APPROVAL OF THE PURCIO ATTACHED CARETAKER DWELLING UNIT

RECITALS
1. Ron Purcio ( "Applicant') has applied to the Community Development Director of
Pitkin County, Colorado for Special Review approval of a attached caretaker dwelling
unit.
2. The property is located at 0022 Beaver Lane, Redstone, and is described as Lot A -4
of Redstone Ranch Acres.
3. The Applicant proposes to deed restrict the proposed caretaker dwelling unit pursuant
to Section 9- 110- 041(c)(2) of the Land Use Code.
4. The Director finds that the Purcio attached Caretaker Dwelling Unit complies with
applicable standards of the Land Use Code Sections 3 -210 and 9- 110 -041 and has
recommended approval of the request based upon compliance with these sections.
THE DIRECTOR DOES HEREBY APPROVE the Purcio attached Caretaker
Dwelling Unit subject to the following conditions:
1. The proposed CDU shall contain less than 700 net livable square feet.
2. The kitchen shall contain at least a two burner stove with oven, standard sink, and
at least a 6 -cubic foot refrigerator plus freezer.
3. One off - street parking space shall be provided for the unit.
4. A deed restriction for the caretaker dwelling unit shall be recorded prior to
issuance of a Building Permit for the caretaker dwelling unit.
5. Prior to issuance of a Certificate of Occupancy for the caretaker dwelling unit, a
site visit shall be conducted by the Housing Office.
6. Floor plans of the caretaker dwelling unit shall be provided to the Housing Office
prior to building permit approval.
7. The applicant shall adhere to all material representations made during the
application process.

SUMMARY: The applicant requests approval to construct an attached caretaker dwelling unit to
be located above the garage.

REFERRAL COMMENTS: The application was referred to the County Attorney, Redstone
Ranch Acres HOA, and Housing. The County Attorney and Redstone Ranch Acres HOA did not
respond, and the Housing Office's comments are attached.
STAFF COMMENTS:
Caretaker Dwelling Unit: A caretaker dwelling unit is listed as a special review use in the AFR-
10 zone district, and therefore must comply with the following standards (as amended by
Ordinance No. 021 - 2001):
A. The special review use shall consider the applicable County Master Plan.
Response: The special review use is consistent with the applicable master plan.
B. The special review use shall not conflict with any applicable sections of the Pitkin County
land Use Code, including the County Land Use Policies in Article 2.
Response: The use is consistent with the Pitkin County Land Use Code and the Land Use
Policies.
C. The special review use shall be consistent with the intent of the Zone District in which it
is proposed to be located.
Response: The AFR -10 zone district is intended to permit low density, single family dwelling
units and customary accessory uses. The County considers a CDU to be a customary accessory
use to a principal residence. While the parcel is non - conforming in size, it is within an
established subdivision that was created before the current zoning was enacted.

D. The special review use shall be compatible with the character of the immediate vicinity of
the parcel proposed for development and surrounding land uses, or shall enhance the
mixture of complimentary uses and activities in the immediate vicinity of the parcel
proposed for development.
Response: The area is a residential subdivision, and the development of an attached caretaker
dwelling unit is compatible with the surrounding land uses.
E. The location, size, design and operating characteristics of the proposed special review
use must be in harmony with the surrounding area and minimizes adverse effects,
including visual impacts, impacts on pedestrian and vehicular circulation, traffic
generation, parking, trash, service delivery, air /water pollution or other impacts on
natural resources, noise, vibrations and odor on surrounding properties.
Response: The proposed CDU will be located in existing space above the garage.
F. There must be adequate public facilities and services to serve the special review use,
including but not limited to roads, potable water, sewer, solid waste, parks, police, fire
protection, emergency medical services, hospital and medical services, drainage systems,
and schools.
Response: The Applicant has installed a new septic system, which is sized adequately to handle
the CDU in addition to the residence. The CDU will not create additional impacts on public
facilities and services, such as fire, EMS, schools, etc., beyond the impacts generated by the
existing principal residence.
G. An application for a special review use must demonstrate to the Board of County
Commissioners that the proposed development will not:
a. Materially endanger the public health, safety or welfare; and
b. Substantially injure the value of adjoining or abutting property.
Response: Staff has no information that would indicate that the development would injure the
value of adjacent properties, or endanger the public health, safety or welfare.
Pursuant to Section 9- 110 -041(C) of the Code, an attached caretaker dwelling unit not to exceed 700
square feet may be permitted on a non - conforming size lot in the AFR -10 zone district under the
following conditions and limitations:
1. The floor area of the caretaker unit shall be included in the total allowed floor area for the
lot or parcel of land.
Response: The parcel is limited to a maximum of 5,750 square feet of floor area exempt from
growth management. The CDU will be included in this maximum.
1. There shall be provided one off - street parking space for each bedroom in the caretaker unit.
Response: The CDU will contain one bedroom. Adequate on -site parking is available to
accommodate the CDU.

3. The applicant shall deed restrict the unit to comply with the caretaker unit deed restriction
pursuant to Section 3- 150- 130(C)(3) of the Land Use Code.
Response: The Applicant agrees to deed restrict the unit. The Housing Office recommends
approval of the CDU.
4. The dwelling unit deed restriction may only be removed upon approval by the Community
Development Director.
Response: This requirement shall be included in the deed restriction
RECOMMENDATION: Staff recommends that the Community Development Director approve
the Purcio attached Caretaker Dwelling Unit subject to the conditions in the attached
Determination.

No. 94 -7 and 99 -37 establish a fee structure for Planning applications and the
payment of all processing fees is a condition precedent to a de;ermin3tion of
application completeness.
3. APPLICANT and COUNTY agree that because of the size, nature or
scope of the proposed project, it is not possible at this time to ascertain the full
extent of the costs involved in processing the application. APPLICANT and
COUNTY further agree that it is in the interest of the parties for APPLICANT to
make payment of an initial deposit and to thereafter permit additional costs to be
billed to APPLICANT. APPLICANT agrees he will be benefited by retaining
greater cash liquidity and will make additional payments upon notiticalioi i by the
COUNTY when they arc necessary as costs are incurred. COUNT4 agree:: it will
be benefited through the greater certainty of recovering its fill costs to process
