USE /SPECIAL EVENT PERMIT FOR A "BROOKS BROTHERS" PHOTO SHOOT
Determination No. 31 - 2011
RECITALS
1. Pursuant to Subsection 4- 30 -50(i) of the Pitkin County Land Use Code, the Community
Development Director of Pitkin County, Colorado ( "Director") may approve a Temporary
Commercial Use /Special Event Permit for commercial activities or special events.
2. Aspen Productions (hereafter, the "Applicant ") has applied to the Director for approval of
a Temporary Commercial Use /Special Event Permit for a "Brooks Brothers" photo shoot.
The photos will be of a small group engaged in various winter outdoor activitiesthaving fun
in the snow (i.e. snowball fights, sledding, skiing). The technical scout/shoot will span a
total of nine possible days, May 9 —16, 2011 (with a weather day on April 6`") from 6AM to
7 PM. The cast and crew consist of approximately 25 people.
3. The photo shoot will take place at the following locations:
a) John Miller's cabin on Little Annie Road PID#2735- 361 -00 -003;
b) Top of Aspen Mountain — sundeck area;
c) Snowmass Mountain — Sam's Knob Smokehouse;
d) Ashcroft, near Pine Creek Cookhouse PID# 2999 - 061 -00 -901;
e) American Trail;
f) Humcane/Richmond Ridge PID# 2909 - 172 - 00-014
4. County Risk Management has received and approved a Certificate of Insurance
covering this event and naming the County as an Additional Insured.
5. The USFS has approved the photo shoot and has issued a permit for the use of their
locations. Releases have been signed by the private owners for the use of their
locations.
6. The Director finds that, to the extent applicable, the application complies with the
standards in Subsection 4- 30 -50(i) of the Land Use Code.
THE DIRECTOR HEREBY APPROVES the Temporary Commercial Use /Special Event
Permit for the Aspen Productions, "Brooks Brothers" Photo Shoot subject to Applicant's
compliance with each of the following conditions:
1. Applicant shall adhere to all material representations made in, or in connection with, the
application, including but not limited to its Safety and Operations Plan. The Applicant
has acknowledged the avalanche hazard in the area and will have beacons and certified
first responder personnel on site.
2. The Applicant shall contact the Colorado Avalanche Info Center (CAIC) to assess the
avalanche risk in the areas they wish to shoot and have the appropriate rescue gear with
them.

3. No emergency access to any location shall be blocked
4. Parking shall be on private property only. No parking shall take place on County roads
or in the rights -of -way with the exception of the pull off at the intersection of Little Annie
Road and Castle Creek Road. Parking is limited in this area and carpooling of vehicles
to the utmost extent is required. The Applicant may also shuttle participants of the photo
shoot to the area in effort to save parking for snowmobilers and the general public
recreating in the area.
5. Little Annie Road shall remain unplowed. The Applicant may be assessed an Impact
Fine for extra services required by such action.
6. All roadways shall remain unobstructed and open to emergency vehicles at all times
7. All participants in the activity agree to abide by and obey all rules and regulations that
may apply.
8. Approval to hold this activity does not imply that extra services will be provided, nor does
it place any additional liabilities on Pitkin County or its staff.
9. The Applicant agrees to hold harmless and indemnify Pitkin County and its staff from
any death, injury or property damage occurring as a result of this activity.
10. Pitkin County maintains the right and authority to amend or cancel this permit at any time
should the Applicant fail to abide by conditions agreed to or if public health, safety and
welfare so dictate.
11. The Applicant may be assessed an Impact Fee for extra services provided by Pitkin
County. Payment, if required is due upon submittal of this application unless other
arrangements have been made.
12. The Applicant shall apply for and obtain a Temporary Special Use Permit from the USFS
prior to the start deadline. The Applicant shall adhere to all rules, regulations and
standards detailed in the permit.
13. The Applicant must demonstrate possession of applicable permits at all times during the
permitted activity and present such permits upon request
14. Failure to comply with the conditions of approval may result in revocation of this permit.

