Health Zonin� Applicant Revised 05/16/94 li 4, MEMORANDUM TO: Woodrow File FROM: Suzanne Wolff DATE: September 27, 1995 ISSUE: The Woodrow Minor 1041 Hazard Review was approved by the Hearing Officer on March 16, 1995 to allow an accessory envelope for a barn and a shed. As a condition of approval, the applicant was required to obtain a letter from Alan Czenkusch of the Colorado Division of Wildlife (DOW) regarding the potential impact of the proposed structures on the adjacent riparian area and the applicant was required to comply with any conditions imposed by the DOW or the U. S. Army Corps of Engineers. In subsequent site visits to the site to resolve these issues, staff became concerned with the proximity of the proposed shed to the floodplain of Snowmass Creek. The applicant was requested to provide a detailed floodplain analysis for review by staff and the Floodplain Administrator. Tom Newland reviewed the analysis provided by Wright Water Engineers, and is satisfied that the shed will not impact the 100 year floodplain. I have reviewed the original approval, and have determined that no changes need to be made to the conditions of approval. Mr. Woodrow has represented that the shed will not have walls on the end which is closest to the creek and the floodplain, as shown on the plan in the file. 01! 1!n02 !,y � TO: Tim Malloy, Pitkin County Hearing Officer FROM: Suzanne Wolff, Planning Office RE: Woodrow 1041 Hazard Review DATE: March 16, 1995 APPLICANTS: Raymond & Debbie Woodrow LOCATION: 5980 Snowmass Creek Road; NE, NW, of Section 23, Township 9 South, Range 86 West ZONING /LOT SIZE: RS -30; 4.518 acres ACCESS: The property is accessed from Snowmass Creek Road via an existing driveway. SITE DATA: The lot is essentially flat and is located between Snowmass Creek and Snowmass Creek Road. There is an existing residence and outbuilding on the property. The proposed structures are located outside of the required yard setbacks. BACKGROUND: A red tag was issued by the Zoning Officer on December 1, 1994, for earthmoving activity without a permit. Alan Czenkusch of the Colorado Division of Wildlife and Mike Claffey of the U.S. Army Corps of Engineers both visited the property to assess the impact of the earthmoving on the floodplain and the riparian area on the property. WATER AND SEWER: Information was not provided by the applicants concerning water and sewer for the existing residence or the proposed barn and shed. The Environmental Health Department (EHD) makes the following comments (attached): a. Information shall be provided to the EHD stating the proposed use of water for the barn, particularly whether water is to be used for human consumption, and, if required, documenting the location of the well and the quality and quantity of water obtained from the well. b. The floor plan for the barn shows floor drains for the horse stalls. A no -fee septic permit can be obtained from the EHD if there will not be a bath /lavatory in the barn. Otherwise, a septic permit will be required. The septic system shall be located a minimum of 50 feet from the high water mark (500 year floodplain line on the site plan) of Snowmass Creek and shall avoid areas of groundwater. 11 O./ REQUEST: The applicants request administrative 1041 Hazard Review approval to construct an equipment shed and a barn. The site is encumbered by low wildfire hazard, the Snowmass Creek floodplain and riparian area. STAFF COMMENTS - 1041 REVIEW Wildfire The property is mapped in a low wildfire hazard area, though it is located adjacent to Snowmass Creek in a riparian area. Since the site was not determined to be in a "no" wildfire hazard area, the applicant will be required to comply with the standards in Section 3- 807(C) of the Land Use Code. These requirements are included in the conditions of approval. Kelly Rogers of the Colorado State Forest Service states, "The combination of low hazard fuels, close proximity to a fire station, and adequate road and driveway access make this proposal a very low risk from wildland fire." The property is serviced by the Basalt Fire District from the Snowmass substation. No comments were received from the Sheriff or the Basalt Fire District. Floodplain The property is encumbered by the Snowmass Creek floodplain. Section 3 -804 of the Land Use Code prohibits development within the 100 year floodplain. The site plan provided by the applicant depicts the 500 year floodplain line, and the proposed structures are located outside of this area. The applicant noted in the meeting that the floodplain line is not accurate, and that the area where the improvements are proposed is above the creek (outside of the floodplain) and on a level with the rest of the property. The applicant shall revise the site plan to accurately depict the 100 year floodplain line, which would be less restrictive than the line shown on the site plan. Tom Newland, Pitkin County Floodplain Administrator, notes that County floodplain permits will not be required because the structures are outside of the 100 year floodplain area. The applicants shall be required to establish a building envelope to encompass the proposed barn and shed, as well as the "horse area" shown on the site plan. The envelope shall be located at least 20 feet from the 100 year floodplain line. All development shall occur within this envelope. Alan Czenkusch, Colorado Division of Wildlife, and Mike Claffey, U.S. Army Corps of Engineers, have visited the site and determined that the proposed location of the shed and the barn will not impact the riparian area along the creek. Mr. Woodrow has agreed to comply with any conditions imposed by the DOW and the Corps of Engineers, including restoring the vegetation along the bank that was disturbed. FINDINGS: 1. The wildfire hazard can be mitigated. 