RE: Gardner Minor Ridgeline Review
DATE: March 4, 1991
REQUEST: The applicant, Thomas Gardner, has applied for a
building permit for construction of a garage which is to be
accessory to his existing residence. The existing residence is
approximately 1,799 square feet in size and is located on Lot 16
of the Shield -O- Terrace Subdivision. The garage is proposed to
be 540 square feet in size. Both the existing residence and
garage are located within the mapped scenic overlay/ ridgeline
area for Snowmass Creek Road. The existing home and proposed
garage do and will break the skyline from one perspective on
Snowmass Creek Road. However, the broader view of the home and
garage site from the Road does not break the skyline. Topography
of the lot is such that building must occur either on the
ridgeline or encroach on significant slopes.
Section 3- 1.13(D) (1) of Ordinance 90 -07 permits the Planning
Director to sign off on ridgeline development "within the mapped
scenic overlay (which) is insignificant and will not impact the
visual quality of the ridgeline or overlay area." In addition,
an administrative review may occur when proposed ridgeline
development meets the following criteria:
In the case of additions or remodels of existing homes,
visible development is thirty percent or less, of the
existing square footage of the structure;
The applicant proposes to build a garage which is to be no more
than 30% of the floor area of his existing residence. The
"visible" development will be far less than 30 %. As such, the
garage may be exempted from the full ridgeline review. Given the
location of the existing residence on the ridgeline, the addition
of the garage will not add a significant visual impact.
FINDINGS:
1. The visible aspect of the proposed garage addition
constitutes 30% or less of the existing square footage
of the residence.
2. The proposed addition does not significantly change the
visual quality of the ridgeline.

Per the information you gave me yesterday, we are withdrawing our appeal of the approval for
the garage building, applied for by Tom Gardener, in the Shield a Terraces area.
Based on your comments, we understand Mr. Gardner is cancelling his building permit for his
planned garage, and that he will be submitting new plans for an addition to his house and a
larger, separate garage. As a result, he will; have to submit new plans and applications. and go
through a full scenic foreground review. We understand we will have full opportunity to
comment and review his new plans at the approprlate'Ume.
If he changes his mind about withdrawing his permit, we of course do not want to cancel this
appeal.
Would you please return the $152.00 appeal fee we submitted at your earliest convenience, if
the appeal hearing Is cancelled.

Pursuant to our conversation today, this is to notify you that we wish to appeal the approval for
the garage building, applied for by Tom Gardener, in the Shield O' Terraces area.
We are not contesting his right to build a garage, but the placement of it on his property. We
believe its current location on a ridgeline is not appropriate for the overall good of the
community.
Please let me know where I should send the $152.00 appeal fee, and if there is any other paper
work I have to fill out to file this appeal.

We are totally confused by the policy regarding the ridge line review process. In particular,
this concerns the approval for a separate garage building, applied for by Tom Gardener, In the
Shield O' Terraces area.
We are concerned over the rapidity of the review and approval. We had understood there would
be a hearing or opportunity to present our homeowner association's viewpoint. There was none.
Also, there are gross inaccuracies in the letter to you dated March 4, recommending approval.
Considering the fact that the planner told me she had not visited the site, this erroneous opinion
is probably understandable. We did submit a set of photos of the planned site, however, to the
Board of Variance, which apprarently she saw. After viewing them, how anyone could write,
..the broader view of the home and garage from the Road does not break the skyline.," is
beyond my comprehension. And the statement, "...the lot is such that building must occur
either on the ridgeline or encroach on significant slopes.," is totally untrue. It can be attached
to the north end of the existing house, which would not have any impact on the ridgeline.
The reason we are concerned is that this new structure will be approximately equal in mass to
the existing house on the ridgeline of the entry way to our area. I was told by Ms. Sassano that,
"It shouldn't make any difference since there's already a house there." With that reasoning, if
this is built and there are two, anopther one or two will be even easier to approve next time!
There is a logical solution to the placement of this garage that will give Mr. Gardener what he
needs and hopefully prevent the natural beauty of our valley from being degraded any more than
it already is. This is a rural, unspoiled valley. Mr. Gardener's home is one of only two homes it
the entire valley that breaks a ridgeline. We thought the ridgeline review was to help prevent
the despoiling of these scenic areas for the overall good of the community. A cursory review and
approval, as apparently happened in this case, seems criminal when there's an easy alternative.
What happens next time when someone wants to build on a ridgeline outside our homeowner's
area, where there is no homeowner's architectural review committee? Does anyone care? We'd
like to know what the appeal process is on this matter.

Dear Mr. Bishop,
A public hearing has been scheduled before the Planning and
Zoning Commission on Tuesday, June 4, 1991 at a meeting to begin
at 9:00 am.
The Land Use Code requires that Scenic Overlay Review appeals be
heard at a public hearing noticed pursuant to Section 6 -3.4. I
have enclosed a copy of the notice requirements of this section.
The appellant is responsible for meeting these requirements.
Please submit a list of all property owners adjacent to the
Gardner property by Friday, May 17th. Thank you.

NOTICE IS HEREBY GIVEN that a public hearing will be held on
Tuesday, June 4, 1991 at a meeting to begin at 9:00 am before the
Pitkin Planning and Zoning Commission, Commissioner's Meeting
Room, 506 East Main Street, Aspen to consider an appeal of the
Planning Office decision giving Scenic Overlay approval to Tom
