Dear Roger Neal
The purpose of this letter is to sumtnarize the pertinent terms of Pitkin County's arrangement
with you to provide the specified services enutnerated in the following paragraph. The
County's obligation under the Wai�kers' Compensation Statute requires Pitkin County and
you to formalize the terms of this engagement in a notarized writing.
As attached in High Country Engineering proposal
It is mutually agreed that the County does not have an exclusive right to your services and it
is contemplated that you may provide similar work to other businesses, govemments and
non-profit organizations. You acknowledge that the work performed for Pitkin County will
be that of an independent contractor and that no employee-employer relationship is created.
You have full control over how the services aze performed and it is expected that work will
be conducted in accordance with industry standazds by applying professional judgment. The
County will provide, if necessary, documents and information to complete the work
described in the preceding paragraph. The County representative signing this letter is
available to you to discuss any details related to this engagement. This letter of engagement
will terminate on December 31 and will require a new document in succeeding years to be
effective. You acknowledge and agree that you shall not be entitled to workers'
compensation beaefits in connectton with this project and that you shall be responsible
for the payment of all state and federal income taxes.

A. In compliance with House Bi1106-1343 and House Bi1107-1073 amending
Title 8 of the Colorado Revised Statutes by the addition of Article 17.5, Illegal Aliens-Public
Contract for Services, enacted by the General Assembly of the State of Colorado, the
Contractor shall not:

Knowingly employ or contract with an illegal alien to perform work
under this contract or;
2. Enter into a contract with a subcontractor that fails to certify to the
Contractor that the subcontractor shall not knowingly employ or
contract with an illegal alien to perform work under this contract.
B. In compliance with House Bill 06-1343 and House Bi1107-1073 enacted by the
General Assembly of the State of Colorado:
l. The Contractor has confirmed or attempted to confirm the employment
eligibility of all employees who are newly hired for employment in the United States
through participation in the Basic Pilot Progam [created in Public Law 208, 104th
Congress, or its successor and expanded in Public Law 156, 108` Congress, or its
successor, that is administered by the United States Department of Homeland
Security] and, if the Contractor is not accepted into the Basic Pilot Program prior to
entering into this contract, tfie Contractor shall apply to participate in the Basic Pilot
Progam every three mqnths,un�il the Contractor is accepted or this contract has been
completed, whichever is earlier` This provision shall not be required or effective if
the Basic Pilot Program is discontinued.
2. The Contractor shall be prohibited from using Basic Pilot Program
procedures to undertake pre-empioyment screening of job applicants while this
contract is being performed.
3. If the Contractor obtains actual knowledge that a subcontractor
performing work under this contract knowingly employs or contracts with an illegal
alien, the Contractor shall be required to:
a. Notify the subcontractor and the County within three days that
the Contractor has actual knowledge that the subcontractor is employing or
contracting with an illegal alien; and
b. Terminate the subcontract with the subcontractor if within
three days of receiving the notice required pursuant to subparagraph (a) of this
pazagraph (3) the subcontractor does not stop employing or contracting with
the illegal aliens; except that the Contractor shall not terminate the contract
with the subcontractor if during such three days the subcontractor provides
information to establish that the subcontractor has not knowingly employed or
contracted with an illegal alien.
4. The Contractor shall comply with any reasonable request by the Department
of Labor and Employment made in the course of an investigation that the Department of
Labor and Employment is undertaking pursuant to the authority established in Subsection
(5) ofC.R.S. § 8-17.5-102.

Fiigh Councry Engineering, Inc. (HCE) is pleased w prepaze the followiag proposal for
providiag the land surveying and civil engineering services for the Home Supply Ditch
project located in Pitkia County, Colorado.
Based on your request for proposal, you would like HCE to perform a topographic survey as
well as hydraulic azialysis recommendarion of an appropriau road crossing saucture for
Home Supply Ditch at Sopris Creek Road.
These services will be performed one time unda chis proposal. Our services aze described
more specifically ac follows:
1. Topo�apLic Sarreyias and Mzppin;. HCE shalt perform a topographic survey of
the Home SuppIy Ditch 2�Q-feet ups�eam and downstreazn of the crossing at 5opris
Creek Raad. The survey wiIl include cross-sectioning of the ditch, as-built any
cutverts, pipa, head graces, locatiag fences, roadway limirs, surface ntilitLes, and any
othtr surface improvements within the rightof way. An e�cisting coaditions map will
be pmpared at a suitabk sca(e showing the mapped improvemenu. This map will be
the basis for subsequeat engineering design.
2. FIyBraulic Calculations. HCE shaIl perform hydraulic calculations far che Home
Supply Ditch. The analysis will be based upan two (Z} tlow rates: the decteed rate of
56 cubic feet per s�ond and che anticipated ma�dmum rate of 75 cubic feet per
second. The aaalysis will include verification of adequate channel capacities
upsueam and downstream of Sopris Creek Road. The analysis will also include
verification of adequate culvtrt capacity beaeath Sopris Cretk Road. HCE will
prcpare a report containing resulu of the calculations and no[e any defiamaa in the
caleulaud capacitia.

3. Strnctnre Recommendations. If the hydrauiic caiculations performed by HCE
indicate deficiencies in capacities of the existing channeI or culvert, then
recommendations for the construction of structures will be prepazed. The
recottimendations will incorporate the physical constraints of the site including:
right-of-way limits, topography, and road deazance limitations. Various types of
strudures will be evaluaLed to achieve an acceptable balance in tmns of
performance, crost, safety, durabi7ity and construccability. HCE w�1( prepare a report
containing a summary of structure recommendations with schematic detaiLs of the
recommended structures.
4. Meetings and lteprodna'ble Fapeases. The Project Manager or Senior Project
Managez will be avaiIable for meetings and coozdination with the various agencies,
co-consultanu, and Client/Owner or the appointed representaiive for the
Client/Owner. It is anticipated that two (2) meetings may be necessary. No written
authorizations will be necessary for this task for each mceting. AtI reproduction
expenses wilI be included within the budgetary allowance for these services.

This proposal does not include work for any of ttze following items: preliminary design, final
design, easement documcnt prrparation, off-site utiliry maia design, access permits, 404
permir work (wetlands), ground water cvaluation, retaining wa11 design, structural design,
water tights research, weil perrnitting, soils or geological investigations, environmental
studies, septic des�gn, bidding, contract admiaistration, construction management,
consuuction obscrvation, legal aotification or publications, iaigation system improvemeats,
&re pzotection plans, sprinkler systems, evaporation beds, cost estimates, foundation under
drain piains, excavation stabilizarion plans, construction znanagemrnt Plan, State of
Colorado Storm Water Management p1an, or other special or unusuai zequsements. If
necessazy, this work can be rnmpleted under future contracts or for sgecialized s[udies a
recoa�mendation for an appropriate consultant will be provided.
