JUL 13 20i� F�iticin Cour,:. �� On behalf of the Petitioner of the above referenced property (the "3ubject Proper[y"), this letter is intended as a petition for abatement or refund of taxes. The current year actual value is shown as $]0,649,400 ($3,015/sfl. I respectfully submit that the increase can't be supported by market conditions during the relevant time period and that the actual value should be adjusted and the petitioner entitled to a tax refund. Following, please find the reasons for my opposition to the increase in value: Subject Property: Located on a flat building sita of 5.73 acres, the Subject was built in 1978. It consists of 3,532 sf with 4 bedrooms and 3 baths. The assessor applied a construction rating of VGT 12. Without question, the Subject Property has spectacular Red Mountain views and is a valuable piece of property. The house itself, while in good condition, is over 30 yeazs old, has dated finishes and is functionally obsolete. If it had been marketed for sale and sold during the relevant time period, its attraction and value would be for the lot, not the improvements. I assert that the land value allocated by the assessor of $9,500,000 is excessive and the improvement value of $1,149,000 ($328/s� is excessive for a home that was built in ] 978 and has a VG 12+ � Baserating. `-�'�'wl%-'<`'_� - !•1l� : �� Analvsis-$/sf: While $/sf is not recognized as a method of valuing and comparing sales, it is used by appraisers and the assessor's as a sort of a measuring stick as a test of reasonability when looking at comparable sales. In this particular case, based on the assessor's valuation of the Subject property, the $/sf is over $3,000/s£ This should be a red flag to the assessor's office as there were no sales in the neighborhood of the Subject Property anywhere close to $3000/sf and the assessor has not valued any of the neighborhood comparables anywhere close to $3000/sf. For Example: Ig �iECENED JUL 13 2010 P+a"� The assessor's own valuations of neighboring homes displays a wide vaziation of values even r though there is a uniformity in the quality of the lots and age and quality of the homes on the 100-through 300 block East Reds Road. Reds Road and feature unobstructed views ofAspen Mt and Jhe City ofAspen. Odd numbered addresses (Subject Property) are on the North side and while the views are excellent, the view is not uttobstructed as they can see the homes across E. Reds Road and automobile traffic an E. Reds Road. Analvsis-LandValue: Since the Subject Property is 5.74 acres, I can only assume that the assessor deems the lazger size than the compazable properties as justification for the increased value. I acknowledge that the lazger lot size has aesthetic benefit but iYs economic value is questionable based on the fact that the Pitkin County land use code severely restricts the Floor Area Ratio ("FAR") in the R-30 zone district of Red Mt (see attached Pitkin County Zoning Districts definitions and Dimensional Requirements). It's important to note that in the R-30 zone district whether a property is 1 acre or 5 acres, the FAR is limited to 5,750 sf. Additional FAR can be added through the purchase of Transferable Development Rights ("TDR's) or allocation of additional square feet through the GMQS process. In any event, TDR's are costly and the GMQS process is also costly, lengthy and with no guarantee of success. In summary, there is no development benefit in the R-30 zone district for having a larger lot. The assessor has allocated a land value of $9,500,000 for the Subject Property, while 300 E. Reds (on the South side of Reds Road and with superior unobstructed views when compared with the Subject) has an allocated land value of $7,500,000. In my opinion, a more appropriate land value for the Subject is $8,000,000 when taking into consideration the aesthetic benefit of having 5.7 acres. Analvsis-Improvements: The assessor has valued the improvements at $328/sf. I assert that this is an excessive number for a property that was built in 1978. In fact, the assessor valued the improvements at 72 West Reds Road at $94/sf even though this property has the same � REr��v�� JUL 13 ?�17t1 Construction Quality rating as the Subject Property (VG 12+Base). Pm not saying the Subject'�iticin Cpurt , improvements aze worth $94-$100/sf, but given its age and quality, a more appropriate value is ��' $200/sf or $700,000-$750,000. Given the evidence presented herein, I assert that the Pitkin County Commissioners should reduce the Subject Property valuation &om $10,649,400 to $8,725,000 ($2,470/s� and abate the petitioner's property taYes accordingly.
