Vos Caudill, Pitkin County, CO ADMINISTRATIVE DECISION OF THE PITHIN COUNTY, COLORADO, COMMUNITY DEVELOPMENT DIRECTOR GRANTING APPROVAL FOR THE ASPEN HIGH MESA LLC ACTIVITY ENVELOPE AND SITE PLAN REVIEW Administrative Decision No. ql:�--2011 RECITALS Aspen High Mesa LLC (hereafter referred to as "Applicant") has applied to the Community Development Director of Pitkin County, Colorado ( "Director ") for Activity Envelope and Site Plan Review for expansion of the turning radius at an access point off Snowmass Creek Road and for stabilization of the uphill driveway cut. 1. The parcel is at located 4001 Snowmass Creek Road. PID #: 264511100003. (Legal Description — Attachment A). 2. The parcel is approximately 202 acres, is in the RS -30 zone district, and is conforming in size. 3. Previous land use decisions apply to the property in the form of GMQS approvals from 1986. These approvals are not applicable to the current application. The Lot is currently developed with a single family residence and ADU. 4. The Application was referred to the Basalt and Rural Fire Department. The District provided comments on the expansion and was supportive of the request. 5. Public notice was published in the Aspen Times Weekly on October 9, 2011. An affidavit of public notice was mailed on October 7, 2011. No objections were received within 30 days. 6. The Director finds that the proposal meets the standards of the Land Use Code for Activity Envelope and Site Plan Review specifically Section 7- 20- 20(c)(4). APPROVED by the Director, subject to the following conditions: 1. The Applicant shall adhere to all material representations made in the current or prior applications or in public meetings or hearings and shall consider those representations to be conditions of approval, unless amended by other conditions. 2. All previous land use approvals apply to the parcel, however, these approvals do not need to be furnished at access permit submittal. 3. Prior to submission of the future access permit application, the Applicant shall be required to submit for approval by the County Attorney and Community Development a Site Plan with an Activity Envelope in accordance with Land Use Code Section 2- 30 -20(g) and Application Manual Section 2.1.12. The above referenced approvals shall be a condition precedent to finalization and recordation. 4. Boulder retaining walls over 4' shall be engineered with drawings submitted in association with the access permit. Page / of 2 5. No development shall occur outside the approved activity envelope. 6. Prior to commencement of any earthmoving or other construction activity, the Applicant shall stake the corners of the activity envelope and install construction fencing around the construction site. The fencing shall remain in place until issuance of a Certificate of Occupancy. 7. All areas disturbed by construction shall be re- vegetated with native vegetation within one growing season of the project's completion. 8. Statutory vested rights for the approval contained herein are granted pursuant to the Pitkin County Land Use Code and Colorado Statutes, subject to the exceptions set forth in Pitkin County Land Use Code, § 2 -20 -170 and C.R.S., § 24 -68 -105. The statutory vested rights granted herein shall expire on November _ _��_ 2014. 9. Failure to comply with the conditions of this approval may result in revocation of this approval, or any subsequent permit(s) or approval(s) related to this property, or vested rights associated with this property. Hyman Suite 305 Aspen, CO. 81611 RE: Jensen Property /Driveway Dear Mr. Peterson: Exhibit "B" Resolution #86 -27 I have viewed the driveway accessing the upper meadow where the Jensen improvements are. The driveway is cut in Quaternary age glacio- fluvial terrace deposits which consist of poorly sorted and poorly graded clays, silts, sands, gravels and cobbles. Although the driveway is a little steep, approaching eight to ten percent grade in one stretch, it is well constructed with a good base. There is no evidence of slumping or other instability at this time an the cut bank side of the road. The underlying bedrock in this area is the Cretaceous age Mancos Shale which dips approximately twenty degrees to the south, or generally into the hillside. On balance, this is a positive factor, but the eroded surface of the shale beneath the glacial deposits probably slopes into the valley. This, In conjunction with an irrigation ditch which crosses the hillside above the steeper part of the access road, could cause instability and potential failures along the road cut. This potential, of course, would be magnified if the ditch itself were to fail. My recommendations are to irrigate this section of the pasture on the terrace above the road carefully, and to leave water in this particular ditch for as short a period of time as possible. Obviously, the ditch should be well maintained so as to keep the potential for failure at a minimum. In the fall, after the irrigation season is over, this portion of the ditch above the road should be made to catch and carry as little spring runoff as possible. Despite possibly decades of irrigation at this site,_I saw no significant signs of instability along the access road and expect little trouble with mass wasting, especially if the above recommendations are followed. The roughly triangular shaped lot is approximately 70 acres along the west side of the Snowmass Creek Road. This is within the SE 1/4 of Sec. 2, T 9 S, R 85 W of the Sixth P.M., within the Woody Creek 7 1/2 minute quadrangle, Pitkin County, Colorado. None of the property goes beyond the base of the steep hillside to the west. The building site as shown on the accompanying map is near the west central portion of the lot. The topography of the proposed site consists of irrigated pasture interspersed with groves of scrub oak. The site is quite flat and is more than 80 feet away from the base of the steep hillside. There are no