unless there are no alternative building sites on the lot.
Applicant's Response: The proposed residential development will not break
a ridgeline as viewed from SH 82. Please refer to Exhibit D which illustrates the
location of the existing residence relative to the ridgeline /skyline.
5. Whether the proposed development has avoided the location of uses on
the highest ground or most visible portion of the site as viewed from State
Highway 82 and public rights -of -way.
Applicant's Response: The new residence will be located in approximately in
the same Nation as the existing residence, and as far away from Highway 82
as possible given the constraints of the site.
6. Whether the proposed development has been located outside of the
designated Scenic Overlay or on a suitable site at the greatest distance
possible from State Highway 82 and identified ridgelines.
Applicant's Response: The residence is being proposed in areas that are the
greatest possible distance from Highway 82, given site constraints.
7. Whether the proposed development has been landscaped in accordance
with the State Highway 82 Corridor landscape guidelines and has
preserved natural vegetation to the maximum extent possible, including
avoidance of development within irrigated meadows. Existing vegetation
shall be maintained to the maximum extent possible, while using existing
vegetation to screen development. The Applicant shall submit a
landscaping plan.
8. Applicant's Response: Natural vegetation will be preserved to the
maximum extent possible to screen the development and protect wildlife

habitat. The Applicant will commit to planting additional evergreen trees in
key areas to further screen the residences from the Highway. A
conceptual landscape plan is attached as Exhibit E. Please note that the
proposed tree locations are located in areas that will most effectively
enhance the screening the residences as viewed from Highway 82.
8. Whether the proposed development's exterior lighting has been designed
in such a manner that light sources, such as facade and landscape
lighting, will not been seen from public rights-of-way as identified in
Section (B)(1). In addition, an application shall be consistent with lighting
regulations identified in the Pitkin County Land Use Code.
Applicant's Response: The exterior lighting will be designed so it is not
visible from the public right -of -way. The Applicant is not proposing facade and/or
landscape lighting.
9. Landforms and earthmoving shall generally not be acceptable as the sole
measure of compliance with these regulations. However, they may be
utilized in conjunction with other site techniques designed into the
development plan. These methods may be acceptable when utilized as
one of several methods to complement and enhance development, rather
than as the single device for screening development from view.
Applicant's Response: The use of landforms, such as berms, may not be
appropriate or necessary given the distance from Highway 82 and the
Applicant's utilization of existing vegetation and topography to screen the
development.
10. Whether the proposed development has been designed so as to avoid, to
the maximum extent possible, any Scenic Viewplane identified on the
State Highway 82 Corridor Master Plan and the Doom Valley
Comprehensive Plan.
Applicant's Response: The proposed residential development is not located
in a mapped scenic view plane.
11. In the case where 1041 Hazard Areas may be in conflict with the
preservation of scenic areas, the Board acknowledges that 1041 issues
take precedence over scenic concerns. These issues shall be reviewed
on a case -by -case basis.

12.Applicant's Response: The development is proposed in approximately
the same location as the existing residence. There are no such conflicts
in this case.
Section 3-80 Areas of Local and State Interest
1041 Environmental Hazard Areas
This section demonstrates compliance with Geologic, Wildfire, Wildlife and
standards, as identified in the pre - application conference summary.
Section 3- 80-050(C). Geologic Hazards - Potentially Unstable Slopes
Section 3- 80 -050C(2a) Exception for minor changes in slope development may
be permitted on lands that have slope in excess of 30°x6 when the slope is due to
the presence of a minor natural or man -made change in gradient of a continuous
slope, provided the following conditions are met:
1) Not subject to instability: The applicant demonstrates that the slopes
ground surface is not prone to instability or failure and that the
proposed development will not cause greater instability or increase the
potential for slope failure.
2) Compliance with other regulations: the applicant demonstrates that
development on slopes in excess of thirty percent (30°x6) does not
increase visual, wildfire, or wildlife impacts, or compromise or conflict
with other policies or standards of the Land Use Code.
Applicant's Response: The proposed primary building envelope contains slopes
of 0- 40°x6. Those areas within the proposed envelope with slopes in excess of
30% comprise approximately 20% of the envelope. These >30% areas have
already been developed for such uses as a patio, ornamental planting beds,
retaining walls, and a storage shed. The proposed envelope is sized to
accommodate the allowable floor area (5,750 sq.ft.) for this lot.
The Applicant will utilize accepted professional engineering practices to assure
that the proposed development will not cause greater slope instability or
increase potential for slope failure. The proposed development on already -
disturbed slopes in excess of 30°x6, will not increase visual, wildfire, or wildlife
impacts.

