Weiss, Eric C. Weiss, Jeffrey W. Weiss and Jennifer Weiss (hereafter "Applicant') have applied to the Community Development Director of Pitkin County (hereafter "Director ") to establish an Activity Envelope that encompasses the existing single family residence and proposed improvements, and Site Plan Review approval to add a garage and a new entryway to the residence and to improve the driveway. 2) The property is located at 250 Draw Drive, and is described as Lot 28, Ridge of Red Mountain. The existing residence was constructed in 1976. 3) The lot is zoned R -30 and contains approximately 30,350 square feet. 4) The Director finds that the request complies with the applicable provisions of the Code, as follows: A) The activity envelope primarily contains slopes of less than 30 %. The small areas of slopes in excess of 30% qualify as minor slope anomalies pursuant to Sec. 7- 20- 20(c)(3) of the Code. The slopes in excess of 30% are man -made fill slopes on the south side of the driveway that have been determined to be stable and the new construction will not negatively impact the stability. B) The wildfire hazard is rated as severe, and can be mitigated pursuant to the provisions of Sec. 7-20 - 60(c) of the Code. C) The parcel is within the mapped Scenic View Protection Area as seen from Highway 82, but the residence is not visible from the highway. D) The proposed additional residential development is exempt from growth management up to 5,750 square feet of floor area, pursuant to Sec. 6-30-110 of the Code. APPROVED by the Director, subject to the following conditions, which shall run with the land and be binding on all successors in interest: 1. The Applicant shall adhere to all material representations made in the application and shall consider those representations to be conditions of approval, unless amended by other conditions. 2. Prior to submission of any building permit applications for the improvements, the Applicant shall be required to submit for approval by the County Attorney and Community Development a Site Plan with an Activity Envelope in accordance with Land Use Code Section 2- 30 -20(g) and Application Manual Section 2.1.12. The above referenced approvals shall be a condition precedent to finalization and recordation of them. 3. The parcel is exempt from Growth Management for up to 5,750 square feet of floor area. 4. Prior to issuance of a building permit for the residence, the Applicant shall: Administrative Decision No" tg 2011 Page 2 A. Obtain an access permit for improvements to the driveway, which shall be approved by Planning/Zoning and Aspen Fire Department. B. Submit a site specific drainage and erosion control plan prepared by a qualified engineer or geologist for review and approval by Planning/Zoning. C. Pay the applicable road and employee housing impact fees. D. Submit a construction management plan for review and approval by Planning/Zoning. E. Submit a detailed revegetation plan for disturbed areas with appropriate seed mixes. F. Submit a tree mitigation and landscape plan. 5. The Applicant shall provide adequate engineering of any retaining walls over 4' in height and /or any improvements to retaining walls over 4' in height. 6. The Applicant shall comply with the following standards for Development in a Severe Wildfire Hazard Area: A. Defensible Space: The area around all buildings /structures, limited by property boundaries that may limit a property owner's ability to comply with this section, shall incorporate landscaping with wildfire defensible space considerations as follows (note: actual vegetation manipulation to meet these conditions may not be necessary where the natural vegetation patterns have already fulfilled these conditions): 1) Remove dead vegetation between the residence and the properties to the east and west. 2) Clear dead wood from the native brush to the south for a distance of 100' from the residence. 3) New landscaping to the east of the garage shall be limited to Aspen trees, irrigated grass and shrubs or flower beds. 4) Remove or chip and spread cut and collected material. 5) No new conifer trees shall be planted within ten (10) feet of a residence. 6) No flammable mulches shall be placed within two (2) feet of a residence. 7) The property owner shall be responsible for the continued maintenance of the defensible space vegetation requirements. B. Roofing Materials: Class A covering or Class A Assembly as defined by the currently adopted Building Code. No wood shakes or shingles. All other adopted Building Code compliant methods and materials permitted. Roofs with less than a 3:12 pitch are not permitted unless they comply with the following: 1) All roof coverings shall be constructed of non - combustible materials and installed on a Class A roof assembly. 2) All roof coverings shall have a surface that shall facilitate the natural process of clearing roof debris. 3) Protrusions above the roofline, such as parapets, shall be prohibited. 4) Roofs shall be installed as required by the adopted Building Code and shall have a minimum pitch of 1:48. 