RECITALS
Mark and Karen Hedstrom (hereafter referred to as "Applicants ") have applied to the Community
Development Director of Pitkin County ( "Director") for Site Plan approval for construction of additions
to an existing residence. The Applicants are desirous to utilize an existing vested envelope for development
totaling 5,750 square feet.
1. The Lot is located at 9555 Castle Creek Road and is legally described as Lot 1 of the BOCC
approved HES Subdivision. The Lot is within the AR -10 zone district and is approximately 21 acres.
P1D#: 290919102001.
2. The HES 305 Subdivision is a two lot subdivision that was approved pursuant to BOCC
Resolution No. 80 -7 with the Final Plat recorded at Plat Book 8 at Page 77. The Lot contains an
existing residence that received a Certificate of Occupancy in 1982. The Hearing Officer approved
an Activity Envelope, Site Plan, and Special Review for a TDR Receiver Site for development up to
8,250 square feet pursuant to Hearing Officer Determination No. 06 -2008 (Reception No. 550177).
The Site Plans were recorded at B87 P69 -70 (Rec. No. 550177).
3. Though the Lot has approval to construct floor area up to 8,250 square feet, the Applicants intend to
develop only 5,750 square feet of floor area-
4. The property is mapped within a scenic view protection area as viewed from the Castle Creek Road,
a mapped scenic corridor.
5. The Environmental Health and Natural Resources (EH/NR) Department commented on the
application and agreed with the Applicants' septic consultant who recommended additional tank
capacity and secondary treatment while utilizing the existing absorption field.
6. The Aspen Fire District commented on the proposal and states that due to location of the residence,
any structures, regardless of size, shall have approved sprinkler systems. These comments are
consistent with prior comments made in 2008 and implemented in Hearing Officer Decision No. 09-
2008.
7. The affidavit of public notice was mailed on March 3, 2011 to the adjacent property owners of the
subject parcel. No objections were received within 30 days. Public notice was published in the
paper on March 13, 2011.
8. The Director finds that the site proposed for development meets the criteria for site plan review,
specifically sections 7 -20 -10 and 7 -20 -130.

The Applicant shall adhere to all material representations made in the current or prior applications or
in public meetings or hearings and shall consider those representations to be conditions of approval,
unless amended by other conditions.
2. No calculations for height, bulk, setback, size, floor area, or any other building and zoning
requirements have been conducted. These requirements will be considered at the time of building
permit review. Structures represented in the application may not be permitted under building and
zoning regulations.
3. Prior to submission of any future building permit applications, the Applicant shall submit for
approval by the County Attorney and Community Development an amended site plan in
accordance with 2.1.12of the Pitkin County Land Use Application Manual. The above referenced
approvals shall be a condition precedent to finalization and recordation.
4. The Applicant shall comply with Hearing Officer Determination No. 06 -2008 (Reception No.
550177) unless otherwise amended by this approval.
5. Condition 45 shall be rescinded and amended to read "At building permit submittal for the new
residence, the Applicant shall: ".
6. Condition #5(G) — the following language shall be rescinded "The existing system shall be properly
abandoned, if it is not retained to serve the barn
7. Statutory vested rights for the approval contained herein are granted pursuant to the Pitkin County
Land Use Code and Colorado Statutes, subject to the exceptions set forth in Pitkin County Land
Use Code, 2-20-170 and CA-S, § 24 -68 -105. The statutory vested rights granted herein shall
expire on ]n r I orl , 2014.
8. Failure to comply with the conditions of this approval may result in revocation of this approval, or
any subsequent permit(s) or approval(s) related to this property, or vested rights associated with
this property.

Type of Application: Site Plan Review
Description of Project/Development: The Applicant is requesting site plan approval for an addition to an existing single
family residence with vested rights. The Lot received Activity Envelope, Site Plan, and Special Review for TDR's up to
8,250 square feet pursuant to Hearing Officer Determination No. 06 -2008 (Rec. No. 550177).
The Applicant has indicated a desire to not construct the 8,250 square feet residence approved in the above mentioned site
plan but rather construct additions to the existing residence that total less than 5,750 square feet. From review of the
recorded site plan, it appears that the previously approved activity envelope can be used but that site plan approval is needed
prior to submission of a building permit.
The Applicant should show the location of the expanded septic field, realigned driveway, and other improvements needed
for the additions.
Land Use Code Sections to be addressed in letter of request (application):
Sec. 2- 30- 20(g): Site Plan Criteria for Approval;
Sec. 7- 10 -50: Site Plan;
Sec. 7- 20- 120(d): Standards for Scenic View Protection Areas;

Staff will refer the application to the following agencies: Aspen fire Department, Maroon/Castle Creek Caucus, and
EH/NR.

