PITKIN COUNTY, COLORADO, APPROVING THE COLLINS SITE PLAN REVIEW
FOR A GARAGE

RECITALS
1) James H. Collins (hereafter "Applicant ") has applied to the Community Development Director of
Pitkin County (hereafter "Director ") to obtain Site Plan review approval to construct a garage/bam
within the previously approved building envelope. The proposed building will contain approximately
993 square feet of floor area (750 square foot garage and 243 square feet of subgrade storage space) and
750 square feet of exempt barn floor area.
2) The property is located at 201 River Ridge Road, and is described as Lot 3, River Ridge in Woody
Creek Subdivision.
3) The lot contains 20.85 acres and is a conforming size lot in the AR -10 zone district.
4) The Board of County Commissioners ( "BOCC ") approved the three lot River Ridge Subdivision,
pursuant to Resolution Nos. 093 -2002 and 092 -2004. The Final Plat was recorded in Plat Book 72 at
Page 25. The vested rights expired in June, 2009. The existing residence was built in the 1960s and
contains approximately 4,483 square feet and an existing garage (to be removed) contains approximately
525 square feet.
5) The lot is exempt from growth management for up to 5,750 square feet of floor area. The BOCC
granted a GMQS allotment for an additional 3,000 square feet of floor area, pursuant to Resolution
No. 003 -2007.
6) The parcel is exempt from floor area for up to 1,740 square feet for a barn, pursuant to Sec. 5- 20 -70(i)
of the Land Use Code ( "Code "), as amended by BOCC Ordinance No. 11 -2011.
7) The Director finds that the previously approved building envelope complies with the applicable
provisions of the current Land Use Code ( "Code "), as follows:
A) The envelope avoids the 100 year floodplain of the Roaring Fork River.
B) The envelope complies with the required 100' setback from the Roaring Fork River.
C) The envelope contains slopes of less than 15 %.
D) The wildfire hazard is rated as low, and can be mitigated.
E) The parcel is not within any mapped wildlife habitat areas.
8) The Director further finds that the proposed Site Plan for the garage/bam complies with the applicable
provisions of the Code:
A) The lot is within the mapped Scenic View Protection Area. The garage is not visible from
Highway 82, but is visible from Upper River Road. The visual impact is minimized by siting the
building in the same general location as the existing garage and adjacent to /in front of the existing

residence (as seen from Upper River Road); the location is approximately 850 feet from the road.
The garage is one -story in height, has a simple form and will have natural coloring and non -
reflective materials on the exterior.
B) The garage /barn is sited at the edge of the meadow and is clustered with existing development.
C) The garage/barn will be accessed from the existing driveway and utilities are available at the site.
D) The Applicant can develop the proposed additional floor for the garage and storage space without
utilizing the growth management allotment for additional floor area, since the gross floor area
will remain below 5,750 square feet.
APPROVED by the Director, subject to the following conditions, which shall run with the land and be
binding on all successors in interest:
1. The Applicant shall adhere to all material representations made in the application and shall consider those
representations to be conditions of approval, unless amended by other conditions.
2. The conditions of BOCC Resolution No. 093 -2002 and 092 -2004 shall remain in full force and effect,
except as amended herein.
3. Prior to submission of a building permit application for the garage/barn, the Applicant shall be
required to submit for approval by the County Attorney and Community Development a Site Plan in
accordance with Land Use Code Section 2- 30 -20(g) and Application Manual Section 2.1.12. The
above referenced approvals shall be a condition precedent to finalization and recordation of them.
4. The parcel is exempt from floor area for up to 1,740 square feet for a barn; the 750 square feet of barn
space within the garage /barn shall count towards this total.
5. The lot is exempt from growth management for up to 5,750 square feet of floor area. The proposed
building will contain approximately 993 square feet of floor area (750 square foot garage and 243 square
feet of subgrade storage space), which shall count towards the 5,750 square foot growth management
exemption.
6. Prior to issuance of a building permit for the garage/bam, the Applicant shall:
A. Submit a covenant to the Community Development Department for approval and recordation.
The covenant shall specify that the exempt floor area for the barn may only be used in association
with the raising, producing or keeping of plants or livestock, or cultivation and management of
other crops or farm products, and that any area not consistent with those uses would count as
floor area. The covenant shall allow the County to inspect the barn at any time for compliance
with the specified use limitations, subject to the provision of reasonable notice to the property
owner.
B. Submit a drainage and erosion control plan for review and approval by Planning/Zoning. All
historic and natural drainage patterns shall be maintained.
C. Submit a construction management plan for review and approval by Planning/Zoning.
D. Provide proof of an adequate water supply (in terms of quantity and availability), if applicable.
E. Submit a detailed revegetation plan for disturbed areas with appropriate seed mixes.
Areas disturbed by construction shall be re- vegetated within one growing season of the project's
completion.