existing structures on this site. The geology of the site consists of surficial deposits of glacio- fluvial origin of Quaternary age. This is in the form of poorly sorted silts, sands and gravels on a terrace above the present level of Snowmass Creek. :Underlying this material, perhaps 50 to 100 feet below the surface, is the Cretaceous age Mancos Shale which in this general area dips approximately 15 degrees to the south.: There are no other geologic structures which could adver$ely affect this site. The building site as depicted is far enough away from the base of the steep hill to the west so ;as not to be affected by any gravity related phenomena there. There are no significant gullies an that hillside which could have an affect on the building site. ._This is van excellent site for the development of a single family dwelling, but high ground water conditions should be expected, ospeciaily during irrigation season. Waste disposal should be available through the construction of a septic system with accompanying leach field in these permeable soils. Once again, the complicating factor may be the potential for high ground water; the Pitkin County Sanitation Engineer should be consulted for his specific recommendations. The clustering concept causes the effective density of the four unre- stricted units to be about 2 -2.5 acre /unit. Additional consideration needs to be given to the wells downslope of the proposed septic fields and the potential for partially treated sewage to "daylight" on the steep slope just below the proposed structures. In summary, we feel that there are no geology - related problems associated with any of the three proposals to render them infeasible, but careful attention will be required to resolve the septic waste disposal issues on the Aspen -Mass Ranch tract. While taking into consideration a realistic space to accomplish this design, we will also minimize the impact on constrained areas by establishing a conservative Activity Envelope. (b) A realistic, but conservative Activity Envelope is proposed which we believe to be in compliance with the Land Use Code and in conformity with the Comprehensive Plan for the area. (c) The Activity Envelope proposed in this Site Plan Review is designed to accommodate moving the existing retaining wall into the hillside 3', construction of a retaining wall to support the existing road cut on the uphill side of the road, and the excavation necessary for these activities. In the event that the ranch gate is approved and is allowed to move forward, this Activity Envelope will also accommodate it, though no special considerations for the Ranch Gate were needed to be made to determines this activity envelope. (d) The site is located in a scenic view protection area. The retaining contained in this site plan review improves upon the character of this location. See the Scenic View Protection Exhibit. (e) N/A (f) The natural grade, topography, vegetation and drainage of areas outside the defined areas shall not be disturbed except as specifically permitted in the Land Use Code. Prior to any development activity, the boundaries of the Activity Envelope shall be identified with construction fencing which shall remain in place until development has been completed. (c) Tree Removal and Mitigation Vegetation removal shall be as minimal as possible. Nothing with a caliper over 6" shall be removed. (d) Protection of Natural Terrain In addition to the safety measures that this application addresses (see 7 -20 -20 C4d), the goal of our work in is to provide visual relief from existing scaring and river rock boulder wall that was created for the establishment of this driveway access. The new retaining will be Colorado moss rock granite that will blend into the natural surroundings with native plantings. (1) REVEGETATION Revegetation with native plant material similar to that adjacent to the work will be completed during the first planting season after construction. See plant list and seed list on sheet L 1 a. (2) TOPSOIL There is no existing top soil to be saved. The existing surface is either, already a cut, existing river boulders or a minimal amount of poor sandy soil. (3) WEED PREVENTION A maintenance program will be in place at the time of completion. (4) UTILITY INSTALLATION N/A (5) EROSION, SEDIMENTATION, AND STORMWATER MANAGEMENT (a) 1. This work shall eliminate erosion control problems in the area of work. If practicable, all soil shall remain on site. 2. Natural vegetation and soil cover will be left in tact to the best of our ability. Minimizing disturbances is a focus for this area since one of the goals is to enhance the native setting. 3. All cuts and fills are designed to control erosion and stabilize the slope with boulders and vegetation. 4. Natural drainage patterns shall remain in tact. 5. N/A (b) Mitigation measures identified in an approved erosion, sedimentation, or Stone water management plan shall remain in place until re- vegetation is viable. 7- 20 -20: STEEP AND POTENTIALLY UNSTABLE SLOPES (C) Thirty (30) Percent or Greater Gradient (4) EXISTING ROADS AND DRIVEWAYS Through the Site Plan process, an exception for minor road and driveway improvements may be permitted to existing roads and driveways that traverse previously disturbed slopes equal to or in excess of thirty (30) percent, provided that the applicant demonstrates that all of the following conditions are met: (a) As can be seen in the letter from Nicholas Lampris, Engineer, dated, April 14 1986, the driveway was in place at that time and was constructed prior to 1993. (b) The current driveway services an existing ranch and residential structure. The use shall remain the same. (c) The existing driveways traverses a previously disturbed slopes equal to or in excess of thirty percent. (d) The improvements to this driveway shall be minor in scope and shall be the minimum required to ensure the safety of both the general public and safety agency