COUNTY, COLORADO, GRANTING A TEMPORARY USE PERMIT FOR CAMPING ON THE
STAPLETON PROPERTY FOR THE ASPEN HARMONY FESTIVAL ON AUGUST 6-8, 1999
AND AMENDING CERTAIN CONDITIONS OF RESOLUTION NO. 98-218

RECITALS
1, The Wolfs Den Foundation and The Howling Wolf, ("Applicant") have applied to the Board of
County Commissioners of Pitkin County, Colorado ("BOCC") for approval of a Temporary Use Permit to
allow camping on the Stapleton property adjacent to Buttermilk on Friday, Saturday and Sunday, August 6-
8, 1999, during the Aspen Harmony Festival.
2. The Applicant also requests to amend a condition of Resolution No. 98-218 to change the
requirements for the submission of letters of credit.
3. The Applicant has obtained permission to use the property from Craig Stapleton, the owner.
4. Pursuant to Section 3-200-030 of the Land Use Code, the Community Development Director
("Director") may permit the temporary use of land in the County for special events and commercial
activities, if adequate provision has been made for police supervision, if necessary; public parking;
insurance; site set-up maintenance and clean-up; emergency services; and safety of operations.
5. Due to the nature of this request, the Director opted to forward this request to the BOCC for
approval.
6. The BOCC considered the Applicant's request at a public meeting on June 29, 1999, at which time
the BOCC found that the request for camping on the Stapleton property meets the requirements of the Land
Use Code.
NOW, THEREFORE, BE IT RESOLVED by the BOCC that it does hereby grant a Temporary
Use Permit for camping on the Stapleton property for the Aspen Harmony Festival, subject to the following
conditions:

1. This temporary use permit is issued to allow camping for the Aspen Harmony Festival on the
Stapleton property adjacent to Buttermilk on Friday, Saturday and Sunday, August 6-8, 1999, for a
maximum of 2,000 people.
2. At least 4 weeks prior to the festival (by July 9, 1999), the Applicant shall:
A. Submit, and the Risk Manager shall review and approve, insurance for the camping area.
B. Submit written verification that the terms of the Mediation Agreement have been complied
with, or if certain items have not been accomplished, provide a written agreement as to how
and when the terms will be met.
C. Stake the wetland areas that will be fenced during the festival. Coordinate with CDOT and
the Aspen Skiing Company to ensure that the staking does not conflict with any stakes they
may have placed on the property.
D. Submit a signed contract to provide transportation services.
3. The Applicants shall comply with the conditions required by CraigStapleton in his letter to Paul
Levine dated April 26, 1999.
4. The Applicant shall designate the 250 parking spaces on the Stapleton property for campers only.
Those vehicles shall remain parked for the duration of the festival, to minimize traffic in and out
of that parking area.
5. The Applicant shall designate a pedestrian crossing from the camping and parking areas on the
Stapleton property across to Buttermilk in order to minimize the disturbance to through traffic on
West Buttermilk Road.
6. To avoid adverse impacts to the wetlands, the Applicant shall:
A. Erect a 6' or greater chain link fence set back a minimum of 20' from any wetland or wet
area on the property. These areas will be established by the County Wildlife Biologist or an
independent wetland consultant approved by the Wildlife Biologist.
B. Restore any vegetation damaged by the camping to its original state by planting mature
plants and saplings. Seeding will only be acceptable for grassy areas. Plant species used
for revegetation shall be approved by the Wildlife Biologist.
C. Mitigate any jurisdictional wetlands negatively impacted at a proportion of 5:1 in area. The
location for the mitigation shall be selected by the Wildlife Biologist.
7. All music in the campground shall cease by 11:00 PM.
8. The Applicant shall adhere to all material representations made in the application and in the public
meeting.
BE IT FURTHER RESOLVED by the BOCC that it does hereby amend Resolution No. 98-218
as follows:

Condition #F4 shall be replaced with the following The Applicant shall submit a $5,000 letter of
credit to benefit unanticipated emergency services and a $20,000 letter of credit to the benefit of the
Inn at Aspen for potential future losses or property damage incurred as a result of the event. The
letters of credit shall be submitted in a form acceptable to the County Attorney.
2. Add a new condition that states: "The Applicant shall provide a copy of a signed contract to
provide transportation services during the festival to the Community Development Department at
least 4 weeks prior to the festival."
APPROVED AND ADOPTED ON THE 29TH DAY OF JUNE, 1999.
