The Aspen Ski Company (hereafter, the "Applicant') has applied to the Director for approval of a Special Event Permit to conduct the Power of Four Ski Mountain Bike Race. The race will consist of relay teams and solo racers who will scale and descend the four ski mountains in the area. The event will occur on Saturday August 28, 2011 from 8:00 AM to 5:00 PM with setup and takedown dates of August 27 and 29 respectively. Approximately 150 -200 participants are expected with an overall cap of 250 participants. The Applicant anticipates approximately 20 staff members. Participants will bike Snowmass, Buttermilk, Highlands, and Aspen Mountains. The route is as follows: • Start in Base Village in Snowmass Village. • Ride up Snowmass to Cross Mountain Trail. • Ride from Cross Mountain Trail to Elk Camp Summer Road to Vapor Trail. • Take Vapor Trail to Government Trail to Buttermilk Tieback base area. • From the base of Tiehack, to the top of Buttermilk via the Summer Road. • Top of Buttermilk to Government Trail and back down to the base of Tieback. • From the Tieback parking lot, cross the ARC bridge and then up the bike path to the base of Aspen Highlands. • Base of Highlands up the Summer Road to the Congo Trail. • Congo Trail Down to Castle Creek Road. • From Castle Creek Road to Midnight Mine Road. • Midnight Mine Road to Little Annie Road intersection. • Little Annie Road to the top of Richmond Ridge. • Richmond Ridge to East Rim Singletrack. • East Rim to Summer Road Crossing. • Summer Road to top of Aspen Mountain. • Finish line in front of the Sundeck. Relays will occur at the base of Tieback and at the Castle Creek/Midnight Mine Road intersection. 4. The Pitkin County Sheriff's Office, Aspen Fire Protection District, Emergency Manager, Public Works Department, Aspen Ambulance, Communications Department, Open Space and Trails Department, the United States Forest Service, Risk Manager, City of Aspen, Colorado Division Page 1 of 2 L91 - 7-0 1 1 of Wildlife, Aspen Valley Hospital, Environmental Health, and the Maroon/Castle Caucus were all referred on the application. Nearly all referral agencies commented on the application and were in support with some conditions. 5. The Applicant has successfully obtained a United States Forest Service Permit for the event. No Open Space and Trails Department permit is needed for this race to occur. The Applicant has provided proof of adequate insurance covering the event. Course marshals will be staffed at the Maroon Creek and Castle Creek Road Crossings. 6. The Director finds that, to the extent applicable, the application complies with the standards in Subsection 4- 30 -50(i) of the Land Use Code. THE DIRECTOR HEREBY APPROVES the Special Event Permit for the 2011 Power of Four Mountain Bike Race subject to Applicant's compliance with each of the following conditions: 1. All material representations made by the Applicant in the application (which shall specifically include representations made in all related supporting documents, correspondence subsequently provided by the Applicant, and representations made by phone), shall be adhered to, and considered conditions of approval, unless superseded by specific conditions in this Decision. 2. The Applicant must demonstrate possession of applicable permits at all times during the permitted activity and present such permits upon request. 3. Approval to hold this activity does not imply that extra services will be provided nor does it place any additional liabilities on Pitkin County. 4. The Applicant shall be responsible for assuring that all areas outside the ski area resorts have signage removed and garbage /debris removed after the event. 5. By August 26th, the Applicant shall post signs at the entrance at Loges Spring Road and Midnight Mine Road and place flyers on doorsteps of the residence along these roads alerting them of the race. 6. Failure to comply with the conditions of approval may result in revocation of this permit. Also a contact sheet with cell numbers will be provided to event staff. The holder shall not install any improvements not specifically identified and approved above or in exhibits. 6. No soil, trees, or other vegetation may be destroyed or removed from National Forest System lands without specific prior, written permission from the authorized officer. 5 7. The holder shall comply with all federal, state, county, and municipal laws, ordinances, and regulations which are applicable to the area or operations covered by this permit. 8. The holder shall maintain the improvements and premises to standards of 7epair, orderliness, neatness, sanitation, and safety acceptable to the authorized officer. The holder shall fully repair and bear the expense for all damages, other than ordinary wear and tear, to National Forest System lands, roads and trails caused by the holder's activities. 9. The holder has the responsibility of inspecting the use area and adjoining areas for dangerous trees, hanging limbs, and other evidence of hazardous conditions which would pose a risk of injury to individuals. After securing permission from the authorized officer, the holder shall remove such - -- -- hazards. 10. The holder shall be liable for any damage suffered by the United States resulting from or related to use of this permit, including damages to National Forest resources and costs of fire suppression. 11. The holder shall hold harmless the United States from any liability from damage to fife or property arising from the holder's occupancy or use of National Forest System lands under this permit. 12. The holder agrees to permit the free and unrestricted access to and upon the premises at all times for all lawful and proper purposes not inconsistent with the intent of the authorization or with the reasonable exercise and enjoyment by the holder of the privileges thereof. 13. This permit is subject to all valid existing rights and claims outstanding in third parties. 14. This permit may be revoked or suspended upon breach of any of the conditions herein or at the discretion of the authorized officer. Upon expiration or revocation of this authorization, the holder shall immediately remove all improvements except those owned by the United States, and shall restore the site within 2 days, unless otherwise agreed upon in writing. If the holder fails to remove the improvements, they shall become property of the United States, but that will not relieve the holder of liability for the cost of their removal and restoration of the site. 15. This permit is a license for the use of federally owned land. It does not grant any interest in real property. This permit is not transferable. Upon approval of the authorized officer, the holder may enter into agreements with third parties to exercise the rights and privileges granted by this authorization. 16. The holder is required to comply with standards for adequacy and type of services set out in the attached operating_ plan. 17. Gambling or gambling machines or devices will not be permitted on National Forest System lands regardless of whether or not they are lawful under State law or county ordinances. 