RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN
COUNTY, COLORADO, GRANTING APPROVAL OF AN AMENDMENT TO THE
BUTTERMILK SKI AREA MASTER PLAN FOR TERRAIN PARK FEATURES

RECITALS
1. Aspen Skiing Company ( "Applicant') has applied to the Pitkin County Board of County
Commissioners (`BOCC ") to amend the AF -SKI master plan for the Buttermilk ski area to allow
earthwork for terrain park features as a Permitted Use in the Master Plan.
2. The property is described as the Buttermilk Ski Area and is zoned AF -SKI.
3. The BOCC approved the Buttermilk Ski Area Master Plan pursuant to Resolution No. 86 -81. The
Master Plan permits "trail constriction and maintenance to the extent that such work does not effect,
significantly, historic drainage patterns, visual quality or proper vegetation management"
4. The BOCC considered the application at a duly noticed public hearing on August 27, 2003, at
which time evidence and testimony was presented with respect to the application,
5. The BOCC finds that the features will not change the basic character and visual appearance of the
ski area. In addition, allowing earthwork for terrain park features will not increase off -site impacts,
endanger the public health, safety or welfare, generate additional employees, or increase floor area.
6. The BOCC further finds that the application is otherwise consistent with the applicable provisions
of the Pitkin County Land Use Code.
NOW, THEREFORE, BE IT RESOLVED by the BOCC that it does hereby approve an
amendment to the Buttermilk Master Plan, which shall run with the land and be binding on all successors in
interest:
1. Earthwork for terrain park features shall be included as a Permitted Use in the Master Plan. Such
earthwork shall only occur within the Terrain Park Boundary as shown on the attached site plan
(Exhibit A). The Applicant shall obtain an earthmoving permit each year for all terrain park features
to be constructed during that construction season.
2. The Applicant shall revegetate all areas disturbed by the construction of the terrain features as soon
as earthwork is completed.
3. The Applicant shall return the areas where the terrain features are constructed to their original
contours if the features are no longer necessary in the future.
4. The Applicant shall adhere to all material representations made in the application or in public
meetings and hearings.

REQUEST: The Applicant is requesting to amend the Buttermilk Ski Area Master Plan to allow earthwork
for terrain park features as a Permitted Use in the Master Plan.

BACKGROUND: The BOCC approved the Buttermilk Ski Area Master Plan pursuant to Resolution No.
86 -81. The Master Plan permits "trail construction and maintenance to the extent that such work does not
effect, significantly, historic drainage patterns, visual quality or proper vegetation management."
REFERRAL COMMENTS: Referral comments from the City of Aspen are attached for reference. The
application was referred to the West Buttermilk Homeowners Association and the Inn at Aspen, but
comments were not received.
STAFF COMMENTS:
As noted by the Applicant, the terrain park at Buttermilk is renowned for being one of the only top -to -bottom
parks in the country and is nearly 2 miles long. The terrain park features are formed primarily with man-
made snow. The Applicant estimates that 8 -12 million gallons of water are required to create the half -pipe
and that a considerable amount of energy is consumed to run water pumps and air compressors. The
Applicant proposes to create the rough form of the terrain park features with earthmoving, which will reduce
the amount of man -made snow required, and the associated energy and water requirements, by as much as
half. For the half -pipe, the Applicant proposes to construct 2 berms at the base of Buttermilk that will be
approximately 400 feet long and 10 -12 feet high. Approximately 6,000 cubic yards of cut and fill will be
required to build the half -pipe.
Staff determined that earthmoving to construct terrain park features does not fall within the realm of "trail
construction and maintenance" as anticipated in the 1985 Master Plan, and, therefore, that an amendment to
the Master Plan was required. In addition, staff was concerned with the visual impact of the berms built for
the half -pipe since they will be located on the portion of the ski area that is visible from the highway.
The Applicant has committed to revegetate the areas where the terrain features are created and to return the
areas where the terrain features are constructed to their original contours if the features are no longer
necessary in the future.

