Proposal The proposed 2000/2001 Stapleton parking program has three elements: • 95 spaces will be used every day of the season to replace the spaces lost by better delineating West Buttermilk Road and • 135 spaces will be used for Aspen Highlands intercept parking as required under BOCC Resolution No. 97 -199. • An additional 100 spaces will be used during the annual three day ski equipment trade show to be held in February 2001. Background The Stapleton parcel has been annually approved by the Board as a secondary parking facility for the Buttermilk Ski Area since the 1993 -94 season. For the last five seasons the Board has granted permission to use 95 spaces at Stapleton every day of the season (to replace parking spaces lost as a result of better delineating West Buttermilk Road) as well as the use of 120 additional spaces for the three day ski industry trade show held every February. The Board has only approved use of Stapleton on a single- season basis because of the number of unresolved transportation issues related to Buttermilk and the Highway 82 nr'r . a. L -1 �. corridor and because of the outdated Buttermilk Master Plan. The Board has expressed a willingness to approve Stapleton issues on a permanent basis only in the context of an updated Master Plan. Buttermilk Master Plan The current Buttermilk Master Plan was adopted in 1986. While there has been a desire for quite some time to update the document, several outstanding issues have only recently been resolved; the resolution to the Entrance to Aspen and the publication of the Record of Decision, final approval of the Aspen Highlands AF -SKI Master Plan and the Maroon Creek Corridor Detailed Transportation Plan, and the recommendations of the Links Task Force. Aspen Skiing Company submitted the 1999 Buttermilk Ski Area AF -SKI Master Plan to Pitkin County in January 1999 and withdrew the document from the approval process in February 2000. A new Master Plan will be submitted to Pitkin County in November 2000. We expect the review and approval process to take at least six months, and consequently must apply for this temporary use permit for the 2000/2001 ski season. The 2000 Buttermilk Master Plan will address the current and long -term parking program including the functions that currently take place on the Stapleton property as well as the Aspen Highlands intercept parking operations. A parking program will be proposed that serves both immediate and long -term parking needs and will negate the need to annually revisit this issue with the Board. Buttermilk Parking The Buttermilk parking inventory consists of 257 spaces in the central paved parking lot, 63 of which are set aside as High- Occupancy Vehicle (HOV) spaces; 95 parking spaces at Stapleton; 121 spaces at Tiehack and 50 spaces at West Buttermilk. 97 spaces are used at the Inn at Aspen for employee parking. These 621 total spaces are less than the 870 approved in the 1986 AF -SKI Master Plan. The Entrance to Aspen Final Environmental Impact Statement and the Record of Decision environmentally clear 750 parking spaces for the main base area at Buttermilk. �JUUJU 3 95 Spaces for West Buttermilk Road Delineation Prior to the 94/95 season, the Board approved a parking plan which shifted 95 spaces from the downvalley side of the parking lot over to the Stapleton property. This allowed for a much better delineation of West Buttermilk Road, which benefits both West Buttermilk residents and Buttermilk skiers. The road is now separated from the parking areas by a wooden fence on one side and by forest green jersey barriers on the other. West Buttermilk Road and Owl Creek Road will be relocated next summer (2001) by CDOT, at which time a new parking layout will be developed. The 2000 Buttermilk AF- SKI Master Plan, which will be submitted in November 2000, addresses the implications of relocating these roads. The ongoing construction on Highway 82 will not impact access to and from Buttermilk and the surrounding road network during the 2000/2001 season. 135 Spaces for Aspen Highlands Intercept Parking The Maroon Creek Corridor Detailed Transportation Plan, and the Board's subsequent conditions of approval for the Aspen Highlands AF -SKI Master Plan (Resolution No. 97- 199), identified a 135 -space intercept parking facility at Buttermilk as an integral part of the Highlands -area traffic mitigation plan. This application serves as a one -year proposal to meet that condition of approval. Provisions for the 2000/01 season and beyond are encompassed in the 199913uttermilk Ski Area AF -SKI Master Plan. The intercept parking is served by an Aspen Ski Company shuttle that transports employees, skiers and guests between Buttermilk and Aspen Highlands every day of the ski season. Service is provided at 15- minute headways from 7:30am until 5:30pm every day of the ski season. 