BACKGROUND : For management and rate-setting purposes we use six classifications of airport aeronautical users; however, we currently have no pre-signatory or seasonal airlines: 1. Signatory Airlines - airlines with lease and use permits that have provided scheduled service of at least one flight daily for at least one full year 2. Pre-Signatory Airlines - airlines that intend to qualify for signatory status but are in their first year of performance 3. Multi-Seasonal Airlines - airlines that provide scheduled service only during the winter and summer but rent space year-round 4. Seasonal Airlines - all other airlines that occupy and use the airport airline terminal and associated facilities 5. Locally-Based General Aviation - year-round, locally-based aircraft with a maximum gross landing weight of 12,500 pounds or less 6. General Aviation - all other aeronautical users of the airport, excluding military. LINK TO STRATEGIC PLAN: Prosperous Economy --- Sustainable economy and employment KEY DISCUSSION ITEMS: We generally set airport fees and charges on , i.e., charges to the airline and general aviation users cover the cost of their use of airport facilities. FAA regulations limit landing fees to an amount that covers the full operating and capital costs of the and capital costs of the terminal. The 2012 rates cover the airside and terminal operating costs, but not the capital costs (depreciation and amortization) that are also allowed. Landing fees are stated as an amount per one thousand pounds of maximum allowable gross landing -700 (67,000 pounds) is approximately $277 (67 x $4.13), and this would increase to approximately $304 in 2012. Airline and general aviation landing fee increases are needed to cover projected airside cost increases resulting from the longer runway. Airport staff will inform the airlines and general aviation representatives about the proposed fee increases and will bring their comments to the public hearing. Terminal rents are increasing by 2.5% to keep pace with the nominal increase in operating costs. Car rental customer facility charges (CFCs) $3.00 per customer per transaction day. In May of 2006 the fee was increased to $4.50. The increase to $5.50 for 2012 was included in the recent bid process for the on-airport rental car company leases. BUDGETARY IMPACT: The proposed fee increases are required to meet the revenue estimates in the 2012 capacity and flexibility for future capital improvement projects. RECOMMENDED BOCC ACTION: Conduct the public hearing and approve on second reading. ATTACHMENTS: Setting Initial Airport Fees and Charges for 2012 Resolution 3 RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF PITKIN COUNTY, COLORADO, SETTING INITIAL AIRPORT FEES AND CHARGES FOR 2012 RESOLUTION NO. ___-2011 RECITALS 1. 2. The County has authority to set, charge, collect and enforce rents, fees and charges for the occupancy and use of the Airport, pursuant to, inter alia, Sections 41-4-101 et seq., 30-11-107, and 30-35-202, C.R.S., as amended, the Pitkin County Home Rule Charter, as amended, and the Pitkin County Code, Title X, Airport Regulations, as amended. 3. The Airport financial and rate-setting policies are set out in Resolution #87-56A. 4. aviation fees are set to recover the cost of their use of airport facilities. 5. The Airline-related Policies, Procedures and Standards, adopted by Resolution #001- 2001, provide that in December of each year, the County will adopt its budget after affording the opportunity for airline input, and will set airline rates and charges effective January 1 of the following year. 6. The airlines and general aviation have been given the opportunity to comment on the proposed fees and charges for 2011 ital improvement plan. The 2011 budget for the Airport was reviewed in public session on November 8, 2011. 7. The County has compared its proposed airport fees and charges to those of other comparable airports and determined that its proposed fees and charges are not excessive. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Pitkin County, Colorado that: Section 1. The terminal rent for exclusive and preferential space for Signatory, Pre- signatory, and Multi-Seasonal Airlines for 2012 shall be $64.00 per square foot for indoor space and $21.33 per square foot for outside covered space. The terminal rent for preferential space for Seasonal Airlines for 2012 shall be $89.60 per square foot for indoor space and $29.86 per square foot for outside covered space. The terminal rent for shared-space for all airlines for 2012 shall be $64.00 per square foot. Twenty percent of the monthly shared-space rent shall be allocated equally among the airlines and eighty percent shall be allocated in the ratio of enplaned passengers. Seasonal and Multi-Seasonal Airlines shall pay shared-space rent according to the same allocation formula except that they sha-0 per aircraft departure if such fee is less than the 20% of shared space rent to be split equally between the airlines monthly. Such Seasonal 1 and Multi--e 20% shared-space monthly rent before splitting this rent equally between the other airlines. : Section 2. Landing fees for air carriers There is hereby imposed on, and shall be paid by, all FAR Part 121 or 125 air carriers and scheduled FAR Part 135 (air taxi and/or commuter) operators authorized to serve Pitkin County and using the airport, a rate or charge on all arrivals of aircraft from which such carrier or operator shall derive revenue, equal to the following amounts per one thousand (1,000) pounds of maximum allowable gross landing weight: $4.54 for Signatory, Pre-signatory, and Multi-Seasonal Airlines, and $6.36 for all others including Seasonal Airlines. There is hereby imposed on, and shall be paid by, such carriers or operators a rate or charge on all arrivals of aircraft from which such carriers or operators shall not derive revenue, equal to $.25 per one thousand (1,000) pounds of maximum allowable gross landing weight. Section 3. Landing fees for general aviation: There is hereby imposed on, and shall be paid by, all non-scheduled FAR Part 135 (air taxi, charter, and/or commuter) operators and all FAR Part 91 operators (but excluding operators of year-round locally based aircraft with maximum gross landing weights of 12,500 pounds or less) using the airport, a rate or charge on all arrivals of aircraft equal to $5.35 per one thousand (1,000) pounds of maximum allowable gross landing weight. Section 4. The fuel flowage fee collected by the fixed base operator on behalf of the County shall be unchanged at $.12 per gallon. Section 5. The car rental customer facility charge shall be increased to $5.50 per customer per transaction day. Section 6. The rates, fees and charges established herein shall be effective on and after January 1, 2012. Section 7. The rates, fees and charges established herein are determined and declared by this Board to be in compliance with its rate-making policy as adopted in Resolution #87-56A and its Airline-related Policies, Procedures and Standards adopted by Resolution #001-2001. Section 8. The rates, fees, and charges herein established are found to be in compliance Section 9. The provisions of this Resolution shall be severable and if any portion(s) or provision(s) of this Resolution shall be declared invalid or unenforceable, such a declaration shall not render any of the other portion(s) or provision(s) invalid or unenforceable and all remaining portions or provisions of this Resolution shall be given full force and effect. Section 10. This Resolution shall be available for public inspection during normal business hours in the office of the Director of Aviation, Aspen-Pitkin County Airport.
