The Gaylord Donnelley Trust (hereafter referred to as the "Applicant ") has applied to the Community Development Director of Pitkin County, Colorado ( "Director ") for Activity Envelope Review for construction of ground mounted solar panels on a parcel that is currently developed with a single family residence. Because no previous land use approval applies to the parcel the Applicant has proposed an Activity Envelope that encompasses all existing development on the parcel. 2. The property is located at 2262 Snowmass Creek Road and is legally described in attachment A. PID#:246734400588 3. The Lot is approximately 35 acres acres, is in the RS -30 zone district, and is conforming in size. 4. The subject parcel was previously part of a 70 acre parcel. This 70 acre parcel was subject to multiple land use reviews including GMQS allocations, Employee Dwelling Units, and 1041 approvals in the 1990's. In the late 1990's, the 70 acre parcel was split through State Subdivision Law and the subject parcel was created. The subject parcel contains a free market dwelling unit and a previously approved employee dwelling unit. No envelope was ever approved on the subject parcel. The parcel is mapped within an elk severe winter range where, per the Land Use Code, development is prohibited. The Colorado Division of Wildlife has verified that the parcel is not mapped within the severe winter range and that this mapped range is located north of Snowmass Creek. 6. The Snowmass /Capitol Caucus Solar Subcommittee has commented on the proposal and unanimously supported the request for the panels. 7. Public notice was published in the paper on August 7th, 2011. The Applicant mailed the public notice to property owners within 300' of the subject property on August 15th, 2011. No objections were received within 30 days. Comments were received from a neighbor who expressed concerns about scenic impact of the panels from their property APPROVED by the D subject to the following conditions: The Applicant shall adhere to all material representations made in the current or prior applications or in public meetings or hearings and shall consider those representations to be conditions of approval, unless amended by other conditions. 2. Prior to submission of permits for the solar panels, the Applicant shall be required to submit for approval by the County Attorney and Community Development an Activity Envelope Plan in accordance with Land Use Code Section 2- 30 -20(g) and Application Manual Section 2.1.1. The above referenced approvals shall be a condition precedent to finalization and recordation. 3. No structural development, with the exception of fencing, in excess of 30" shall occur within the setbacks of the Lot. Landscaping in the form of berms shall not exceed four feet from the most restrictive grade. Any external development located within setbacks mandated by County zoning regulations shall require a variance from the Board of Adjustment. 4. No development shall occur outside the approved activity envelope with the exception of vegetation removal necessary to comply with the wildfire mitigation measures described above. No structures shall be permitted outside of the approved building envelope. 5. Prior to commencement of any earthmoving or other construction activity, the Applicant shall stake the corners of the activity envelope and install construction fencing around the construction site within the perimeter of the building envelope. The fencing shall remain in place until issuance of a Certificate of Occupancy. 6. All areas disturbed by construction shall be re- vegetated with native shrubs and grasses within one growing season of the project's completion. 7. Statutory vested rights for the approval contained herein are granted pursuant to the Pitkin County Land Use Code and Colorado Statutes, subject to the exceptions set forth in Pitkin County Land Use Code, § 2 -20 -170 and C.R.S., § 24 -68 -105. The statutory vested rights granted herein shall expire on September 4SR_ 2014. 8. Activity Envelope The proposed 8.1 kW ground mounted PV array has an overall footprint of approximately 1189 square feet (including the space between the two rows). The PV array, inverter mounting, sub panel for point of interconnection, and disconnect are sited within the proposed activity envelope. The proposed residence avoids all constrained areas (other than Wildlife Habitat Areas to be addressed below) as defined by 7 -10 -50 of the Pitkin County Land Use Code. Wildlife Habitat Areas The entire property is mapped within and adjacent to the elk and deer severe winter range. Our Caucus' Renewable Energy Subcommittee met with Laura Donnelley in February of this year, at her request, to review the plans for a proposed solar installation on her property. In discussing this application at our meeting on August 29, it was brought to our attention that neighbor Tom Danis had raised some concerns regarding effects of this solar array on his viewplane. While we haven't received an official request from the county to review these plans, we did a site visit on February 19th, 2011. Those present at the 2 -19 visit were caucus members Ken Smith and Barb Sullan, along with Andy Lietz of Sun Sense, and the property manager, Scott Wheeler. We also consulted Rick Heede, a Snowmass caucus solar subcommittee member who was unable to attend, for his input. We understand that the proposed location for the arrays may be outside the building envelope and will be subject to county review and approval. However, we did a preliminary evaluation based on the information that was available to us at the time. If the building envelope changes and the arrays move to a different location, the solar subcommittee would like the opportunity to conduct a further review. If the county approves the building envelope as is, and the solar arrays remain located as shown, the subcommittee approves the Donnelley's application. The Snowmass Caucus sent recommendations to Pitkin County in 2010 regarding guidelines that we would like the county to consider before writing the final language for solar applications in the new land use code. We based our observations of the Donnelley project on those guidelines and are as follows: (Snowmass Caucus Recommendations to Pitkin County in 2010 in Black — Solar Subcommittee comments in blue) Glare: • The glare effect produced by light reflecting from a solar panel shall not create an adverse impact with an intensity and duration sufficient to cause a nuisance. If glare creates an unreasonable off -site impact, vegetative screening, repositioning of the panels, or other effective means of reducing glare may be required to instigate that impact. • When glare is determined to be a nuisance, the system owner is responsible for mitigation. Laura Donnelley along with Andy Lietz from Sun Sense understood our concerns related to glare and are willing to mitigate any future problem that might develop. That being said, they understood that they may need to adjust the array angle or plant bushes and /or trees to help reduce or eliminate a glare problem, if a "nuisance" situation should occur. The array will be angled due south and inclined to 40 degrees, and neighbors toward the SE and SW inay be affected by glare, although at a considerable distance and thus of short - duration, given the distance from the array to the property line and to Ms. Donnelley's neighbors. Off -site impacts from free - standing arrays might be best dealt with through homeowners associations where impacts can be analyzed on case by case basis. Concerns with placement need to be considered in areas of higher density. Home owners typically place arrays behind or to the side of their home where neighbors feel the impact. Vegetative screen, placing the array below grade in a trough, or other effective means of reducing impact need to be considered The array height is 10 feet which falls within the limits that we had agreed was acceptable. We were favorably impressed by the PV collectors being used in this project. They are by a company named SunPower and the panel is the E /18 225 solar panel.