100 Spaces for Ski Equipment Trade Show, February 2001 An additional 100 spaces will be used during the annual three day ski equipment trade show to be held in February 2001. The spaces, as identified on the attached map, will be plowed out in advance and will only be used for the three days of the show. By providing these parking spaces we will be able to ensure that the 135 spaces designated for Aspen Highlands guests are not infringed upon. The Stapleton parcel has undergone a Ci:.i�JU 7 recent rigorous inspection by the Army Corps of Engineers to determine the boundaries of any and all wetlands areas. The wetlands boundary as shown on the attached map exceeds the actual boundaries of the Stapleton wetlands, but shows that the additional parking area does not infringe upon any wetlands area. Aspen Highlands Traffic Monitoring Report The 1999/2000 Aspen Highlands Transportation and Parking Monitoring Report was submitted to Pitkin County in September 2000 in order to comply with conditions attached to Resolution 97 -199. Resolution 97 -199 states that Highlands monitoring will continue for three years following the completion of the 450 -space parking garage. Report findings show that parking and transit demand were both down relative to the last three years because of a decrease in skier visits. The decrease in skier visits is attributed to the lack of early season snow and reflects the skier visit decrease experienced across Colorado this past season. Property Owner Permission Mr. Craig Stapleton owns the entire Stapleton parcel, including the portion proposed for parking. Aspen Skiing Company has signed a lease that allows us to use his parcel for ski area operations. A copy of the lease is included with this application. CDOT and Pitkin County have initiated discussions with Mr. Stapleton regarding acquisition of the property bus as of August 29, 2000 had yet to purchase the land. Applicable Land Use Code Sections Section 3 -80 -010 1041 Environmental Hazard Areas: Applicability The proposed use of the Stapleton property avoids 1041 environmental hazard areas. The property is not shown as a sensitive area for scenic, ridgeline, wildlife, or floodplain issues. The Stapleton parcel does have three wetlands as identified in the Entrance to Aspen FEIS. They are separated from the parking areas as shown in the attached site plan. A Corps of Engineers survey of the wetlands in May 1999 indicated that the boundaries of the wetlands are even smaller than delineated in the FEIS. Section 3-200-090 Minor Amendments to a Development Permit A. The amendment must be a clarification or a technical correction to a plat. This provision does not apply to this application. B. The amendment must not change the use of the proposed development between residential, commercial, and tourist accommodation uses. The principal use of the Buttermilk Ski Area base will remain commercial. C The amendment must be consistent with action taken during the review of the original development and does not constitute a new land use activity. The proposed amendment conforms with the original intent of the 1985 Buttermilk Ski Area Master Plan, which was to designate the Main Buttermilk base area as the primary access point for skiers and snowboarders'. The improved delineation of West Buttermilk Road through the Main parking lot is the reason for requesting this amendment, which will allow for use of a portion of the Stapleton lot to replace the lost spaces. D. The proposed activity does not: 1. Change the basic character of the approved use of land on which the activity occurs including basic visual appearance and method of operation. The amendment request is to allow for temporary use of a portion of the Stapleton parcel. The parking spaces will be plowed out during the period in which they are being used and will revert to their natural state when not in use. The basic character of the Stapleton parcel remains unchanged. The visual appearance of the parcel from Highway 82 is obscured by the berms of snow that surround the parking area. ' 1985 Buttermilk Ski Area Master Plan, page 16, Proposed Facilities I r•' +n q 2 Increase off -site impacts in the surrounding neighborhood The request for use of the Stapleton parcel stems from the West Buttermilk Road delineation project, which improved traffic circulation for day skiers and the West Buttermilk neighbors. Off -site impacts are improved under the current parking scenario. 3 Endanger the public safety, health, or welfare. Public safety, health, and welfare conditions are improved by modifying the circulation pattern on West Buttermilk Road and re- distributing the parking. d. Violate any Land Use Code Standard. This proposed amendment is in conformity with 1041 guidelines and all other applicable Land Use Code standards. S. Substantially increase the need for on -site parking or utilities, or effect affordable housing generation. The proposed amendment redistributes the approved parking spaces and does not generate any additional need for on -site parking, utilities, or effect any affordable housing generation. 