Pursuant to Section 2- 20 -150.b of the Land Use Code, Elk Mountain Lodge LLC ( "Applicant ") has applied to the Community Development Director of Pitkin County, Colorado ( "Director ") to amend the recorded site plan as follows: A. Reflect the existing landscaping, as amended since the 2008 plan. B. Depict the location of several existing storage sheds comprising 480 square feet of floor area, which were permitted by the County but not shown on the site plan. C. Add a wood storage shed containing 180 square feet of floor area to the south of the existing storage sheds. 2. The property is located on Rooney Circle, off of Castle Creek Road, and is more specifically described in Exhibit A. 3. The property is zoned AR -10 and contains approximately 52 acres. 4. The Board of County Commissioners ( "BOCC ") granted approval of the following pursuant to Resolution No. 034 -2007: special review, activity envelope, site plan review, GMQS exemptions, caretaker dwelling unit, and changes to non - conforming structures. In addition, the BOCC designated the historic resources to the County's Historic Register. The site plan is recorded in Plat Book 84 at Pages 66 -68. The Community Development Director approved amendments to the site plan, pursuant to Administrative Decision No. 83 -2008. The amended site plan is recorded in Plat Book 88 at Pages 52- 54. 5. The Director finds that the proposed site plan amendments comply with the applicable provisions of the Land Use Code, and that the proposed amendments will not change the use of the proposed development or the basic character of the land, are consistent with action taken during the original review, do not increase off -site impacts, and will not endanger the public health, safety or welfare. 6. The Director further finds that the addition of 180 square feet is within the allowable 27,500 square feet of floor area allowed for the property, as established in BOCC Resolution No. 034 -2007. The Director further finds that the storage sheds are within the previously approved activity envelope, which complies with the 100' setback from Castle Creek, and that the storage sheds are not visible from Castle Creek Road. The applicant is represented by Davis Horn Incorporated in this land use application. This application references Attachments and Figures which are bound to the back of the text. Refer to Attachment 1, a Vicinity Map, which depicts the location of the Elk Mountain Lodge. The application is divided in the following sections: 1. Background; 2. Existing Conditions; 3. Project Description; and 4. Land Use Approvals. BACKGROUND The Board of County Commissioners approved Resolution No.034 -2007 on April 25, 2007 (see Attachment 2). The Resolution granted a Special Review approval for a variety of land uses on the site. Refer to the 2007 approved Site Plan/Activity Envelope Plan recorded in Plat Book 84, Pages 86 -88 which appears as Figure 1 (three sheets). On August 8, 2008 the Planning Director approved Adminstrative Decision No. 83 -2008 which approved minor amendment to the 2007 Site Plan (see Attachment 3). The first amended Site Plan which appears as Figure 2 was recorded Plat Book 88, Pages 52 -54 (three sheets). The following minor amendments approved in 2008. The minor amendments are depicted on Figure 2 and summarized below. Relocate the existing Cabin C East (336 sf of floor area) to the west side of the pond. Cabin C East is approved as Accessory Structure with bathroom facilities and will continue to function as approved. 2. Slightly relocate the secondary residence (aka Cabin A Carley House) and modify the design to make it less obtrusive from Castle Creek Road. 3. Realign the proposed stream linking the upper and lower ponds. 4. Relocate the independent waste water disposal system. Split the drain field in two portions of the site. Realign the road opposite the Lodge, add a staircase and wall opposite the front door of the Lodge and add a wall on the south side of the road to the west of the Lodge. 13. Add docks to each pond. 14. Add a generator pad to the north of the bam. 15. Realign the driveway to the north of the barn to accommodate the relocation of Cabin C East. 16. Add two parking spaces to the south of Building D with steps up to the west. 17. Minor realignment of the entry driveway to the east of Castle Creek Road. Oi )UU2 EXISTING CONDITIONS The site contains approximately 52 +/- acres and is located in the AR -l0 zone district. Figure 3, the Second Amended Site Plan, depicts the existing buildings on the property with the exception of a 180 square foot structure identified as a stable on Figure 4, a 2007 survey of the property. The stable is located in the northeast corner. The stable has not yet been demolished and has been used to store fire wood. The applicant is currently seeking a demolition permit for the stable. The structure will be carefully dismantled because the applicant is proposing to reconstruct the building in a different location as part of this land use application. It will be used to store and shelter fire wood. The 2007 land use approval permits 27,500 square feet of floor area on the property. Figure 5 which is entitled Gate House: Proposed Site Plan and FAR calculations presents the existing floor area located on the property by structure. Figure 5 is on file with the Pitkin County Community Development Department and represents the current floor area on the property. Figure 5 depicts several storage sheds encompassing 480 square feet of floor area. These sheds have been permitted by the Building Department, however their location was not approved in the 2007 or 2008 land use approvals. The landscaping for the property has been completed, however it is inconsistent with the landscape plan approved in 2007 and 2008. You visited the site with me in April of 2010 and observed the landscaping. Based upon our site visit, you requested the applicant to amend the landscape plan and relocate several spruce trees. This application seeks approval of the existing landscaping. PROJECT DESCRIPTION This application seeks to amend the land use approvals for the Elk Mountain Lodge. The following three amendments are requested. 