The Aspen/Pitkin County Airport ( "Applicant ") has applied to the Community Development Director of Pitkin County, Colorado ( "Director ") to amend Administrative Decision No. 95 -2009, which approved an air traffic control closed circuit camera system. The proposed amendments include: A. Increasing the height of the knoll on which the pole and camera system equipment rack are sited by a maximum of 7 feet, in order to screen the equipment rack from Highway 82, as represented in the original application. B. To increase the potential number of cameras from two to sixteen. 2. The property is located on Highway 82, west of Aspen and across from the Aspen Airport Business Center, and is more specifically described in Exhibit A. The camera tower is located on the top of an existing knoll near the south end of the runway between the runway and the highway. 3. The BOCC approved the 2004 Aspen/Pitkin County Airport Master Plan, pursuant to Resolution No. 057 -2004. The Master Plan identified relocation of the Air Traffic Control Tower ( "ATCT") as a recommended improvement at the Airport, pending further review. 4. The Community Development Director approved an amendment to the Master Plan and granted scenic view protection approval for an air traffic control closed circuit camera system, pursuant to Administrative Decision No. 95 -2009. 5. The equipment rack, as installed, is currently visible from the highway. The Applicant had represented that the equipment rack would be screened from the highway, and now proposes to change the grade on the knoll to accomplish the screening as represented. 6. The Applicant stated in the original application that there would be a total of two cameras mounted on the tower, based on information provided by the FAA at that time. The FAA has since refined the design and has identified the need to utilize multiple cameras to provide the required accuracy and redundancy in case of a system failure. Therefore, the FAA has determined that up to sixteen (16) cameras may be required, which includes a second redundant system. Eight test cameras are currently installed, and the actual number and arrangement of cameras required will be finalized once the testing period is complete. 7. The Director finds that the proposed amendments will not change the use of the proposed development or the basic character of the land, are consistent with action taken during the original review, and will enhance public safety and welfare by improving the air traffic control capabilities at the Airport. 8. The Director further finds that the additional grading to screen the equipment rack will have a minimal visual impact and will screen not only the equipment rack, but a little more of the lower portion of the camera tower. The Director further finds that the additional number of cameras is necessary to provide the system accuracy and redundancy that is required by the FAA, that the cameras provide a less intrusive alternative to improve the air traffic control system than constructing a new air traffic control tower, and that the visual impact of the cameras is minimal. THE DIRECTOR DOES HEREBY APPROVE an amendment to Administrative Decision No. 95 -2009, subject to the following conditions, which shall run with the land and be binding on all successors in interest: 1. The Applicant shall adhere to all material representations made in the application. 2. In the application provide for the administrative review it was represented that the equipment rack associated with the camera system would be screened from Highway 82 due to its location on the runway side of an existing knoll. The application also described the system as including two (2) cameras mounted near the top of the tower. As you know, the camera system equipment rack was installed late last year and is visible from Highway 82. The reason for this has to do with the topography in the area and the need to keep the rack no more than io feet from the pole in order to reduce the wire run length, thereby minimizing the potential for breakdown of the electrical signal from the cameras. When the application was being prepared we used available topographic data that appeared to show a greater change in the grade between the pole and proposed location for the equipment rack than actually existed. As a result, the equipment rack is at nearly the same elevation as the base of the camera tower. In an effort to honor the intent of the application we have developed a solution to screen the equipment rack from the Highway. The solution involves adding dirt to the existing knoll as shown in Figure 2. As Figure 2 shows, the height of the knoll would have to be increased by a maximum of 7 feet at the highest point. This solution was chosen because it provides the best screening for the lowest cost. The Airport is scheduled to begin construction on the runway extension project this spring. That project involves substantial earthmoving and bringing some additional dirt over to this area represents a minimal change to the overall runway extension project. Figures 3, 4 and 5, show what the change to the knoll would look like from three locations along Highway 82, including two locations from the northbound lanes and one from the southbound lanes. Figure 3 shows the view (both existing and proposed) from a location in the northbound lanes of Highway 82 which is nearly directly across from the camera pole. Figure 4 depicts the view from a location in the northbound lanes which is further to the south. Figure 5 shows the view from southbound lanes of the Highway at the point in front of the BMC West property. The approximate locations of the viewpoints depicted in these figures are shown on Figure t. We believe this solution results in the screening described in the original land use application while creating a minimal change in the visual character of the airport in this area. It also has the added benefit of screening a little more of the lower portion of the camera tower itself. The second issue has to do with the number of cameras that will be mounted on the camera tower. In the original land use application we stated that there will be a total of two (2) cameras mounted just below the top of the tower. This was based on information provided to us by the FAA at the time. Since then the FAA's Air Traffic Control Division has been refining the design for the system based on available camera technology. It should be noted that the concept of using closed circuit cameras as part of an air traffic control system is relatively unique and the process of designing the system has involved, and will continue to involve, some experimentation based on the specific site conditions at our airport. The design process has uncovered the need to utilize multiple cameras to provide the required accuracy and redundancy. As part of the design process the FAA plans to install and evaluate multiple camera configurations prior to determining the final type, number and arrangement of the cameras in the ultimate system. Based on the FAA's current analysis, the initial