REVIEW, 1041 HAZARD REVIEW AND GMQS EXEMPTION

RECITALS
1. St. Benedict's Monastery ("Applicant") has applied to the Board of County Commissioners
of Pitkin County, Colorado ("BOCC") for Special Review and 1041 Hazard Review and GMQS
Exemption for an Essential Community Facility to comprehensively address planned improvements
over the next 20 years to the non-public facilities of the Monastery, in order to avoid further land use
review each time certain improvements are proposed.
2. The Monastery is considered a pre-existing use operating under a special review permit and
has been determined in the past to be exempt from GMQS as an essential community facility.
3. The parcels that comprise the Monastery property are located along Capitol Creek Road,
approximately 3 miles from the intersection of Capitol Creek and EastSopris Creek Roads, and are
more specifically described in Exhibit A.
4. The Applicant's two separate parcels are zoned RS-30 and contain approximately 3,500
acres.
5. The Planning and Zoning Commission ("Commission") reviewed the application at a
regularly scheduled meeting on March 2, 1999 and recommended approval with conditions.
6. The BOCC reviewed the application at a regularly scheduled meeting on March 24, 1999,
and a duly noticed public hearing on April 14, 1999, at which time evidence and testimony were
presented with respect to this application.
7. The BOCC finds that the application is generally consistent with the applicable provisions of
the Code.
NOW, THEREFORE, BE IT RESOLVED by the BOCC that it does hereby approve the
St. Benedict's Monastery Special Review, subject to the following conditions which shall run with

the land and be binding on all successors in interest, with the exception of the vested rights provided
for in condition 47 below:
1. The Applicant shall submit a 1041 hazard review site plan on a 24 x36 inch mylar sheet to
the Community Development Department for approval and recording, prior to submission of
any building permit applications. The site plan shall also be submitted in digital format
suitable for integration into the County's GIS system. The site plan shall be modified as
follows:
A. Amend the designated "zones" to exclude severe wildfire hazard areas.
B. Include signature blocks for the owner, the Chair of the Board of County
Commissioners and the Clerk and Recorder.
C. Include the following disclaimer on the site plan: "1041 environmental hazard areas
exist that might affect the property, any improvements, and the use and occupancy
thereof."
2. By August 1, 1999, the Applicant establish a plan to be approved by the Environmental
Health Department to bring all sewage disposal treatment systems up to the minimum
Pitkin County standards, including abandonment of the existing outhouses and
replacement with approved systems and upgrading of existing systems as necessary.
3. The Applicant shall comply with the following wildfire hazard mitigation for the various
zones:
A. Monastery (Zone 1): For a distance of 10 feet around all structures, establish and
maintain vegetation of 6 inches or less (i.e. hardscape, lawn, or low growing
perennials). Flammable materials shall be stored outside of this perimeter.
B. Retreat Center (Zone 2): Continue to comply with the provisions of Resolution
No. 92-382 regarding wildfire mitigation.
C. Ranch House/barns/corral (Zone 3): Mow grass around all structures.
D. Gobbo property/Schoolhouse/Stanley property (Zone 4): Mow native grasses
and clear any woody vegetation within 10 feet of all structures.
E. Flattop Hermitage (Zone 5): Mow native grasses around the structure.
F. McCartney Hermitage: Thin the existing aspen for a distance of forty feet into
the stand, and maintain a minimum of 10 feet between the edges of the tree
crowns. Remove lower limbs on the remaining trees to eliminate ladder fuels.
Mow the surrounding area periodically to minimize flashy fuels.
G. Gates property (Zone 7): Mow grass around all structures.
4. The Applicant shall comply with the following wildlife mitigation:
A. Dogs, excluding working ranch dogs, shall be prohibited in Zones 2 and 3, and in
the area south of the existing Monastery in Zone 1.
B. Removal of native vegetation shall be prohibited unless it is for the purposes of
wildfire mitigation, agricultural practices, or wildlife management.
C. Adhere to a minimum of a 20 foot setback from the high water line of Capitol
Creek and Lime Creek.
D. Continue to allow access to the property by personnel of the Colorado Division
of Wildlife for wildlife management and inventory purposes.
E. Fencing shall be limited to that necessary for agricultural or ranching purposes.

F. Bear -proof trash containers shall be utilized to minimize the chance that human -
bear conflicts occur.
5. All conditions of Resolution No. 92-382 shall remain in effect.
6. The Applicant is not required to commence the proposed improvements within 12 months
of the date of this approval, but the Applicant shall submit reports every five years on the
date of this approval attesting to any progress in completing the improvements.
7. The Applicant shall have vested rights for the following improvements for a period of 20
years from the date of this approval as the BOCC finds that such extended vesting period
is warranted in light of all relevant circumstances, including the size and phasing of the
development as it relates to this specific Applicant. This vested right is specific to the
ownership and use of the land by the St. Benedict's Monastery and shall not run with any
portion of the land that is sold to any entity other than the Monastery. A maximum of
15,000 gross square feet shall be available for all improvements undertaken within the
designated zones during the 20 year period of vested rights for this special review
approval as listed below, but not including the proposed West Wing Addition to the
Monastery and any new agricultural buildings.
A. Construction of the approximately 9,600 square foot West Wing Addition to the
Monastery, which incorporates additional space for the monks, including bed
space, office and conference space, a kitchen, a library, an exercise room and
storage space;
B. Completion of the Cloister;
C. Modifications to the Eggery;
D. Expansion of the Greenhouse;
E. Addition of a utility/maintenance shed within the building envelope established for
the Retreat Center;
F. Construction of additional maintenance facilities in the area of the ranch yard;
G. Stabilization or rehabilitation of the Gates barn and cabin.
H. Improvements not listed that are incidental to the direct operation of the Monastery
(such as garages and agricultural buildings). New habitable structures or
commercial spaces shall not be considered incidental improvements.
I. Rehabilitation, refurbishing or limited expansion of any buildings, including the
Flattop Hermitage, the McCartney Hermitage, the Gobbo cabins, the
Schoolhouse, the Ranch House and the dwelling on the Stanley property, subject
to approval by the County for any exterior modifications, if required according to
the Land Use Code regulations regarding historic buildings in effect at the time
of the request for said rehabilitation, refurbishing or expansion.
8. Further land use review shall be required for the following improvements/activities:
A. Additional housing for Monastery employees;
B. Construction of new public retreat facilities;
C. New commercial operations;
D. Ridgeline/scenic overlay review for exterior remodeling or expansion of the
McCartney Hermitage;
E. Uses not listed.
F. Removal or relocation of hi tore build ngs.

9. All material representations made by the Applicant in the application or in public
meetings shall be adhered to and considered conditions of approval, unless amended by
other conditions.
