The Open Space and Trails Board has adopted the plan and recommends approval by the Board of County Commissioners. BACKGROUND: In early 2011, the US Department of Justice (DOJ), as part of the Americans with Disabilities Act, released new regulations defining the difference between a"wheelchair" and an "othe� power-driven mobility device" (OPDMD). The new regulations also defined assessment factors to use when determining what OPDMD vehicles could be used in which locations. In response, Pitkin County Open Space and Trails (OST) inventoried the existing trail system and defined a trail as: either Open, Restricted or Closed for OPDMD use. "Open" means that any OPDMD may be used. "Closed" means that no OPDMD may be used. A"Restricted" trail designation means that the OPDMD must meet the following design standards: less than 32" wide, design speed of 20mph or less, must be electrically powered, and a vehicle weight of 601bs or less (not including the weight of rider). These assessments took trail safety and environmental impacts into consideration to determine what would be appropriate where. The Appendix contains maps showing trails and approved OPDMD use. Pages 6 and 7 of the Appendix list the trails, the approved OPDMD use and the rationale behind the designation. All future trail additions to the OST system will define the use of OPDMDs in their respective management plans. OST also developed the following policies to govern the use of OPDMDs. ■ Use only if mobility impaired. ■ Some trails are off limits or restricted; check before you go. ■ Mobility Devices used on trails designated as Restricted must fit the following design requirements: less than 32" wide, design speed of 20mph or less, must be electrically powered, vehicle weight of 601bs or less (not including the weight of . ri er) . ■ Stay on trail. ■ No use of Nordic Ski trails. ■ Be safe and courteous of others. The Open Space and Trails Board is authorized to adopt management plans for Pitkin County Open Space Assets pursuant to Title 12 of the Pitkin County Code, Article 2-4. Where such plans also create specialized rules that are enforceable by our rangers and subject to civil penalties, such management plans also require adoption by the BOCC pursuant to an Ordinance. Title 12 of the County Code generally prohibits public use of motorized vehicles on Pitkin County Trails. The proposed Othe� Powe� D�iven Mobility Device Manageynent Plan creates a special exception to this general rule for certain trails, provided that the mobility device complies with our regulations regarding the dimensions, weight, and design speed. Anyone using a device not within those standards, and anyone without a mobility impairment using such vehicles, will be subj ect to penalties as otherwise provided in the County Code. Therefore, action by the BOCC is required for this plan. LINK TO STRATEGIC PLAN: This plan meets the County's Focus Areas of a Flourishing Natural and Built Environment by developing a trail system that allows ease of safe mobility for those with mobility disabilities, while limiting OPDMD use in areas that may be unsafe or cause environmental damage. KEY DISCUSSION ITEMS (ALTERNATIVES): OST Staff has distributed the OPDMD Management Plan to our adj oining trail management agencies. We want to work together to create a seamless system where ever we can. Currently RFTA draft guidelines have a different design weight limit for OPDMD's. OST Staff has spoken with RFTA Staff about this discrepancy. The current plan is to work on this difference in policy when the RFTA Board begins discussion for RFTA Final OPDMD guidelines, which we expect to occur in late fall. BUDGETARY IMPACT: Signage and outreach would be the only impacts and they are currently covered in our budget. RECOMMENDED BOCC ACTION: Adopt the proposed plan on first reading and set for second reading and public hearing. ATTACHMENT: Other Power-Driven Mobility Device Management Plan 2 AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY, COLORADO, ADOPTING THE OTHER POWER DRIVEN MOBILITY DEVICE MANAGEMENT PLAN ORDINANCE # , SERIES OF 2011 RECITALS 1. The Voters of Pitkin County and the Pitkin County Commissioners established an Open Space and Trails Fund for the purposes of preserving and providing open space and trails resources in Pitkin County, and established an Open Space and Trails Board of Trustees to guide the expenditure of those funds. 2. The Open Space and Trails Program is charged with protecting public access to waterways, scenic view planes, and habitat. 3. Title 12 of the Pitkin County Code, article 2-4, authorizes the Open Space Board to adopt management plans for Open Space and Trails properties, and requires Board of County Commissioner action by Ordinance when such plans require special use rules that differ from the general open space rules in Title 12. 4. The proposed Other Power Driven Mobility Device Management Plan sets new guidance for the use of Other Power Driven Mobility Devices on Pitkin County Open Space and Trails properties and trails, and this special rule requires approval by the Board of County Commissioners. 