personnel. There are three areas of concern that will be addressed in this construction; n nr _ nULu" 1. The turning radius for a large trailer is such that, to make the entrance and exit to the ranch safely, and without interfering with Snowmass Creek Road, there exists a section of wall that needs to be pushed back into the hillside an additional three feet. This will allow a large trailer to make the turn without imposing safety issues on the road. This section of road has a rise and a curve when traveling from the west to the east making it particularly difficult to see a vehicle in this driveway intersection. The additional space on the uphill side of the driveway where the radius will be increased, shall remain gravel and herbaceous plantings. The maximum height for this area is 10 feet 2. The sight lines from the driveway shall be improved by cutting the hillside on the west side of the entrance back 20' and removing an existing service berry. 3. Prior to the start of wall construction, submit the following: (a) References citing satisfactory completion of at least three (3) boulder walls of similar height and face area. (b) A summary of the experience of the primary equipment operator responsible for placement of base, facing, and cap rocks. General. Survey as required to verify the limits of the boulder wall installation. The following definitions apply to boulder wall construction: (a) Base Rock: The base rock is the lowermost rock in the boulder wall, and bears directly on the soil /rock subgrade. (b) Facing Rock: The facing rocks comprise the bulk of the boulder wall and are stacked above the base rock. (c) Cap Rock: The cap rock is the uppermost rock in the boulder wall section and "caps" the boulder wall. Boulder Wall Construction. (a) Embankment Construction. All embankment shall be placed prior to foundation excavation to create a cut -wall condition. (b) Foundation Excavation. Excavate a foundation trench at least 6 inches below the bottom of the wall base rock, running the full length of the proposed wall. Deeper embedment may be required where a toe slope is present or where a leveling pad is specified. Place the first course of rock (base rock) on a layer of bed course material fill that has been placed on firm, unyielding soil or bedrock with full contact between the rock and the subgrade. Excavate any loose, soft or otherwise unsuitable material present at foundation grade and replace with bed course material as required to provide a firm, unyielding subgrade. Compact the bed course material to a density of not less than 95 percent of maximum density determined in accordance with AASHTO T 180. As the wall is constructed, place the rocks so that there are no continuous joints in either the vertical or lateral direction. Stockpile a sufficient number of rocks to provide good selection for placement. To obtain a better fit, place rocks which do not match the spaces offered by the previous course in a different location. Avoid placing rocks which have shapes that create voids with a linear dimension greater than 12 inches. Except in isolated cases, place each rock so that it bears on at least two rocks below it. Locate at least one bearing point a distance no greater than 6 inches from the average face of the boulder wall. The allowable tolerance for base rock widths is 6 inches; however, do not place two or more consecutive base rocks with a width less than specified on the plans. Slope the top surface of each rock towards the back of the boulder wall at an inclination of at least five (5) percent. The minimum boulder wall thickness is based on minimum base rock width, as specified on the plans, and allowable face batter. All rocks, including the base rocks shall be placed. Securely place facing rocks so that the rocks are unable to be moved with a pry bar after the wall is complete. (d) Voids. Where voids with a minimum dimension of 6 inches or greater exist in the face of the boulder wall, chink the voids with smaller rock. (1) If there is no rock contact within the wall thickness, chink the void with a smaller piece of rock. (2) Chinking rocks do not provide primary structural support for the overlying rock. (3) Chinking rocks can not be moved or removed by hand after the boulder wall is complete. Reset loose chinking rocks until securely placed or grouted in place. The application as I understand is for activity envelope and access permit to improve the driveway from Snowmass Creek road to the residence. I took note of geotechnical concerns as referenced in letters provided by consulting geologist Nicholas Lampiris dated April, July 1986 respectively. The entry way as it presently exist poses a significant collision hazard due to proximity of a blind corner and increase in service volume since it's original construction. The applicant points out the difficulty of negotiating trailers and farm equipment utilizing three point turn options that due to time delay places drivers at greater risk of collision. Widening and flaring out this section as proposed would benefit everyone including emergency response personnel negotiating with large apparatus. The retaining wall as proposed and engineered by SGM, (that took into account Mr. Lampiris correspondence improves access to the home site and the Fire district is in support of the proposal. The one concern I observed is that the brush on the downhill side of the driveway prior to the open meadows at the top is overgrown and poses a significant hazard to drivers in wildfire event. I recommend that the applicant reduce the fuel load using best practice approaches in fuel mitigation. The applicant could consult with a wildfire mitigation expert to develop a mitigation plan that will meet the needs of mitigation but maintain esthetic concerns of the County and nearby residents. The brush on the uphill side will be mitigated for this purpose through the normal construction activity during retaining wall construction.
