Prior to the issuance of a building permit, the County Engineer shall be satisfied that the driveway will not exceed 8% grade, and 2. The owner /applicant shall place restrictive covenants on the property requiring the use of fenced enclosures for any dogs which may be kept on the premises, and WHEREAS, the Board of County Commissioners have reviewed the application with regard to the required review criteria and have considered the evidence and testimony presented with regard to this application at a public hearing at their regular meeting held March 10, 1480. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Pitkin County, Colorado, that it does hereby grant Special Review approval for the separate development of Lots 6 and 7, Block 2, Filing 3 of the Gateway of Snowmass Subdivision, subject to the following conditions: 1. Lots 6 and 7 are located at the very top of the subdivision, at the end of the cul -de -sac. The lots are owned by Jon Chapman. The Planning Office comments with regard to the review criteria found in Section 7 -2.4 of the Land Use Code are as follows: 1. There are a large number of substandard sized lots which have already been developed in the Gateway of Snowmass Subdivision. There will be no adverse impacts upon the character of the neighborhood in the event that these lots are allowed to be developed separately. The purposes of the RS -30 zone category are already so compromised by the existance of the Gateway of Snowmass Subdivision that additional development will not be noticeable. 2. The lots comply substantially with existing subdivision regulations with the exception of size. The title to the property is in order, access to the lots is readily available, water is available from an existing subdivision system which, according to Bob Nelson, conforms with the Colorado Department of Health requirements and sewage disposal by means of a septic tank /seepage pit seems feasible as well. 3. We anticipate no adverse impacts on available utilities, roads or other public services. 4. The lots are substantially level without any physical limitation to residential development. 5. The configuration of the lots lends themselves to separate development. 6. Lot 7 is already improved with a single family residence which is the home of Jon Chapman. Lot 6 would have very little value if separate development was not granted. 7. Lot 7 was purchased in January of 1976. The residence located on Lot 7 was completed in the summer of 1977. In August of 1977, Lot 6 was purchased as an investment. 8. These lots have been available for residential develop- ment since Gateway of Snowmass was originally subdivided in 1969. Pat Dobie has commented that he is aware of no significant engineering problems, the one exception being road access. Pat recommends approval of the application provided the driveway not exceed eight percent grade and provided proper drainage is maintained on the subdivision road.
