PERMIT FOR THE WINTER DRIVING SCHOOL

RECITALS
Pursuant to Subsection 4- 30 -50(i) of the Pitkin County Land Use Code, the Community
Development Director of Pitkin County, Colorado ( "Director ") may approve a Temporary
Commercial Use Permit for commercial activities.
2. Rally Art Organization, Inc. through Mark Cox (hereafter, the "Applicant ") has applied to the
Director for approval of a Temporary Commercial Use Permit to conduct a winter driving school.
The driving school is proposed to provide guests with driving education in winter conditions that
include snow packed and icy roads. The Applicant proposes that 6 cars will be utilized at one
time for 12 guests. Six professional drivers will be staffed during the use. Event hours are from
9:OOAM to 4:30PM.
3. The use is proposed at 26150 Hwy 82 and owned by Ron Kanan. The Applicant proposes the
following 2012 event dates:
• January 23 -24;
• January 30 -31;
• February 2 -3;
• February 6 -7;
• February 9 -10; and
• February 13 -14
4. The Sheriff's Office, Basalt and Rural Fire District, and Communications Department were all
referred on the application. All were in support of the proposal with some conditions outlined
below. The Applicant has obtained consent from the property owner to use the property in this
fashion
5. The Applicant has not furnished a certificate of liability insurance naming Pitkin County as an
additionally insured yet. The Applicant has explained that the certificate will be furnished prior
to January 23` 2012. This will be a condition of approval.
6. The Director finds that, to the extent applicable, the application complies with the standards in
Subsection 4- 30 -50(i) of the Land Use Code.
THE DIRECTOR HEREBY APPROVES the Temporary Commercial Use for the Rally Art
Organizations, Inc Winter Driving School subject to the Applicant's compliance with each of the
following conditions:
1. The Applicant shall adhere to all material representations made in, or in connection with, the
application.

2. The Applicant shall have a properly working AED on site during the events
3. Prior to January 23, 2012 the Applicant shall furnish the Director with a certificate of liability
insurance naming Pitkin County as the Certificate Holder and have $2 million aggregate
coverage and $1 million coverage for each occurrence. If this certificate is not furnished
prior to this date, the Winter Driving School shall not proceed.
4. There shall be no parking on County roads or Hwy 82.
5. Failure to comply with the conditions of approval may result in revocation of this permit.

Dear Mike:
We have been approached by Mark Cox of Rally Art Organization Inc. We have been asked to provide this letter of approval in
order to allow the Special Use Permit process to proceed and we are happy to comply.
We authorize the use of our ranch for ice driving training. To this end ice tracks are to developed in several of our fields. We
understand and approve of activities from track preparation and construction through the actual ice training course attended by
applicants. The time frame is from Dec. 2011 through February 2012. Approval may be withdrawn upon breech of contract. Please

The only comment I have is, if it the same folks that put on the winter driving school in Steamboat, they do an
amazing job. They are safe and professional. Knowing they may do the same school here might save us some
money as we plan on sending at least 3 deputies this winter.

DETAILS & DOCUMENTS:
Event Summary:
The event will provide guests driving education, entertainment and
demonstrate the benefits and capabilities all -wheel drive vehicles in low traction
and inclement weather conditions.
This event will occur on a surface of packed snow on an empty hay field. The
property is within a fenced, gated community.
The event will consist of two private two -day programs per week.
January 23 -24; January 30 -31; February 2 -3;

Event hours are from 9:00 to 4:30 each day with a catered lunch break.
6 cars will be utilized for 12 guests, along with 6 professional drivers acting as
instructors, in each car.
Cars are licensed and conform to all applicable laws and regulations.
In addition to professional drivers, event staff will consist of four additional staff
members for track maintenance, safety, and guest services.
A first aid certified staff member, trauma kit and AED will be on site at all times
during event operations.
12 guests will be shuttled to and from the event daily in two Suburbans.
There will be no spectators allowed.
There will be no vendors, music, PA system, lighting, etc.
Site Plan (and maps):
Boundaries:
26150 Hwy 82. he entire event will be contained within the Shooting Star Ranch
boundaries. See attached site plan.
Property is fenced and gated. Main gate will be used for access.
No advertising banners, signs, etc. will be utilized.
Sections of snow fence appoximately 3' high x 30' long may be used to provide
visual reference on the driving area in low visibility.
Site Improvements:
No temporary staging, structures, etc. are anticipated.
No portable genretaors, screens, lighting, etc. are anticipated.
No RV's, busses, tech vans, etc. will be utilized.
Security, Medical and Safety:
Main gate will be the controlled access point
All roads and buildings were developed to county code.
Additionally, the entry/exit to the driving area will be physically
blocked at all times.
The driving surface will be approximately 50' wide.
No temporary signage or night lighting will be utilized
Transportation and Parking:
12 guests will be transported daily using 2 Suburbans.
Parking for the Suburbans, track and catering staff will be at and around the
equestrian barn. There is more than ample parking, including disabled, available.