8. Roofing Materials: Roofs shall be constructed with a Class A roof covering or a Class A assembly as
defined in the building code. Wood shake /shingle roof coverings are prohibited. Roofs with less than a
3:12 pitch are not permitted unless they comply with the following:
A. All roof coverings shall be constructed of non - combustible materials and installed on a Class A
roof assembly.
B. All roof coverings shall have a surface that shall facilitate the natural process of clearing the roof.
C. All roof designs shall facilitate the natural process of clearing debris. Protrusions above the
roofline, such as parapets, shall be prohibited.
D. Roofs shall be installed as required by the approved building code and shall have a minimum
slope of 1:48.
E. All roof designs, coverings or equivalent assemblies shall be specifically approved by the Fire
Marshal prior to submittal of a building permit application.
9. No calculations for height, bulk, setback, size, floor area, or any other building and zoning requirements
have been conducted. These requirements will be considered at the time of building permit. Any
structures represented in the application may not be permitted under building and zoning regulations.
10. Failure to comply with the conditions of this approval may result in revocation of this approval, or
any subsequent permit(s) or approval(s) related to this property, or vested rights associated with this
property.
11. Statutory vested rights for the approval contained herein are granted pursuant to the Pitkin County
Land Use Code and Colorado Statutes, subject to the exceptions set forth in Pitkin County Land Use
Code, § 2 -20 -170 and C.R.S., § 24 -68 -105. The statutory vested rights granted herein shall expire on

PROJECT DESCRIPTION
A. Application Request
This is an application to replace an existing detached garage with a new detached
garage/barn structure on a lot in unincorporated Pitkin County. The legal description of
the parcel is Lot 3, River Ridge in Woody Creek Subdivision. The lot's street address is
201 River Ridge Road, Woody Creek. The Parcel ID# for the property is 264309302003.
A vicinity map showing the location of the property is included in this application booklet. It
shows that the subject property is located off of Upper River Road, just west of where
Upper River Road intersects with Woody Creek Road. Access to Lot 3 is provided by
River Ridge Road, a minor dirt road.
The application is being submitted by the owner of the subject property, Mr. Jim Collins
(hereinafter, "the applicant "). Proof of ownership of the property is provided in the
Commitment for Title Insurance, attached hereto as Exhibit #1.
The applicant is being represented by Alan Richman Planning Services for this
application. A letter from the applicant confirming this arrangement is attached as Exhibit
#2.
A pre - application conference was held with staff of the Community Development
Department. The Pre - Application Conference Summary issued by the staff (see Exhibit
#3) lists the following sections of the Pitkin County Land Use Code that should be
addressed by the applicant to obtain Site Plan approval:

The applicant also hereby requests that this development be granted vested rights status
pursuant to Section 2 -20 -170 of the Pitkin County Land Use Code.
The following sections of this application identify the Code provisions applicable to these
procedures and provide responses to the applicable County standards. First, however, a
brief description of the property and summary of the proposed development plan for the
lot are presented below.