2. The proposed barn and equipment shed avoid the Snowmass Creek floodplain and the riparian areas along the creek. RECOMMENDATION: Pursuant to Section 3- 801(B)(2) of the Land Use Code, the Hearing Officer is authorized to approve a site plan and application for a Minor 1041 Hazard Review. Based on the findings referenced above, Staff recommends approval of the Woodrow Minor 1041 Hazard Review. Said approval is subject to the conditions of approval listed below. This memo will serve as a reference document authorizing approval of said application. The Hearing Officer's sign -off on a 1041 Hazard Review Site Plan is also necessary for completion of the review process. The Site Plan shall be recorded in the Clerk & Recorder's office, and a copy shall be placed in the file. De Mi'J3] dF 1. The applicant shall record a 1041 Site Plan, prior to submission of any building permit applications. All conditions of approval shall be noted on the site plan. The plan shall be modified in the following manner: a. The signature block for the Hearing Officer shall be added. b. An acceptance for recording block for the County Clerk shall be included on the site plan. C. Add a vicinity map to the site plan. d. The 1041 waiver shall state, "Applicant acknowledges that he /she has been informed by Pitkin County of the existence of 1041 environmental hazard areas that might affect the property, any improvements, and the use and occupancy thereof." e. The survey shall be amended to accurately depict the 100 year floodplain line. The survey shall be certified by the surveyor. 3 is . f. The building envelope, as established by staff, shall be depicted on the site plan. The envelope shall be located a minimum of 20 feet from the 100 year floodplain line. 2. Prior to issuance of a septic permit, the applicants shall provide documentation to the Environmental Health Department stating the proposed use of water for the barn, and the location of the well and the quantity /quality of the water, if required. 3. A septic permit shall be obtained from the Environmental Health Department prior to issuance of a building permit. The septic shall be located 50 feet from the 100 year floodplain line. 4. Woodburning devices are prohibited in barns or agricultural buildings. 5. The applicant shall comply with the following landscaping and wildfire defensible space mitigation standards: a. Brush, debris, and non - ornamental vegetation shall be removed within a minimum 10 foot perimeter around the structure. b. Vegetation shall be reduced to break up the vertical and horizontal continuity of the fuels a minimum of a 30 foot perimeter around the structure. C. Spacing between clumps of brush and vegetation within the 30 foot perimeters shall be a minimum of two times the height of the fuel. Maximum diameter of the clumps shall not exceed 10 feet. All measurements shall be from the edges of the crowns of the fuel. d. All branches from trees and brush within the 30 foot perimeter shall be pruned to a height of 10 feet above the ground and ladder fuels from around trees and brush shall be removed. f. Tree crown separation within the 30 foot perimeters shall have a minimum of 10 feet between the edges of the crowns. g. All branches which extend over the roof eaves shall be trimmed and all branches within 15 feet of the chimneys shall be removed. h. The density of fuels within a 100 foot perimeter of the structure shall be reduced. i. All deadfall within the 100 foot perimeter shall be removed. j. The applicant shall be responsible for the continued maintenance of the defensible space vegetation requirements. 6. The applicant shall comply with the following additional wildfire mitigation standards: C a. The building envelope shall not be located in draws, canyons or on slopes greater than 30%. b. Roof construction shall be Class A, non - combustible material (no wood shake /shingles) with no flat roofs. C. Vents shall be screened with corrosive resistant wire mesh with mesh , inch maximun. d. Roofs and gutters shall be kept clear of debris. e. Yards shall be kept clear of all litter, slash, and flammable debris. f. All flammable materials shall be stored on a parallel contour a minimum of 15 feet away from any structure. g. Weeds and grasses within the 10 foot perimeter shall be maintained to a height not more than 6 inches. h. Firewood /wood piles shall be stacked on a parallel contour a minimum of 15 feet away from the structure. i. Swimming pools shall be accessible to Fire Department vehicles. j. Fences shall be kept clear of brush and debris. k. Wood fences shall not connect to the structure. 1. Any outbuildings or additional structures shall adhere to the same standards as structures. M. Fuel tanks shall be installed underground with an approved container. n. Propane tanks shall be installed according to NFPA 48 standards and on a contour away from the structure with standard defensible space vegetation mitigation around any above - ground tank. Any wood enclosure around the tank shall be constructed with materials approved for 2 hour fire - resistive construction on the exterior side of the walls. o. Each structure shall have a minimum of one 10 pound approved ABC fire extinguisher placed in a visible and accessible location. p. Addresses shall be clearly marked with 2 inch non- combustible letters and shall be visible and installed on a non - combustible post. q. Utility lines shall be buried. 