1 CONCERNING EMERGENCY USE OF
ROCKY MOUNTAIN LANDING LIGHTS
I
THIS AGREEMENT is made this 3rd day of July ,
1975, by and between ROCKY MOUNTAIN AIRWAYS, INC. (hereinafter
referred to as "Rocky Mountain "), and THE BOARD OF COUNTY COM-
MISSIONERS OF PITKIN COUNTY (hereinafter referred to as "the
County ").
WHEREAS, Rocky Mountain owns and operates a system
of airport runway lights at Sardy Field (Aspen Airport) for
its night flights, and
WHEREAS, such airport runway lights are permitted by
Pitkin County according to the terms and conditions of an agree-
ment between Rocky Mountain and Pitkin County dated May 5, 1975,
and
WHEREAS, such agreement restricts the hours of use of
the lights and requires that no use thereof may be made by other
than Rocky Mountain without the prior written request and per-
mission of Pitkin County, and
WHEREAS, certain emergencies have arisen in which use
of the lights would be of great benefit for safety and other such
reasons,
NOW, THEREFORE, the parties hereto, in consideration
of mutual promises contained herein, agree as follows:
1. Rocky Mountain shall make available the use of
its lights, as hereinafter set forth, for the following
emergency conditions:
a. Evacuation out of the Aspen area of seriously
injured persons for hospitalization or medical
services elsewhere;

b. Landings of search aircraft after dark that
have been on bona fide, emergency air rescue
missions in the area; and
2. Rocky Mountain shall make available the use of its
runway lights for emergency purposes only. Rocky Mountain shall
provide an external control box for activation of the runway
light system, contained within a secure enclosure. Access to
the control box shall be accomplished by lock and key, and
Rocky Mountain Airways shall provide the security with lock
and key, and shall provide at least three copies of the keys
to the County. Nothing contained herein shall be deemed to
create a duty on the part of the County or Rocky Mountain to
keep personnel available for light activation.
3. The County shall designate certain groups that
shall have the authority to activate the runway lights for
emergency use.
The lights may be activated in the following situa-
tions by the persons designated opposite the category:
Category of Emergency Persons
Par. 1(a), above Any member of Aspen Valley
Hospital administrative council,
doctors on duty at the hospital,
or medical emergency personnel,
or law enforcement personnel,
or County airport personnel as
may be designated in advance
in writing by the Board of
County Commissioners
Par. 1(b), above County airport personnel, members
of Mountain Air Rescue, or law
enforcement personnel as may be
designated in advance in writing
by the Board of County Commis-
sioners
All use of the lights in emergency purposes shall be
deemed to have been done at the instance of the person acti-

vating the system and operated under their control.
4. The County may publish from time to time rules
and regulations for the use by the groups listed in paragraph
3 above. This shall include, by way of example and not by
limitation, the requirement of the filing with the County of
a report by the using group, within 24 hours after activation
that shall contain the following information:
a) Name of group
b) Person in charge
c) Reason for use and category of emergency
d) Time of request for use
e) Person requesting use
f) Period of use
g) Number of take -offs and landings
h) Aircraft by registration number
i) Pilot of aircraft
j) Name of persons subject to emergency
5. The parties agree that use of the lights under
i this agreement is in the condition "as is ". The County shall
endeavor to obtain such releases of liability of the parties
hereto as may be appropriate from those involved in use of
the lights, including those who are to benefit from such use
on any particular occasion.
6. Rocky Mountain and the County agree that use of
the lights as above set forth shall in no way be construed to
1 breach either party's obligations under their contract dated
May 5, 1975, or any renewal, extension or substitution thereof,
unless (and to the extent) that later writing specifically
is stated to affect this agreement.
1 7. Rocky Mountain agrees to bear the cost of
electrical power utilized by the lights for the above - listed
emergency uses.

8. This agreement may be terminated by either
party hereto upon thirty days' written notice.

Dear Gordon:
I enclose a copy of the agreement signed by the
Commissioners with regard to use of Rocky Mountain's landing
lights in certain emergency conditions. Would you please
return two signed copies to me. As you know, the FAA did not
wish local tower personnel officially to have any participation,
and therefore, I have dropped mention of them.
The Commissioners hereby designate the following to
be in charge of activating the lights and receiving a key
therefor:
1. The Ground Rescue Coordinator of the Pitkin
County Air Rescue Group (as you know, the actual ground coordina-
tor may vary from mission to mission depending on who first
arrives at the airport in a rescue situation. Usually it is
Tom Sardy, Betty Pfister, or Bill Martin. The group maintains a
locker at the tower and their key will be located at the tower).
2. Walter Scott, Administrator of the Aspen Valley
Hospital.
3. Al Blomquist, County Manager, Pitkin County Air
Rescue Group.
I assume, unless I hear from you, that the above are
acceptable to Rocky Mountain and that you will provide keys
either to me or preferably to Betty Pfister for distribution to
these people. I will communicate further with them to outline
responsibilities under the agreement.