18. The holder, in advertisements, signs, brochures, letterheads, and like materials, as well as orally, shall not misrepresent in any way, either the accommodations provided, the status of the authorization, or the area covered by it or the vicinity. The fact that the permitted area is located on the National Forest shall be made readily apparent in all formats of the holder's brochures and advertising regarding the use and management of the area and authorized facilities. 19. Pursuant to 31 U.S.C. 3717, et seq., interest shall be charged on any fee amount not paid within 30 days from the date the fee or fee calculation financial statement specified in this authorization lJ becomes due. The rate of interest assessed shall be the higher of the rate of the current value of funds to the U.S. Treasury (i.e., Treasury tax and loan account rate), as prescribed and published by the Secretary of the Treasury in the Federal Register and the Treasury Fiscal Requirements Manual Bulletins annually or quarterly or at the Prompt Payment Act rate. Interest on the principal shall accrue from the date the fee or fee calculation financial statement is due. In the event the account becomes delinquent, administrative costs.to cover processing and handling of the delinquency will be assessed. Apenalty of 6 percent per annum shall be assessed on the total amount delinquent in excess of 90 days and shall accrue from the same date on which interest charges begin to accrue. -- - -- Payments will be credited on the date received by the designated collection officer or deposit location: - - If the due date for the fee or fee calculation statement falls on a non - workday, the charges shall not apply until the close of business on the next workday. Disputed fees are due and payable by the due date. No appeal of fees will be considered by the Forest Service without full payment of the disputed amount. Adjustments, if necessary, will be made in accordance with settlement terms or the appeal decision. If the fees become delinquent, the Forest Service will: Liquidate any security or collateral provided by the authorization. If no security or collateral is provided, the authorization will terminate and the holder will be responsible for delinquent fees as well as any other costs of restoring the site to it's original condition including hazardous waste cleanup. Upon termination or revocation of the authorization, delinquent fees and other charges associated with the authorization will be subject to all rights and remedies afforded the United States pursuant to 31 U.S.C. 3711 et seq. Delinquencies may be subject to any or all of the following conditions: Administrative offset of payments due the holder from the Forest Service. Delinquencies in excess of 60 days shall be referred to United States Department of Treasury for appropriate collection action as provided by 31 U.S.C. 3711 (g), (1). The Secretary o, the Treasury may offset an amount due the debtor for any delinquency as provided by 31 U.S.C. 3720, et seq.) 20. For the purpose of administering this permit (including ascertaining that fees paid were correct and evaluating the propriety of the fee base), the holder agrees to make all of the accounting books and supporting records to the business activities, as well as those of sublesees operating within the authority of this authorization, available for analysis by qualified representatives of the Forest Service or other Federal agencies authorized to review the Forest Service actvitles. Review of accounting books and supporting records shall be made at dates convenient to the ho'der and reviewers. Financial information so obtained shall be treated as confidential as provided in regulations issuded by the Secretary of Agriculture. The holder shall retain the above records and keep them available for review for 5 years after the end of the year involved, unless disposition is otherwise approved by the authorized officer in writing. 21. Appeal of any provisions of this authorization or any requirements thereof shall be subject to the appeal regulations at 36 CFR Part 251, Subpart C, or revisions thereto. 22. This permit is accepted subject to the conditions set forth herein, including any conditions in any exhibits attached to and made apart of this authorization. 23. Inform all racers and event staff prior to the race of the presence of black bears. 24. Allow no dogs off leash on Aspen- Sopris District during these events. 25. As a leave no trace ethic, event staff are responsible for managing all waste, food, and garbage throughout the event. All waste, trash, and food should be removed immediately from the area of influence. This includes human waste, food and garbage of staff, competitors, and related personnel. 26. Information on the Government trail closure shall be provided and shared with competitors as a way of educating the public and community about the need for this closure to protect elk in spring. 27. There is a great deal of behind the scenes coordinating to put this kind of event on and be successful. Once you determine the dates you are welcome to re- submit; the online application gives -•J you the opportunity to make a copy of the application that you have already submitted, edit it and resubmit. Submitting this year, might be a tad early —you may want to wait until about 6 months out from the next date to send it in. You can always meet up with the referral agencies during the wait, show them what you have, get feedback and make changes while you're waiting to resubmit. Normally application for events like these are submitted 90 days before the event — hence the sense of urgency. I spoke with my supervisor about the multi -year permit. It's been our policy to issue single event permits for the first -time events. That way we are better able to determine the outcome and how much work might be involved the next time. Good news! Also, I wanted you to be aware that the Maroon Rd crossing might be a bit of an issue, RFTA closes the road on the weekends to all but local traffic so they can run the Maroon Bells Tour. They may have an issue not running the buses during your race /crossing. One of the other bike events we are reviewing is currently having the same issue — not insurmountable but definitely an area to consider. The $312 per hour is the hourly fee charged for all land use approvals in Pitkin County (including the Special Event Permit fee and Temporary Commercial Permit fees). The number of hours involved including the time of the Planner /Coordinator to get all the necessary information to the referral agencies, the referral agencies time and issuing the permit. The more complicated the event (multiple locations, use of multiple County roads & properties (trails, open space etc) & road closures, the number of people involved, duration oethe event, events covering multiple jurisdictions, the need for first responders, the impact on local public transportation etc). In this case your event, due to all the variables is considered a major event. Most, if not all of the bicycle events (road or otherwise) are considered major events. The City of Aspen has different fees due to the fact that we are a different jurisdiction.