7. The applicant shall comply with all conditions imposed by the Colorado Division of Wildlife (DOW) and the U.S. Army Corps of Engineers regarding the riparian area on the property. The applicant shall work with the DOW and the Army Corps representatives to verify the required setback from the creek and the location of the structures. 8. No development, including grading and landscaping, shall occur outside of the approved building envelope, except for utility and driveway extension and maintenance, and as may be necessary to implement the wildfire mitigation measures. 9. A letter from Alan Czenkusch of the Division of Wildlife, 5 stating his opinion of the impact of the proposed structures on the riparian area, shall be provided to the Community Development Department prior to recording of the 1041 site plan. 10. All material representations made by the applicants in the application or in public meetings shall be adhered to and considered conditions of approval, unless amended by other conditions. The study, which was conducted by a professional water engineer and is based on accepted floodplain studies, concludes that the lowest floor of the proposed structures are at least 1 -foot above the Base Flood Elevation. Based on the study, I am satisfied that the structure will not impact the 100 -year floodplain. I understand that when the planning office inspected the site this year during peak runoff, Snowmass Creek appeared to be at or near the 100 -year flood event as described within the accepted floodplain studies. This year's runoff event in the Roaring Fork River basin has been categorized as a 15- to 20 -year flood event by the Colorado Water Conservation Board (CWCB). However, this categorization applies to the river basin as a whole, and there is a very good possibility that flood waters in localized areas of the river basin could have reached the magnitude of a 100 -year event during a portion of the runoff period. This concludes my comments regarding this application. Because the development is removed from the 100 -year floodplain, no local or federal floodplain permits are required. Based on our analysis, the location of the proposed structures (shed and barn) would be outside the Snowmass Creek 100 -year floodplain. The analysis included review of the following: • Federal Emergency Management Agency (FEMA) Flood Insurance Rate Map (panel 08097C0068C, effective date June 4, 1987); • FEMA Flood Insurance Study, Pitkin County, Colorado and Incorporated Areas dated June 4, 1987; • 1988 and 1994 surveys of the property completed by Alpine Survey, Inc.; • Field visit on August 1, 1995; and • Field survey on August 4, 1995 and August 29, 1995. The flood profile presented in the 1987 FEMA Flood Insurance Study for Snowmass Creek identifies the flood elevations for the 10 -year, 50 -year, 100 -year and 500 -year floods. For the 100 -year flood, the flood elevation is approximately 3.5 feet above the thalweg of the creek. A WWE field survey of seven different locations along Snowmass Creek, on the Woodrow property, determined the minimum elevation from stream bed to the top of the bank to be Raymond Woodrow August 30, 1995 Page 2 approximately 4.1 feet. The stream bed elevation surveyed is approximately one to two feet above the thalweg of the stream, which could not be measured due to high streamflows. In the area adjacent to the proposed shed, the top of the bank is more than 6 feet above the stream bed and approximately 8 feet above the thalweg of the stream. The 100 -year floodplain basically follows the northerly /westerly channel bank and does not encroach onto the lower field adjacent to the stream. The proposed locations for the shed and barn are outside the floodplain boundary as shown on the attached Figure 1. The floodplain was plotted based on field analyses and review of the background engineering data supporting the FEMA floodplain delineation. Did woodrow do a site specific floodplain analysis to determine exactly where the floodplain is on the property? As stated in condition No. 7 of the Minor 1041 Hazard Review that was approved by the Hearing Officer on March 16, 1995, you are required to comply with all of the conditions that are imposed by the DOW. Alan Czenkusch also verbally provided the following requirements: 1. A 20' setback shall be maintained from the 100 year floodplain line or the 500 year floodplain line, whichever is greater. 2: Revegetation of the disturbed areas shall not occur until Fall of 1995. A site visit by Alan Czenkusch of the DOW shall occur between July 31 and August 31 of 1995 to determine the extent of the revegetation required and to establish -a location for the sediment trap /polishing pond.. 3. The pad and the riprap referred to in the letter shall be removed in the Fall of 1995. 4. The DOW shall establish the number, type and location of all vegetation required. They are in no particular order. One basic criterion for all further work should be "zero release of fines." This reach of Snowmass Creek enjoys good water quality and it is a significant spawning stream which contributes greatly to recruitment in the upper Roaring Fork. This reach of stream also tends to be laterally unstable due to the amount of bedload is is carrying. At least some of the pad which currently constricts the floodplain should be removed. If all of the proposed buildings were nestled into the base of the hill, all of the pad could be removed. There would also then be the advantages of those buildings facing south, and being out of the 100 -year floodplain. The 20' setback from the top of the bank should be permanently fenced off and dedicated as a riparian buffer. Where necessary, native riparian species should be re- established, including whole willow -clump transplants. Off- stream stock watering should be provided so that there is no need for stock to