PLANNING OFFICE COMMENTS: Shelley Schaller and Christine Lindquist are requesting approval of a Subdivision Exemption for a Lot Line Adjustment between a 70 acre parcel (referred to as the Schaller tract) and a 36 acre parcel (referred to as the Lindquist tract), pursuant to Section 4 -2.2 (a) (2) of the Land Use Code. The Schaller tract is improved with a single family residence. The Lindquist tract is currently unimproved. The purpose of the adjustment is twofold: 1. To create more privacy for the existing Schaller residence, which is currently located in close proximity to the northern property line; and 2. To provide better access to Snowmass Creek Road from the Lindquist tract. Ms. Lindquist currently uses the tract for grazing and riding horses. The boundary adjustment will UU;a .iU� facilitate easier horse trailer access. An even exchange of 12.446 acres is proposed. The acreage of each tract will therefore be the same. Section 4- 2.2(a)(2) of the Land Use Code establishes a procedure for a lot line adjustment as a subdivision exemption. A lot line adjustment is permitted provided that the following five criteria are met: 1. The adjustment creates not more than the original number of lots. 2. The purpose or effect of the lot line adjustment is not the creation of a new lot or parcel for development or resale purposes. 3. In the case of conforming lots and parcels, any resulting lot or parcel shall conform to the minimum requirements for area or width established by the provisions of the Code. 4. In the case of existing nonconforming lots or parcels, any resulting lot or parcel shall not increase in nonconformity. 5. All laws relating to the amendment of recorded plats are complied with. The adjustment will not create more than the original number of parcels, nor will it create a parcel substantially different in size or dimensions for the purpose of resale. Both lots are currently conforming and will continue to be conforming after the adjustment. The applicant will submit a formal lot line adjustment plat which meets the approval of the County Engineer and Attorney prior to recording.