6 Increase the floor area of the use by more than two percent at- decrease the open space on the site by more than three percent. The open space will not be impacted due to the temporary nature of the parking areas. The parking will be plowed out and the surface of the Stapleton property will remain undisturbed. Section 4 -40 Review procedures This application will be reviewed under the Minor Amendment to a Development Permit standards as specified in Section 4 -40 -020 of the Pitkin County Land Use Code. Applicant/Representative: Chris Kiley Location: Buttermilk Base Area Description: The parking program contains three elements: 1.) 95 spaces to be used everyday of the season. 2.) 135 spaces to be used only as specified in BOCC Resolution #97 -199 (i.e. intercept parking for Aspen Highlands) available everyday. 3.) 100 spaces only to be used during the Trade Show in Feburary. Staff Analysis: The following is a summary review and analysis of the applicant's proposal for parking operations on the Stapleton Property and the storage of semi trailers at the Buttermilk Base Area relative to the most applicable policies and standards of the Land Use Code. I. Section 3- 230 -010: Minor amendments to an AF -SKI Master Plan may be reviewed Pursuant to Section 3- 200.080. II. Section 3- 200.080: Minor Amendment to a Development Permit. 1. The amendment must be consistent with action taken during the review of the original development and does not constitute a new land use activity. The Buttermilk Master Plan states that the base area should function primarily as an access for skiers. Using adjacent property as temporary parking during the ski season does not contradict that purpose. OG01 015 W- 2. The proposed activity does not change the basic character of the approved use of land on which the activity occurs including basic visual appearance and method of operation. While the plowing operations and car parking will affect visual appearance of the Stapleton property (especially during the ski -day), the impact will not be permanent as would more permanent types of development. As soon as the ski season ends, the parking area will be returned to its previous state. 3. The proposed activity shall not increase the off -site impacts in the surrounding neighborhood or endanger public safety, health, or welfare. The proposed parking program serves to minimize off -site impacts of skiing at both Buttermilk and Aspen Highlands. The West Buttermilk Road delineation project necessitated the provision of 95 parking spaces that were lost by the effort to improve the roadway through the Buttermilk Base Area. BOCC Resolution 97 -199 requires the provision of a 135 space intercept parking facility at Buttermilk for Aspen Highlands skiers if available parking spaces at the Aspen Highlands Ski Area drop below 450. The parking spaces will available at Aspen Highlands will be less than 450 for the 99/00 season. 4. The proposed activity does not increase the floor area by more than 2% or decrease the open space by more than 3 %. Seasonal parking does not consume the open space on which it occurs. Referral Agency Comments: Engineering: The County Engineer pointed out that C.D.O.T. proposes to purchase the Stapleton property and use it for the realignment of Owl Creek Road and West Buttermilk Road. The current C.D.O.T. Right of Way Plan from AABC to Buttermilk would directly interfere with the parking plan as it currently stands. SkiCo's representative Chris Kiley has made assurances to Staff that the road work on the Stapleton Property will not begin until the end of the ski season. The County Engineer also estimates that work will not begin on the Stapleton property until after the ski season. Proposal The proposed 1999/2000 Stapleton parking program has two elements: • 95 spaces will be used every day of the season to replace the spaces lost by better delineating West Buttermilk Road and • 135 spaces will be used for Aspen Highlands intercept parking as required under BOCC Resolution No. 97 -199. Back rg ound The Stapleton parcel has been annually approved by the Board as a secondary parking facility for the Buttermilk Ski Area since the 1993 -94 season. For the last four seasons the Board has granted permission to use 95 spaces at Stapleton every day of the season (to replace parking spaces lost as a result of better delineating West Buttermilk Road) as well as the use of 120 additional spaces for the three day ski industry trade show held every February. The Board has only approved use of Stapleton on a single- season basis because of the number of unresolved transportation issues related to Buttermilk and the Highway 82 corridor and