5. The Open Space and Trails Board passed a unanimous motion recommending this management plan to the Board of County Commissioners on July 27th, 2011. NOW THEREFORE BE IT ORDAINED by the Board of County Commissioners of Pitkin County, Colorado, that: 1. The Board of County Commissioners hereby adopts the Other Power Drive Mobility Device Management Plan and authorizes this to be enforced through Article 6 of Title 12 of the Pitkin County Code. 2. OTHER POWER- DRIVEN MOBILITY DEVICE MANAGEMENT PLAN EXECUTIVE SUMMARY In early 2011, the US Department of Justice (DOJ), as part of the Americans with Disabilities Act, released new regulations defining the difference between a"wheel- chair" and an "other power-driven mobility device" (OPDMD). The new regulations also defined assessment factors to use when determining what OPDMD vehicles could be used in which locations. In response, Pitkin County Open Space and Trails (OST) inventoried the existing trail system and defined a trail as: either Open, Restricted or Closed for OPDMD use. OST also developed a set of policies gov- erning OPDMD use on the OST trail system. All future trail additions to the OST system will define the use of OPDMDs in their respective management plans. A wheelchair is allowed in any area open for pedestrian use. Wheelchairs are de- fined as being designed primarily for use by an individual with a mobility disability for indoor or both indoor and outdoor use. Locations where OPDMD use is permitted is defined by the local public entity, tak- ing into consideration safety and environmental factors. An OPDMD is defined as any mobility device/vehicle, whether or not its primary design is for use by individu- als with mobility impairments, but is used by individuals with mobility impairments for locomotion and is not a wheelchair, as previously defined. The following policies govern the use of OPDMDs on OST assets and easements. • Use only if mobility impaired. • Some trails are off limits or restricted; check before you go. • Mobility Devices used on trails designated as Restricted must fit the following design requirements: less than 32" wide, design speed of 20mph or less, must be electrically powered, vehicle weight of 601bs or less (not including the weight of rider) . • Stay on trai I . • No use of Nordic Ski trails. • Be safe and courteous of others. For trails constructed after March 2011, please refer to the respective management plans. In the Pitkin County Open Space and Trails Other Power-Driven Mobility Device Management Plan the Introduction and Plan Purpose sections give the background of the new DOJ rule and outlines OST's response. The Department of Justice Other Power-Drive Mobility Device Definitions and Ru/es section contains the language of the new rules. Open Space and Trails Policies on Other Power-Driven Mobility Device Use and Open Space and Trails Penalties for Improper Use of an OPDMD share the OST regulations for OPDMDs and then the fines for inappropriate OPD- MD use. Appendix A contains the OPDMD trail designation maps and justifications for designations. OTHER POWER- DRIVEN MOBILITY DEVICE MANAGEMENT PLAN Page I I NTRODUCTION I n recent years, the choice of mobi I ity devices avai lable to i nd ivid uals with d is- abilities has increased dramatically. Questions began to arise concerning which mobility devices should be accommodated in public facilities and under what circumstances. The Department of Justice (DOJ) responded to these concerns by developing a two-tiered mobility device definition that defined the term wheelchair separately from other power-driven mobility device (OPDMD) . Along with this clari- fication in definition, the DOJ established requirements to allow the use of devices in each definitional category. Use of wheelchairs and manually-powered mobil ityaids. A public entity shall permit individuals with mobility disabilities to use wheelchairs and manu- ally-powered mobility aids, such as walkers, crutches, canes, braces, or other similar devices designed for use by individuals with mobility disabilities in any areas open to pedestrian use. ( 35.137 (a) ) Use of other power-driven mobility devices. A public entity shall make reasonable modifications in its poli- cies, practices, or procedures to permit the use of other power-driven mobility devices by individuals with mobil- ity disabilities, unless the public entity can demonstrate that the class of other power-driven mobility devices cannot be operated in accordance with legitimate safety requirements that the public entity has adopted pursu- ant to � 35.130(h). ( 35.137 (b.1) ) PLAN PURPOSE The purpose of the Other-Power Driven Mobility Device Management Plan (OPDMD Management Plan) is to define policies and procedures for the use of OPDMDs on Pitkin County Open Space and Trails (OST) properties and easements, in accor- dance with the DOJ direction. Part of the Mission for OST is to acquire, preserve, maintain, and manage properties and easements for recreational and access purposes. OST takes great pride in providing excellent recreational opportunities in breathtaking settings and works to make these opportunities accessible when possible. As previously mentioned, the DOJ rule addressing OPDMD use first clarified a wheelchair versus an OPDMD and established requirements for allowed use of each device. It then defined the Assessment Factors to use when determining what mobility device should be used and where or if an area should be closed to OPD- MDs. The OPDMD Management Plan will define: the DOJ OPDMD guidance; OST's policies on OPDMD use on current OST assets and address use on future proper- ties; approved OPDMD vehicles and the locations where OPDMDs are allowed; and penalties for improper OPDMD use. OTHER POWER- DRIVEN MOBILITY DEVICE MANAGEMENT PLAN Page 1 Wheelchair user en�oying a hiking trail. www. patriciaebauer. com DEPARTMENT OF JUSTICE OTHER POWER-DRIVEN MOBILITY DEVICE DEFINITIONS AND RULES The DOJ defines a wheelchair and OPDMD as the following: Wheelchair means a manually-operated or power-driven device