RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS
OF PITRIN COUNTY, COLORADO, GRANTING THE SCHALLER /LINDQUIST
SUBDIVISION EXEMPTION FOR A LOT LINE ADJUSTMENT
Resolution No. 91 -0
WHEREAS, Shelley Schaller and Christine Lindquist
(hereinafter "Applicants ") are the owners of real properties in the
portion of Pitkin County known as Old Snowmass; and
WHEREAS,'said properties are located on Snowmass Creek Road,
in Sections 3 and 34, Township 8 South, Range 86 West, more
specifically described in Exhibit "A;" and .
WHEREAS, the Applicants request approval of a lot line
adjustment pursuant to Section 4- 2.2(a)(2) of the Pitkin County
Land Use Code; and
WHEREAS, the Board of County Commissioners considered the
Applicants request at a regularly scheduled public meeting on
October 15, 1991; and
WHEREAS, the Board of County Commissioners found the proposed
Lot Line Adjustment to be consistent with the Pitkin County Land
Use Code criteria for a Lot Line Adjustment.
NOW, THEREFORE, BE IT RESOLVED by the Pitkin County Board of
County Commissioners that it hereby grants a Subdivision Exemption
for a Lot Line Adjustment to the Applicants pursuant to Section 4-
2.2(a)(2) of the Pitkin County Land Use Code subject to the
following condition:
1. The applicant shall prepare a Lot Line Adjustment Plat
which meets the approval of the County Attorney and the
County Engineer prior to recording.

an equal exchange of 12 acres.

BACKGROUND
REQUEST: Shelley Schaller and Christine Lindquist are requesting
approval of a Subdivision Exemption for a Lot Line Adjustment
between two parcels of land located in Old Snowmass pursuant to
Section 4 -2.2 (a)(2) of the Land Use Code.

REFERRALS:
The County Engineer and Attorney had no objections to the proposed
lot line adjustment.
PLANNING OFFICE COMMENTS:
Shelley Schaller and Christine Lindquist are requesting approval
of a Subdivision Exemption for a Lot Line Adjustment between a 70
acre parcel (referred to as the Schaller tract) and a 36 acre
parcel (referred to as the Lindquist tract), pursuant to Section
4 -2.2 (a) (2) of the Land Use Code. The Schaller tract is improved
with a single family residence. The Lindquist tract is currently
unimproved. The purpose of the adjustment is twofold:
1. To create more privacy for the existing Schaller residence,
which is currently located in close proximity to the northern
property line; and
2. To provide better access to Snowmass Creek Road from the
Lindquist tract. Ms. Lindquist currently uses the tract for
grazing and riding horses. The boundary adjustment will

facilitate easier horse trailer access.
An even exchange of 12.446 acres is proposed. The acreage of each
tract will therefore be the same.
Section 4- 2.2(a)(2) of the Land Use Code establishes a procedure
for a lot line adjustment as a subdivision exemption. A lot line
adjustment is permitted provided that the following five criteria
are met:
1. The adjustment creates not more than the original number
of lots.
2. The purpose or effect of the lot line adjustment is not
the creation of a new lot or parcel for development or
resale purposes.
3. In the case of conforming lots and parcels, any resulting
lot or parcel shall conform to the minimum requirements
for area or width established by the provisions of the
Code.
4. In the case of existing nonconforming lots or parcels,
any resulting lot or parcel shall not increase in
nonconformity.
5. All laws relating to the amendment of recorded plats are
complied with.
The adjustment will not create more than the original number of
parcels, nor will it create a parcel substantially different in
size or dimensions for the purpose of resale. Both lots are
currently conforming and will continue to be conforming after the
adjustment. The applicant will submit a formal lot line adjustment
plat which meets the approval of the County Engineer and Attorney
prior to recording.
The Planning Office recommends approval of the Schaller /Lindquist
Lot Line Adjustment subject to the following conditions:
1. The applicant shall prepare a Lot Line Adjustment Plat which
meets the approval of the County Attorney and the County
Engineer prior to recording.

This is a letter application seeking an exemption from the
definition of the term "subdivision", for a division of land that
is for the purpose of adjusting lot lines between adjacent parcels
of land. The exemption is sought pursuant to Section 4 -2.2 of the
County Land Use Code.
The two properties involved in the lot line adjustment are as
follows:
1. A tract of land slightly over 70 acres located in
Old Snowmass, currently improved with a single family
residence. The legal description of such tract is attached
hereto as Exhibit A. (hereinafter referred to as the
"Schaller Tract ") . Such property is currently zoned RS -30
PUD. The property is located at 2262 Snowmass Creek Road.

of land slightly over
36 acres
located in
Old Snowmass. The legal description
of such
property is attached hereto as
Exhibit B (hereinafter
referred
to as the
"Lindquist Tract ").
Such property is also
zoned
RS -30 PUD
and is adjacent to
the Lindquist Tract.
The Schaller Tract is owned by Shelley B. Schaller (also known
as Shelley Burke). The Lindquist Tract is owned by Christine
Lindquist and Associates, Inc., a Florida corporation.
The current configurations of the two tracts are shown on
Exhibit C. The parties wish to adjust their respective lot lines
to allow each of the owners to achieve certain individual goals.

(1) Schaller desires to own certain land (as depicted on
Exhibit D) currently owned by Lindquist. Schaller desires to
add such property to the north of the existing Schaller Tract
in order to create more privacy for her existing residence,
which is located close to her northerly boundary.
(2) Lindquist desires to own additional land (as
depicted on Exhibit E) currently owned by Schaller. Lindquist
desires to add such property to the south of its existing
boundary in order to afford it better access to Snowmass Creek
Road. Lindquist currently uses the Lindquist Tract for
grazing and riding horses and such access will afford easier
horse trailer access.
The resulting parcels after the lot line adjustment are
depicted on Exhibit F attached hereto. The foregoing lot line
adjustment would satisfy the provision of Section 4 -2.2 of the Land
Use Code in that:
(A) the lot line adjustment would not create more than
the original number of parcels. Two tracts curretnly exist
and only two tracts would exist subsequent to the lot line
adjustment.
(B) the purpose or effect of the lot line adjustment is
not the creation of a new lot or parcel for development or
resale purposes, but is instead being undertaken to satisfy
the unique needs of the two adjoining landowners.
(C) the resulting lots or parcels would conform to the
minimum requirements for area and width established by the
Code.
(D) Neither of the tracts are nonconforming. Therefore
the lot line adjustment would not increase any existing
nonconformity.
