To: John Ely, Tim Beaton, Aaron Ladd From: Mike Sayler Subject: Stapleton Brothers Ditch Change to ISF Purposes — Scope of Work — Phase II Job: 1001 MO Date: August 4, 2011 This memorandum summarizes the proposed scope of work for Phase II of the Stapleton Brothers Ditch change of use to instream flow purposes, Our March 31, 2010 letter defined a scope of work for. Phase I. That scope took us through completion of a water court application and engineering report. Phase 11 will include work to be completed in negotiating with objectors in the case, including reviewing initial comments from the objectors and providing a.response to those comments. Some of the work in Phase II involves analyses of issues that we previously anticipated would be raised by objectors. Some of that work has already been done and billed in our previous invoices to the County. Those tasks which are already completed and invoiced will be noted below. All of the other tasks listed herein have yet to be completed. 1. Analyze the "duty" or amount of water required per irrigated acreage as stated in the Stapleton' Brothers Ditch decree, and as actually has occurred. Also analyze the duty of water (decreed and actual) for various other ditches in the Roaring Fork Valley and throughout western Colorado. Compare the Stapleton Brothers Ditch duty to the other ditches. This issue was anticipated and the analysis is already completed. The cost of this task is approximately $2,500. 2. Preliminary review of objectors comments. Comments were received from Maroon Creek, LLc, Roaring. Fork Land and Cattle Company (RFLCC), Starwood Metro District, the City of Aspen and Basalt Water Conservancy District and discuss with legal counsel and the CWCB. This task is also completed. The cost of this task is approximately $1,400. 3. Review Division Engineer's Summary of Consultation and discuss with the Division Engineer, This task is also completed. The cost of this task is approximately $700. 4. Prepared detailed accounting forms showing how the Stapleton Brothers Ditch water rights would . • be accounting for in the future. This task is also completed. The cost of this task is approximately $900. 5. Conduct a detailed review of objectors comments. We are currently in the process of completing a more detailed review of the objector comments referred to in (2) above. The task will involve further research of the objectors concerns, as well as review of the objectors water rights in order to determine inconsistencies with the concerns that may be apparent with the .objectors water rights. The cost to complete this task is estimated to be approximately $2,300. 6. Meetings/conference call with objectors. We envision the need to meet or hold conference calls' with the objectors in order to discuss the issues raised and determine if there is potential . for resolution of those issues. This task will entail preparing for and attending those meetings. The cost to complete this task is estimated to be approximately $6,200. 7. Prepare an engineering letter report to respond to the issues raised by objectors. This task will involve additional analyses of the issues raised by objectors, including, but not limited to historical diversions, irrigation efficiency, delayed return flows, ditch losses,' duty of water, HUP protection, future instream flow credits and future ' operations. This task will include additional research,'and presentation of our findings in a letter report which can be distributed to the objectors. We estimate the cost to complete this task to be approximately $12,800. 8. Additional internal meetings and discussions with legal counsel, client and the CWCB. This task will include additional meetings and conference calls to internally discuss our efforts, plan strategy, and get comments, We have budgeted for two additional meetings as well as various conference calls. We estimate the costs to complete this task will be approximately 3,400. The total cost estimate for the Phase II tasks described above is $30,200. This cost estimate includes approximately $5,500 that has already been billed to you. With this amendment, the total costs for this project, through Phase I and Phase II will be $52,700. Should the County not be successful in settling this case through Phase II negotiations with objectors, it will be necessary to prepare an additional scope -of work for Phase III which will include trial preparation and attendance at trial. • • 3
