D5(o , 2011 RECITALS 1. The County of Pitkin in the State of Colorado is a duly created political subdivision of the State organized and operating as a home rule charter county pursuant to the general statutes of the State and a County Home Rule Charter ( "the Charter ") adopted pursuant to the Colorado Home Rule Powers Act. 2. The members of the Board of County Commissioners of the County ( "the Board ") have been duly elected, chosen and qualified. 3. The current "line of site" technology for wireless communication is not adaptable to many of our mountain communities for wireless communication. This technology means that in order for your wireless device to send and receive signals it must see a tower that is broadcasting these signals. This technology significantly limits the coverage area in mountain communities, unless towers are built more extensively than currently located. 4. The Board recognizes that it is appropriate for the electorate to determine whether unfunded communication services such as cellular phone, broadband internet services and other new technologies be added to the purpose of the FM radio and translator property tax previously approved by the electorate on November 7, 1995, as they become available and affordable. 6. This new language will not affect the current operations of the translator system. 5. The current mill levy is at .179 NOW THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY, COLORADO: 1. That the following question shall be submitted to the electorate at an election to be held on November 1, 2011: Expanding the purpose of the Pitkin County FM & TV Translator Property Tax Without increasing taxes, shall the purpose of the existing FM radio and TV translator property tax be expanded to include researching and facilitating the extension of wireless communication and internet services within Pitkin County, if and when the technology is available and affordable, as well as continuing to fund all costs related to the FM radio and TV translator system?