DATE: May 6, 2011
REQUEST: The Applicant is requesting approval of a Temporary Commercial Use /Special
Event Permit in order to shoot "winter lifestyle" photos for advertising. The photo shoot will
span a total of nine (9) days, with a technical scout on May 9th and 10"', and the photo
shoot from May 11- 16,(with May 17th as a bad weather day) from 6AM to 7 PM (for sunrise
& sunset shots). The crew will consist of approximately 25 cast and crew members.
APPLICANT: BaM Productions Inc., (thereafter, "Applicant ").
REPRESENTATIVES: Liz and Jere Long of Aspen Productions.
LOCATIONS: The following locations have been proposed:
1) John Miller's cabin on Little Annie Road PID# 2735 - 361 -00 -003

BACKGROUND: The photo shoot will take place at the locations above and cover a span
of 9 days total, including a possible 'bad' weather day if needed. Property releases signed
by John Miller, John Wilcox for Ashcroft and the Aspen Ski Company have been provided,
along with a Certificate of Insurance demonstrating adequate General Liability Insurance
and naming Pitkin County as an additional insured. Parking will occur at the Aspen
Mountain and Snowmass Ski Areas, the pull off at the intersection of Little Annie Road and
Castle Creek Road and the parking lot at the King Cabin for Ashcroft.
REFERRAL COMMENTS: The Application was referred to the following agencies: Pitkin
County Sheriffs Department (Tom Grady), Communications (Mark Gamrat), the Aspen Fin;
Protection District, the USFS, Aspen Valley Hospital and Public Works (G. R. Fielding).
The USFS issued a permit for the portion of filming as it takes place on lands managed by
them. The Pitkin County Sheriffs Office signed off on the event and its safety and
operations plan with conditions, as did Communications and Public Works. No comments
were received from the AFPD, but standard conditions apply.

STAFF COMMENTS:
Pursuant to Section 4- 30 -50(i) of the Land Use Code, Applicant must demonstrate that
adequate provisions have been made for all of the following:
1. Police supervision (if necessary);
2. Public parking;
3. Insurance;
4. Site set -up, maintenance and clean -up;
5. Emergency services; and
6. Safety of operations.
Additionally, temporary structures must conform to applicable building codes and other
County regulations. Each of these requirements is addressed, in turn, below.
Police Supervision: N/A
Public Parkins: The 25 person cast and crew will use private, insured vehicles to access
the locations. They will park in provided parking lots and will leave room for other users
and shall adhere to all rules and regulations for parking. The use of as few vehicles as
possible and carpooling is strongly encouraged.
Insurance: The Applicant has provided adequate proof of insurance in the correct form.
Site Set -Up. Maintenance and Clean -Up: Outdoor set -up is minimal for this type of
event. The Applicant will provide set -up, maintenance and clean up, including trash
removal from the sites. The Applicant shall follow the USFS permit guidelines for use of the
sites. Aspen Productions is the party responsible for site cleanup.
Emeruency Services: The Applicant has provided a plan for dealing with emergencies
during the shoot. This includes 911 services. Radio communications and cell phone shall
be used in addition to a hard line for emergencies. The Sheriff's Office has conditioned the
Applicant to contact CAIC to assess the avalanche risk and have the appropriate gear.
Safety of Operations: A first aid kit shall be available on site and a 1" responder will
accompany the crew in 'remote' locations. Avalanche beacons will be on site.

RECOMMENDATION: Staff recommends that the Director approve the Temporary
Commercial Use /Special Event Permit application subject to Applicant's compliance with
each of the conditions in the attached Administrative Determination.

Temporary structures shall conform to any and all applicable building codes and other
County regulations. The applicant shall obtain any required building permits from the
County Building Department. If a tent is to be erected, the Fire Marshal shall be
contacted to complete a life safety inspection prior to the event.

codes and other County regulations. The applicant shall obtain any required electrical
permits from the County Building Department.

applicable Fire Marshal and the Sheriff, and shall comply with the County regulations on
Noise Abatement (Code Title 6, Chapter 6.36).

required to submit an Event Coordinator's Application and, in connection with its food

Law enforcement services will be charged out at the current hourly rate established by
the Sheriffs Department and ONLY if resources permit. The Sheriff reserves the right to
place officers and staff at the event, at the permittee's expense, if deemed necessary in