B. Property Description
The subject lot is an irregularly shaped, essentially flat parcel of land that is approximately
20.85 acres in size. It is one of three lots in the River Ridge Subdivision. The subdivision
was approved pursuant to BOCC Resolution 092 -2004, recorded in September, 2004 as
Reception No. 502098 (see Exhibit #4). The Final Plat for the subdivision is recorded in
Plat Book 72 at Page 25 as Reception No. 507712, a copy of which is included in this
application booklet.
The final plat shows that Lot 1 is 3.995 acres in size, Lot 2 is 10.421 acres in size and Lot
3 is 20.850 acres in size. Included in Lot 3 is a non - development area of 5.594 acres.
This area contributes the necessary additional acreage to allow Lot 1 to meet the 10 acre
minimum lot area per dwelling unit standard of the AR -10 zone district.
Also depicted on the final plat is an agricultural preservation area on Lot 3 that also
extends onto Lot 2. The agricultural preservation area, taken together with the non -
development area on Lot 3, provides a continuous area that will not be developed along
the frontage of the subdivision. This area is complimented by a riparian protection zone
along the rear of Lots 1 and 2, protecting the valued wildlife and water resources along
the Roaring Fork River.
The final plat designates a building envelope for each of the three lots in the subdivision.
The building envelope for Lot 3 is in excess of 4 acres in size. It includes the existing
residence and detached garage. The residence was originally constructed in the 1960's
and has since been remodeled and expanded. It contains approximately 4,483 sq. ft. of
floor area on two levels (along with a walk out basement). The existing garage is
approximately 525 sq. ft. in size.
Lot 3 received a GMQS Allocation for an additional 3,000 sq. ft. pursuant to BOCC
Resolution 003 -2007 (see Exhibit #5). That application contemplated the development of
a 1,000 sq. ft. detached CDU and an addition to the existing residence. The GMQS
Covenant documenting that approval has not yet been recorded. The vested rights for
that approval expired on January 10, 2010 (although the allocation remains valid). The
applicant is not prepared to move forward with that development at this point in time and
is instead pursuing the development of a replacement garage/barn structure.
C. Proposed Development
The applicant's proposed development is shown on the site plan, building elevations and
floor plans that are included in this application booklet. The applicant proposes to remove
the existing garage and replace that structure with a new detached garage/barn. All
development will occur within the building envelope that was previously designated on the
final plat.

The garage /barn will be a simple one story building. The building measures
approximately 50' by 30', so it will contain approximately 1,500 sq. ft. of floor area. There
will also be a subgrade storage area below the structure that is accessed by a stairway.
The perimeter of this subgrade space will be limited to a height of no more than 5'6" and
will not count as floor area. The central portion of this space, consisting of approximately
243 sq. ft., will be of standard height and will count as floor area.
The conformance of the proposed site plan with the applicable standards of the Land Use
Code is addressed in the sections which follow.

II. STANDARDS FOR SITE PLAN REVIEW
Chapter 7 of the Land Use Code establishes the standards related to the quality of
development in Pitkin County. Following are the applicant's responses to the applicable
standards of that chapter, as specified in the pre - application summary form.
A. Site Preparation and Grading (Sec. 7- 20 -10)
(a) Grading and Fill Placement. The applicant agrees that all grading and filling
associated with this project will take place within the designated building envelope.
(b) Clearing, Grubbing and Vegetation Removal. The applicant agrees that all
clearing, grubbing and vegetation removal associated with this project will take place
within the building envelope depicted on the site plan.
(c) Tree Removal and Mitigation. There are no trees in excess of 6" caliper that will
be removed as a result of the proposed development.
(d) Protection of Natural Terrain. The applicant agrees to follow those design and
construction techniques that may be recommended by the County Planning Engineer or
the Community Development Director to mitigate any physical or visual damage from the
proposed development. This shall include, but not be limited to:
♦ Revegetation of the areas disturbed by the re- development of this property.
Revegetation will be completed during the first planting season after completion of
the construction, using native vegetation.
♦ Removing and saving topsoil prior to any mass grading or excavation, and
replacing it following construction;
♦ Employment of appropriate weed prevention techniques that are consistent with
the provisions of the 2006 Revised Pitkin County Weed Management Plan; and
♦ Following the County's adopted erosion and sedimentation control and stormwater
management standards. Sediment barriers will be placed on -site as necessary to
control the impacts of soil disturbing activities (see Section 11.6, below).