break down the streambanks. The present riprap, at the upstream end of the flat, seems like overkill. Adequate toe -of -slope protection can be accomplished (and therefore bank erosion controlled) without such a massive pile of rock. This section of bank should be rebuilt, to generally resemble the habitat work CDOT recently did just below the Basalt upper bypass bridge (right bank). That is, the rocks should be placed so as to produce an undercut bank, topsoil backfilling the rock and contained by a membrane (mirafi 140 -N or equivalent) laterally and underneath and by rock mulch on the surface. The surface of the rock mulch should be approximately at high water level. The topsoil should be heavily planted with native grasses, forbs and shrubs. All finish grades should be at or below pre- violation elevations. Excess material should be removed to an upland site. In the interest of water quality, the terrain where stock are to be kept should be adjusted so that any stormwater runoff drains into a sediment trap /polishing pond -- an artificial wetland or some such. ADEQUATE PROVISIONS FOR WATER NEEDS: Sections 2 -17 and 3 -1104: "It is the policy of the County to insure the availability of a water supply of adequate quality, quantity, pressure and dependability for fire protection and support of a proposed land use prior to approval of the use. The County shall require land uses to hook up to existing public systems if serviceis available." If well water will be used for human consumption at the barn, this Department needs adequate information on the quantity and quality of water available. This can be done from tests of wells present on -site by a water engineer's or well driller's report. The applicant must ensure that the water quality is acceptable by having it tested by a lab such as Snowmass Water and Sanitation. Water of acceptable quality and quantity has been obtained in other lots in this area. Before a septic permit can be issued the location of the well must be indicated to assure that setback requirements from the well to the septic system can be complied with. A condition of approval for this application is receipt of information stating proposed use of water at the barn and documenting the location of the well and quantity /quality of the well. SEWAGE TREATMENT AND COLLECTION: Sections 2 -18 and 3 -1105: "It is the policy of the County to insure that adequate sewage treatment facilities are available to serve existing and new developments. Public and private sewage disposal systems and connectionsto such systems shall comply with the sewage disposal guidelines of Pitkin County Code Title X." 1 &.9OnN Lots in the Wildcat area are served by individual septic systems. The rough drawing of the barn submitted with this application shows floor drains for the horse stalls and no bathroom\lavatory. This department has a concern because of the proximity of the barn to Snowmass Creek. An on -site inspection was not done because of the deep snow in that area this time of the year. We were not able to ascertain either if there is a suitable site for the septic system a minimum of 50 feet from the creek or if ground water might be a problem. If there is no bathroom\lavatory, the Environmental Health Department would do a no -fee permit for the barn and design the septic system using a septic tank and dry well. It would be important to first do a profile hole at the proposed site of the dry well to be sure there is no ground water in the area of the septic system. The second concern is that the septic system maintain a minimum 50 foot setback from the high water mark of Snowmass Creek. If the barn will contain a bathroom \lavatory, all such systems installed within Pitkin County require septic permits issued by the Environmental Health Department, and must comply with the County septic regulations. To receive a Septic Permit, the applicant will need to submit a Septic Permit Application and appropriate fee with a completed Soil Data Form including perc test results and profile hole information. It must be possible to design an adequate septic system before a building permit can be issued. The Aspen/Pitkin Environmental Health Department will design the system for the applicant as part of the permit fee, unless an engineered system is needed, which we determine based on site specific soil test results. An engineered system is required if any one of the following conditions occurs: a percolation rate faster than 5 mpi or slower than 60 mpi; maximum seasonal level of the groundwater table or bedrock less than four feet below the bottom of the proposed absorption system; or a slope in excess of 30 %. The applicant will need to adhere to minimum horizontal setback requirements for placement of septic system components which should be no problem on this lot depending on the placement of the barn. The leach field will need to be located a minimum of 100 feet from their well and from any neighboring wells. It is desirable to locate the system below the barn so that the system can operate by gravity. The applicant should refer to the Pitkin County Sewage Regulations for detailed information, or call our office to discuss this site. Flood irrigation and/or water drainage from any ditch could impair the functioning of the septic system by overloading and saturating the soils. This would severely impair the soil's ability to absorb and filter water of the septic system. Measures to mitigate water drainage could include but are not limited to culverting the ditch or creating diversion swales to move the water away from the septic system. The system must be located at least fifty feet away from the ditch to adhere to Pitkin County Code.