Section 3- 80-070: Wildfire Hazards
Pitkin County's adopted wildfire hazard maps indicate that the subject property,
and the properties immediately surrounding it, is rated as Low Hazard: Trees
and Grass.
Applicant's Response: Attached as Exhibit B, is a report on wildfire hazards
for the subject parcel prepared by Art Hoagland. Mr. Hoagland has
recommended standard wildfire mitigation measures for the development.
Section 3- 80-080: Wildii/e Hazards
The property is not within any mapped wildlife habitat areas.
Summary
The Applicant is requesting County approval of 1041 Hazard Review and Scenic
Overlay Review to allow for the construction of a new single family residence in
approximately the same location as an existing residence. The Applicant is also
requesting vested rights for all approvals.

Subject: Wildfire Hazard Mitigation for the property in the vicinity of Brush Creek
Road and Medicine Bow Road, Pitkin County, Colorado.
Dear Mr. Magill,
Thanks for accompanying me to this site on Thursday, June 29 to orient me to
the site. I remained on site to take some photos and evaluate the wildfire hazard at this
site. I will qualify my observations as those of conditions as they now exist.
The existing house is located on a slope that generally exceeds 20 1 /6 with some
slopes in the vicinity exceeding 35/40%. The vegetation consists of scattered pinion and
juniper up to 15 -feet in height, oak and serviceberry up to 8 -feet in height and some
sagebrush up to 6 -feet in height and native grass low on the property. The vegetation is
scattered and separated over much of the area indicated to me to be within the proposed
building envelope. Because of the meandering but continuous vegetation providing a
continuous fuel path to the existing house I would expect that a fire from whatever cause
would behave as in a high hazard area and for that reason I determine this to be a High
Wildfire Hazard Area. However with a moderate amount of vegetation management I
believe that this property could be reevaluated as a medium hazard area and I recommend
that this be considered. In lieu of doing this the following is recommended:
Vegetation Management and Modification Recommended
1. Around the proposed house and beyond the furthermost projection of combustible
construction for a distance of 15 -feet the area should be of primarily noncombustible
hard scape surfaces, low growing perennials, flowerbeds, cut grass and deciduous,
well - trimmed and irrigated plants. Woody vegetation should not be planted within
this area. Firewood or other combustible materials should not be stored within this
area. If the owner would like to have ornamental trees near the house this may be
done if the 15 -foot area is extended outward from the furthest growth expected from
the mature trees. In other words, these trees should have defensible space as the
buildings do.

2. Beyond the 15 -foot area up to 45 -feet down slope and 35 -feet of the building cross
slope and up slope maintain natural and/or irrigated grass at less than 6- inches and
thin existing trees and brush into individual or clusters. Oak, pinion, juniper,
serviceberry and other brush should be thinned and clustered. Limbs should be
pruned to one half the height of the tree or 10 -feet whichever is less. No brush or
shrubs which when mature will be tall enough act as ladder fuel should be provided
or maintained around the trees. Clusters of bushes or shrubs should be separated
from each other ng•d from those beyond the 35 -foot area by a distance of 2 '/z times
the height of the mature vegetation. The diameter of a cluster should be limited to
2 '/2 times the height of the mature vegetation. As an example: If the expected mature
height of the vegetation is 10 feet then the diameter of the cluster should be no greater
than 25 feet and the distance between clusters should be greater than 25 feet. Ideally
the plant material growing between trees and clusters of bushes or shrubs is grass
maintained at 6- inches or less.
Thin and remove lower branches of brush or shrubs within clusters or individual
plants to eliminate ladder fuel. Most of the shrubs that will be cut are vigorous
sprouting plants and the cut ends should be treated with a product named Garlon® or
an equivalent by a by person licensed to apply herbicides. Cut materials should be
either removed or chipped and spread.
3. Remove or chip all standing dead and deadfall within 100 -feet of all buildings on the
property.
New Construction:
I recommend that the design, materials and construction of buildings conform to the
design features and materials required by Pitkin County for safe construction in a high
wildfire hazard area as restated below:
Pitkin County has Structural Design and Construction Requirements, the following are
paraphrased from 3 -80 -070 Wildfire Hazard Areas and may not contain exact language
but it is intended to be consistent with the intent and purpose of the Pitkin County
Requirements.
Projections:
I recommend that no portion of the building(s) or addition(s) be constructed with
unenclosed projections such as decks. Eves should be kept to a minimum on the down
slope side and on the sides and should not have ventilation openings unless the design
and configuration of the openings are specifically approved by Pitkin County.
Projections may include, but are not limited to eaves; cornices; soffits; roofs over open
decks, cantilevered floors; bay windows; decks or balconies. Projections may cause heat
traps and should be protected as follows:
1. Any projection should be constructed with materials approved for one -hour
fire - resistive construction