B. Water Courses and Drainage (Sec. 7- 20 -30)
(b) Encroachment or Channeling. No encroachment or channeling activities are
proposed in the Roaring Fork River.
(c) Drainage. A drainage report and plan describing how the developed runoff
volumes will not exceed that of the current site will be prepared and submitted at
the time of building permit review.
(d) Groundwater. No activities are proposed that would interfere with groundwater
recharge or pollute groundwater. No contaminants will be introduced to
groundwater as a result of the proposed development.
(e) Irrigated Areas. The proposal will have no affect on water supplies available for
irrigation or any water rights.
(f) Irrigation Ditches. The will be no impacts to irrigation ditches as a result of the
proposed development.
(g) Sedimentation. The applicant will comply with the County's standards for
controlling sedimentation. A plan will be prepared as part of the building permit
application package that locates and describes the erosion and sedimentation
control measures that will be installed during construction. Sediment barriers, to
include straw bales, silt fences and similar filtering devices, will be placed down -
slope of all disturbed areas. Disturbed areas will be re- vegetated no later than one
growing season after completion of construction by applying native seed mixes
and fertilizer to disturbed areas and mulching seeded areas with straw.
(h) Water Quality.
(1) The building envelope is set back by more than 100' from the Roaring Fork
River and is located along the top of slope, which is a considerable vertical
distance above the elevation of the River.
(2) The applicant will comply with those state and federal statutes and
regulations concerning water quality that may apply to the proposed
development.
(i) Efficient Water Use. The applicant will comply with this standard.

C. River and Stream Corridors and Wetlands (Sec. 7- 20 -80)
Section 7 -20 -80 (c) (3) of the Land Use Code provides an exemption from the County's
river and stream corridor development standards for "Development on lots in County
approved subdivisions with designated building or development envelopes ". Therefore,
this proposal is exempt from the standards of Sec. 7 -20 -80 of the Land Use Code.
Nevertheless, the building envelope designated on the plat is set back by more than 100'
from the Roaring Fork River and is located along the top of slope, which is a considerable
vertical distance above the elevation of the River, ensuring that the proposed
development will comply with the County's stream setback and other standards of this
section.

D. Scenic View Protection (Sec. 7 -20 -120)
This site is visible from both State Highway 82 and from Upper River Road. Therefore the
applicant has conducted an evaluation of the extent of the visual impacts the
development would create from both of these scenic view corridors.
The applicant has determined that because of the viewing angles and the mature
vegetation that has grown up along the Roaring Fork River, the property can only be seen
from Highway 82 for a very limited distance, primarily if a vehicle were parked along the
shoulder and the occupant were to get out of the car to look towards this property. This
limited visibility is hardly of concern to the public and does not merit a detailed response
under the scenic review standards of the Code.
The site is visible from Upper River Road. Therefore, the applicant has taken a series of
photos from the road looking toward the site. One such photo is presented herein, using
standard (naked eye) settings, showing that the house and existing garage are visible
from the road. These structures sit quite a distance back from the road (approximately
850 feet). They are framed by the natural backdrop of trees and hillsides and they are
partially screened by the existing row of trees along the ditch.
One of these photos has been digitally enhanced to paste the proposed barn /garage into
the view to help the reviewer to understand the proposal in three dimensions and to
ensure that the garage/barn will not break a ridgeline as viewed from the road. This view
has also been magnified with a tele -photo lens to allow the reviewer to see the structure's
design. Please note that the trees along the ditch have been removed from this
simulation so the reviewer can actually see the proposed structure. Elevations have also
been prepared illustrating the proposed design of the structure.
Following are the applicant's responses to the County's scenic view protection standards.
1. The proposed development shall utilize existing topography and natural
vegetation, such as ridges, hills and existing trees, to screen buildings to the
maximum extent practicable.
Response: The site is screened from public view from Highway 82 by the mature trees
that are located along the Roaring Fork River and by the natural topographic difference
between the site and the Highway. There are no such opportunities to use natural
topography or vegetation to screen the proposed development from view along Upper
River Road.
2. The proposed development shall avoid the location of structures within the Scenic
View Protection Areas and shall avoid the location of structures within any
Viewp/ane identified in the State Highway 82 Corridor Master Plan and Down