The neighbors ( West Buttermilk and Inn at Aspen) have not expressed concerns regarding the visual impact.
Given that the features, and in particular the half -pipe, are to be constructed in areas that have already been
disturbed by the ski area, staff finds that the features will not change the basic character and visual
appearance of the ski area. In addition, allowing earthwork for terrain park features will not increase off -site
impacts. Material excavated from the trench of the half -pipe will be used to build the berms on the sides,
therefore, the earthwork will be self - contained and will not generate truck trips to deliver or remove material.
In addition, the earthwork will not endanger the public health, safety or welfare, generate additional
employees, or increase floor area. As noted by the Applicant, the earthwork will also result in water and
energy savings, and will make Buttermilk more attractive to ESPN for a long -term contract for the X Games.
RECOMMENDATION: Staff recommends that the BOCC adopt a "motion to approve the Buttermilk Ski
Area Master Plan Amendment, subject to the attached Resolution:'

Dear Lance and Suzanne,
This letter describes a Minor Master Plan Amendment application submission to the Buttermilk Mountain
Master Plan (BMMP) for the Terrain Park Features Earthwork. The current BMMP allows for earthwork
for general trail /terrain improvements. With this Minor Master Plan Amendment, Aspen Skiing Company
(ASC) hopes to include earthwork for terrain park features as a Permitted Use within the BMMP.
Terrain Parks, which include half pipes, various sized "hits ", railrides and table tops, have become critical
elements of any mountain resort and is currently a very popular aspect of Buttermilk Mountain. During
the past 5 years, the Crazy T'rain Park at Buttermilk Mountain has grown in size and popularity. The park
is now renowned for being one of the only top -to- bottom parks in the country and is nearly 2 miles long.
The Terrain Park currently follows Teaser Trail from the summit, to Uncle Chuck's Glade, to Jacob's
Ladder and finishes on Government and Spruce Trails.
The quality of Buttermilk Mountain's terrain park caused ESPN's Winter X -Games organizers to initially
consider Aspen as a host for the popular event which benefits the community financially and creates
unprecedented exposure. ESPN has shown interest to enter into a multi -year contract with Aspen.
Creating these features with earthwork, especially the half pipe, will be a critical issue in their decision.
Currently all the terrain park features at Buttermilk Mountain are formed primarily with manmade snow.
The amount of manmade snow required is substantial and in the case of the half pipe is estimated to
require between 8 million and 12 million gallons of water. In addition to the water required, the energy
consumed to run water pumps and air compressors is also significant. ASC estimates the half pipe
construction costs between $80,000 and $100,000 annually — of which nearly half that amount are direct
energy costs.
If the rough form of such terrain park features were created with earthwork, the amount of man made
snow required to complete the features, and therefore the associated energy and water requirement, could
be reduced by as much as 50% annually.
In the case of the Half Pipe, the earthwork will resemble two berms in the fall line at the base of
Buttermilk Mountain (see the attached mountain mapping). The berms will be approximately 400 feet
long and approximately 10 -12 feet high. The amount of actual earthmoving is approximately 6,000 cubic
yards of cut and fill. The total area of disturbance will be approximately 2 acres.
The half pipe will appear as a large gully near the base of the mountain. Its contours will be blended
naturally into the existing terrain and all manmade slopes will be revegetated upon completion in
accordance with ASC Revegetation Plan.

Similarly, the large hits in the terrain park would be formed with earthwork to reduce the amount of snow
required to create them. ASC anticipates that each year, for the next three years, several of the key terrain
features would be constructed until the work is completed.
It should noted that the possibility exists for terrain parks and half pipes, sometime in the future, to be no
longer be popular with young people, resort guests and the media. In that case, ASC fully intends to
reclaim these earthwork features to their original and natural contours. Returning the earthwork back to its
natural condition would be a relatively simple process.
Following is a response to the criteria outlined in Pitkin County Land Use Code Section 3- 200 -080, Minor
Amendment to a Development Permit:
A. This amendment can be considered a clarification and/or a technical correction to the approved
Buttermilk Mountain Master Plan.
B. This amendment does not change the proposed development use between residential,
commercial or tourist accommodation uses.
C. This amendment is consistent with the action taken during the original development review
and does not constitute any new land development activity.
D. The proposed activity does not:
1. change the basic character or operation of the originally approved Land Use and only
slightly changes the basic visual appearance;
2. increase off -site impacts in the surrounding neighborhoods,
3. endanger public health, safety or welfare;
4. violate any Land Use Code Standard;
5. affect affordable housing generation;
6. increase floor area or decrease open space.
In summary, ASC requests approval for this Minor Master Plan Amendment for the following reasons:
1) The Terrain Park Earthwork features result in water and energy savings,
2) All earthwork will be graded into the existing contours as naturally as possible and revegetated
upon completion,
3) All earthwork terrain features will be returned natural contours if for any reason use of such
features is no longer necessary.
4) Providing such earthwork will be attractive to ESPN to enter into a longer term contract for future
X -Games benefiting the community with increased exposure and sales revenues.
Based on this information, ASC is requesting the County supports the Minor Amendment to the
Buttermilk Mountain Master Plan that will be presented before the Pitkin County BOCC on Wednesday,
August 27, 2003.

