Pursuant to Subsection 4- 30 -50(i) of the Pitkin County Land Use Code, the Community Development Director of Pitkin County, Colorado ( "Director ") may approve a Temporary Commercial Use /Special Event Permit for commercial activities or special events. 2. The City of Aspen (hereafter, the "Applicant ") has applied to the Director for approval of a Temporary Commercial Use /Special Event Permit to conduct the Owl Creek Chase on February 13, 2011. The race will be staged from the Snowmass Nordic Center, proceed along Owl Creek Trail, and finish at the Aspen Valley Ski and Snowboard Club. Only a portion of the event occurs within Unincorporated Pitkin County. The event will run from approximately 8:OOAM — 4:OOPM. Approximately 200 -300 participants are expected as well as 70 staff and volunteers. 3. The Pitkin County Sheriffs Office, the Emergency Management Department and the Road and Bridge Department all approved this event. A Certificate of Insurance covering this event and naming the County as an Additional Insured has been reviewed and approved. 4. The Applicant has requested the use of the Owl Creek Trail and has obtained the required Special Event Permit from the Open Space and Trails Department. 5. The Director finds that, to the extent applicable, the application complies with the standards in Subsection 4- 30 -50(i) of the Land Use Code. THE DIRECTOR HEREBY APPROVES the Temporary Commercial Use /Special Event Permit for the 2011 Owl Creek Chase, subject to Applicant's compliance with each of the following conditions: All material representations made by the Applicant in the application (which shall specifically include representations made in all related supporting documents, correspondence subsequently provided by the Applicant, and representations made by phone), shall be adhered to, and considered conditions of approval, unless superseded by specific conditions in this Determination. 2. During the event, the Applicant shall place signs at all major road intersections (e.g., subdivision entrances /exits) warning motorists that there is a race in progress. Traffic marshals shall be present at all road crossings to facilitate the ability of race participants to cross intersections. 3. No emergency access shall be blocked. 4. Parking shall be on private property only. No parking shall take place on County roads. No parking shall take place in the rights -of -way. 5. Hired security and volunteers helping with all road crossings shall receive adequate training prior to the event. 6. Pennants, banners and posters advertising the event shall not be erected more than two weeks prior to the event and must be removed within two (2) days after the termination of the event. 7. Approval to hold this activity does not imply that extra services will be provided, nor does it place any additional liabilities on Pitkin County or its staff. 8. The Applicant agrees to hold harmless and indemnify Pitkin County and its staff from any liability for death, injury or property damage occurring as a result of this activity. 9. The Applicant shall supply all necessary manpower and equipment to safely conduct this activity. 10. The Applicant shall be responsible for any and all damage to County resources and/or facilities that result from this activity. 11. All Pitkin County ordinances and Colorado statutes apply. 12. The area in which the activity takes place shall be cleaned up and restored to its prior condition. 13. Pitkin County maintains the right and authority to amend or cancel this permit at any time should the Applicants fail to abide by conditions agreed to or if public health, safety and welfare so dictate. 14. The Applicant may be assessed an Impact Fee for extra services provided by Pitkin County. Payment, if required is due upon submittal of this application unless other arrangements have been made. 15. The Applicant must demonstrate possession of applicable permits at all times during the permitted activity and present such permits upon request. 16. No aid stations shall be allowed on the Moore Open Space. 17. The Applicant shall submit for and obtain a Special Event Permit from the Open Space and Trails Department for the use of the Owl Creek Trail. Applicant shall abide by all terms, conditions and stipulations as required in the permit. 18. All participants in the activity agree to abide by and obey all rules and regulations of Pitkin County Open Space & Trails and any other regulations that may apply. 19. Volunteers /security shall man all road crossings (Owl Creek Road, Maroon Creek Road) etc. during the race. 20. Permission from all private land owners along the course shall be obtained. 21. APPLICANT: City of Aspen (hereafter, "Applicant"). LOCATION: The 21 K race begins at the Snowmass Nordic Center, proceeds along the Owl Creek Trail and ends at the Aspen Valley Ski and Snowboard Club. REFERRAL COMMENTS: The application was referred to the Pitkin County Sheriff's Office (Tom Grady), Communications (Mark Gamrat), Emergency Management (Ellen Anderson), Open Space and Trails (John Armstrong), Risk Management (Kris Jewkes) and Public Works/Roads & Bridges (G. R. Fielding). Ellen Anderson signed off on the application for Emergency Management. Tom Grady reviewed and approved the application for the Pitkin County Sheriff s Office via Valerie McDonald. A Certificate of Insurance from the Applicant was reviewed and approved by Kris Jewkes, Risk Management. Ranger John Armstrong, Open Space and Trails, has issued a Special Events Permit for the Owl Creek Trail. The Applicant shall abide by the terms, conditions and stipulations as required in the permit. The application has also been submitted to Snowmass Village and the City of Aspen for separate permitting. STAFF COMMENTS: Pursuant to Subsection 4- 30 -50(i) of the Land Use Code, Applicant must demonstrate that adequate provisions have been made for all of the following: 1. Police supervision (if necessary); 2. Public parking; 3. Insurance; 4. Site set -up, maintenance and clean-up; 5. Emergency services; and 6. Safety of operations. Additionally, temporary structures must conform to applicable building codes and other County regulations. Each of these requirements is addressed, in turn, below. Police Supervision: No special provisions are deemed necessary. The Sheriffs Office has signed -off on the application. Public Parking: Parking will be provided at the Middle School lot with shuttles (recreational 15- passenger vans) to the start line at the Snowmass Nordic Center. The Aspen Country Day School bus will also be shuttling participants. RFTA's scheduled times will be provided online and ridership encouraged. RFTA has been alerted of possible increased ridership. Insurance: The Applicant has provided adequate proof of insurance. Site Set -Up. Maintenance and Clean -Up: The City of Aspen is responsible for any clean up required. Pennants, banners and posters advertising the event shall not be erected more than two weeks prior to the event and must be removed within two (2) days after the termination of the event. Emergency Services: The Applicant has provided a plan for dealing with emergencies during the races. This includes aid stations along the way staffed by individuals that are in radio or cell phone contact with each other as well as the race directors. Local emergency personnel will be notified of the event. Safety of Operations: There will be four aid stations, approximately 35 volunteers and a course Marshall. Each major road crossing and aid station will be equipped with a HAM radio operator in direct contact with the Chief of Medical. All road crossings will have crossing guards. The major road closure will have race Marshalls and TOSV officers. Signs and neighbor notices are put up in the Tiehack area and notices are published in the Snowmass Sun and other newspapers for the Owl Creek Road closure. Where does the race end?