Sanitation and Solid Waste:
3 existing indoor restrooms will be utilized. 1 for staff, 1 for guests, 1 spare.
Trash and recycle containers and a dumpster are currently in use at the facility and
will be used for this event.
Alcohol, Food Service, Vending and Tech Areas:
No alchohol will be served or allowed during this event.
No food vendors, will be used. A licensed caterer will provide lunch at no charge
to the guests.

through of the event will be requested to assure familiarity and understanding.

Our safety plan adresses staff interaction with EMS staff to direct
ambulances directly to the accident site.

We have a 28 year track record with no injuries. This event will utilize the same
level of staff training, operational protocols and safety measures as our other
ongoing programs.
Safety Plan:
CAPACITY: -12 guests per event day.
- Procedure to respond to emergencies- please see attached EOP.
-Fire extinguishers are located in every building on the property. Two buildings
with multiple extinguishers each are immediately accessible.
-2 track maintenance vehicles are equipped with extinguishers and present during
all on track operations.
-A spill kit is also carried in the track maintenance vehicles.
- Inclement weather is anticipated and considered a part of this event.
- The event does not pose substantial risks to the individual participant or public
safety.
-The event does not occur in wilderness, swift water /open water or
mountainous terrain or have the potential to affect normal public safety resources.
-No fixed wing or rotor aircraft will be used.

- We have operated nearly identical programs in Steamboat Springs (29 yrs),
Cordillera -Vail (5 yrs), Deer Valley (2 yrs), Lake Tahoe (2 yrs), Killington (3 yrs)
and Mt. Tremblant CAN (2 yrs) with no complaints. All of these programs were
much closer to homes, and a higher density of homes,than the subject site.
Liability Insurance:
- General liability of $2m is currently in place
-Event specific liability coverage and participant injury coverage will be added
upon approval of SEP.

Emergency Plans
The Bridgestone Winter Driving School has been in operation for over 25 years in Steamboat
Springs. To date the only one incident requiring emergency services was a plane crash on our
track NOT a driving related incident.
ACCIDENT w /Possible Injury — First Aid kits and continually charging AED are in track
maintenance trucks at all times.
1. Instructor /track staff who sees a potential injury accident notifies all other instructors
and track staff by radio of accident location. Track staff member who reaches the
accident scene first takes charge. All other drivers will be directed to the parking area.
Two instructors control guests and remaining instructors respond to accident scene.
2. Staff member in charge of scene will assess the scene, stabilize the scene and patient
and determine if EMS is needed.
3. If needed, 2nd instructor /staff to site will CALL 911 IMMEDIATELY and then RAO, Inc.
office.

4. 2nd Instructor and track staff help with immediate stabilization needs and care
appropriate to his /her level of training. Keep in mind that you may have someone in the
class who is able and qualified to help with the incident. Use that help!
5. When the patient and scene are stable, send a staff member to the Chaparral main
gate. Assure that the gate is open and ready and direct the ambulance to the scene
immediately on arrival.
6. Upon ambulance arrival, help as directed by the ambulance crew.
7. Take many pictures of the scene, vehicle and any other potential items of interest before
movement of the vehicle.
8. Remove vehicle and continue class as quickly as possible. Be efficient with available
staff. Store damaged vehicle out of site of guests and passersby.
9. Each staff member should complete an Incident Report as soon as practical after the
incident.

1. Evacuate all persons to a safe area.
2. Determine severity of situation and CALL 911 IMMEDIATELY if needed.
3. Call other on -site staff members via radio and or cell phone and advise to bring fire
extinguishers to location of incident.
4. If safe to approach, move adjacent combustibles.
5. Extinguish fire completely if possible (or) wait for Fire Department and assure access.
6. Assure complete control and re -check often.
7. Call RAO, Inc. office to report incident.
8. Identify cause of fire if possible and remedy any similar situations.
FUEL LEAKAGE OR SPILL -containment kits in track trucks.
1. If small spill from fueling car etc. Use absorbent pads to soak up petroleum products.
Pads will absorb petroleum based fluids only, not water. Bag used mats and shovel
contaminated snow into separate bags.
3. Apply mats at source and anywhere possible to contain leak. Deploy containment booms
in parallel on downhill perimeter as close to tank as possible. Use mats to absorb fluid
before it contacts booms if possible.
EVACUATION will be at the discretion of - A. Track Manager or B. Lead Instructor
1. Determine safest route of evacuation, Main Entrance or Emergency Access route.
2. Lead all guests to shuttle vehicles
3. DO NOT LEAVE PROGRAM VEHICLES BLOCKING ANY ACCESS POINTS.
4. The Track Manager in charge will assure the facility is empty and exit last.