Valley Comprehensive Plan, if possible. If location outside of the Scenic View
Protection Area and defined viewplanes is not practicable, then the proposed
development shall not be located on the highest ground or most visible portion of
the site as viewed from those corridors listed above.
Response: The lot is located along Upper River Road so it is not possible to fully avoid
the location of structures within the Scenic View Protection Area. However, the proposed
structure is not located on the highest ground or the most visible portion of the site since
they it is set back by approximately 850 feet from the Road. A location in the foreground
would be more visible from the Road than is this backdrop location.
3. The proposed development's height and bulk shall be designed to avoid, to the
maximum extent practicable, the visibility of buildings from those corridors listed
above. This may include, but shall not be limited to, breaking the mass of the
building down into a series of smaller forms, articulation of the building facades to
avoid a wall or row effect, and staggering rooflines to avoid a long unbroken plane.
Response: The proposed elevations show that this will be a small, simple building. Its
form is dictated by its function as a storage building for agricultural equipment and
vehicles. It will be a low building ( just 17' to the mid -point and 22' to the peak of the roof)
that will sit in front of the taller residence (see close up photo simulation for an image of
how the two buildings are positioned in relation to one another).
4. The proposed structure shall be placed so that it does not project above a ridgeline
such that a structure silhouettes against the sky when viewed from those corridors
listed above, unless there are no alternate building sites on the lot or parcel.
Response: The computer - generated photograph shows that the proposed structure will
not penetrate a ridgeline and will not silhouette against the sky.
5. The proposed development shall be designed to compliment the natural
topography of the land through the use of techniques such as earth sheltered
design, the use of natural materials and coloring, the use of low- reflectance
materials, or clustering of structures on the least visible portions of the site. When
a building is proposed near a ridgeline, then its form (particularly its roof form) shall
replicate, parallel or compliment the natural form of the ridgeline so that it appears
to be an element of the natural ridgeline.
Response: The proposed elevations show that the applicant plans to use natural
materials or man made materials that have natural coloring and are non - reflective. The
structure will have wood siding. Its roof will be made from non - reflective metal panels or
fire- resistant asphalt shingles.

6. The proposed development shall preserve natural vegetation and avoid
development within irrigated meadows to the maximum extent practicable.
Response: The structure has been sited to avoid existing trees and other native
vegetation and will not be located within an irrigated meadow.
7. The proposed development shall install utilities in locations and through
procedures that minimize visual impacts to the maximum extent practicable.
Response: Utilities have previously been installed underground to serve the existing
residence and garage. No new utility extensions are anticipated for this project.
8. All satellite dishes in the proposed development shall be located to minimize
visibility from those rights -of -way listed above and shall use earth tone colors
and/or screening to minimize their visual impact.
Response: The applicant will comply with these requirements.
9. The proposed development shall not utilize earth moving and berms as the primary
means of compliance with these regulations, but earth moving may be utilized in
conjunction with other techniques to comply with the standards of this section.
When: earth moving techniques are necessary, man -made forms should be
undulating and natural in appearance.
Response: Earth moving and berms are not proposed as the means of complying with
these regulations.
10. In the Rural Area only, development shall be located so that activities and
development occur in at least one of the locations specified in subsection (e) as
they may apply to the particular property.
Response: The proposed barn /garage will be located at the edge of the meadow, at the
greatest possible distance from the County road. It will be located adjacent to existing
development ( the existing residence) and therefore complies with the guidelines of
subsection ( (1).
11. The exterior of all development shall be built or painted with indigenous earth tone
materials or colors.
Response: The graphic representations that have been submitted demonstrate how the
applicant will comply with this requirement. Please note that the photo - simulation shows
the house having a blue color (which is does not today and will not in the future) but it will
instead retain the same earth tone appearance it has today.