5) All roof designs, coverings, or equivalent assemblies shall be specifically approved by the Fire Marshal prior to submittal of a building permit application. C. Roof Venting: I) Soffit venting shall be located in the outer 1 /3` portion of the overhang. Administrative Decision No. p a 2011 Page 3 2) Attic, soffit and other roof venting shall be of non - corrosive metal mesh with maximum ''/4" openings. D. Projections at the Roofline, including Soffits, Rafters, Porch or Deck Roofs, Fascias, or Other: One hour rated material or any material underlain by 5/8" Type X gypboard or equal, or "Type IV" Heavy Timber materials, per the currently adopted building code. E. Decks, Decking, Cantilevered Floors, or Other Projections Below the Roofline: I ) Construction with noncombustible or one (1) hour rated material, or material with flame spread <25 (tested to ASTM E84 and listed for exterior use), or 2) Conventionally framed deck with waterproof surface and underside protected with 5/8" Type X gypboard or equal (decking as "a" above), or 3) "Type IV" Heavy Timber materials: joist and beams minimum 6 "x10 ", columns minimum 8'x8 ", decking minimum 4" in depth, or decking as "a" above: or equivalent log construction, or 4) Enclose projection vertically to ground with one hour fire resistive materials. Decking as "a" above. F. Railings: Railings must be constructed of noncombustible or "Type IV" Heavy Timber materials. G. Exterior of the Structure, Including All Walls: 1) One (1) hour fire resistive rated materials, or 2) 5/8" gypboard underlying combustible materials, or 3) Cement stucco, minimum 3 /4" thickness. 4) All glazing to be tempered glazing; and 5) Doors to be metal or wood 1 3 /4" thick minimum. H. Foundations: Foundations, skirting, and crawl space openings shall be fully enclosed and constructed with materials approved for one (1) hour fire- resistive construction on the exterior side of the walls and shall extend from the top of grade to the underside of the floor decking or walls. K. Maintenance and Miscellaneous Requirements 1) Roofs and gutters shall be kept clear of debris. 2) Roof vents shall be screened with corrosive resistant wire mesh, with mesh one -fourth ('/4) inch maximum. 3) Any outbuilding shall adhere to the same wildfire requirements. 4) Yards shall be kept clear of all litter, slash and flammable debris. 5) All flammable materials shall be stored on a parallel contour a minimum of fifteen (15) feet away from any structure. 6) Weeds and grasses within the ten (10) foot perimeter shall be maintained to a height not more than six (6) inches. 7) Firewood /wood piles shall be stacked on a parallel contour a minimum of fifteen (15) feet away from the structure. 8) Swimming pools and ponds shall be accessible by the local fire district. 9) Fences shall be kept clear of brush and debris. 10) Wood fences shall not connect to other structures. 11) Fuel tanks shall be installed underground with an approved container. 12) Propane tanks shall be buried, if possible, or installed according to NFPA 58 standards and on Administrative Decision No.O OZ -2011 Page 4 a contour away from the structure with standard defensible space vegetation mitigation around any aboveground tank. Any wood enclosure around the tank shall be constructed with materials approved for two (2) hour fire- resistive construction on the exterior side of the walls. 13) Each structure shall have a minimum of one ten (10) pound ABC fire extinguisher. 14) Addresses shall be clearly marked with two (2) inch non - combustible letters and shall be visible at the primary point of access from the public or common access road and installed on a non - combustible post. 15) Utilities shall be extended underground. 7. The Applicant shall comply with the following measures to mitigate impacts to wildlife: A. Native vegetation shall be maintained outside of the activity envelope. B. Trash/garbage shall be kept in an approved bear resistant container or enclosure, pursuant to the County's Wildlife Protection Ordinance. Verification of compliance shall be provided prior to issuance of a certificate of occupancy. C. Contractors /construction workers shall be required to provide bear proof containers for all edible and food related trash. D. Avoid fruit- bearing trees and shrubs in any landscaping. E. Construction workers are prohibited from bringing their dogs on site. F. All outside doors shall utilize only solid round handled door knobs, unless another type is required by the applicable Building Code for disabled accessibility purposes. 8. No development including grading, excavation, fill placement, berming, landscaping, vegetation removal or disturbance, shall occur outside of the approved activity envelope, except as necessary to comply with the wildfire mitigation measures described above. 9. Prior to commencement of any earthmoving or other construction activity, the Applicant shall stake the corners of the activity envelope and install construction fencing around the construction site within the perimeter of the activity envelope. The fencing shall remain in place until issuance of a Certificate of Occupancy. 10. All areas disturbed by construction shall be re- vegetated with native shrubs and grasses within one growing season of the project's completion. 11. No development in excess of 30" above or below natural grade shall occur within the setbacks of the lot, with the exception of driveways and associated retaining walls of up to 6' above or below natural grade and fencing. Landscaping in the form of berms shall not exceed four feet from the most restrictive grade. Any development located within setbacks mandated by County zoning regulations that does not comply with these restrictions shall require a variance from the Board of Adjustment. Approval of an activity envelope within such setbacks does not assure approval of a variance. 