PITKIN COUNTY / _ 4 7 7 b BOARD OF COMMISSIONERS CONTRACT FOR SERVICES OF KAREN SMITH CONTRACT #606.-/Q 75 CONTRACT #75- to THIS CONTRACT, effective the 20th day of January 1975, by and between Pitkin County, Colorado, hereinafter referred to as Pitkin County and Karen Smith, hereinafter referred to as the Contractor. WHEREAS, authority exists in the Law and funds have been budgeted in the Commissioners' Consultant account; and WHEREAS Pitkin County desires that the Pitkin County Zoning Resolution be reviewed and revised where appropriate; and WHEREAS, the Contractor has the necessary skills and proven ability to assist in the review and revision of the land use and zoning regulations, NOW, THEREFORE, it is hereby agreed that: 1. The Contractor will perform the necessary work to carry out the following duties which will include but not be limited to: a) Evaluation of the effectiveness of the current zoning regulation; and b) Assist Pitkin County in the rewriting of the Zoning Resolution to accommodate the ROMCOE Code provisions and CSU Environmental Inventory, and c) Incorporate 1041 regulations and 1034 powers into the zoning resolution where appropriate; and d) Perform related duties as required; and e) During the first 2 to 4 weeks the Contractor will edit the ROMCOE draft to eliminate excess verbiage and will charge half her time and cost for doing this to Pitkin County and the other half to La Plata County. All subsequent time spent on Pitkin County work will be billed direct to Pitkin County. 2. The Contractor will work under the general and specific direction of Commissioner Joseph E. Edwards. 3. The Contractor may negotiate the modification of these duties with Commissioner Edwards but will be bound by Commissioner Edwards' decision on any such negotiations. Pitkin County will,itx.consideration of the execution by the Contractor of this contract, cause to be paid to the Contractor the sum of $9.00 per hour, payable monthly. Total amount of this contract shall not exceed Four Thousand and Five Hundred Dollars ($4,500). Upon approval of this contract, the County shall pay the Contractor $500 as the first payment on the above. 5. Upon presentation of bills for secretarial services and needed materials, the County will reimburse the Contractor up to a total not to exceed $500.00. 6. Either party to this contract may cancel and terminate this contract at any time, as long as the party canceling or terminating gives a ten (10) day notice in writing of intent to cancel or terminate; however, this contract will terminate on April 20, 1975. 7. Pitkin County will make available in Aspen without charge to the Contractor, such office space necessary for the perforance of the services agreed to under this Contract. 8. This contract is personal in nature and cannot be assigned. 9. The laws of the State of Colorado shall control in the execution and interpretation of this contract. 10. Time is of the essence in the performance of this contract. IN WITNESS WHEREOF, the parties hereto have executed this Agreement as if written on the day first above written.