12. All roofs shall have a non - reflective color or composition. Reflective roof materials
shall not be used unless the materials are treated prior to installation to eliminate
reflection, with the exception of materials associated with solar or photovoltaic
equipment.
Response: The applicant will comply with this requirement.
13. Lands disturbed by earth moving or berms should be revegetated using native
species that are already growing on or near the site. Topsoil shall be stockpiled
and placed on disturbed areas. Irrigation shall be provided to the revegetated
areas if it is necessary to ensure the survival of planted native species.
Response: The applicant will comply with this requirement.
14. To the maximum extent practicable, roads and driveways shall be located to skirt
the edge of and avoid dividing meadows and pastures and to avoid major road
cuts. Roads and driveways should take advantage of the screening potential of
natural topography and existing vegetation. Existing roads and driveways shall be
used where practical. To enhance screening, a row of trees may be planted along
the roads or driveways. To the maximum extent practicable, roads and driveways
located around the edge of or in meadows shall be laid out with sof curving edges
and shall avoid straight line corridors that are incongruous with the natural setting.
Response: No changes are planned to the location of the existing driveway.

E. Landscaping and Vegetation Protection (Sec. 7 -20 -130)
The applicant is not planning any significant changes to existing landscaping on the
property. Following are the applicant's responses to the standards in this section.
(b) General Provisions.
1. Protection of Natural Vegetation. The applicant will preserve the natural
vegetation on the site that is located outside of the building envelope. There will
be minimal disturbance of vegetation within the building envelope to build the
proposed structure.
2. Conformance With Wildfire Regulations. There is no conflict between the County's
wildfire regulations and the requirement to protect natural vegetation on this site.
3. Berms. A berm is not proposed for this site.
4. Landscape Enclosures. There is an existing row of trees along the front of the
property that lines an irrigation ditch (but does not "enclose' the property). This
row of trees was started by the applicant several decades ago, before the County
Code addressed such landscaping and has been augmented from time -to -time
since then. The applicant anticipates continuing to plant trees where there is water
on the property, as this is where trees have the best chance of survival.
5. Visibility Clearance. No landscaping is proposed where it would inhibit the visibility
of drivers.
6. Utility Easements. Landscaping will not be installed over a utility easement.
7. Financial Security. The applicant requests that no financial security be required for
this project.
8. Maintenance. The applicant agrees to maintain all installed landscaping in a
healthy condition and to replace plants that do not survive.
(c) Required Landscaping in Rural Areas
1. None of the purposes for which landscaping is required in the Rural Area apply to
this proposal.
2. The applicant will cluster any shrubs and trees that are planted into natural
groupings and will avoid planting in regularly spaced lines or rows (except along
irrigation ditches, as described above). Indigenous species will be used.

F. Lighting (Sec. 7 -20 -140)
All exterior lighting will comply with the applicable provisions of the Land Use Code, as
follows:
♦ Exterior lighting will be down - directional. Fully shielded fixtures will be used so the
bulb is not directly visible from adjacent and neighboring properties or the adjacent
right -of -way. Fixtures will be selected to ensure that light trespass levels at the
property line are no greater than one -half (1/2) foot - candle.
♦ Lighting placed along a walkway will be set at no more than twelve inches (12 ")
above finished grade.
♦ There will be no spot lighting or flood lighting of the new structure.

G. DRIVEWAYS, PARKING AND UTILITIES (Sec. 7 -30 and 7 -50)
The applicant does not plan any activities that would have significant impacts on the
County's road network. The applicant will use the existing driveway that serves this
property. The applicant does not plan any significant changes to this driveway.
Parking on the site will comply with the adopted County standard of 2 spaces per dwelling
unit and will comply with all applicable design standards.
Utilities have previously been installed underground to serve the existing residence and
garage. No new utility extensions are anticipated for this project. Sewage disposal will
occur on -site, using the existing ISDS. Water will be supplied by the existing on -site well.