12. No calculations for height, bulk, setback, size, floor area, or any other building and zoning requirements have been conducted. These requirements will be considered at the time of building permit. Any structures represented in the application may not be permitted under building and zoning regulations. 13. Failure to comply with the conditions of this approval may result in revocation of this approval, or any subsequent permit(s) or approval(s) related to this property, or vested rights associated with this property. Martin Mata Mata Design Company 250 Draw Drive Aspen - Activity Envelope and Site Plan Review p 2 08 -17 -2011 Mata Design Company 000002 Prior Approvals/ Existing Property Conditions: The immediate neighborhood is located on Red Mountain, Is zoned R -30 and generally consists of single - family homes in platted subdivisions with lots of varying sizes The subject property is Lot 28 of The Ridge Of Red Mountain Subdivision. A subdivision plat was recorded In the fall of 1968 A vicinity and neighborhood map is attached as exhibit 'A'. A copy of the recorded plat is attached as Exhibit 'B' A single family residence was constructed on the property in 1976. According to building permit records subsequent minor alterations have been made over the years since 70's With a bedroom addition in 1993 being the latest modification The site is on the south side of Draw Drive, slopes to the South from the street down to the bottom of the draw where the Salvation Ditch runs through the property, approximately 70 ft Below the driveway access point. An existing 14 ft. sewer utility easement runs across the property. 7 ft. wide general utility easements are located along the side and rear property lines Existing development is located on the northern half of the property. On Pre - Existing Lots: Section 6- 30- 100(a)(2) of the land use code provides a GMQS exemption for expansion of an existing structure. The existing residence was legally established The certificate of occupancy for the existing structure is on file with the Pitkin County Building Department. There is no change proposed to the use of the structure The expansion will continue as a single - family residential use. Since the property is in a board - approved subdivision, section 6- 30- 100(a)(2) allows for development of up to 5,750 s.f of floor area on this lot. Section 7 -10 -50 Site Plan and Activity Envelope: The proposed envelope defined in this application encompasses existing conditions and provides for a continuation of the established uses of the subject property. The garage addition proposed in this application is relatively minor and Is attached to the existing primary structure . The driveway extension is within an area that has been previously disturbed. The existing driveway is to be re -built and expanded to Pitkin County Standards. Adequate room exists for on -site staging and parking during construction. The excavation and site work required will be limited to the building addition areas indicated on the architectural site plan (see exhibits 'C & D') No material change in site drainage and minimal removal of vegetation is anticipated. Vegetation is to be modified as recommended by the wildfire consultant's report (exhibit 'H') including trees to be removed greater than 6" dbh. Site drainage will be addressed at permit submittal as required by the county engineering department. The proposed work Is to be further detailed per building permit requirements at building permit submittal Section 7 -20 -20 Steep and Potentially Unstable Slopes: The existing driveway and house were built in 1976 with no significant changes made to the site slopes since the original construction. The attached 2011 slope analysis (exhibit 'E')shows that the 1976 construction created minor man -made slope anomalies in excess of 30% The included geotechnical report (exhibit 'I') demonstrates that the proposed construction meets the exemption criteria of 7- 20- 20(b)(2) and 7- 20- 20(c)(3) MINOR SLOPEANOMALY Section 7 -20 -30 Water Courses and Drainage: Since the proposed work is to be relatively small in scope, the required drainage and erosion control will be modest. No water courses, groundwater, irrigated areas or ditches are to be affected by the proposed development. As may be required by the Pitkln County Engineering Department, a drainage and erosion control plan is to be submitted with a building permit application. On Wednesday, August 3" I went to the property to take photos, measure slopes and evaluate the wildfire hazard on the property. The house is set back about 60 feet from the slope to the south going down to the Salvation Ditch. The area between the house and the slope is mostly irrigated grass and flower beds and is well maintained. The slope down to the Salvation Ditch is generally 30 percent or more and is heavily vegetated with oak, service berry, native grass and other native brush. The dense vegetation in the draw as well as the configuration of the geology of the draw creates a high wildfire hazard in this area. The property lines to the east and west are fairly close to the house as typical of these properties on Draw Drive. There is currently some established vegetation between the houses that appears to be intended for visual screening. The conceptual design indicates that the only addition to the house will be the garage at the northeast comer of the house. Vegetation Management and Modification Recommended: Between the house and property to the west the dead wood should be cleaned out of the screening vegetation. The proposed garage addition will cause the removal of much of the vegetation in this area - Any vegetation provided