because of the outdated Buttermilk Master Plan. Buttermilk Master Plan The current Buttermilk Master Plan was adopted in 1986. While there has been a desire for quite some time to update the document, several outstanding issues have only recently been resolved; the resolution to the Entrance to Aspen and the publication of the Record of Decision, final approval of the Aspen Highlands AF -SKI Master Plan and the Maroon Creek Corridor Detailed Transportation Plan, and the recommendations of the Links Task Force. Aspen Skiing Company submitted the 1999 Buttermilk Ski Area AF -SKI Master Plan to Pitkin County in January 1999. We expect the review and approval process to take at least one year, and consequently must apply for this temporary use permit for the 1999/2000 ski season. The 1999 Buttermilk Master Plan addresses the current and long -term parking program including the functions that currently take place on the Stapleton property as well as the Aspen Highlands intercept parking operations. A parking program has been proposed that serves both immediate and long -term parking needs and will negate the need to annually revisit this issue with the Board. Buttermilk Parkine The Buttermilk parking inventory consists of 257 spaces in the central paved parking lot, 63 of which are set aside as High- Occupancy Vehicle (HOV) spaces; 95 parking spaces at Stapleton; 121 spaces at Tieback and 50 spaces at West Buttermilk. 97 spaces are used at the Inn at Aspen for employee parking. These 621 total spaces are less than the 870 approved in the 1986 AF -SKI Master Plan. The Entrance to Aspen Final Environmental Impact Statement and the Record of Decision environmentally clear 750 parking spaces for the main base area at Buttermilk. r,, ") 1) n nJ L.iZu 95 Spaces for West Buttermilk Road Delineation Prior to the 94/95 season, the Board approved a parking plan which shifted 95 spaces from the downvalley side of the parking lot over to the Stapleton property. This allowed for a much better delineation of West Buttermilk Road, which benefits both West Buttermilk residents and Buttermilk skiers. The road is now separated from the parking areas by a wooden fence on one side and by forest green jersey barriers on the other. West Buttermilk Road and Owl Creek Road will be relocated next summer (2000) by CDOT, at which time a new parking layout will be developed. The submitted 1999 Buttermilk AF -SKI Master Plan addresses the implications of relocating these roads. 135 Spaces for Aspen Highlands Intercept Parkin¢ The Maroon Creek Corridor Detailed Transportation Plan, and the Board's subsequent conditions of approval for the Aspen Highlands AF -SKI Master Plan (Resolution No. 97- 199), identified a 135 -space intercept parking facility at Buttermilk as an integral part of the Highlands -area traffic mitigation plan. This application serves as a one -year proposal to meet that condition of approval. Provisions for the 2000/01 season and beyond are encompassed in the 1999Buttermilk Ski Area AF -SKI Master Plan. The intercept parking will be served by a RFTA shuttle transporting employees, skiers and guests between Buttermilk and Aspen Highlands every day of the ski season. Service will initially be provided at 15- minute headways and levels will be adjusted to match demand as the season progresses. The Buttermilk- Highlands service will be paid for by Aspen Skiing Company as part of the skier shuttle service contract with RFTA. Aspen Highlands Traffic Monitoring Report The 1998/99 Aspen Highlands Transportation and Parking Monitoring Report will be submitted to Pitkin County in July 1999 in order to comply with conditions attached to Resolution 97 -199. Resolution 97 -199 states that Highlands monitoring will continue for three years following the completion of the 450 -space parking garage. Report findings show that parking and transit demand were both down relative to the last three years because of a decrease in skier visits. The decrease in skier visits is attributed nn,n�7 Ut1LUc J to the lack of early season snow and reflects the skier visit decrease experienced across Colorado this past season. Property Owner Permission Mr. Craig Stapleton owns the entire Stapleton parcel, including the portion proposed for parking. Aspen Skiing Company has signed a lease that allows us to use his parcel for ski area operations. A copy of the lease is included with this application. Applicable Land Use Code Sections Section 3 -80 -010 1041 Environmental Hazard Areas: Applicability The proposed use of the Stapleton property avoids 1041 environmental hazard areas. The property is not shown as a sensitive area for scenic, ridgeline, wildlife, or floodplain issues. The Stapleton parcel does have three wetlands as identified in the Entrance to Aspen FEIS. They are separated from the parking areas as shown in the attached site plan. A Corps