III. CONCLUSION
The applicant has responded to all applicable criteria of the Pitkin County Land Use
Code, pursuant to direction given during the pre - application conference. Sufficient

Prior to recording of the Final Plat, the Applicant shall provide a covenant or guarantee to Tun

RECITALS
1. On December 6, 2006, the Planning and Zoning Commission ( "Commission ") held a duly noticed
public hearing, at which time evidence and testimony were presented with respect to Rural Area Growth
Management applications.
2. The Commission reviewed the following application for the 2006 Rural Area GMQS competition for
additional floor area:

• Collins: requesting an additional 3,000 square feet of floor area for a property located in Woody
Creek and is described as Lot 3, River Ridge in Woody Creek Subdivision.
I. The Commission scored the application as follows:

4. The application met the minimum threshold score of 48 points AND achieved the minimum threshold
score for each scoring category, as required to be eligible for an allotment.
5. Pursuant to Section 4 -60 -060 of the Code, the Commission's scores were forwarded by resolution to
the Board of County Commissioners CTOCC ") on December 20, 2006.

6. No appeals of the Commission's scores were filed within the required 14 day appeal period.
NOW, THEREFORE BE IT RESOLVED by the BOCC that it does hereby allocate a total of
3,000 square feet of floor area to the following property as shown for the 2006 Rural Area GMQS
competition for additional floor area:
* Collins: 3,000 sq. ft, of floor area
L This allocation is conditioned upon recordation of a covenant documenting the representations made in
the application for the additional square footage. This covenant shall be reviewed and approved by
Community Development Department and recorded against the property, prior to issuance of a building
Permit to utilize the awarded floor area.
2. Statutory vested rights for the approval contained herein are granted pursuant to the Pitkin County
Land Use Code and Colorado Statutes, subject to the exceptions set forth in the Pitkin County Land

PITKIN COUNTY COMMUNITY DEVELOPMENT DEPARTMENT
AGREEMENT FOR PAYMENT OF LAND USE APPLICATION FEES
PITKIN COUNTY (hereinafter COUNTY) and James H. Collins (hereinafter APPLICANT) AGREE AS
FOLLOWS.
1. APPLICANT has submitted to COUNTY an application for S ite Plan Review
(hereinafter, THE PROJECT).
2. APPLICANT understands and agrees that Pitkin County Ordinance No. 022 -2006
establishes a fee structure for land use applications and the payment of all processing fees is a condition
precedent to a determination of application completeness. The fee structure is based on the County's
policy that development shall pay, in full, the cost of development review in Pitkin County. Fees have
been set to be consistent and fair to the public and to reflect the expense incurred in providing such
services to the public.
3. APPLICANT and COUNTY agree that because of the size, nature or scope of the
proposed project, it may not be possible at the time of application to ascertain the full extent of the costs
involved in processing the application.
4. APPLICANT and COUNTY agree that fees charged for the processing of land
use applications shall accumulate if an application includes more than one type of land use
review.
5. COUNTY and APPLICANT further agree that it is impracticable for COUNTY staff to
complete processing or present sufficient information to the Planning Commission and/or Board of
County Commissioners to enable the Planning Commission and/or Board of County Commissioners to
make legally required findings for project approval, unless current billings are paid in full prior to
decision.
6. 'Therefore, APPLICANT agrees that in consideration of the COUNTY's waiver of its
right to collect full fees prior to a determination of application completeness, APPLICANT shall pay a
base fee in the amount of $1,639 which is based on 5 hours of staff time. If actual time spent by staff to
process the application exceeds the average number of hours by more than 20 %, then the COUNTY will
bill the APPLICANT quarterly for the additional time spent. Such periodic payments shall be made
within 30 days of the billing date. APPLICANT further agrees that failure to pay such accrued costs shall
be grounds for suspension of processing.