east of the garage should be either Aspen trees, bushes, irrigated grass or flower beds. The site plan showing the driveway, retaining wall and existing trees along Draw Drive is appropriate. To the south of the house the lawn and flower beds provide for appropriate defensible space. New Construction: I recommend that the design, materials and construction of buildings conform to the design features and materials required by Pitkin County for safe construction as restated below: Pitkin County has Structural Design and Construction Requirements, the following are paraphrased from Pitkin County Land Use Code, Chapter 7, Section 7 -20 -60 Wildfire hazards and may not contain exact language but it is intended to be consistent with the intent and purpose of the Pitkin County Requirements. Projections: I recommend that no portion of the building(s) or addition(s) be constructed with unenclosed projections such as decks. Eves should be kept to a minimum on the down slope side and on the sides and should not have ventilation openings unless the design and configuration of the openings are specifically approved by Pitkin County. Projections may include, but are not limited to eaves; cornices; soffits; roofs over open decks, cantilevered floors; bay windows; decks or balconies. Projections may cause heat traps and should be protected as follows: Any projection including guardrails should be constructed with materials approved for one -hour fire- resistive construction, any material underlain by 5/8° Type X gypboard or approved equal or Type IV Heavy Timber materials per the currently adopted building code. Projections should have no inside angles of less than seventy -five (75) degrees. An alternative construction for projections would require the use of non - combustible building materials or materials with a flame spread rating of less than twenty five (Q5 tested to ASTM E84) and listed for exterior use. Areas below projections should be void of vegetation or other combustible materials. The areas below these projections shall be protected from accumulation of vegetative materials by placement of a vegetative barrier covered with rocks or gravel or shall be concrete or stone. The findings of our observations and recommendations for design are presented in this report. The services were performed in accordance with our agreement for professional engineering services to you, dated August 5, 2011. Proposed Construction: The proposed garage will be a one story structure over a crawlspace. We understand that the fill slopes for the new portions of the driveway are proposed to be supported with new boulder retaining walls. Slope Review: The overall slope in the addition area is down to the southwest at about 18 % grade. The slope is vegetated with relatively thick aspen trees and oak brush. The only slopes steeper than about 20% in the building area are man -made fill slopes on the south side of the driveway. Part of the driveway in the stairs /entry area is supported by timber crib retaining walls. The remaining, eastern portion of the driveway has a steep man -made fill slope, about 5 to 6 feet high, with grades of 50% to 60 %. The slope is vegetated with grass, weeds, brush and small trees. Cobble -sized rock was exposed on the slope surface. No evidence of slope instability such as ground cracking, distressed vegetation, slumping, water seepage or erosion was observed on the steep slope or other slopes at the site. The existing steep man -made fill slopes appear stable under current conditions and the new construction will not negatively impact the stability. There is no slope instability hazard posed by new development as planned. It is our understanding that the existing steep driveway fill slope will be mostly replaced with new driveway fill and that new fill slopes will be supported with boulder retaining walls. The existing timber crib walls will also be replaced with new concrete retaining walls. F. 7, 1- n n „^ U - rUG August 11, 2011 Page 2 New Boulder Retaining Walls: The new boulder walls up to 7 feet high should be designed as gravity walls with the base width of at least 2 /3 of the retained wall height. For example, if the wall height is 7 feet the base width should be 4 feet, 8 inches. A typical boulder wall section (Figure 1) is attached. The design assumes that the boulders will be internally stable. This will depend on the careful placement of the boulders by an experienced contractor and preferably the use of rectangular shape rather than round boulders. Some grouting of the boulders may be needed if they bulge or shift in the future. Backfill placed behind the boulders against the new fill should consist of 3 A -inch screened rock. A 4 -inch diameter perforated drainpipe sloped at a minimum 1 % grade to daylight should be provided at the bottom of the screened rock backfill. The recommendations submitted in this letter are based on our observation of the existing site conditions and our understanding of the proposed construction. We recommend that we observe excavations for the garage and provide density testing of structural fill as needed. Subsurface exploration and analysis has not been conducted to evaluate the slope stability. Variations in the subsurface conditions could change our findings and recommendations. We approved the Weiss garage on August 5, 2011 and everything seemed in good order, but we did require them to put in planting along the eastern side of the garage tomake the wall have less of an impact on the adjecent nerighbor, Bill Montgomery.