designed primarily for use by an individual with a mobility disability for the main purpose of indoor, or of both indoor and outdoor locomotion. This definition does not apply to Federal wilderness areas; wheelchairs in such areas are defined in section 508(c)(2) of the ADA, 42 U.S.C. 12207 (c)(2). (35.104) Other power-driven mobility device means any mobility device powered by batteries, fuel, or other engines whether or not designed primarily for use by individuals with mobility disabilities that is used by individuals with mobility disabilities for the purpose of locomo- tion, including golf cars, electronic personal assistance mobility devices (EPAMDs), such as the Segway0 PT, or any mobility device designed to operate in areas without defined pedestrian routes, but that is not a wheelchair within the meaning of this section. This definition does not apply to Federal wilderness areas; wheelchairs in such areas are defined in section 508(c)(2) of the ADA, 42 U.S.C. 12207(c)(2). (35.104) The main difference between the two definitions is that a wheelchair must be de- signed specifically for use by individuals with a mobility disability. OPDMDs may be used by individuals with a mobility disability, but that is not necessarily the original design intent of the device. The DOJ defines the use of a wheelchair and the use of an OPDMD as the following: . . . . Use of wheelcha�rs and manually-powered mob�l�ty a�ds. A public entity shall permit individuals with mobility disabilities to use wheelchairs and manually-powered mobility aids, such as walkers, crutches, canes, braces, or other similar devices designed for use by individuals with mobility disabilities in any areas open to pedestrian use. In determining whether a particu- lar other power-driven mobility device can be allowed in a specific facility as a reasonable modification under paragraph (b)(1) of this section, a public entity shall consider (i) The type, size, weight, dimensions, and speed of the device; (ii) The facility's volume of pedestrian traffic (which may vary at different times of the day, week, month, or year); (iii) The facility's design and operational characteris- tics (e.g., whether its service, program, or activity is conducted indoors, its square footage, the density and placement of stationary devices, and the availability of storage for the device, if requested by the user); (iv) Whether legitimate safety requirements can be es- tablished to permit the safe operation of the other pow- er-driven mobility device in the specific facility; and (v) Whether the use of the other power-driven mobility device creates a substantial risk of serious harm to the immediate environment or natural or cultural resources, or poses a conflict with Federal land management laws and regulations. Inquiry about disability. A public entity shall not ask an in- dividual using a wheelchair or other power-driven mobil- ity device questions about the nature and extent of the individual's disability. ( 35.137 (c.1) ) Inquiry into use of other power-driven mobility device. A public entity may ask a person using an other power- driven mobility device to provide a credible assurance that the mobility device is required because of the per- son's disability. A public entity that permits the use of an other power-driven mobility device by an individual with a mobility disability shall accept the presentation of a valid, State-issued, disability parking placard or card, or other State-issued proof of disability as a credible as- surance that the use of the other power-driven mobility device is for the individual's mobility disability. In lieu of a valid, State-issued disability parking placard or card, or State-issued proof of disability, a public entity shall accept as a credible assurance a verbal representa- tion, not contradicted by observable fact, that the other power-driven mobility device is being used for a mobility disability. A"valid" disability placard or card is one that is presented by the individual to whom it was issued and is otherwise in compliance with the State of issuance's requirements for disability placards or cards. ( 35.137 (c.2) ) OTHER POWER- DRIVEN MOBILITY DEVICE MANAGEMENT PLAN Page 4 OPEN SPACE AN D TRAI LS POLICI ES ON OTHER POWER-DRIVEN MOBILITY DEVICE USE Open Space and Trails (OST) manages its assets for a variety of users to maintain diverse recreational opportunities. We strive to make the recreational experience on Open Space properties as accessible as possible. We are adapting our current policies and are redesigning our existing system to meet national access standards. We work closely with our neighboring trail managing agencies in attempt to create a seamless trail system. OST strives to maintain an enjoyable user experience while planning for a diverse range of trail users. OST has developed the following policies for Other Power-Driven Mobility Device (Mobility Device) use on OST managed assets. 1. Use Only if Mobility Impaired. Mobil- 3. Stay on the trail. Mobili- ty Devices must be operated in a responsible and prudent fashion, with respect to other trail user density and speeds and operated at a safe speed for conditions. Where other users are present, a safe speed for an Mo- bility Device is deemed to be the average speed at which the other trail users are trav- eling; under no condition shall an OPDMD be operated in excess of 20 mph. Please refer to Appendix A for maps illustrating the Mobility Device trail designations and associated trail assessments. Future trail designations will be covered in their associated Management Plans.