2. APPLICANT understands and agrees that Pitkin County Ordinance No. 32 -2002 establishes a
fee structure for land use applications and the payment of all processing fees is a condition precedent to a
determination of application completeness. The fee structure is based on the County's policy that development
shall pay, in full, the cost of development review in Pitkin County. Fees have been set to be consistent and fair
to the public and to reflect the expense incurred in providing such services to the public.
3. APPLICANT and COUNTY agree that because of the size, nature or scope of the proposed
project, it may not be possible at the time of application to ascertain the full extent of the costs involved in
processing the application.
4. APPLICANT and COUNTY agree that fees charged for the processing of land use applications
shall accumulate if an application includes more than one type of land use review.
5. COUNTY and APPLICANT further agree that it is impracticable for COUNTY staff to complete
processing or present sufficient information to the Planning Commission and/or Board of County
Commissioners to enable the Planning Commission and/or Board of County Commissioners to make legally
required findings for project approval, unless current billings are paid in full prior to decision.
6. Therefore, APPLICANT agrees that in consideration of the COUNTY's waiver of its right to
collect full fees prior to a determination of application completeness, APPLICANT shall pay a base fee in the
amount of $ °° which is based on 3 hours of staff time, and if actual time spent by staff to process the
application exceeds the average number of hours by more than 20 %, then the COUNTY will bill the
APPLICANT quarterly for the additional time spent. Such periodic payments shall be made within 30 days of
the billing date. APPLICANT farther agrees that failure to pay such accrued costs shall be grounds for
suspension of processing.

2. APPLICANT understands and agrees that Pitkin County Ordinance No. 32 -2002 establishes a
fee structure for land use applications and the payment of all processing fees is a condition precedent to a
determination of application completeness. The fee structure is based on the County's policy that development
shall pay, in full, the cost of development review in Pitkin County. Fees have been set to be consistent and fair
to the public and to reflect the expense incurred in providing such services to the public.
3. APPLICANT and COUNTY agree that because of the size, nature or scope of the proposed
project, it may not be possible at the time of application to ascertain the full extent of the costs involved in
processing the application.
4. APPLICANT and COUNTY agree that fees charged for the processing of land use applications
shall accumulate if an application includes more than one type of land use review.
5. COUNTY and APPLICANT further agree that it is impracticable for COUNTY staff to complete
processing or present sufficient information to the Planning Commission and/or Board of County
Commissioners to enable the Planning Commission and/or Board of County Commissioners to make legally
required findings for project approval, unless current billings are paid in full prior to decision.
6. Therefore, APPLICANT agrees that in consideration of the COUNTY's waiver of its right to
collect full fees prior to a determination of application completeness, APPLICANT shall pay a base fee in the
amount of $ (C;�. °' which is based on 3 hours of staff time, and if actual time spent by staff to process the
application exceeds the average number of hours by more than 20 %, then the COUNTY will bill the
APPLICANT quarterly for the additional time spent. Such periodic payments shall be made within 30 days of
the billing date. APPLICANT further agrees that failure to pay such accrued costs shall be grounds for
suspension of processing.

The Planning Office has completed its preliminary review of the captioned application. We have
determined that this application is not complete. Please submit a digital copy of the application
per Pre - Application Conference Summary requirements. After a more detailed review of
the submittal information, additional information specific to the application may be requested in
order to adequately review and process the application. The planner in charge of the review will
request the information from you directly.
We have scheduled this application for review at a public hearing by the Board of County
Commissioners on Wednesday, August 27, 2003 at a meeting to begin at 3:00 P.M. in the Plaza
One Meeting Room at 530 East Main St., Aspen. Should this date be inconvenient for you, please