of Engineers survey of the wetlands in May 1999 indicated that the boundaries of the wetlands are even smaller than delineated in the FEIS. Section 3- 200 -080 Minor Amendments to a Development Permit A. The amendment must be a clarification or a technical correction to a plat. This provision does not apply to this application. B. The amendment must not change the use of the proposed development between residential, commercial, and tourist accommodation uses. The principal use of the Buttermilk Ski Area base will remain commercial. C. The amendment must be consistent with action taken during the review of the original development and does not constitute a new land use activity. The proposed amendment conforms with the original intent of the 1985 Buttermilk Ski Area Master Plan, which was to designate the Main Buttermilk n "'� U�'U22 �.a base area as the primary access point for skiers and snowboarders'. The improved delineation of West Buttermilk Road through the Main parking lot is the reason for requesting this amendment, which will allow for use of a portion of the Stapleton lot to replace the lost spaces. D. The proposed activity does not: 1. Change the basic character of the approved use of land on which the activity occurs including basic visual appearance and method of operation. The amendment request is to allow for temporary use of a portion of the Stapleton parcel. The parking spaces will be plowed out during the period in which they are being used and will revert to their natural state when not in use. The basic character of the Stapleton parcel remains unchanged. The visual appearance of the parcel from Highway 82 is obscured by the berms of snow that surround the parking area. 2. Increase off -site impacts in the surrounding neighborhood. The request for use of the Stapleton parcel stems from the West Buttermilk Road delineation project, which improved traffic circulation for day skiers and the West Buttermilk neighbors. Off -site impacts are improved under the current parking scenario. 3. Endanger the public safety, health, or welfare. Public safety, health, and welfare conditions are improved by modifying the circulation pattern on West Buttermilk Road and re- distributing the parking. 4. Violate any Land Use Code Standard. ' 1985 Buttermilk Ski Area Master Plan, page 16, Proposed Facilities iJIJi,UL This proposed amendment is in conformity with 1041 guidelines and all other applicable Land Use Code standards. S. Substantially increase the need for on -site parking or utilities, or effect affordable housing generation. The proposed amendment redistributes the approved parking spaces and does not generate any additional need for on -site parking, utilities, or effect any affordable housing generation. 6 Increase the floor area of the use by more than two percent or decrease the open space on the site by more than three percent. The open space will not be impacted due to the temporary nature of the parking areas. The parking will be plowed out and the surface of the Stapleton property will remain undisturbed. Section 4 -40 Review Procedures This application will be reviewed under the Minor Amendment to a Development Permit standards as specified in Section 4 -40 -020 of the Pitkin County Land Use Code. Section 5 -50 Submission Requirements This application contains all submission requirements as specified in Section 4 -40 of the Pitkin County Land Use Code and as detailed during the pre - application conference of June 22, 1999 and recorded in the subsequent Pitkin County Community Development Pre - Application Conference Summary Sheet. Operation of Parking Lot. Lessee shall utilize the Premises solely for the purpose of operating a parking lot, in such manner as may be approved by Pitkin County. Obtaining any required governmental approvals shall be the sole responsibility of Lessee. Lessee may use the Premises only from November 1 through April 10 of each year. During said period, Lessee shall have the exclusive right to use the Premises. 2. Rental Payment. As rent for the Premises, Lessee shall pay Lessor $10,000 per year, payable on November 1# of each year of the term of the lease commencing on November 1, 1997. Said rental payment shall increase by 10% per year for each subsequent year of the lease. Term and Termination. The term of this lease shall commence on November 1, 1997 and continue through and until October 31, 2002 unless sooner terminated as set forth herein. In the event of any default of any of the terms set forth herein, either party may terminate this lease provided that written notice is given to the defaulting party and such default remains uncured for a period of 30 days after delivery of such notice. In the event that Lessee is entirely prohibited by any governmental agency having jurisdiction from using the Premises for parking then Lessee may terminate this lease.
