COLORADO, GRANTING APPROVAL TO RAYMOND AND CAMILLA AUGER FOR AN
ATTACHED CARETAKER DWELLING UNIT

RECITALS
1. Raymond and Camilla Auger ("Applicant") have applied to the Pitkin County Board of County
Commissioners ("BOCC") for approval of an attached caretaker dwelling unit.
2. The property is located on North Spruce Street (a private extension of Spruce Street), north of the
Williams Ranch and Silver Lode Subdivisions, and is more specifically described in the attached
Exhibit A.
3. The Applicant proposes to deed restrict the proposed caretaker dwelling unit pursuant to Section 3-
150.130(B), Caretaker Dwelling Units, and Section 3-210.10, Special Review, of the Pitkin County
Land Use Code ("Code").
4. The BOCC heard this application at a duly noticed public hearing on May 26, 1999, at which time
evidence and testimony were presented with respect to the application.
5. The BOCC has determined that the caretaker dwelling unit meets the standards established in
Section 3-150-130 of the Land Use Code.
NOW, THEREFORE BE TT RESOLVED by the Pitkin County Board of County Commissioners
that it does hereby grant approval to Raymond and Camilla Auger for an attached caretaker dwelling unit,
subject to the following conditions which shall run with the land and be binding on all successors in
interest:
1. The Applicant shall adhere to all material representations made in the application and public
meetings.
2. The Applicant shall comply with all conditions of the Hearing Office Determination No. 99-2,
unless otherwise replaced or amended by the conditions of this approval.
3. Prior to the submittal of any building permit applications of the caretaker dwelling unit, the
Applicant shall record a deed restriction for the caretaker dwelling unit with the Housing Office.
Floor plans for the unit shall be provided to the Housing Officer when the deed restriction is
submitted.
4. Housing Office staff shall inspect the unit prior to issuance of a Certificate of Occupancy.
5. The kitchen unit shall contain at least a two -burner stove with oven, a standard sink, and no less
than a 6 cubic foot refrigerator plus freezer.

6. The caretaker dwelling unit shall not exceed 700 net livable square feet as calculated by the
Aspen/Pitkin Housing Authority.
7. The vested rights associated with the approval herein shall expire on May 26, 2002.
