REGARDING A MINOR AMENDMENT TO THE ASPEN MOUNTAIN
CONSTRUCTION MANAGEMENT PLAN DATED MARCH 23,1999

RECITALS
1. On August 30, 1998, the Board of County Commissioners ("BOCC") approved the 1997
Aspen Mountain Master Plan pursuant to Resolution 98-80. Condition 11(b) of this
Resolution required the Aspen Skiing Company ("Applicant") to submit a construction
management plan for BOCC approval. On March 30, 1999, the BOCC approved the Aspen
Mountain Construction Management Plan ("AMCMP"), dated March 23, 1999, pursuant to
Resolution 99-63. On July 13, 1999, the BOCC approved a Minor Amendment to the
AMCMP specifically to allow early deliveries of concrete, pursuant to Resolution 99-135.
2. This request by the Applicant is for approval of a second Minor Amendment to the
AMCMP.
3. Page 24 of the AMCMP approved 10 exception days to the normal schedule outlined for the
use of Little Annie Road; Those exception days allow for deliveries to occur at 8:00 a.m.
rather than 9:00 a.m.; Resolution 99-135 allows the Applicant to begin accessing Little
Annie Road at 6:15 a.m. for 3 concrete,deliveries.
4. The Applicant currently requests the following changes:
• Increase in the number of exception days from 10 days to 12 days.
• Allow trucks to be off Little Annie Road by 7 p.m. instead of off Castle Creek Road by
4:00 p.m.
• Permit the plowing of Little Annie Road by large equipment before 9:00 a.m. until
October 1;
• Direct certain construction traffic to use Little Annie Road "due to safety reasons" even
with Summer Road clear and accessible;
• Increase the posted speed limits on the following mountain roads by 5 miles per hour
("mph"):

NOW THEREFORE BE IT RESOLVED by the Pitkin County Board of County
Commissioners that:
1. An increase in the number of exception days from 10 clays to 12 days is denied.
2. All truck deliveries must be off Little Annie Road by 3:30 p.m. and off Castle Creek Road by
4:00 p.m. on exception and non -exception days; all other Aspen Skiing Company (ASC) traffic
must be off Little Annie Road by 7 p.m. No ASC construction traffic is permitted on Little
Annie Road before 9:00 a.m, As of September 8, 1999, ASC has 3 remaining exception days.
On these 3 exception days, truck deliveries and construction traffic may start up Little Annie
Road at 8:00 a.m. rather than 9:00 a.m. On 2 of the remaining 3 exception days, ASC may start
concrete deliveries up Little Annie Road at 6:15 a.m. , but all other truck deliveries and
construction traffic may not start up Little Annie Road until 8:00 a.m. ASC shall notify the
Little Annie Homeowners Association a minimum of 24 hours before it uses an exception day.
3. Pitkin County shall hire and ASC shall pay for 2 guards to monitor ASC truck deliveries and
construction traffic on Little Annie Road. The guards shall be stationed at the top of Little
Annie Road and at the Little Annie Road/Castle Creek Road junction. The guards shall
continue to monitor the construction traffic until at least December 1, 1999 unless otherwise
determined by the Community Development Director.
4. Plowing Little Annie Road is not allowed before 9:00 a.m. Plowing is allowed expressly for
the purposes of Sundeck Restaurant construction until October 1, 1999.
5. Little Annie Road shall not be used as a primary access road for construction projects. The
contractor shall route all construction traffic to Summer Road and use Midnight Mine Road
only if necessary while those roads are clear and accessible. The contractor is responsible for
the safety of the construction project, including the delivery of materials and equipment. Loads
deemed unsafe by the ASC and contractor to travel Summer Road and Midnight Mine Road
even when the roads are open, clear, and accessible shall use Little Annie Road.
6. Increasing the posted speed limits on Little Annie Road inside the Rural/Remote Zone to 15
miles per hour and on Summer Road to 15 miles per hour is approved.
7. Increasing the posted speed limits on Midnight Mine Road and Little Annie Road outside the
Rural/Remote Zone is denied.
8. ASC shall meet with the BOCC in a public hearing on December 1, 1999 to present a
construction schedule for the Sundeck Restaurant, to review construction activities, and to
discuss the restoration of Little Annie Road.
