HomeMy WebLinkAboutbocc.res.106.1999RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY, COLORADO, GRANTING MAJOR PLAT AMENDMENT AND LOT LINE ADJUSTMENT APPROVAL TO THE GILMORE/ADGER AMENDMENT TO THE LITTLE ELK CREEK SUBDIVISION Resolution No. 99- / 0 6 RECITALS 1. Harvey Gilmore and Allen Adger ("Applicant") have applied to the Board of County Commissioners of Pitkin County, Colorado ("BOCC"), for approval of a major plat amendment and lot line adjustment pursuant to the Pitkin County Land Use Code. 2. The subject property is located in the Little Elk Creek Subdivision and is described as Lot 12 and Lot 13, Little Elk Creek. 3. The Planning and Zoning Commission reviewed this application on April 6, 1999, and directed staff to forward a recommendation of approval to the BOCC. 4. The BOCC heard this application at a regularly scheduled public hearing on May 26, 1999, at which time evidence and testimony were presented with respect to this application. 5. The BOCC determined that the proposed activity meets the applicable criteria established in the Land Use Code, provided the conditions listed in this resolution are adhered to. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Pitkin County, Colorado, that it does hereby grant approval of the Gilmore/Adger major plat amendment and lot line adjustment, subject to the following conditions which shall run with the land and be binding on all successors in interest: 1. The Applicant shall prepare a final plat in accordance with Land Use Code Section 5- 40. The plat shall be recorded prior to submission of any building permit applications. The plat shall be identified as the "Revised Plat of Lots 12 and 13, Block 1, Little Elk Creek Subdivision" " The plat shall also be submitted in a digital format for integration into the County Geographic Information System. 2. All material representations made by the Applicant in the application shall be adhered to and considered conditions of approval. 3. The additional access off of Capitol Creek Road on Lot 13 shall be for moving horses or other livestock on and off the property or for other permitted uses only. An access permit shall be obtained from the County Engineer prior to construction of the new access. 4. This new access from Capitol Creek Road shall not be allowed to continue beyond the boundaries of Lot 13 so as to constitute a new access to the subdivision. 5. The Gilmore Parcel (Lot 12) shall be deed restricted against any increase in floor area resulting from the increased parcel size. This restriction shall be approved by the County Attorney's Office and recorded prior to recordation of the revised plat. 6. The statutory vested rights associated with this approval shall expire on May 26, 2002. NOTICE OF PUBLIC HEARING PUBLISHED IN THE ASPEN TIMES WEEKLY ON THE 24th DAY OF APRIL, 1999.
