Pursuant to Subsection 4- 30 -50(i) of the Pitkin County Land Use Code, the Community Development Director of Pitkin County, Colorado ( "Director") may approve a Temporary Commercial Use/Special Event Permit for commercial activities or special events. 2. The Independence Pass Foundation, (hereafter, the "Applicant') has applied to the Director for approval of a Temporary Commercial Use /Special Event Permit to conduct the Independence Pass Foundation Ride For The Pass on May 21st, 2011. The event is typically staged from the winter gate on Independence Pass and ends at the Independence Ghost Town. However, due to unusually heavy snow this winter, the 2011 event will begin at the Difficult Creek Campground at mile marker 45 and end at Independence Rock Climbing Area at mile marker 53. The event will run from 10:00AM — 12:30PM. Approximately 500 people are expected. 3. The event garnered a 3 year permit in 2008, which subsequently expired this year. 4. The Pitkin County Sheriffs Office, the Aspen Fire Department, and the Emergency Management Department have all approved this event. The Applicant has provided a Certificate of Insurance covering this event and naming the County as an Additional Insured, satisfactory to the requirements of the Risk Manager. Colorado State Patrol has reviewed and approved the application. The County Engineer and the USFS have also reviewed and approved the application. 5. The Director finds that, to the extent applicable, the application complies with the standards in Subsection 4- 30 -50(i) of the Land Use Code. The Director further finds that based on the historical safety and success of the event that it qualifies for a three year permit. THE DIRECTOR HEREBY APPROVES the Temporary Commercial Use/Special Event Permit for the Ride for the Pass subject to Applicant's compliance with each of the following conditions: 1. Applicant shall adhere to all material representations made in, or in connection with, the application. 2. No emergency access shall be blocked. 3. The Applicant shall notify the Community Development Department 60 days prior to the event to identify the date and location of the event and any changes in the nature, size, or activities to be conducted since the preceding event covered by the permit. If the Community Development Department determines that changes in the event were not anticipated or covered by the existing permit, and could have unanticipated adverse impacts on surrounding properties or traffic on County rights -of -way, or the event has not complied with provisions Page l oft of the previous approval it may be revoked and/or the Department may require that the Applicant (a) apply for and receive a new temporary use permit, or (b) modify the event to avoid the unanticipated adverse impacts. If the Community Development Department does not respond to the notice with concerns about unanticipated adverse impacts, the event may proceed without the need to obtain a new temporary use permit. 4. This is not a vested approval and the event is subject to any new Code or County Special Events Committee requirements through the life of this permit. 5. This permit shall expire in 2014. 6. Event Description The Ride for the Pass is a bicycle ride for both recreational and competitive riders that takes place on Highway 82 east of Aspen between approximately Mile Markers 47 and 57. The Ride's route is along the Highway from the "Winter Gate" near Tagert Lake to the Independence Town Site approximately 3.5 miles below the summit of the Pass. The Ride takes place on the weekend before Memorial Day which is when the road is open to vehicular traffic, so the only vehicles on the road during the Ride are Ride support vehicles (1 each at the two aid stations and four more that go to the Finish Line). Approximately 500 riders participate. 2011 will be the 17 year for the event. The event starts with the Competitive Riders start at 9:OOAM and ends with the sweep of the course at 12:30 PM. This year the event will be held on May 21. Communications and Safety: Since the Pass is out of range for most radio frequencies, we rely on the emergency radio channel (14) to communicate critical events such as accidents, injuries, etc. We have never needed to use the radios for this purpose in the history of the event. Radios will be at the Start and Finish Lines and at the two aid stations and at least two ride -along EMTs will have radios. The Aspen Ambulance Service will be on standby a the Winter Gate if emergency transport is needed. The Colorado State Patrol will also have a patrolman on duty between the start and the finish of the event. At least two ride -along EMTs will be with the riders en route and will remain at the Summit until the course is swept. A motorcyclist acts as a forerunner for the Ride and sweeps the course at least once during the event to check for accidents or riders in distress. All the Aid Stations (Start, Finish, Lincoln Creek and Lost Man) are equipped with fast aid kits and bike repair kits. Parking: The Difficult Campground area is opened for parking prior to the event and there is a shuttle service from the Campground to the Start Line. There is also parking available near the Start Line and at various pullouts between the Start Line and the City Limits. Since there is no through traffic on the road there is generally not a problem with vehicular/bike conflicts. Many riders ride their bicycles from Aspen to the Start Line. Transportation: There will be a minim of seven vehicles that transport course workers and, if necessary, riders. There will be one vehicle each at the two aid stations, a timing truck, a 1W forerunner (motorcycle), a small RFTA van and at least one additional truck plus a flatbed trailer from Blazing Adventures to shuttle down any riders with faulty equipment or who are otherwise unable to ride. Depending on the amount of material to be ferried to the Finish Line, an additional truck may be dispatched to the Finish Line. The vehicles will carry extra clothing for the riders, course workers (two Course Marshals and three or four aid- station workers), and supplies (food, water) to the various stations along the route. The vehicles will leave for the Finish Line at least 1 /2 hour prior to the start of the Ride. The motorcycle rider will leave just ahead of the competitive riders, pacing them up the hill and watching for road hazards. The RFTA bus will be the last vehicle down the hill and will pick up all volunteers and riders needing assistance. Rider Notice: Since the event is weather dependent and in a remote location, last minute notice to riders in the event of a cancellation is difficult. Decisions to cancel or postpone the event may be made on site and at the last minute depending on conditions. Refunds will be offered in case of cancellation but no alternative date or time will probably be set. Announcements about conditions and Ride status will be made at the Start Line. Insurance: The Independence Pass Foundation is in possession of a certificate of insurance naming Pitkin County as a co- insured.