1. Approve the amended landscape plan which reflects the existing landscaping on the site (see Figure 3). Refer to Figure 6, an analysis of the landscape plan approved in 2008, which identifies the status of plantings approved in 2008. 2. Approve the location of several existing storage sheds comprising 480 square feet of floor area which have been permitted by the County, but do not appear in the approved plan. The sheds are located to the south of building D as depicted on Figure 3. The sheds are located more than 100 feet from the Castle Creek high water mark. 3. Approve the development of a wood storage shed containing 180 square feet of floor are to be located to the south of the previously referenced sheds as depicted Oui?;(3 on Figure 3. The shed will be constructed from the materials which were formerly part of the stable. As depicted on Figure 3, the proposed shed will be located more than 100 feet from the Castle Creek high water mark. LAND USE APPROVALS This section of the land use application demonstrates compliance with the standards identified in the Pitkin County Pre - Application Conference Summary Sheet (see Attachment 4). Section 2 -2 -150 is the only Code section referenced in Attachment 4. Minor Amendment to a Development Permit Section 2- 20 -150.b This section of the application demonstrates compliance with the standards for a Minor Amendment to a Development Permit. Standards appear in bold followed by the applicant's responses. (a) Minor Amendments Defined A minor amendment to any development application or permit is one that meets the following criteria, as determined by the Community Development Director: (1) Is consistent with action(s) taken during previous development approvals for the property; and The first two amendments reflect existing on site conditions. It is best to visit the site to fully understand the proposed amendments. Approximately 12 spruce trees were relocated since our last site visit. The trees have been transplanted further from Castle Creek Road in order to break up the continuity of the vegetation along the Road and preserve views of the mountains for people traveling on the Road. The third amendment, developing a small wood shed is very minor. There is some approved floor area remaining as noted by the table which appears on Figure 5. The 2007 approval permits the development of 27,500 square feet of floor area. There are 26, 815 square feet of floor area located on the property as per the calculations submitted to the Community Development Department with the reconstruction of the Carley House (aka Gate House or Cabin A). The relocated shed (stable) will not be too visible from the Road if located in the proposed location. (2) Does not change the use of the proposed development between residential, commercial and tourist accommodation uses; and There are no changes proposed between categories. (3) Does not change the basic character of the approved use of land on which the activity occurs, including basic visual appearance and method of operation; and A review of the Figures presented in this application shows there will not be a significant change in the character or visual appearance of the property. (4) Does not constitute a new land development activity; and The primary land use activity approved for the site will not change as a result of the amendment application. 0U` °U f� (5) Does not increase off -site impacts in the surrounding neighborhood; and The proposed amendment will not have any impact on the surrounding neighborhood. (6) Does not endanger the public health, safety or welfare; and The proposed amendment will not affect the public health safety and welfare. (7) Does not violate any Land Use Code standard; and The proposed amendment does not violate any Land Use Code standard. (8) Does not substantially increase the need for on -site parking or utilities, or affect affordable housing generation; and There will not be any increase in on -site parking resulting from the proposed amendment. The demand for affordable housing will not be increased. The applicant intends to have a full time employee living in the secondary free market house. Does not increase the floor area of the use by more than five (5) percent or decrease the open space on the site by more than five (5) percent. Figure 5 shows that approximately 27,000 square feet of floor area is proposed to be improved on the site. Board of County Commissioner's Resolution 034 -2007 permits up to 27,500 square feet of floor area on site (see Attachment 2). Summary This land use application summarizes the proposed amendment to the Elk Mountain Lodge land use approvals. The applicant has demonstrated compliances with the Land Use Code standards identified in the Pre - Application Conference Summary Sheet (see Attachment 4). Prior to submission of any future building permit applications, the Applicant shall be required to submit for approval by the County Attorney and Community Development the Site Plan with an Activity Envelope in accordance with Land Use Code Section 2- 30 -20(g) and Application Manual Section 2.1.12. The above referenced approvals shall be a condition precedent to finalization and recordation. The Site Plan shall also incorporate the following changes: A. Include a note that the tennis court may only be constructed within the activity envelope on slopes in excess of 45% if the Code is amended in the future to accommodate development on slopes in excess of 45 %. B. Designate the location of the well and septic system on the site plan. C.