ALL APPLICANTS: Please complete the attached Safety and Operations Plan or
provide a separate document containing all of the required information (see Attachment
A). A Safety and Operations Plan is required for planned events /activities
because the emergency service infrastructure Is funded by the Pitkin County
taxpayers to offset unplanned events that pose a threat to life and property. As a
result, any demand for services generated by a planned eventlactivity should be
alleviated ahead of time by the event sponsor or organizer. The posting of financial
security, in an acceptable form, may be deemed necessary by the Pitkin County Sheriffs
Office upon review of the Safety and Operations Plan.

A. The County may revoke a Temporary Commercial Use /Special Event Permit prior to or
during the event if the permittee violates any of the conditions of the permit.
B. The County may require the permittee to participate in a post -event debriefing with
referral agencies, affected citizens and other interested /involved parties to address
issues that arose during the event.
C. The County may require the permittee to post financial security to ensure compliance
with any of the conditions of the permit.
D. If a major incident or emergency occurs in the County during the event, the Sheriff
reserves the right to remove any and all emergency medical, fire and law resources from
the event.
E. The permittee shall adhere to all representations made in the application and in public
meetings.

SAFETY AND OPERATIONS PLAN REQUIREMENTS
The purpose of this part of your application process is to promote public safety in the
conduct of special events in Pitkin County. Please provide the following information as
it applies to your event. Note that some questions will not be applicable, or appropriate, given
the nature and /or scale of your event.
Contact the Public Safety Council for additional information or direction regarding these
requirements.

Rick Deane with us who will have a radio & will be able to communicate with the T
Lazy 7 Ranch in the event of an emergency. If the Deane's are not available we
will be working with Aspen Powder Tours who also be on radio communication.

A winter lifestyle shoot for Brooks Brothers.
• In the event of a medical emergency -our first responder will stabilize the individual
/ apply appropriate care & seek further assistance if needed from outside help.
In the event of an emergency & someone does need to be rushed to the hospital
we will have a Suburban standing by to take them to the hospital. We will also have
a hard line or radio available to use to call 911.
ADDITIONAL INFORMATION REGARDING PARKING & VEHICLES:
Below is a list of our possible staging areas:
Little Annie's Road - the pull off directly past the Little Annie's turn. (If shoot day is on a
week -day, we will park 3 -4 vehicles at pull -out, if shoot is on a weekend we will park 2
vehicles at pull -out and shuttle remaining vehicles)
Aspen Ski Company Mountains - we will park in existing parking areas per the Ski
Company's suggestion.
Ashcroft - we will park in the designated parking area at Kings Cabin.

TEMPORARY SPECIAL - USE PERMIT

AUTHORITY:

Asoen Productions on behalf of BaM Productions hereinafter called the Holder, is hereby authorized to
use, subject to the terms and conditions of this permit, National Forest System land (NFSL) identified below,
as it occurs at the Ashcroft, Aspen Mountain, American Lake Trailhead, Hurricane Ridge, and Snowmass Ski
Area located within the Aspen - Sopris Ranger Districts of the White River National Forest.
This authorization covers approximately 5 acres and /or N/A miles.
The holder is authorized to conduct the following activities and /or install the following temporary
improvements on the permitted area: Conduct a motion picture and still picture commercial shoot.
The below locations are authorized under this permit:
• Aspen Mountain
• Ashcroft
• Snowmass Ski Area
• Hurricane Ridge
• American Lake Trailhead
Filming within the Ashhroft Ski Touring permit area will require approval from American Adventure
Productions (John Wilcox). Access and shooting within any ski area will be managed by the Aspen Skiing
Company (ASC letter of authorization in permit file). Letters of authorization from the above entities are in the
permit file.
This authorization covers five (5) days of filming on NFS land. One weather day will be allowed with prior
Forest Service notification.
This Special Use Authorization covers National Forest System land only.
No use is authorized within desiMted Wilderness Areas.
TERMS AND CONDITIONS
1. Use under this permit shall begin on 05/11/2011 and end on 05/16/2011. Filming is to occur five of these
six days. A weather day is permitted on 05/17/2011. The permit shall not be extended.
2. The fee for this use is $1,250.00 (One thousand two hundred fifty dollars). It shall be paid in advance
and is not refundable.
3. The holder shall conduct the authorized activities according to the attached approved plans and
specifications.
4. The holder shall not install any improvements not specifically identified and approved above.
5. No soil, trees, or other vegetation may be destroyed or removed from National Forest System lands
without specific prior written permission from the authorized officer.
6. The holder shall comply with all Federal, State, county, and municipal laws, ordinances, and regulations
which are applicable to the area or operations covered by this permit.
7. The holder shall maintain the improvements and premises to standards of repair, orderliness, neatness,
sanitation, and safety acceptable to the authorized officer. The holder shall fully repair and bear the -