test system will be comprised of two rows of four (4) cameras for a total of eight (8) cameras a shown on Figure 6. These test cameras have been installed on the pole. When the testing period is complete (most likely this summer) and the FAA is satisfied with the information being provided in the Air Traffic Control Tower, the actual number and arrangement of cameras required will be finalized, and a redundant system will be installed. The total number of cameras per system is not expected to exceed eight (8) for a total of 16 (including the redundant system) though the final total would likely be fewer than 16 cameras. The test cameras that were installed two weeks ago have not been painted to match the tower since they may not be part of the ultimate system. Once the final system has been determined, the cameras will be painted to match the tower. REVIEW CRITERIA Section 2- 20- 15o(b) - Minor Amendments Defined Compliance with Section 2- 20- 15o(b) is addressed in the following paragraphs (actual code text provided in bold and italics). (t) is consistent with action(s) taken during previous development approvals for the property; and Response: The proposed additional grading is intended to honor the intent of the original approval which was to screen the equipment rack from Highway 82. Adding some additional earth to the existing land form resolves a situation created as a result of utilizing inaccurate topographic information in the original application. The change with respect to the number and arrangement of the closed circuit cameras is also consistent with the original approval in as much as the intent of the original application was to provide a less intrusive alternative for improving the air traffic control system than constructing a new air traffic control tower. The proposed increase in the number of cameras, although slightly more visible than the two cameras originally approved, still constitutes a dramatically less intrusive solution then a new air traffic control tower. Nor does either of the proposed changes constitute a new development activity. The approval granted via Administrative Decision No. 95 -2009 contemplated a change in how visual information is gathered for air traffic control at the airport by introducing closed circuit cameras as part of the system. Adding cameras, as currently proposed, is simply a design requirement to accomplish that purpose. (5) Does not increase off -site impacts in the surrounding neighborhood; and Response: The proposed grading is intended to reduce off -site visual impacts to the level contemplated in the original approval. Increasing the number of cameras on the pole will create a very minor increase in the visual impacts of the facility. One mitigating factor is that the cameras will be mounted on the runway side of the cameral mast, which is approximately 18 inches wide and will partially screen the cameras from Highway 82 and other off -site locations. (6) Does not endanger the public health, safety or welfare; and Response: The addition grading will have no effect on public health, safety or welfare. The changes to the camera numbers and configuration are being made specifically to increase public safety and welfare by creating the most reliable air traffic control system with the available technology. (7) Does not violate any Land Use Code standard; and (8) Does not substantially increase the need for on -site parking or utilities, or affect affordable housing generation; and (9) Does not increase the floor area of the use by more than five (5) percent or decrease the open space on the site by more than five (5) percent. Response: The proposed changes do not violate any Land Use Code standard and will not alter the need for parking, utilities or affordable housing. The changes do not involve any increase in square footage or any change in open space. The changes do not result in an increase in the height of the facility and the proposed grading is located outside of the required setback. SUMMARY The airport is seeking a minor change to two aspects of the approvals granted via Administrative Decision No. 95 -2009. The proposed changes are intended to honor the intent of the original approvals and have been shown to comply with the required standards in Section 2- 20 of the Pitkin County Land Use Code, which allows these changes to be approved administratively. The Aspen/Pitkin County Airport ( "Applicant ") has applied to the Community Development Director of Pitkin County, Colorado ( "Director ") to amend the 2004 Airport Master Plan and obtain scenic view protection approval for an air traffic control closed circuit camera system. 2. The property is located on Highway 82, west of Aspen and across from the Aspen Airport Business Center, and is more specifically described in Exhibit A. The camera tower is located on the top of an existing knoll near the south end of the runway between the runway and the highway, and the associated equipment rack is located on the runway side of the knoll. 3. The BOCC approved the 2004 Aspen/Pitkin County Airport Master Plan, pursuant to Resolution No. 057 -2004. The Master Plan identified relocation of the Air Traffic Control Tower ( "ATCT ") as a recommended improvement at the Airport, pending further review. 4. The Applicant has determined that the closed circuit camera system and camera tower will augment the existing ATCT and improve the air traffic control capabilities at the Airport, and avoids the need for a new ATCT. 5. The Director finds that the proposed amendment will not change the use of the proposed development or the basic character of the land, is consistent with action taken during the original review, does not increase the allowable floor area, and will enhance public safety and welfare by improving the air traffic control capabilities at the Airport. 6. The Director further finds while the tower is within the scenic view protection area and will break a ridgeline as seen from the highway, the visual impact has been minimized to the extent practicable by siting the tower on a knoll, which reduces the required height of the tower, and by the slim profile of the tower. 7. The Director further finds that: A. The 40' overall height (including tower, cameras and antenna) is necessary to provide the optimum viewing of the runway and the potential runway extensions, and the location and height provide the best horizontal and vertical angles to meet FAA requirements for air traffic control. B. The equipment rack is screened from view from the highway, due to location on the runway side of the knoll. C. The camera tower and equipment rack comply with the 100' highway setback. D. The location of the tower and rack is proximate to the existing airport perimeter road, so no driveway or parking area will be required for installation or maintenance. 8. The BOCC reviewed the application and heard a presentation on the alternatives to the camera tower at a regularly scheduled meeting on October 28, 2009, and directed staff to approve the request, based on the findings made herein.
