BOARD OF COUNTY COMMISSIONERS
PITKIN COUNTY
December 6, 1971
PRESENT: Commissioners Sardy, Vagneur, Baxter,
Internal Auditor Kleeman and County
Attorney Oates.

John Doremus was present representing him-
self. After considerable discussion the follow-
ing resolution was unanimously approved:
RESOLUTION Oati -- 11 ? 1
WHEREAS, the owners of all the lands front-
ing and abutting on that portion of the public
road right -of -way to be vacated and described be-
low have petitioned this Board for vacation of that
protion of North Starwood Drive, Pitkin County,
Colorado, described below which was dedicated for
road purposed by the plat of Starwood filed for
record in Ditch Book 2A at page 282 of the Pitkin
County records; and
WHEREAS, said petition has been approved by
the Pitkin County Planning and Zoning Commission; and
WHEREAS, it appears that the portion of
said roadway sought to be vacated is entirely
within Pitkin County and entirely without the
limits of any town or city and does not constitute
the boundary line of any town or city in Pitkin
County; and
WHEREAS, provision for the dedication of
a new road right -of -way has been made so that the
vacation sought will not leave any lands adjoining
without an established public road connecting with
another established public road; and
WHEREAS, it appears that there are no rights -
of way or easements presently in use across the
portion of the roadway sought to be vacated which
should be reserved; and

WHEREAS, it appears that no maintenance or
construction has been performed or expended upon
that portion of the roadway sought to be vacated:
NOW, THEREFORE, upon motion duly made and
seconded, the following resolution was unanimously
adopted:
BE IT RESOLVED, the the portion of North
Starwood Drive, Pitkin County, Colorado, described
- as follows:
A tract of land situated in Lot 6 in the
Southeast 4 of the Northwest 4 of Section
26, Township 9 South, Range 85 West of the
6th Principal Meridian, and in Lot 7 in
the Southwest 4 of the Northeast 4 of
Section 26, Township 9 South, Range 85
West of the 6th Principal Meridian, Pitkin
County, Colorado, more particularly des-
cribed as follows:
Beginning at a point on the east right -of-
way line of North Starwood Drive of the
original Starwood Subdivision whence the
West 4 corner of Section 26, Township 9
South, Range 85 West of the 6th Principal
Meridian bears S73 ° 02'03 "W 2537.86 feet;
THENCE 222.63 feet along the arc of a
curve to the right having a radius
970.00 feet and whose chord bears
N08 ° 23'30 "E 222.14 feet;
THENCE 139.54 feet along the arc of a curve
to the right having a radius of
409.25 feet;
THENCE S55 ° 30'E 60.00 feet;
THENCE 119.08 feet along the arc of a curve
to the left having a radius of
349.25 feet and whose chord bears
S24 ° 44'05 "W 118.50 feet;
THENCE 78.30 feet along the arc of a curve
to the left having a radius of 910.00 feet;
THENCE S52 ° 45'W 15.50 feet;

THENCE 137.79 feet along the arc of
a curve to the left having a
radius of 155.00 feet to the
point of beginning, and con-
taining which was dedicated for
road purposes by the plat of
Starwood filed for record in
Ditch Book 2A at page 282 of
the records of Pitkin County,

Colorado, be and the same is
hereby vacated without re-
servation of any easements or
rights- of - way.
Resolution to approve Starwood plat, amended,
at regular meeting 12/6/71.
Harvey Hale, Road Overseer, was present to
discuss the activites of his department. The
Board and Mr. Hale discussed the cost of sanding
and plowing in the County. Mr. Hale informed the
Board that the cost for December 4, 1971 alone
was $600.00. Upon Mr. Hale's request, the Board
approved increases in salary for two of his em-
ployees who are moving to new positions.
Internal Auditor Kleeman was instructed by
the Board to draft a personnel manual to comply
with the auditor's recommendations and present
it to the Board for review.
County Appraiser, Warren Conner was present
to discuss the activities of the Assessor's office.
He presented House bill 1040 provisions as follows:

July 1, 1971, grants a property tax
credit through the State Revenue Depart-
ment
for those persons who are 65 years
of age, or older,
Who have resided within the State
of Coloardo during the entire year for
which credit is claimed,
Who do not have a net worth of
$20,000 or more and who have income of
less than $2,400 if single or less than
$3,700 if married,
The maximum credit that may be