2. An alternative construction for projections would require the use of non - combustible
building materials, or heavy timber or log construction. If the underside of the
projection is covered with materials approved for one -hour fire - resistive construction
and if there are no inside angles of less than seventy-fire (75) degrees. Areas below
projections should be void of vegetation or other combustible materials. The areas
below these projections shall be protected from accumulation of vegetative materials
by placement of a vegetative barrier covered with rocks or gravel or shall be concrete
or stone. There shall be no storage of combustible materials under projections. The
walls under projections shall be constructed of materials approved for one -hour fire-
resistive construction on the exterior side of the wall. Window openings in walls
below projections shall be tempered glass. Doors shall be noncombustible or one and
three- fourths inch (1 3 /4 ") solid wood.
Windows and Glass:
Glazed openings shall be provided with closing, solid, exterior non - flammable
shutters or shall be tempered glass.
Exterior Walls and Siding:
Siding and exterior wall construction shall have a minimum of one-hour fire-resistive
rating, ground level to roofline. Exterior doors shall be noncombustible or one and
three - fourths inch (1 % ") solid wood. If a hardscape patio and masonry wall has been
designed as a buffer, exterior doors having tempered glass may be used if approved
by the fire marshal.
Foundation:
Foundations, skirting and crawl -space openings shall be fully enclosed and
constructed with materials approved for one-hour fire-resistive construction on the
exterior side of the walls and shall extend from the top of grade to the underside of
the floor decking or walls.
Roofs:
Roofs shall be constructed with a Class A roof assembly as defined in the 2003
International Building Code (IBC) Section 1505.2 Wood shaketshingle roof coverings
are prohibited in all wildfire hazard areas. Roofs with less than a 3:12 pitch are not
permitted in wildfire areas unless they comply with the following:
1. All roof coverings shall be listed for installation as a part of the Class A roof
assembly.
2. All roof coverings shall have a surface that shall facilitate the natural process of
clearing the roof.
3. All roof designs shall facilitate the natural process of clearing the roof of debris.
Protrusions above the roofline, such as parapets, shall be prohibited.
4. Roofs shall be installed as required by the adopted building code and shall have a
minimum slope of 1:48.
5. All roof designs, coverings or equivalent assemblies shall be specifically
approved by the Fire Marshal prior to submittal of a building permit application.

6. Vents shall be screened with corrosive resistant wire mesh, with mesh one- fourth-
inch (' /a ") maximum.
Maintenance:
1. Roofs and gutters shall be kept clear of debris.
2. Yards shall be kept clear of all litter, slash and flammable materials and debris.
3. All flammable materials shall be stored on a parallel contour a minimum of
fifteen -feet (15') from any structure.
4. Weeds and grass within the fifteen -foot (15') perimeter and under trees, bushes
and brush shall be maintained at a height of not more than six - inches (6 ").
Miscellaneous:
1. Firewood/woodpiles shall be stacked on a parallel contour a minimum of fifteen -
feet (15') from any structure.
2. Swimming pools shall be accessible to the Fire Department.
3. Fences shall be kept clear of brush and debris.
4. Wood fences shall not connect to structures.
5. Any outbuildings or additional structures shall adhere to the same standards
described herein.
6. Each structure shall have a minimum of on one ten -pound (10#) Class ABC fire
extinguisher.
7. Addresses shall be clearly marked with two-inch (2 ") noncombustible letters and
shall be visible at the primary point of access from the public or common access
road and installed on a noncombustible post.
I also recommend a publication titled "Firewise Construction Design and Materials"
available from the Colorado State Forest Service.

2. APPLICANT understands and agrees that Pitkin County Ordinance No. 011 -2005 establishes a
fee structure for land use applications and the payment of all processing fees is a condition precedent to a
determination of application completeness. The fee structure is based on the County's policy that development
shall pay, in full, the cost of development review in Pitkin County. Fees have been set to be consistent and fair
to the public and to reflect the expense incurred in providing such services to the public.
3. APPLICANT and COUNTY agree that because of the size, nature or scope of the proposed
project, it may not be possible at the time of application to ascertain the full extent of the costs involved in
processing the application.
4. APPLICANT and COUNTY agree that fees charged for the processing of land use applications
shall accumulate if an application includes more than one type of land use review.
5. COUNTY and APPLICANT further agree that it is impracticable for COUNTY staff to complete
processing or present sufficient information to the Planning Commission and/or Board of County
Commissioners to enable the Planning Commission and/or Board of County Commissioners to make legally
required findings for project approval, unless current billings are paid in full prior to decision.
6. Therefore, APPLICANT agrees that in consideration of the COUNTY's waiver of its right to
collect full fees prior to a determination of application completeness, APPLICANT shall pay a base fee in the
amount of $ which is based on — hours of staff time, and if actual time spent by staff to process the
application exceeds the average number of hours by more than 20 %, then the COUNTY will bill the
APPLICANT quarterly for the additional time spent. Such periodic payments shall be made within 30 days of
the billing date. APPLICANT further agrees that failure to pay such accrued costs shall be grounds for
suspension of processing.