Public Hearing: No. The Applicant shall post a public notice sign on the property at least 15 days prior to the date
specified for the Administrative Decision pursuant to Sec. 2- 20- 100(a)(3) of the Land Use Code. In addition, the
Applicant shall mail notice (by certified mail) to all adjacent property owners and mineral estate owners with the return
address of the Community Development Department (form of notice to be obtained from the Community Development
Department). The names and addresses shall be those on the current tax records of Pitkin County, as they appear no more
than 60 days prior to the date of the public hearing. A property owner receiving the public notice shall have 2 weeks
from the date the notice was postmarked to submit comments or objections to the Community Development Department.

AGREEMENT FOR PAYMENT OF LAND USE APPLICATION FEES
PITKIN COUNTY (hereinafter "COUNTY ") and jWAV.X
(hereinafter "APPLICANT ") AGREE AS FOLLOWS:

2. APPLICANT understands and agrees that Pitkin County Ordinance No. 30 -2009 establishes a fee
structure for land use applications and the payment of all processing fees is a condition precedent to a determination of
application completeness. The fee structure is based on the COUNTY'S policy that development shall pay, in full, the
cost of development review in the COUNTY. Fees have been set to be consistent and fair to the public and to reflect the
expense incurred in providing such services to the public.
3. APPLICANT and COUNTY agree that because of the size, nature or scope of the proposed PROJECT, it
may not be possible at the time of application to ascertain the full extent of the costs involved in processing the
application.
4. APPLICANT and COUNTY agree that fees charged for the processing of land use applications shall
accumulate if an application includes more than one type of land use review.
5. COUNTY and APPLICANT further agree that it is impracticable for COUNTY staff to complete
processing or present sufficient information to the Planning Commission and/or Board of County Commissioners to
enable the Planning Commission and/or Board of County Commissioners to make legally required findings for project
approval, unless current billings are paid in full prior to decision.
6. Therefore, APPLICANT agrees that in consideration of the COUNTY'S waiver of its right to collect full
fees prior to a determination of application completeness, APPLICANT shall pay a base fee in the amount of $ 3 /
which is based on 1rhours of staff time, and if actual time spent by staff to process the application exceeds the average
number of hours by more than 20 %, then the COUNTY will bill the APPLICANT quarterly for the additional time spent.
Such periodic payments shall be made within 30 days of the billing date. APPLICANT further agrees that failure to pay
such accrued costs shall be grounds for suspension of processing.

In 2008, The Owner's, Mark and Karen Hedstrom, received approval for Activity
Envelope, Site Plan and Special Review for TDR's up to 8,250 square feet per Hearing
Officer Determination No 06 -2008 (Rec No 550177). They now desire to renovate and
add onto the existing residence for a total less than 5,750 square feet. The existing home
was built in 1982.
Section 7 -10 -50 Site Plan: the previous 2008 approval defined Activity Envelopes that
took into consideration all the "constrained areas" that are part of this lot. The constraints
are the following: Blue Zone Avalanche, 100 foot setback from an intermittent stream
and setbacks from Castle Creek Road and Castle Creek. The attached Site Plan
maintains these existing activity envelopes to reflect the same constraints. They are
mostly in the exact location as shown previously except we removed the ISDS envelope
that was created for the larger home and incorporated miscellaneous envelopes like
"horse pasture" into the overall extents of Activity Envelope #1. Also the West boundary
more closely follows the 100' setback from the mapped intermittent stream. All
development will occur within these Activity Envelopes.
Section 7 -20 -120 (d) Scenic View Protection: This home is located on Castle Creek Road
and is subject to the criteria listed in this section. The attached photos show the existing
from the only location on Castle Creek Road where you can get a glimpse of the
structure. It is well screened by the existing aspen trees. (7 -20- 120 -d -1). The new
addition's height and bulk will not be greater than the existing home. Most of the bulk of
the addition will be on the northwest side of the home and therefore out of view from the
corridor (d -3). It is not silhouetted against the sky (d -4). The proposed development will
use natural materials and colorings and the roof will be made of non reflective material
(d -5, 11, 12). The proposed addition will preserve natural vegetation and avoids irrigated
meadows (d -7). Utilities are non - visible from Castle Creek Road (d -7). Satellite dishes'
visual impact will be minimized by painting them in earth tone colors. There are existing
dishes on the home (d -8). There will be no earth berms required to screen the home (d -9).