expense for all damage, other than ordinary wear and tear, to National Forest System lands, roads and
trails caused by the holder's activities.
8. The holder has the responsibility of inspecting the use area and adjoining areas for dangerous trees,
hanging limbs, and other evidence of hazardous conditions which would pose a risk of injury to
individuals. After securing permission from the authorized officer, the holder shall remove such hazards.
9. The holder shall be liable for any damage suffered by the United States resulting from or related to use of
this permit, including damages to National Forest resources and costs of fire suppression.
10. The holder shall hold harmless the United States from any liability from damage to life or property arising
from the holder's occupancy or use of National Forest lands under this permit.
11. The holder agrees to permit the free and unrestricted access to and upon the premises at all times for all
lawful and proper purposes not inconsistent with the intent of the permit or with the reasonable exercise
and enjoyment by the holder of the privileges thereof.
12. This permit is subject to all valid existing rights and claims outstanding in third parties.
13. This permit may be revoked upon breach of any of the conditions herein or at the discretion of the
authorized officer. Upon expiration or revocation of this permit, the holder shall immediately remove all
improvements except those owned by the United States, and shall restore the site within 1 day(s), unless
otherwise agreed upon in writing. If the holder fails to remove the improvements, they shall become the
property of the United States, but that will not relieve the holder of liability for the cost of their removal and
restoration of the site.
14. This permit is a license for the use of federally owned land. It does not grant any interest in real property.
This permit is not transferable. The holder shall not enter into any agreements with third parties for
occupancy of the authorized premises and improvements.
15. Appeal of any provisions of this permit or any requirements thereof shall be subject to the appeal
regulations at 36 CFR, Subpart C, or revisions thereof.
16. This permit is accepted subject to the conditions set forth herein, condition(s) 1 -21 and attached to and
made a part of this permit.
17 The Permittee will remove all trash generated by the shoot at the end of each day of shoot. The
area will be maintained in a neat and orderly fashion at all times.
18. All vehicles must stay on designated roadways and parking areas.
19. This authorization covers fiver shooting days at the specified locations unless amended.
20. Letters of authorization from American Adventure Productions and Aspen Skiing Company will be
required as a condition of approval for this permit.
21. The above clauses shall control if they conflict with additional clauses or provisions.

Hi Cori Anne. It does not sound like they will be near a landline at all times. I would like more
detail on this if possible. The simplest way to solve contacting emergency services would be
a satellite phone. I would be OK with that..

*The Applicant contact CAIC (Co Avalanche Info Center) to assess the avalanche risk in the area they wish to
shoot and that they have the appropriate rescue gear with them.

We have an application for a Photo Shoot taking place in various locations in the County including Top of Aspen
Mountain, Hurricane/Richmond Ridge, John Miller's cabin off Little Annie's Rd, Snowmass Mountain, Buttermilk
Mountain, Ashcroft (near Pine Creek Cook House) and Ashcroft (American Trail).
The Applicant has also submitted an application for a USFS Permit. We have received the required liability insurance and
a release from Ashcroft with others coming shortly.
There will be approximately 20 -25 people working on this project. Technical Scouting will take place May 9 th & 10th;
the shoot will take place May 11 -16 with May 17` as a possible weather day. I would like to set the deadline for
comments for Friday, May 6 th at noon.
As always, some of you are included to keep you in loop only.
