Proper notice procedures, including the notification of all adjoining property owners, has been shown by the applicant. 2. The required hardship or practical difficulty has been established. 3. Granting such relief will not cause substantial detriment to the public welfare and will not substantially impair the intent and purpose of the Zoning Resolutions and the zoning maps. Schaffner, Zoning Officer and acting secretary Brewster- McLeod opened the meeting at 5:40 pm. There is no tape recording of this meeting. Minutes are based on notes taken at the meeting. CASELOAD: Case # 10 -2010 GSS Properties, LLC 7989 Highway 133 Architect, George Winne, and GSS Properties tenant, Oak Applegate, were present to request an 18'5' south side yard setback variance to construct an addition to a single - family residence. The property contains 5.4 acres, is located in the RS -30 zone district. and requires a 30 foot side yard setback. The Affidavit of Posting was submitted. There were no members of the public present to comment on this application. Winne explained the desire for increased living area in this small residence. The lot is long and narrow, with steep slopes at either end, separated by a small flat bench. The existing and proposed developments are located on this bench. The proposed addition has been located in the side yard setback to avoid development in the front yard, where the septic system and large trees limit development potential. Large trees in the rear yard could have been at risk. The proposed location is the most logical given the floorplan of the existing house. Winne mentioned that there was no objection from the neighbor to the south, whose residence is located up the hill behind the applicant house. He also stated that an application has been submitted to the Community Development Department for Site Plan / Activity Envelope review, but has not yet received a decision/determination. Head motioned to approve the variance based on the narrowness of the property resulting in peculiar practical hardships. Throm seconded the motion. The motion passed 3 to 1, with Brewster - McLeod dissenting. MINUTES: Head made a motion to approve the minutes from the October 15, 2010 meeting and the motion was seconded by Brewster- McLeod. Comments: Application material was referred to: Zoning Officer.: J,n C,, n3 architecture V _ October 27, 2010 Pitkin County Community Development Planning & Zoning Department 130 South Galena Street Aspen, CO 81611 RE: Variance Application Addition to an Existing Residence for GSS Properties, LLC 7989 Highway 133, Carbondale, CO 81623 PID #2649- 044 -00 -002 Dear Sirs, This letter is being submitted as part of the application for a `Setback Variance' for an addition to an existing single family residence located at 7989 Hwy 133, Carbondale, Colorado. The new addition will include a 453 square foot Living/Dining room addition on the ground floor and a 420 square foot storage room basement. The total addition will consist of 873 square foot. The addition will be constructed on the south side of the existing residence, and be finished with exterior materials to match the existing residence. To the best of our knowledge, after requesting information from the County, there was no information on file regarding previous approvals, permits, or drawings for this property. Due to this situation, it was determined that an 'Activity Envelope & Site Plan Approval' would be required prior to submitting for a building permit. That application has been submitted to the Planning Department and is presently under review. We are also required to submit for a `Setback Variance Approval', as this addition extends beyond the minimum side setback. The existing residence is occupied by a family of five (2 parents & 3 small children), of which the husband is the ranch manager for the owner of the property, GSS Properties, LLC. This residence has the appropriate number of bedrooms & bathrooms, but the Living room & eat -in Kitchen, located on the south side of the residence, is too small for the family's daily activities. The owner has agreed to construct an addition to provide the family with a separate dining area & an enlarged living room. After reviewing this design criteria and considering the existing room layout & site conditions, the most appropriate location for the addition is on the south side of the existing residence. A separate Dining area is proposed to the south of the existing kitchen, and the existing Living area would be enlarged to the south. The addition is to be constructed as a simple rectangular box (15' x 28') with a new gable roof that is an extension of the existing roof. This design solution resulted in building the addition over the side setback. This property is zoned RS-30 with side setbacks of 30 feet. We are proposing a new south side setback of 15.0 feet for the main structure and 11.5 feet for the cantilevered fireplace /log storage section. Architectural site plan, floor plans & elevations are included in this application, describing these conditions. p.o. box 95 • Carbondale • colorado • 81623 phone 970.618.4346 fax 970.704.5062 email: grwarch @comcast.net Variance Application 7989 Hwy 133, Carbondale, CO Page 2 The following list describes our reasons for locating the addition on the south side of the existing residence and the request for a Variance to build the addition within the south side setback: L This property is a subdivision of a larger tract (Upper Sewell Tracts) which was created a number of years ago, prior to the present zoning standards. The shape of this property is unusual in that the proportions of width -to -depth are quite extreme, 120' wide by 1968' deep. When the 2 side setbacks of 30 feet each are considered, the buildable width of the property is reduced by half to approximately 60 feet. The existing residence is 58 feet wide and centered in the lot width, therefore eliminating any opportunity to build on the sides of the residence. 2. Although there is buildable area on the east side of the residence (front) towards Highway 133, the new spaces are best suited along the south side: the dining room off the kitchen, and the extension of the living area to adjoin the new dining room. 3. An addition on the east side of the residence would require the elimination of the primary entrance to the existing residence, requiring the family to enter the home through the garage or from an existing exterior door on the southwest comer (back door). By placing the addition on the south side, the existing entrance to the residence and access to all the interior rooms would not be affected. The daily activities of the family could continue during construction, and not be adversely affected. 4. If the addition were constructed on the east side, the existing sewer line (from house to septic tank) would have to be removed and relocated, and the family would have to relocate for a period of time while the basement construction and revisions to this utility were being completed. This would also create an additional expense for the project that the owner wants to avoid. 5. An addition on the east side would adversely affect the existing landscaping. There are several large mature pine trees in front of the residence that would have to be removed due to the excavation for the basement and relocation of utilities. Again, this would add further expenses to the project & the owner wants to leave the existing landscaping intact. An addition on the south side does not affect any of the existing landscaping, particularly the mature trees on the site. 6. By constructing the addition on the south side, the existing exterior wall that would be removed is a non - bearing wall that would not affect the structural integrity of the roof framing. If the addition is placed on the east side, a portion of the existing east exterior wall would be removed. This wall is a bearing wall for the existing roof framing and would require temporary support during construction and new structural beams and columns to support the existing roof for the new interior opening created by the addition.