All disturbed area will be re- vegetated using native species (d -13). The existing
driveway is located at the edge of the meadow. Where it meets the property it enters the
aspen grove. The existing driveway's path will not be altered unless the Fire Department
requires it to be widened or a turn out built. Activity Envelope #2 is 30 wide to anticipate
if any work on the driveway is required (d -14).
Section 7 -20 -120 (e) Rural Character Guidelines for Building Location: the existing
home and proposed addition meets this guidelines section (2) by being located behind
and existing stand of aspens. Please refer to the photo taken February 2, 2011. In the
summer the home is almost completely screened by the leaves.
Section 7 -20 -130 Landscaping and Vegetation Protection: The addition meets all the
criteria listed in this section. The natural vegetation will be protected and maintained.

ALL SERVICE septic, LLC has reviewed the current OWS conditions and has determined that with
the use of a new septic tank, secondary treatment, and a pump the existing drain field may be utilized
for the proposed construction.
The existing drain field has approximately 1600SF as permitted in 1982. The drain field has existing
observation pipes, and is constructed with pipe and gravel. All observation pipes were dry during our
last observations. The drain field is functioning normally.
Due to the increase of the total number of bedrooms (5 total bedrooms proposed) a new concrete
septic tank with secondary treatment and a pump (to dose drain field) will be proposed. The existing
septic drain field will be utilized in the area that it currently lies.
LIMITS:
This review design is based on information submitted. If conditions encountered are different from
conditions described in report, ALL SERVICE septic, LLC should be notified. All OWS construction
must be according to the county regulations. Requirements not specified in this report must follow
county regulations. The installer should have documented and demonstrated knowledge of the
requirements and regulations of the county in which they are working.

DISCUSSION The Pitkin County Environmental Health Department has reviewed the details
of the Hedstrom Site Plan Review application under the authority of the Pitkin County Land Use
Code and the Pitkin County Onsite Wastewater Treatment System (OWTS) Regulation and has
the following comments.
On April 8, Michael Kraemer and Carla Ostberg from the Pitkin County Community
Development Department conducted a site visit to the property.
- -- WATER SUPPLY
The residence is currently served by a private well. No well permit was provided in the
application; however, in connection with any OWTS Construction Permit for the property, this
Department will require a copy of the well permit issued by the Colorado Division of Water
Resources.
— SEWAGE TREATMENT AND COLLECTION:
The current residence is served by an OWTS. Individual Sewage Disposal (ISDS) Permit
82017 documents a system sized to accommodate a 2 bedroom home. This system was
designed by an engineer and the permit was finalized by this Department; however, in reviewing
the file, it is noted that groundwater was found at 48" below the ground surface. The engineer
had specified that the "absorption bed elevation was to be placed not more than 1.5 feet below
the residences top of footing..." and subsequent to final site observation indicates that "...the
Contractor made evident that the entire seepage field was constructed in the existing ground
and was not partially mounded as previously believed." The existing system utilizes 1250
gallons of tank capacity and gravity feeds to a distribution box and 1656 square feet of pipe and
gravel absorption bed area. In order to accommodate a 5 bedroom home under current
regulation, there must be at least 1406 gallons of tank capacity and 1336 square feet of
absorption area.
A letter from All Service Septic, LLC dated January 31, 2011 proposes to add tank capacity and
secondary treatment while utilizing the existing absorption area. The addition of secondary

treatment will result in cleaner effluent and is a recommend addition to this system due to the
fact that high seasonal groundwater is present and it is not completely clear if this factor was
adequately addressed through the permitting and system installation process in 1982. These
proposed changes will allow use of the existing absorption area and enhance treatment of the
effluent entering the absorption area.
The County cannot issue a Building Permit until an OWTS Construction Permit has been
obtained.
